<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 3122</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20231025">October 25, 2023</action-date><action-desc><sponsor name-id="S323">Mr. Risch</sponsor> (for himself and <cosponsor name-id="S266">Mr. Crapo</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Land Policy and Management Act of 1976 to provide for the denial of certain applications for solar or wind energy development projects right-of-way applications.</official-title></form><legis-body><section id="idcef39b27657b44f99fec0aaf1d3587c6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Don’t Develop Obstructive Infrastructure on our Terrain Act</short-title></quote> or the <quote>Don’t DO IT Act</quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id77e2386cd99c4ca2a08fa3f77903798a"><enum>2.</enum><header>Denial of certain solar and wind energy development project right-of-way applications</header><text display-inline="no-display-inline">Section 501 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1761">43 U.S.C. 1761</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3653BAF4A2FE4A1ABC7A06415ED2C6A9"><subsection commented="no" display-inline="no-display-inline" id="id082af97838a84861a8bb850f4048e928"><enum>(e)</enum><header>Solar or wind energy development project right-of-Way applications</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section, in the case of a solar or wind energy development project right-of-way application submitted under this section, the Secretary shall deny the application if the Secretary has received from the Governor of the State in which the proposed project is located notice that the State legislature has enacted legislation disapproving the proposed project.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
