which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Sloan Canyon National Conservation Area Act to adjust the boundary of the Sloan Canyon National Conservation Area, to amend the Apex Project, Nevada Land Transfer and Authorization Act of 1989 to include the city of North Las Vegas, Nevada, and the Apex Industrial Park Owners Association, to clarify the authority of the Department of Defense to conduct certain military activities at the Nevada Test and Training Range, to designate the Southern Paiute Wilderness in the State of Nevada, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting National Security and Preserving Access to Public Land in Southern Nevada Act of 2023</short-title></quote>.</text></section><section id="idaa86482054da43b88d7ee5a3da434362"><enum>2.</enum><header>Sloan Canyon National Conservation Area boundary adjustment</header><subsection id="idd015dea35f81482bab3fc553fc755269"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id36b394972a254f419ffca5fc850d7740"><enum>(1)</enum><header>Conservation area</header><text>The term <term>Conservation Area</term> means the Sloan Canyon National Conservation Area.</text></paragraph><paragraph id="id8b4a096823fe4d57800238011a022f43"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior (acting through the Director of the Bureau of Land Management).</text></paragraph></subsection><subsection id="ideba2b9ddc06e47fd92679ff0a38f0986"><enum>(b)</enum><header>Boundary adjustment</header><paragraph id="id1447caa99c4c45f1a74ebbe167714706"><enum>(1)</enum><header>Map</header><text>Section 603(4) of the Sloan Canyon National Conservation Area Act (<external-xref legal-doc="usc" parsable-cite="usc/16/460qqq-1">16 U.S.C. 460qqq–1(4)</external-xref>) is amended by striking <quote>map entitled <quote>Southern Nevada Public Land Management Act</quote> and dated October 1, 2002</quote> and inserting <quote>map entitled <quote>Proposed Sloan Canyon Expansion</quote> and dated June 7, 2023</quote>.</text></paragraph><paragraph id="ida1f43c6489254969ba25aa7a3039d1aa"><enum>(2)</enum><header>Acreage</header><text>Section 604(b) of the Sloan Canyon National Conservation Area Act (<external-xref legal-doc="usc" parsable-cite="usc/16/460qqq-2">16 U.S.C. 460qqq–2(b)</external-xref>) is amended by striking <quote>48,438</quote> and inserting <quote>57,728</quote>.</text></paragraph></subsection><subsection id="id1530098d47c44d2fb21213e99a3dcf9a"><enum>(c)</enum><header>Right-of-Way</header><text>Section 605 of the Sloan Canyon National Conservation Area Act (<external-xref legal-doc="usc" parsable-cite="usc/16/460qqq-3">16 U.S.C. 460qqq–3</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd573013277f8429e8da6dd176079c72b"><subsection id="id284bc725c6b54258ab33405a0bca6037"><enum>(h)</enum><header>Horizon lateral pipeline right-of-Way</header><paragraph id="id47b7d119aaf9450d934abe53fb13a93c"><enum>(1)</enum><header>In general</header><text>Notwithstanding sections 202 and 503 of the Federal Land Policy Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>, 1763) and subject to valid existing rights and paragraph (3), the Secretary of the Interior, acting through the Director of the Bureau of Land Management (referred to in this subsection as the <quote>Secretary</quote>), shall, not later than 1 year after the date of enactment of this subsection, grant to the Southern Nevada Water Authority (referred to in this subsection as the <quote>Authority</quote>), not subject to the payment of rents or other charges, the temporary and permanent water pipeline infrastructure, and outside the boundaries of the Conservation Area, powerline, facility, and access road rights-of-way depicted on the map for the purposes of—</text><subparagraph id="id4b4ccfe4b70c4dd0ba499d449e19353b"><enum>(A)</enum><text>performing geotechnical investigations within the rights-of-way; and</text></subparagraph><subparagraph id="id16ec59c8e4334ca59d501c86d7ff2561"><enum>(B)</enum><text>constructing and operating water transmission and related facilities.</text></subparagraph></paragraph><paragraph id="id74649e44e4194bc2a61769c7bbc9d1f6"><enum>(2)</enum><header>Excavation and disposal</header><subparagraph id="id70e2a378d0dd4ec6932f11a399e61633"><enum>(A)</enum><header>In general</header><text>The Authority may, without consideration, excavate and use or dispose of sand, gravel, minerals, or other materials from the tunneling of the water pipeline necessary to fulfill the purpose of the rights-of-way granted under paragraph (1).</text></subparagraph><subparagraph id="id9dfa75f1a4c145b8ab3e1ebfc2ea0706"><enum>(B)</enum><header>Memorandum of understanding</header><text>Not later than 30 days after the date on which the rights-of-way are granted under paragraph (1), the Secretary and the Authority shall enter into a memorandum of understanding identifying Federal land on which the Authority may dispose of materials under subparagraph (A) to further the interests of the Bureau of Land Management.</text></subparagraph></paragraph><paragraph id="id64cd940cc4324a1bbad868ce62074634"><enum>(3)</enum><header>Requirements</header><text>A right-of-way issued under this subsection shall be subject to the following requirements:</text><subparagraph id="id1fafd4e81ae54c54b0863c134ed089f5"><enum>(A)</enum><text>The Secretary may include reasonable terms and conditions, consistent with section 505 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1765">43 U.S.C. 1765</external-xref>), as are necessary to protect Conservation Area resources.</text></subparagraph><subparagraph id="ida905b58daf1f4802bbe768a4520b9c8f"><enum>(B)</enum><text>Construction of the water pipeline shall not permanently adversely affect conservation area surface resources.</text></subparagraph><subparagraph id="idb205756ad88542fe992621309676ba3c"><enum>(C)</enum><text>The right-of-way shall not be located through or under any area designated as wilderness.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id76b4134be1814131919f1cabc867c491"><enum>(d)</enum><header>Preservation of transmission and utility corridors and rights-of-Way</header><text>The expansion of the Conservation Area boundary under the amendment made by subsection (b)—</text><paragraph id="idaf497b93a29d43ef8aed2375e4266818"><enum>(1)</enum><text>shall be subject to valid existing rights, including land within a designated utility transmission corridor or a transmission line right-of-way grant approved by the Secretary in a record of decision issued before the date of enactment of this Act;</text></paragraph><paragraph id="id2c125b2a52334836bf82d6d31937b34a"><enum>(2)</enum><text>shall not preclude—</text><subparagraph id="id85e6c080f3dc4e5bbea502cd7da671dc"><enum>(A)</enum><text>any activity authorized in accordance with a designated corridor or right-of-way referred to in paragraph (1), including the operation, maintenance, repair, or replacement of any authorized utility facility within the corridor or right-of-way; or</text></subparagraph><subparagraph id="ide39e2aafa70348da9e08bbab92e2095a"><enum>(B)</enum><text>the Secretary from authorizing the establishment of a new utility facility right-of-way within an existing designated transportation and utility corridor referred to in paragraph (1) in accordance with—</text><clause id="ideda48a23c7f74c75b9f2e1c7de2ac96f"><enum>(i)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) and other applicable laws; and</text></clause><clause id="id97eb8bf30f39411c8e894005b1f38ab2"><enum>(ii)</enum><text>subject to such terms and conditions as the Secretary determines to be appropriate; and</text></clause></subparagraph></paragraph><paragraph id="id9ce8a0c93e664153babd584a6c4ad31e"><enum>(3)</enum><text>except as provided in the amendment made by subsection (c), modifies the management of the Conservation Area pursuant to section 605 of the Sloan Canyon National Conservation Area Act (<external-xref legal-doc="usc" parsable-cite="usc/16/460qqq-3">16 U.S.C. 460qqq–3</external-xref>).</text></paragraph></subsection></section><section id="HBDF8E1771AB74300B3D30A0E175DACA7"><enum>3.</enum><header>Amendments to the Apex Project, Nevada Land Transfer and Authorization Act of 1989</header><subsection id="H41F5FC9E7E494DAABBA104734F3241A2"><enum>(a)</enum><header>Definitions</header><text>Section 2(b) of the Apex Project, Nevada Land Transfer and Authorization Act of 1989 (<external-xref legal-doc="public-law" parsable-cite="pl/101/67">Public Law 101–67</external-xref>; 103 Stat. 169) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id28012c48dc134b55ab9673202127f667"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by striking <quote>As used in this Act, the following terms shall have the following meanings—</quote> and inserting <quote>In this Act:</quote>; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id881b14647eed4d5f8c4fdd4be95a12fa"><enum>(2)</enum><text>in each of paragraphs (1), (2), (4), and (5), by inserting a paragraph heading, the text of which comprises the term defined in that paragraph;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idedd02a4a4e3d4d65897ce5723f1c6647"><enum>(3)</enum><text>in paragraph (3), by inserting <quote><header-in-text style="OLC" level="paragraph">County; Clark County</header-in-text>.—</quote> before <quote>The term</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0542decd300745ab98a7775a5c8ad712"><enum>(4)</enum><text>in paragraph (6)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6adab01e976240d98c0613eff1252d86"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote><header-in-text style="OLC" level="paragraph">FLPMA terms</header-in-text>.—</quote> before <quote>All</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7c232c4fe52b4a1cb5544fac4328253e"><enum>(B)</enum><text>by inserting <quote>(<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>)</quote> before the period at the end;</text></subparagraph></paragraph><paragraph id="H2F78FDB0A43640069B054FACF189413C"><enum>(5)</enum><text>by redesignating paragraphs (1), (2), (3), (4), (5), and (6) as paragraphs (7), (6), (4), (5), (2), and (8), respectively;</text></paragraph><paragraph id="H93259993511345409965864DC24864D6"><enum>(6)</enum><text>by inserting before paragraph (2) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB439C5FBFFC04B5A9AD7E8119199A503"><paragraph id="H289422A3E4B84ABEA2BD188F4D4DE8E2"><enum>(1)</enum><header>Apex Industrial Park Owners Association</header><text display-inline="yes-display-inline">The term <term>Apex Industrial Park Owners Association</term> means the Apex Industrial Park Owners Association formed on April 9, 2001, and chartered in the State of Nevada (including any successor in interest).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id45ba8ee0c812452f89568dd548427ff9"><enum>(7)</enum><text>by inserting after paragraph (2) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4B053B2296FD459AA7CA10B44113568B"><paragraph commented="no" display-inline="no-display-inline" id="id5675c8bdd93242bcba4a71068d191a37"><enum>(3)</enum><header>City</header><text>The term <quote>City</quote> means the city of North Las Vegas, Nevada.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb94e8644133b4c6793079ee4ec45c1b7"><enum>(b)</enum><header>Kerr-McGee site transfer</header><text>Section 3(b) of the Apex Project, Nevada Land Transfer and Authorization Act of 1989 (<external-xref legal-doc="public-law" parsable-cite="pl/101/67">Public Law 101–67</external-xref>; 103 Stat. 170) is amended—</text><paragraph id="ida41cb4aaad05461cb372a9fc4bf2abdd"><enum>(1)</enum><text>in the first sentence—</text><subparagraph id="ide3d1f60dc56e4ad2a5b49476870e4c4f"><enum>(A)</enum><text>by striking <quote>Clark County</quote> and inserting <quote>Clark County, the City, or the Apex Industrial Park Owners Association, individually or jointly, as appropriate,</quote>; and </text></subparagraph><subparagraph id="idC4A98D4E31CB4A45827F7F9C56CD28F8"><enum>(B)</enum><text>by striking <quote>Site</quote> and inserting <quote>Site and other land conveyed in accordance with this Act</quote>; and </text></subparagraph></paragraph><paragraph id="ida428e34463ae446bacf7658339e83a0c"><enum>(2)</enum><text>in the third sentence, by striking <quote>Clark County</quote> and inserting <quote>Clark County, the City, or the Apex Industrial Park Owners Association, individually or jointly, as appropriate,</quote>.</text></paragraph></subsection><subsection id="H12A5D96A901C44E98031E6A3B7BDF80B"><enum>(c)</enum><header>Authorization for additional transfers</header><text>Section 4 of the Apex Project, Nevada Land Transfer and Authorization Act of 1989 (<external-xref legal-doc="public-law" parsable-cite="pl/101/67">Public Law 101–67</external-xref>; 103 Stat. 171) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id6768b7e33cb5425a9da1eb4469d0b251"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c), by striking “Clark County” and inserting “Clark County, the City, or the Apex Industrial Park Owners Association, individually or jointly, as appropriate,”; and</text></paragraph><paragraph id="H41D37FFCC2DD4C1D9E342FB5D5D47AD4"><enum>(2)</enum><text>in subsection (e), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB391CF2318DC4A07AA65495DEBF9A98D"><paragraph id="id5c8fde3beb0b4d76b59cf313bc314bd6" indent="up1"><enum>(3)</enum><header>Mineral materials sale</header><text display-inline="yes-display-inline">Notwithstanding the requirements of part 3600 of title 43, Code of Federal Regulations (as in effect on the date of enactment of this paragraph), the Secretary may sell, at not less than fair market value, without advertising or calling for bids and without regard to volume or time limitations, mineral materials resulting from grading, land balancing, or other activities on the surface of a parcel of land within the Apex Site for which the United States retains an interest in the minerals.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HFD44E6CC1CCE40D389C9D88BF5C59C29"><enum>(d)</enum><header>Environmental considerations</header><text>Section 6 of the Apex Project, Nevada Land Transfer and Authorization Act of 1989 (<external-xref legal-doc="public-law" parsable-cite="pl/101/67">Public Law 101–67</external-xref>; 103 Stat. 173) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H9C15FE525267426F99DF67F4F9D86990"><subsection id="H59FB9B8C7DD540E7B64449D74800548F"><enum>(d)</enum><header>Compliance with environmental assessments</header><text display-inline="yes-display-inline">Each transfer by the United States of land or interest in lands within the Apex Site or rights-of-way issued pursuant to this Act shall be conditioned on the compliance with applicable Federal land laws, including the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) and the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of 1976</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id5edee9a35abb43b5b092880e361d9a33"><enum>4.</enum><header>Clarification of authority of Department Of Defense to conduct certain military activities at Nevada Test and Training Range</header><subsection id="id70dd66e1ff224493a44bf2fd3af21b04"><enum>(a)</enum><header>Authorized military activities</header><text>Section 3011(b) of the Military Lands Withdrawal Act of 1999 (<external-xref legal-doc="public-law" parsable-cite="pl/106/65">Public Law 106–65</external-xref>; 113 Stat. 886) is amended—</text><paragraph id="id59cd9fa7f15c40fb8f029e8ac397dea9"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="idedf42cddffcc4b9d8b37d6c4b44232f5"><enum>(A)</enum><text>in the matter preceding subparagraph (A), in the second sentence, by inserting <quote>, subject to the conditions described in section 3014(a)</quote> after <quote>Secretary of the Air Force</quote>;</text></subparagraph><subparagraph id="id53f36edbac24485bbbb9dbec87d34349"><enum>(B)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id0481f27cf36b46c2970ad46415caf977"><enum>(C)</enum><text>by redesignating subparagraph (D) as subparagraph (G); and</text></subparagraph><subparagraph id="idd5f0e7d38567421caf99ed10367ba46b"><enum>(D)</enum><text>by inserting after subparagraph (C) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5ae0f127963f44ba84a5dec791f23514"><subparagraph id="id4f82caec4652400b81f8e176524c0c51"><enum>(D)</enum><text>for emergency response;</text></subparagraph><subparagraph id="ide8685fccbe824b60b83bb99bb102af2b"><enum>(E)</enum><text>for the establishment and use of existing or new electronic tracking and communications sites, including the construction of not more than 15 equipment pads, not larger than 150-by-150 feet in size, along existing roads to allow placement and operation of threat emitters;</text></subparagraph><subparagraph id="id3b80194d5d1b4d6099ebb916433f3ec1"><enum>(F)</enum><text>for the use and maintenance of roads in existence as of January 1, 2023, depicted on the map entitled <quote>Desert National Wildlife Range Proposed Southern Paiute Wilderness Area</quote> and dated September 7, 2023, to allow access to threat emitters and repeaters for installation, maintenance, and periodic relocation; and</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddb758f08c3f347ddb8b93da85166f241"><enum>(2)</enum><text>in paragraph (5)(D)—</text><subparagraph id="id6FC20D8E4430459CA719B43B6E9A54CF"><enum>(A)</enum><text>in the matter preceding clause (i), by striking <quote>shall be construed to effect</quote> and inserting <quote>affects</quote>; and</text></subparagraph><subparagraph id="id894D71C941FD412AAA73D74E783D0C7A"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB06C903F29154B10A18CA438A26F589E"><clause id="id6195BC9B60F2441A89E5F8744B47FAD6"><enum>(iv)</enum><text>The authority of the Secretary of the Interior to access the portions of the joint use area under the primary jurisdiction of the Secretary of the Interior to carry out the management responsibilities of the Secretary of the Interior for not less than 10 percent of annual calendar days, as enumerated in an annual access schedule jointly prepared by the Secretary of the Interior and the Secretary of the Air Force.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcc5d2f05a1c242c99e8a2214906d6406"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDF659D306C3A44588B6D58B3246F07F9"><paragraph commented="no" display-inline="no-display-inline" id="id3b8b691b8daa4f73825ba429a77cb5e8"><enum>(7)</enum><header>Limitation on use of certain land before operational memorandum of understanding</header><text>Notwithstanding subparagraph (E) of paragraph (1), the Secretary of the Air Force shall not install or make operational use of an electronic tracking and communications site authorized under that subparagraph that was not subject to withdrawal before the date of enactment of this paragraph until the date on which the Secretary of the Air Force and the Secretary of the Interior have entered into a new operational memorandum of understanding for management in the joint use area in the Desert National Wildlife Refuge.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idf18f553271064ef0851d66b6620e0126"><enum>(b)</enum><header>Interagency committee; intergovernmental executive committee</header><text>Section 3011(b)(5) of the Military Lands Withdrawal Act of 1999 (<external-xref legal-doc="public-law" parsable-cite="pl/106/65">Public Law 106–65</external-xref>; 113 Stat. 887; 134 Stat. 4351) is amended—</text><paragraph id="id64019b1462c24ec39ae32e41a7fc41b0"><enum>(1)</enum><text>in subparagraph (G)—</text><subparagraph id="ide25af2f2335946c499db9e1aa0037ad9"><enum>(A)</enum><text>by striking clause (i) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id24e47b99b5724adcaf697a9bbd0aaefd"><clause id="id97563990d7484499bb87ea1cb7919db7"><enum>(i)</enum><header>In general</header><text>The Secretary of the Interior and the Secretary of the Air Force shall jointly establish an interagency committee (referred to in this subparagraph as the <quote>interagency committee</quote>)—</text><subclause id="id0a62502d1be94d48a690396e9910a440"><enum>(I)</enum><text>to facilitate coordination, manage public access needs and requirements, and minimize potential conflict between the Department of the Interior and the Department of the Air Force with respect to joint operating areas in the Desert National Wildlife Refuge;</text></subclause><subclause id="id86a9cad0d8e74094814e01bac35ae990"><enum>(II)</enum><text>to discuss, as needed—</text><item id="id6a4eda8320d04af9b4f6a77a17bc5597"><enum>(aa)</enum><text>activities under consideration in the joint operating areas in the Desert National Wildlife Refuge and the land under the primary jurisdiction of the Secretary of the Air Force in the Desert National Wildlife Refuge; and</text></item><item id="idcc3c59fbea3d42ce98de7d37d1019fc5"><enum>(bb)</enum><text>the activities authorized under paragraph (1); and</text></item></subclause><subclause id="idf7b8f9136ac64ca5abec29c953d785c7"><enum>(III)</enum><text>to provide input to the United States Fish and Wildlife Service and the Department of the Air Force in assessing whether the activities described in subclause (II) may be conducted in the joint operating areas in the Desert National Wildlife Refuge that are under the primary jurisdiction of the Secretary of the Interior or land under the primary jurisdiction of the Secretary of the Air Force in the Desert National Wildlife Refuge, in a manner that is consistent with—</text><item id="idbb9a9264fcec4c94baa1f898cd3aae84"><enum>(aa)</enum><text>the National Wildlife Refuge System Administration Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd et seq.</external-xref>); and</text></item><item id="id0589d64d9149484f81a2e341ae61e7ac"><enum>(bb)</enum><text>any other applicable law.</text></item></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id3c5c1296bca142d18617d4873dafeca2"><enum>(B)</enum><text>in clause (ii)—</text><clause id="idac21d23238614017b349b1969c601ee7"><enum>(i)</enum><text>in subclause (I), by inserting <quote>, including a designee of the Director of the United States Fish and Wildlife Service</quote> before the period at the end; and</text></clause><clause id="idf79155785c8548c19e585a2937943039"><enum>(ii)</enum><text>in subclause (II), by inserting <quote>, including a designee of the Assistant Secretary of the Air Force for Energy, Installations, and Environment</quote> before the period at the end; and</text></clause></subparagraph></paragraph><paragraph id="id6fd68ea4220143619549aa886b82ae3b"><enum>(2)</enum><text>in subparagraph (H)(ii)(II), by striking <quote>with respect to public access needs and requirements</quote> and inserting the following: “with respect to—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6fdfe0e399af4a1da5f4ec40b16589da"><item id="id22f6da7672a64967a4e7303b01aa9379"><enum>(aa)</enum><text>public access needs and requirements; and</text></item><item id="id3754f1b231084e22952e7fe7ccf5eee2"><enum>(bb)</enum><text>any proposal by the Secretary of the Air Force to undertake any of the activities authorized under paragraph (1) in the joint operating areas in the Desert National Wildlife Refuge or the land under primary jurisdiction of the Secretary of the Air Force in the Desert National Wildlife Refuge</text></item><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="ida30bd3e8de8745e1a8b98bf8660e0053"><enum>5.</enum><header>Designation of Southern Paiute Wilderness, Nevada</header><subsection id="ida10c23cb436142d9a50db643590c8d91"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id9a21a211da8b4b219ee8dd2608a35e24"><enum>(1)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id87156cb6122b4bb0b7d6ae1dbb373652"><enum>(2)</enum><header>State</header><text>The term <quote>State</quote> means the State of Nevada.</text></paragraph><paragraph id="idce606cfc71cf4aae806e473fa83d342d"><enum>(3)</enum><header>Wilderness area</header><text>The term <term>wilderness area</term> means the wilderness area designated by subsection (b)(1).</text></paragraph></subsection><subsection id="idd2410256755f47219e7b03cd30529e0d"><enum>(b)</enum><header>Addition to the National Wilderness Preservation System</header><paragraph id="id1349cd146f5d4a45b5b815d05a2afb50"><enum>(1)</enum><header>Designation</header><text>In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), there is designated as wilderness and as a component of the National Wilderness Preservation System the approximately 736,188 acres of Federal land managed by the Director of the United States Fish and Wildlife Service in Clark and Lincoln Counties, Nevada, to be known as the <quote>Southern Paiute Wilderness</quote>.</text></paragraph><paragraph id="idc94526bf1466478db48c99bc82868236"><enum>(2)</enum><header>Boundary</header><text>The boundary of any portion of the wilderness area that is bordered by a road shall be not less than 50 feet from the centerline of the road.</text></paragraph><paragraph id="id7d43ab8961904f939c64024b8705d19a"><enum>(3)</enum><header>Map and legal description</header><subparagraph id="idb6a512209dab4f5588a0f5f3d38d1e87"><enum>(A)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall prepare a map and legal description of the wilderness area.</text></subparagraph><subparagraph id="id50f25d08f8094a8f9619bae517404276"><enum>(B)</enum><header>Effect</header><text>The map and legal description prepared under subparagraph (A) shall have the same force and effect as if included in this section, except that the Secretary may correct clerical and typographical errors in the map or legal description.</text></subparagraph><subparagraph id="ida3f4b9c473b040fd9112b0f160b90c6a"><enum>(C)</enum><header>Availability</header><text>The map and legal description prepared under subparagraph (A) shall be on file and available for public inspection in the appropriate offices of the United States Fish and Wildlife Service.</text></subparagraph></paragraph><paragraph id="ide225dab9c43847c9852ea6dad5e43440"><enum>(4)</enum><header>Withdrawal</header><text>Subject to valid existing rights, the wilderness area is withdrawn from—</text><subparagraph id="idcb9789557ccd4d5eb74a6d3af39cc5a8"><enum>(A)</enum><text>all forms of entry, appropriation, and disposal under the public land laws;</text></subparagraph><subparagraph id="id37420992edcc4b7eb2cc8aef7875e6c5"><enum>(B)</enum><text>location, entry, and patent under the mining laws; and</text></subparagraph><subparagraph id="ideadc5e4303ca49acb95c9c3c00db7556"><enum>(C)</enum><text>operation of the mineral leasing and geothermal leasing laws.</text></subparagraph></paragraph></subsection><subsection id="idf7845e4b88e24c6594c8632c4faa073a"><enum>(c)</enum><header>Management</header><text>Subject to valid existing rights, the wilderness area shall be administered by the Secretary in accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), except that—</text><paragraph id="id14e9a18af0424e1398db371f172ef471"><enum>(1)</enum><text>any reference in that Act to the effective date of that Act shall be considered to be a reference to the date of enactment of this Act; and</text></paragraph><paragraph id="id197b97cb5a4142478c2b607023cd37e2"><enum>(2)</enum><text>any reference in that Act to the Secretary of Agriculture shall be considered to be a reference to the Secretary.</text></paragraph></subsection><subsection id="iddce559d33c674a69bc000435b9f99c20"><enum>(d)</enum><header>Incorporation of acquired land and interests in land</header><text>Any land or interest in land within the boundary of the wilderness area that is acquired by the United States after the date of enactment of this Act shall be added to, and administered as part of, the wilderness area.</text></subsection><subsection id="id14af937c2629415993f901fd8ca19999"><enum>(e)</enum><header>Water rights</header><paragraph id="id7d77b728d4df4dea941276f801f4afad" commented="no"><enum>(1)</enum><header>Findings</header><text>Congress finds that—</text><subparagraph id="idaafc2c32afce41ea9a98ec8f8854312f"><enum>(A)</enum><text>the land designated as the wilderness area—</text><clause commented="no" display-inline="no-display-inline" id="id8687276f313c4c58a906a577b544b53d"><enum>(i)</enum><text display-inline="yes-display-inline">is within the Mojave Desert; </text></clause><clause commented="no" display-inline="no-display-inline" id="id1bc4503042084b23abe08a5c5a2614d0"><enum>(ii)</enum><text display-inline="yes-display-inline">is arid in nature; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ida69571c4e9a646d78b4aa737f12814da"><enum>(iii)</enum><text display-inline="yes-display-inline">includes ephemeral streams;</text></clause></subparagraph><subparagraph id="ide57826cab1bc49d6ad3dc449e4bfd931"><enum>(B)</enum><text>the hydrology of the land designated as the wilderness area is predominantly characterized by complex flow patterns and alluvial fans with impermanent channels;</text></subparagraph><subparagraph id="idc8d32dd9158d40478e6a5fc86ca065af"><enum>(C)</enum><text>the subsurface hydrogeology of the region in which the land designated as the wilderness area is located is characterized by—</text><clause id="id801458ab6c6947629445264ba7d0766e"><enum>(i)</enum><text>groundwater subject to local and regional flow gradients; and</text></clause><clause id="idb7a88e692b5146af8540c580ffaeb52f"><enum>(ii)</enum><text>unconfined and artesian conditions;</text></clause></subparagraph><subparagraph id="id808b8f751b3d493aaf9f84d55561eee8"><enum>(D)</enum><text>the land designated as the wilderness area is generally not suitable for use or development of new water resource facilities; and</text></subparagraph><subparagraph id="iddab2026aa8a1458082b5045a1f234066"><enum>(E)</enum><text>because of the unique nature and hydrology of the desert land in the wilderness area, it is possible to provide for proper management and protection of the wilderness area and other values of land in ways different from ways used in other laws.</text></subparagraph></paragraph><paragraph id="idc0ba135e68924c9a9e373830e7097c82"><enum>(2)</enum><header>Effect</header><text>Nothing in this section—</text><subparagraph id="id26b6460cc57b401c96f5934984d8d614"><enum>(A)</enum><text>constitutes an express or implied reservation by the United States of any water or water rights with respect to the wilderness area;</text></subparagraph><subparagraph id="idc60304e47b6e4792ba71c697d8b86c1c"><enum>(B)</enum><text>affects any water rights in the State (including any water rights held by the United States) in existence on the date of enactment of this Act;</text></subparagraph><subparagraph id="idc66c25775a2c4be7b5062dacda0516a1"><enum>(C)</enum><text>establishes a precedent with regard to any future wilderness designations;</text></subparagraph><subparagraph id="id75188215fba24c329a03ac4a5a78fbac"><enum>(D)</enum><text>affects the interpretation of, or any designation made under, any other Act; or</text></subparagraph><subparagraph id="idc81e1ff957f1471a8c69eca116c49dfc"><enum>(E)</enum><text>limits, alters, modifies, or amends any interstate compact or equitable apportionment decree that apportions water among and between the State and other States.</text></subparagraph></paragraph><paragraph id="id17eea600a55d4d778ad8f771dc12ec22"><enum>(3)</enum><header>State water law</header><text>The Secretary shall follow the procedural and substantive requirements of State law in order to obtain and hold any water rights not in existence on the date of enactment of this Act with respect to the wilderness area.</text></paragraph><paragraph id="ide1c301c87d554a0ba464fcb7183565c1"><enum>(4)</enum><header>New projects</header><subparagraph id="idf85a4f062f9c458ebf63e4b6b9c4d432"><enum>(A)</enum><header>Definition of water resource facility</header><clause id="idf254c0c7fef04d5b8ec65d0956b41e2e"><enum>(i)</enum><header>In general</header><text>In this paragraph, the term <term>water resource facility</term> means an irrigation or pumping facility, reservoir, water conservation work, aqueduct, canal, ditch, pipeline, well, hydropower project, transmission or other ancillary facility, and other water diversion, storage, or carriage structure.</text></clause><clause id="id05c4b84e4ff243c4b6fbdf054687f010"><enum>(ii)</enum><header>Exclusion</header><text>In this paragraph, the term <term>water resource facility</term> does not include a wildlife guzzler.</text></clause></subparagraph><subparagraph id="idd24a54985f784d0faaacf7db3140324b"><enum>(B)</enum><header>Restriction on new water resource facilities</header><text>Except as otherwise provided in this section, on and after the date of enactment of this Act, neither the President nor any other officer, employee, or agent of the United States shall fund, assist, authorize, or issue a license or permit for the development of any new water resource facility within the wilderness area.</text></subparagraph></paragraph></subsection><subsection id="ide02a97ddfe534e9fbe31c5c330f3a114"><enum>(f)</enum><header>Wildfire, insects, and disease</header><text>In accordance with section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>), the Secretary may take such measures in the wilderness area as are necessary for the control of fire, insects, and diseases (including, as the Secretary determines to be appropriate, the coordination of the activities with a State or local agency).</text></subsection><subsection id="idb0987e93ebac4deeb6f1e3502c06fc90"><enum>(g)</enum><header>Data collection</header><text>Subject to such terms and conditions as the Secretary may prescribe, nothing in this section precludes the installation and maintenance of hydrologic, meteorological, or climatological collection devices in the wilderness area, if the Secretary determines that the devices and access to the devices are essential to flood warning, flood control, or water reservoir operation activities.</text></subsection><subsection id="id8fe195a03d7e4eb0a831830d3e206f66"><enum>(h)</enum><header>Military overflights</header><text>Nothing in this section restricts or precludes—</text><paragraph id="id4227ef30f1ba4cc781e23e2e8b55fa18"><enum>(1)</enum><text>low-level overflights of military aircraft over the wilderness area, including military overflights that can be seen or heard within the wilderness area;</text></paragraph><paragraph id="ida4d06ddea5b6484cb3786b86294a25cb"><enum>(2)</enum><text>flight testing or evaluation; or</text></paragraph><paragraph id="id9fe105a1ac1b4534abdf4a82f42de9ee"><enum>(3)</enum><text>the designation or creation of new units of special use airspace or the establishment of military flight training routes, over the wilderness area.</text></paragraph></subsection><subsection id="idb3860cbc40bf4b1fb5987544fea34ac0"><enum>(i)</enum><header>Wildlife management</header><paragraph id="id88288841b4ff4b1e99cfc766ddae9080"><enum>(1)</enum><header>In general</header><text>In accordance with section 4(d)(7) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(7)</external-xref>), nothing in this section affects or diminishes the jurisdiction of the State with respect to fish and wildlife management, including the regulation of hunting, fishing, and trapping, in the wilderness area.</text></paragraph><paragraph id="ideb245cb26f734f57b7519e46bfb8200c"><enum>(2)</enum><header>Management activities</header><text>In furtherance of the purposes and principles of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), the Secretary may conduct any management activities in the wilderness area that are necessary to maintain or restore fish and wildlife populations and the habitats to support the populations, if the activities are carried out—</text><subparagraph id="idd5c48182b6ca43ca8a469159ba942751"><enum>(A)</enum><text>consistent with relevant wilderness management plans or comprehensive conservation plans; and</text></subparagraph><subparagraph id="id1f6b2254b61d4e149c128430714020e8"><enum>(B)</enum><text>in accordance with—</text><clause id="id6c31a44b6c554fd7838657d486efa726"><enum>(i)</enum><text>the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>); and</text></clause><clause id="id3f3afa09cf2349a5b2e838378157cabb"><enum>(ii)</enum><text>appropriate policies, including policies authorizing the occasional and temporary use of motorized vehicles, if the use, as determined by the Secretary, would promote healthy, viable, and more naturally distributed wildlife populations that would enhance wilderness values with the minimal impact necessary to reasonably accomplish those tasks.</text></clause></subparagraph></paragraph><paragraph id="id3cf88ef30955416d91bbfd319cd413d5"><enum>(3)</enum><header>Existing activities</header><text>In accordance with section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>), the State may continue to use aircraft (including helicopters) to survey, capture, transplant, monitor, and provide water for wildlife populations.</text></paragraph><paragraph id="id8b094084e9ed4679923d1f84ee043df6"><enum>(4)</enum><header>Wildlife water development projects</header><text>Subject to subsection (e), the Secretary shall authorize structures and facilities, including existing structures and facilities, for wildlife water development projects, including guzzlers, in the wilderness area if—</text><subparagraph id="id2aff566025ba496da1bce76a56572d6b"><enum>(A)</enum><text>the structures and facilities would, as determined by the Secretary, enhance wilderness values by promoting healthy, viable, and more naturally distributed wildlife populations; and</text></subparagraph><subparagraph id="id91335ac2a53c4321b5bb6a3ba6b1e0a7"><enum>(B)</enum><text>the visual impacts of the structures and facilities on the wilderness area can reasonably be minimized.</text></subparagraph></paragraph><paragraph id="id1af92c17dd774a3589aa8be46b5f43c1"><enum>(5)</enum><header>Hunting, fishing, and trapping</header><subparagraph id="id21057f73733d45c9ba89a9204797d075"><enum>(A)</enum><header>In general</header><text>The Secretary may designate areas in which, and establish periods during which, for reasons of public safety, administration, or compliance with applicable laws, no hunting, fishing, or trapping will be permitted in the wilderness area.</text></subparagraph><subparagraph id="id0f7658ae02684f0eaf88940af5336790"><enum>(B)</enum><header>Consultation</header><text>Except in an emergency, the Secretary shall consult with the appropriate State agency and notify the public before taking any action under subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="idcb6abc32030945e68a01dfc82f82940f"><enum>(j)</enum><header>Preservation of public access</header><text>The area depicted as <quote>Corn Creek / Alamo Road</quote> on the map entitled <quote>Desert National Wildlife Range Proposed Southern Paiute Wilderness Area</quote> and dated September 7, 2023, shall be preserved for public access.</text></subsection><subsection id="idf20ad5e87244435eaaccd2357a0396ee"><enum>(k)</enum><header>Effect of Act</header><text>Nothing in this Act rescinds or precludes the continued management of any other area of the Desert National Wildlife Refuge as proposed wilderness until the date on which the area is designated as a component of the National Wilderness Preservation System by a subsequent Act of Congress. </text></subsection></section><section id="id17abb3c6cb724e1e89ec905730b1d41b"><enum>6.</enum><header>Bureau of Land management and State of Nevada cooperative agreement</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of the Interior shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report that describes the status of the cooperative agreement authorized under section 2905(j)(6) of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/117/263">Public Law 117–263</external-xref>; 136 Stat. 3043). </text></section></legis-body></bill>
