which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Fair Labor Standards Act of 1938 to expand the prohibition related to child labor, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Child Labor Accountability Act of 2023</short-title></quote>.</text></section><section id="id7c447e1ebab94abfbe649fb53d8c4802"><enum>2.</enum><header>Amendment to the Fair Labor Standards Act of 1938</header><text display-inline="no-display-inline">Section 12(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/212">29 U.S.C. 212(a)</external-xref>) is amended by striking <quote>thirty</quote> and inserting <quote>90</quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idf5f0f4587857426a8d285c012e42a905"><enum>3.</enum><header>Report to Congress on child labor law violations</header><text display-inline="no-display-inline">Section 4 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/204">29 U.S.C. 204</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id653E8228E25C472696ED31C66D6B97BE"><subsection commented="no" display-inline="no-display-inline" id="id8f7beead4326493bbe5aad519bfb6d5f"><enum>(g)</enum><header>Report to Congress on child labor law violations</header><paragraph commented="no" display-inline="no-display-inline" id="idac1eb390239f45eea99fce7c6297fd4a"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the date of enactment of the <short-title>Child Labor Accountability Act of 2023</short-title>, and annually thereafter, the Secretary, in consultation with the Attorney General and the head of any other relevant Federal agency, shall submit a report to Congress that— </text><subparagraph commented="no" display-inline="no-display-inline" id="ida9a3b86deaa243d7a39c2af17bc55dbc"><enum>(A)</enum><text display-inline="yes-display-inline">contains summary data on violations of the provisions of section 12 or 13(c), relating to child labor, in the year preceding the date of submission of the report, including—</text><clause commented="no" display-inline="no-display-inline" id="idc5c6221f4afe49b3857f7025e1bab3b4"><enum>(i)</enum><text display-inline="yes-display-inline">the number of complaints of potential violations of such provisions received by the Secretary in such year;</text></clause><clause commented="no" display-inline="no-display-inline" id="ida92506930c2142ddb2ae1b63a4865bdb"><enum>(ii)</enum><text>the number of—</text><subclause commented="no" display-inline="no-display-inline" id="id8f1ffe5522a84a0cae7274976b2b0f8d"><enum>(I)</enum><text display-inline="yes-display-inline">investigations of potential violations of such provisions that are ongoing as of the date of submission of the report; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc824fcef3bb24575a7597d5048f8f60a"><enum>(II)</enum><text display-inline="yes-display-inline">investigations of potential violations of such provisions that have concluded in such year; </text></subclause></clause><clause id="id93fb5704dfe443cb95801a7bcf010d03"><enum>(iii)</enum><text>with respect to violations of such provisions in such year—</text><subclause commented="no" display-inline="no-display-inline" id="idda9695dffa414f669edc9a232470572f"><enum>(I)</enum><text display-inline="yes-display-inline">the total number of such violations;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id7b896a82fe1e404a9ecf26babd1659d1"><enum>(II)</enum><text>the number of such violations disaggregated by the industry in which such violation occurred;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida169a76c50fb4e34b9e1151e40ca9faf"><enum>(III)</enum><text>the number of such violations disaggregated by the provision of law that was violated;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id46e9656dbaba4403afa043f5fc88af12"><enum>(IV)</enum><text display-inline="yes-display-inline">the average and median number of child employees involved in such violations;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb10379c084754a8bbc74f2390d43fafd"><enum>(V)</enum><text display-inline="yes-display-inline">the total number of child employees involved in such violations, disaggregated by characteristics including—</text><item commented="no" display-inline="no-display-inline" id="idd45efe650232463b9d0da35553ae177c"><enum>(aa)</enum><text display-inline="yes-display-inline">the age of such child employee; and</text></item><item commented="no" display-inline="no-display-inline" id="id13474dfafe984e4981bb0ef4da84a94c"><enum>(bb)</enum><text display-inline="yes-display-inline">the sex of such child employee; and</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id8bde61b7c3074e4eaa7436de9959dee7"><enum>(VI)</enum><text display-inline="yes-display-inline">the number of such violations that caused the death or serious injury of any child employee involved in such violation;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idc2e2bcc98627425a95644fd89e920ae4"><enum>(iv)</enum><text display-inline="yes-display-inline">the total, average, and median amount of penalties assessed under section 16(e)(1)(A) in such year;</text></clause><clause commented="no" display-inline="no-display-inline" id="ideb4871c376fe4a7c94e67ba4500c29c9"><enum>(v)</enum><text>with respect to criminal penalties under section 16(a) for violations of section 15(a)(4)—</text><subclause commented="no" display-inline="no-display-inline" id="id3adc9232e0c849e1a08efadd986bcde1"><enum>(I)</enum><text display-inline="yes-display-inline">the number of individuals charged under such section for such a violation in such year, disaggregated by characteristics including—</text><item commented="no" display-inline="no-display-inline" id="id2A2D301D514D4A5A8E352335814D1E4E"><enum>(aa)</enum><text display-inline="yes-display-inline">the age of such individual;</text></item><item commented="no" display-inline="no-display-inline" id="id831F04D07D17441D9672139ACDB2B920"><enum>(bb)</enum><text display-inline="yes-display-inline">the sex of such individual; and</text></item><item commented="no" display-inline="no-display-inline" id="idEFD9E21D57F84A6BA0519B3C2D2C994D"><enum>(cc)</enum><text>the relationship of such individual to any child employee involved in the relevant violation of section 15(a)(4); and</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="idb8a68d3e84f64b7da88058c70546faaa"><enum>(II)</enum><text>the number of individuals convicted under such section for such a violation in such year, disaggregated by characteristics including—</text><item commented="no" display-inline="no-display-inline" id="id30A09106011E4AA0904872A890E5D35E"><enum>(aa)</enum><text display-inline="yes-display-inline">the age of such individual;</text></item><item commented="no" display-inline="no-display-inline" id="id245E6041ECFB40B5A4E28C018E385B0E"><enum>(bb)</enum><text display-inline="yes-display-inline">the sex of such individual; and</text></item><item commented="no" display-inline="no-display-inline" id="id109A16F3BF2A425F9FC0E9ADF1D72BA6"><enum>(cc)</enum><text>the relationship of such individual to any child employee involved in the relevant violation of section 15(a)(4); and</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id398c5afca25c4373ba658d370ca298e2"><enum>(vi)</enum><text>any other information determined relevant by the Secretary;</text></clause></subparagraph><subparagraph id="id6e05ed18af7445368d565bdc3c72907c"><enum>(B)</enum><text>includes information on any activities in such year by the Secretary of Labor, in cooperation with State, Tribal, and local law enforcement, to identify, investigate, and prosecute violations of the provisions of section 12 or 13(c), relating to child labor;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id68ebea66b09441218a0009d1c1c82614"><enum>(C)</enum><text display-inline="yes-display-inline">describes trends with respect to such violations in such year; and</text></subparagraph><subparagraph id="id4d648700c340470ca80d85b55aec2079"><enum>(D)</enum><text>includes recommendations to Congress for combating such violations. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7fda1e0d52e049789e4773c75ec3431f"><enum>(2)</enum><header>Definition of child employee</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <term>child employee</term> means an employee who is younger than 18 years of age.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
