<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 3121</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20231025">October 25, 2023</action-date><action-desc><sponsor name-id="S373">Mr. Cassidy</sponsor> (for himself and <cosponsor name-id="S408">Mr. Hickenlooper</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Individuals with Disabilities Education Act to improve provisions relating to dyslexia, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>21st Century Dyslexia Act</short-title></quote>.</text></section><section id="id8D1BD3E3A4A94C9C803D109083D2B522"><enum>2.</enum><header>Dyslexia</header><subsection id="idD2782253DDF84D6D9C1846D1942F1C0A"><enum>(a)</enum><header>Definitions</header><text>Section 602 of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401</external-xref>) is amended—</text><paragraph id="idB49C25AB0C2A42A891A0D37155058068"><enum>(1)</enum><text>in paragraph (3)(A), by striking <quote>or specific learning disabilities</quote> and inserting <quote>specific learning disabilities, or dyslexia</quote>; </text></paragraph><paragraph id="id0177991D902144FBA36E86FCD6B41F71"><enum>(2)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2FA858628F724012A971739997F6875D"><paragraph id="idF86C736963AA48BF9759CFB43D1AB7CD"><enum>(4)</enum><header>Dyslexia</header><text>The term <term>dyslexia</term> means an unexpected difficulty in reading for an individual who has the intelligence to be a much better reader, most commonly caused by a difficulty in the phonological processing (the appreciation of the individual sounds of spoken language), which affects the ability of an individual to speak, read, and spell.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idF940F86273A74113A03AAD2A5952223A"><enum>(3)</enum><text>in paragraph (30)—</text><subparagraph id="id565B0ED28243465AA88B77CB61BCCACE"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>dyslexia,</quote>; and</text></subparagraph><subparagraph id="id3B59F3370FF74DC09818630D41496EB1"><enum>(B)</enum><text>in subparagraph (C), by striking <quote>or of environmental</quote> and all that follows and inserting <quote>or dyslexia</quote>.</text></subparagraph></paragraph></subsection><subsection id="idCF98A4743CB2456798069D34F22FC505"><enum>(b)</enum><header>Provision of accommodations and services</header><text>The Individuals with Disabilities Education Act is amended by inserting after section 608 (<external-xref legal-doc="usc" parsable-cite="usc/20/1407">20 U.S.C. 1407</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEE4664230E294E259E4C99BEF5757B8E"><section id="idbc8f5ff6edd346a2b7287d0bfbd2e1ec"><enum>608A.</enum><header>Provision of accommodations and services</header><text display-inline="no-display-inline">In determining eligibility for, or providing, an accommodation or service under this title, a local educational agency or other agency shall provide equal access, to the accommodation or service, to all eligible children, including eligible children who are—</text><paragraph id="id550bb93a78974770953c8ac5e89eba8d"><enum>(1)</enum><text>children from low-income families;</text></paragraph><paragraph id="iddde5d52ec70c4c44aa6dff2220709dfd"><enum>(2)</enum><text>children from families with low socioeconomic status; and</text></paragraph><paragraph id="ide886969f46d14f85b0f894ef5f67c7e3"><enum>(3)</enum><text>children who are limited English proficient.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
