<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 3138</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20231026">October 26, 2023</action-date><action-desc><sponsor name-id="S307">Mr. Brown</sponsor> (for himself, <cosponsor name-id="S354">Ms. Baldwin</cosponsor>, <cosponsor name-id="S366">Ms. Warren</cosponsor>, and <cosponsor name-id="S316">Mr. Whitehouse</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend titles XIX and XXI of the Social Security Act to provide for 12-month continuous enrollment of individuals under the Medicaid program and Children’s Health Insurance Program.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H1B6A948ED7F9459C9CD9992A2C7A8965"><section section-type="section-one" id="H1C610F5D0EAB46C381F24B21EDD8F4D6"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stabilize Medicaid and CHIP Coverage Act</short-title></quote>.</text></section><section id="H2F6616CBB00149EB9871AFDC79BB16FF"><enum>2.</enum><header>Providing for 12-month continuous enrollment of individuals under the Medicaid program and Children’s Health Insurance Program</header><subsection id="HF8C4B4AAB1804E46A46943DBC27BAC0D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1902(e)(12) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(e)(12)</external-xref>), as amended by section 5112 of the Consolidated Appropriations Act, 2023, is further amended—</text><paragraph id="H99B26295DBD94CFCA8FFE59FC4861ECB"><enum>(1)</enum><text>in the header, by striking <quote><header-in-text level="paragraph" style="OLC">for children</header-in-text></quote>;</text></paragraph><paragraph id="H1B0BBEE45B5946BB86C9877C953AFD09"><enum>(2)</enum><text>in the matter preceding subparagraph (A), by striking <quote>who is under the age of 19 and</quote>;</text></paragraph><paragraph id="H807D0D269D4F4CCDA36231F53E244E94"><enum>(3)</enum><text>in subparagraph (A), by adding <quote>or</quote> at the end;</text></paragraph><paragraph id="H315645C6D15B4CB39EA11C96269A7D49"><enum>(4)</enum><text>by striking subparagraph (B); and</text></paragraph><paragraph id="HFEC59DB14452408C8FFD6AA26B5EA793"><enum>(5)</enum><text>by redesignating subparagraph (C) as subparagraph (B).</text></paragraph></subsection><subsection id="H43DFADE9372548C2804B9EB26E248945"><enum>(b)</enum><header>CHIP</header><text display-inline="yes-display-inline">Section 2107(e)(1)(K) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397gg">42 U.S.C. 1397gg(e)(1)(K)</external-xref>), as amended by section 5112 of the Consolidated Appropriations Act, 2023, is further amended—</text><paragraph id="H2A42274A34EB448AA92E1F0AB7B8A453"><enum>(1)</enum><text>by striking <quote>for children</quote>;</text></paragraph><paragraph id="HB39C3CA6C21F402BB4B278F41DF548C3"><enum>(2)</enum><text>by striking <quote>a targeted low-income child</quote> and inserting <quote>an individual</quote>; and</text></paragraph><paragraph id="H8BCF4C50FAA047AEB2BFC26B325C6C5D"><enum>(3)</enum><text>by striking <quote>child becomes</quote> and inserting <quote>individual becomes</quote>.</text></paragraph></subsection><subsection id="H3D6E883C134544D988DFD8740AF26357"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect on the first day of the first fiscal quarter that begins on or after the date that is 1 year after the date of enactment of the Consolidated Appropriations Act, 2023.</text></subsection></section></legis-body></bill>
