<congress display="yes">118th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 311</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To correct the inequitable denial of enhanced retirement and annuity benefits to certain U.S. Customs and Border Protection Officers.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section section-type="section-one" id="id4434f849-3185-453b-80a1-2702d90eb84e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>U.S. Customs and Border Protection Officer Retirement Technical Corrections Act</short-title></quote>.</text></section><section id="id2f7669a3-67c4-4116-b769-03b4f6a2c139" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Adjustment related to transition rules</header><subsection id="idc93becc1-f898-41c2-b2f0-64c1c1136206" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Defined term</header><text display-inline="yes-display-inline">In this section the term <term>Eligible Individual</term> means any individual who—</text><paragraph id="id7ef44649-677a-44a9-820d-23f25b1beeac" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">received a tentative offer of employment as a U.S. Customs and Border Protection Officer before July 6, 2008; and</text></paragraph><paragraph id="id46f5358e-c51f-4f9b-9f44-56db0d45b622" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">entered into duty as a U.S. Customs and Border Protection officer on or after July 6, 2008, as a result of an offer described in paragraph (1).</text></paragraph></subsection><subsection id="id863bfa16-597d-40e4-8c70-dd10a3a647bb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Treatment of Eligible Individuals</header><text display-inline="yes-display-inline">Eligible Individuals—</text><paragraph id="id99347d62-3598-42db-9063-28a66ec2974f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">are considered to be individuals serving as U.S. Customs and Border Protection Officers on July 6, 2008, for purposes of section 535(e) of the Department of Homeland Security Appropriations Act, 2008 (division E of <external-xref legal-doc="public-law" parsable-cite="pl/110/161">Public Law 110–161</external-xref>; 121 Stat. 1844); and </text></paragraph><paragraph id="id6e4893e8-204b-44f2-9bdd-fdee9aa0e04f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">are entitled to—</text><subparagraph id="id6e0f25ff-8207-4998-aec2-9673279045f8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the minimum annuity amount required under section 535(e)(2)(C) of such Act; and </text></subparagraph><subparagraph commented="no" id="idaadc94a9-23ab-4d31-a98a-bf039418a5cf" changed="not-changed" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">an exemption from mandatory retirement otherwise required under section 8425(b)(1) of title 5, United States Code.</text></subparagraph></paragraph></subsection><subsection commented="no" id="id16947317-7a95-4134-a051-a52734448479" changed="not-changed" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Implementation</header><paragraph commented="no" id="id166ca649-8e67-4e0c-8c9a-a5c19f5823c6" changed="not-changed" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Submission of information</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Secretary of Homeland Security shall—</text><subparagraph id="id2f7f7bac-bcdd-4262-a7e3-fb54f9630843" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">create a list of all Eligible Individuals;</text></subparagraph><subparagraph id="idc9ea6734-0c5c-4ae5-bce4-39cd3042fab1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">notify each Eligible Individual of the annuity correction described in subsection (b); and</text></subparagraph><subparagraph id="id9230e01b-36eb-49a7-95e5-be511f1c479d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">provide the Director of the Office of Personnel Management with all of the information that is necessary for making annuity corrections with respect to Eligible Individuals. </text></subparagraph></paragraph><paragraph id="id9e8e832c-46d5-4e99-ba5c-78cb676fa6c9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Completion of annuity correction</header><text display-inline="yes-display-inline">After receiving the information described in paragraph (1)(C), the Director of the Office of Personnel Management shall make the annuity correction described in subsection (b) with respect to each Eligible Individual, including a retroactive annuity adjustment for Eligible Individuals who retired before the date of the enactment of this Act.</text></paragraph></subsection><subsection commented="no" id="id4f617030-6d95-44d2-87f6-429deed3ceb2" changed="not-changed" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Waivers and guidance</header><paragraph commented="no" id="idaabfb43a-4512-4438-8189-965798d1ac35" changed="not-changed" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Waivers</header><text display-inline="yes-display-inline">The Secretary of Homeland Security may retroactively waive the maximum entry age requirement under 3307(g) of title 5, United States Code, to the extent necessary, to ensure that each Eligible Individual is eligible for immediate retirement with the annuity correction described in subsection (b).</text></paragraph><paragraph commented="no" id="idaae29c0c-394f-40f6-8420-1f02c09fce21" changed="not-changed" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Guidance</header><text display-inline="yes-display-inline">The Director of the Office of Personnel Management, in consultation with the Secretary of Homeland Security, shall issue appropriate guidance to assist in the implementation of the annuity correction described in subsection (b). </text></paragraph></subsection><subsection id="id776254cf-e785-4daf-8690-e6725be13e3a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Government Accountability Office</header><text display-inline="yes-display-inline">The Comptroller General of the United States—</text><paragraph id="id6d0d10ad-d93f-44c7-9227-080a12b21f01" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">shall review U.S. Customs and Border Protection (referred to in this subsection as <quote>CBP</quote>) hiring practices, policies, and procedures related to eligibility for enhanced retirement benefits referred to in this section by assessing—</text><subparagraph id="id8e90887e-f708-4dee-9169-e018f9fa2bd9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the process for determining whether an employee qualifies for such benefits, including considering any potential factors that would make an employee ineligible for such enhanced retirement benefits;</text></subparagraph><subparagraph id="idb746e376-4ec2-466c-a861-73fd06ad5353" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the internal controls used by CBP to ensure that all eligible employees, and only eligible employees, receive such enhanced retirement benefits;</text></subparagraph><subparagraph id="id9d4812c3-d9a1-47e6-8cd5-bccb02dbc184" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the policies regarding the use of employees’ personnel files to ensure compliance with current laws governing retirement benefits; and</text></subparagraph><subparagraph id="id226f596a-a0bc-48d2-8216-5461e6274449" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">the adequacy of the training provided to CBP senior executives regarding human resources and hiring practices at CBP; and</text></subparagraph></paragraph><paragraph id="idb8adbf59-abd0-48ca-bd16-d7faf480420b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 18 months after the date of the enactment of this Act, shall submit a report to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> that describes the results of the review conducted pursuant to paragraph (1).</text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20231108" chamber="Senate">Passed the Senate November 8, 2023.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
