which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require regular reporting to Congress on individuals encountered along a border of the United States or a port of entry, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Where Are The Terrorists Now Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id0a4e4ca64b2d422cb7d45cac20ee6ea9"><enum>2.</enum><header>Reporting on terrorist watch list</header><subsection commented="no" display-inline="no-display-inline" id="idb5f4bc71c9514fddbcb0e10d7cc16331"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph id="idb28e84d700824ad6b0088e7802fdce38"><enum>(1)</enum><header>Terrorist organization</header><text>The term <term>terrorist organization</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida3e6f3bf42da4b9c9c57579867cff470"><enum>(A)</enum><text display-inline="yes-display-inline">an organization described in subclause (I), (II), or (III) of section 212(a)(3)(B)(vi) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(B)(vi)</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id30c87d7dfab74f8796ef74561e883e81"><enum>(B)</enum><text>any organization that has ever been described in such section 212(a)(3)(B)(vi).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaa2cecdb563f41fcaeeb0bd207ec6c8e"><enum>(2)</enum><header display-inline="yes-display-inline">Terrorist screening database</header><text>The term <term>terrorist screening database</term> has the meaning given such term in section 2101 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/621">6 U.S.C. 621</external-xref>). </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9bad21d2799045298272e6ee4e348aa4"><enum>(b)</enum><header>Report</header><text>Not later than 14 days after the date of enactment of this Act, and every month thereafter for 1 year, and biannually thereafter, the Secretary of Homeland Security, in coordination with the Attorney General and the Director of National Intelligence, submit to Congress a report on individuals encountered by U.S. Customs and Border Protection, U.S. Immigration and Customs Enforcement, or U.S. Citizenship and Immigration Services along a border of the United States or a port of entry, which shall include— </text><paragraph commented="no" display-inline="no-display-inline" id="id69bd84fbe9a341f884b778a894af57c8"><enum>(1)</enum><text>the number of individuals encountered along a border of the United States or a port of entry that are in the terrorist screening database, and the border or port of entry where they were encountered;</text></paragraph><paragraph id="id6fcd74b7d3324f90abb19120d92615b7"><enum>(2)</enum><text>a description of why each such individual is in the terrorist screening database;</text></paragraph><paragraph id="id936c36ed415749dba3c8d58a60f5c573"><enum>(3)</enum><text>any ties each such individual has to a terrorist organization;</text></paragraph><paragraph id="id65f84713657144fa9ad62b9e15f90dee"><enum>(4)</enum><text>the nation of origin of each such individual;</text></paragraph><paragraph id="id8720c4b0cd8a4c7ea9eb8e5f2ddfec50"><enum>(5)</enum><text>any previous criminal conviction of each such individual in the United States;</text></paragraph><paragraph id="id837579e59de14256b48741db1c1686a6"><enum>(6)</enum><text>how each such individual traveled to the border or port of entry, as applicable;</text></paragraph><paragraph id="id87419010dbd4479aa4da3b84b3cfefb3"><enum>(7)</enum><text>if the individual has been detained, where they were detained, if they are still detained, how long they were detained, whether they have been deported or transferred to another agency, and their known whereabouts if they have been released;</text></paragraph><paragraph id="id4a79be25096c4fdf9423aca1b53843b8"><enum>(8)</enum><text>if the individual has been released, how the determination was made that the individual does not present a danger to the United States; </text></paragraph><paragraph id="id880c9d9491f543bf9d19de973b6a15d8"><enum>(9)</enum><text>whether, and if so, how many times, the individual has been falsely identified in the terrorist screening database; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3503edd71de24cdba16681273b53dc78"><enum>(10)</enum><text>the total number of individuals added, rejected, or removed from the terrorist screening database since the last report was submitted, and the total number of individuals on the terrorist screening database as of the date of the report.</text></paragraph></subsection><subsection id="id682557d11425465093211ed98837b680"><enum>(c)</enum><header>Form</header><text display-inline="yes-display-inline">To the extent possible, the Secretary of Homeland Security shall submit each report required under subsection (b) in unclassified form, but may submit such a report, or portion of such a report, in classified form if the Secretary of Homeland Security determines that publication of such report or portion of such report would compromise the national security of the United States.</text></subsection></section></legis-body></bill>
