<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 3144</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20231026">October 26, 2023</action-date><action-desc><sponsor name-id="S385">Ms. Cortez Masto</sponsor> (for herself and <cosponsor name-id="S376">Ms. Ernst</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To protect survivors from brain injury by authorizing the Secretary of Health and Human Services to collect data on the prevalence of brain injuries resulting from domestic and sexual violence.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Survivors from Traumatic Brain Injury Act of 2023</short-title></quote>.</text></section><section id="id1f6058da10f94008bbbe7de770b4b297"><enum>2.</enum><header>Data collection</header><subsection id="id90d54220a3f3444faf21588a99a0e21e"><enum>(a)</enum><header>Collection of data on brain injuries related to domestic and sexual violence</header><paragraph id="ided21befb8cf2420eb616a5553e8c31fb"><enum>(1)</enum><header>In general</header><text>The Secretary of Health and Human Services (referred to in this section as the <quote>Secretary</quote>) shall collect data on the prevalence of brain injuries resulting from domestic or sexual violence in order to assist the Department in understanding, addressing, and allocating resources to prevent, reduce, and treat such injuries, the impacts of such injuries, and the causes of such injuries.</text></paragraph><paragraph id="ide79291720d1b484fa18da7c10e163b58"><enum>(2)</enum><header>Collection</header><text>In carrying out paragraph (1), the Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall, through existing surveys on domestic or sexual violence, collect data on the prevalence and circumstances surrounding brain injuries due to domestic or sexual violence. The Secretary shall allow for data collection for not fewer than 2 years.</text></paragraph><paragraph id="id1dbde933632741f29050e2ee79b04897"><enum>(3)</enum><header>Privacy</header><text>Data shall be collected, stored, and analyzed under this section in a manner that protects individual privacy and confidentiality.</text></paragraph></subsection><subsection id="iddeaf98467fc84d50a919f3fee69c6526"><enum>(b)</enum><header>Report</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary shall submit to relevant congressional committees, and post on the website of the Department of Health and Human Services, a report that shall contain—</text><paragraph id="id83e657ccf96049e3b4ec9da2723b0b93"><enum>(1)</enum><text>an analysis of the data collected under subsection (a) relating to the connection between domestic and sexual violence and brain injuries; and</text></paragraph><paragraph id="idb747b48900444a0e93feaa4292bf19e6"><enum>(2)</enum><text>a description of the steps that the Department of Health and Human Services is taking to increase awareness, increase services, decrease prevalence, and otherwise respond to the public health issue of brain injury that results from domestic and sexual violence.</text></paragraph></subsection><subsection id="id9d8d4488250948719bf4da7606e01715"><enum>(c)</enum><header>Funding</header><text>There is authorized to be appropriated such sums as may be necessary to carry out this section.</text></subsection><subsection id="id6a0371e945b74455b3554859f7b0c3da"><enum>(d)</enum><header>Definition</header><text>In this section, the term <term>brain injury</term> means an injury that impacts the function of the brain as a result of trauma, choking, or strangulation due to domestic or sexual violence. </text></subsection></section></legis-body></bill>
