<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 3119</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20231024">October 24, 2023</action-date><action-desc><sponsor name-id="S346">Mr. Lee</sponsor> (for himself, <cosponsor name-id="S417">Mr. Budd</cosponsor>, <cosponsor name-id="S410">Ms. Lummis</cosponsor>, and <cosponsor name-id="S350">Mr. Rubio</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the Federal Communications Commission from reclassifying broadband internet access service as a telecommunications service and from imposing certain regulations on providers of such service.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H52B8B159F86C4D7CA58BF76562272B9E"><section section-type="section-one" id="H3843F1A1807A4E3CB744ACBFFE921393"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restoring Internet Freedom Act</short-title></quote>.</text></section><section id="H328F8185309546369F046E4F3E85CBD2"><enum>2.</enum><header>Limitation on authority of FCC</header><subsection id="H2CAE738726344A329545B3EDFDF8E3EB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The notice of proposed rulemaking adopted by the Federal Communications Commission in WC Docket No. 23–320 on October 19, 2023 (relating to broadband internet access service) shall have no force or effect, and the Commission may not adopt any rule pursuant to that notice or adopt any substantially similar rule unless the rule is specifically authorized by a law enacted after the date of enactment of this Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idceb66764497b458a81d27d9eabca40d8"><enum>(b)</enum><header>Applicability</header><text>Subsection (a) shall apply to any rule adopted pursuant to the notice described in that subsection, or any substantially similar rule, that is adopted before, on, or after the date of enactment of this Act.</text></subsection><subsection id="HBB4201173379417AAB195F221E3074D6"><enum>(c)</enum><header>Rule defined</header><text>In this section, the term <quote>rule</quote> has the meaning given the term in section 804 of title 5, United States Code.</text></subsection></section></legis-body></bill>
