which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the National Dam Safety Program Act to reauthorize and improve that Act, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Dam Safety Program Reauthorization Act of 2023</short-title></quote>.</text></section><section id="id7dc70a2f65ae491ca28205c556c372d4"><enum>2.</enum><header>Improvements to National Dam Safety Program</header><subsection id="idcf6cfe079c674cd194fbd4b15febae25"><enum>(a)</enum><header>Definitions</header><text>Section 2 of the National Dam Safety Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/467">33 U.S.C. 467</external-xref>) is amended—</text><paragraph id="id3794d2ac59914d5f8f4a4c2406d97a92"><enum>(1)</enum><text>by redesignating paragraphs (13) through (16) as paragraphs (14) through (17), respectively; and</text></paragraph><paragraph id="id129a6bc978554dc68017412d468300a3"><enum>(2)</enum><text>by inserting after paragraph (12) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9a902820887949a49e7022a2d9a87583"><paragraph id="idddd7d156dbbb44f58cadc223b5130641"><enum>(13)</enum><header>Small disadvantaged community</header><text>The term <term>small disadvantaged community</term> means a community with a population of less than 50,000 that has a median household income of less than 80 percent of the statewide median household income.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idbfa6713559024193ba0b8c014b1a52c5"><enum>(b)</enum><header>Rehabilitation of high hazard potential dams</header><text>Section 8A of the National Dam Safety Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/467f-2">33 U.S.C. 467f–2</external-xref>) is amended—</text><paragraph id="id240959cb31374227a3d5949c69e39b4d"><enum>(1)</enum><text>in subsection (c)(2), by striking subparagraph (C) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id20008FBCD6FA477B9834F67646CE1A0A"><subparagraph id="id01edd050a21d4bb487e4494af1ec5fe8"><enum>(C)</enum><header>Grant assurance</header><text>As part of a grant agreement under subparagraph (B), the Administrator shall require that each eligible subrecipient to which the State awards a grant under this section provides an assurance from the dam owner, with respect to the dam to be rehabilitated, that the dam owner will carry out a plan for maintenance of the dam during the expected life of the dam.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idd8377c70e9ec46e99ef18f4c76f65451"><enum>(2)</enum><text>in subsection (d)(2)(C), by striking <quote>commit</quote> and inserting <quote>for a project not including removal, obtain a commitment from the dam owner</quote>;</text></paragraph><paragraph id="id78146cb73f9e4741aab365f94c0d0e01"><enum>(3)</enum><text>by striking subsection (e) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6c6d1ef88b1e4af283aec122ffedebe8"><subsection id="id7bb7536e14f74ec58cfe5468c944726c"><enum>(e)</enum><header>Floodplain management plans</header><paragraph id="id099bf1b80edc4a55bf29f553089e879a"><enum>(1)</enum><header>In general</header><text>As a condition of receipt of assistance under this section, an eligible subrecipient shall demonstrate that a floodplain management plan to reduce the impacts of future flood events from a controlled or uncontrolled release from the dam or management of water levels in the area impacted by the dam—</text><subparagraph id="id34e6f365077a48dc85945df7a16e493f"><enum>(A)</enum><text>for a removal—</text><clause id="id84bbec4f72d24e8ab3f8dc8225d295cc"><enum>(i)</enum><text>is in place; and</text></clause><clause id="idab6831eae5074dbe8e96ed58c8327c44"><enum>(ii)</enum><text>identifies areas that would be impacted by the removal of the dam and includes a communication and outreach plan for the project and the impact of the project on the affected communities; or</text></clause></subparagraph><subparagraph id="id415994079f72450e84d4660fbffadd0b"><enum>(B)</enum><text>for a project not including removal—</text><clause id="idcce151b7a6e94e4b8b97c4d4b7bf17be"><enum>(i)</enum><text>is in place; or</text></clause><clause id="idb5df8f96a4e7423ab224ff8ee1cb460d"><enum>(ii)</enum><text>will be—</text><subclause id="id4315b32f0d1f4b8fbafe4afc58c0d3e5"><enum>(I)</enum><text>developed not later than 2 years after the date of execution of a project agreement for assistance under this section; and</text></subclause><subclause id="id9c625371ab9741508758bec14831aa40"><enum>(II)</enum><text>implemented not later than 2 years after the date of completion of construction of the project.</text></subclause></clause></subparagraph></paragraph><paragraph id="idee6135de06a24b4399e096a06f4bd1f3"><enum>(2)</enum><header>Requirement</header><text>In the case of a plan for a removal, the Administrator may not impose any additional requirements or conditions other than the requirements in paragraph (1)(A).</text></paragraph><paragraph id="idac3f0279365a4d68a869c5458e2e4aa7"><enum>(3)</enum><header>Inclusions</header><text>A plan under paragraph (1)(B) shall address—</text><subparagraph id="id561973995d86461da5ac6a9c2b9112eb"><enum>(A)</enum><text>potential measures, practices, and policies to reduce loss of life, injuries, damage to property and facilities, public expenditures, and other adverse impacts of flooding in the area protected or impacted by the dam;</text></subparagraph><subparagraph id="idcf8bf689f1b54eefbee6b8f5bdaecb40"><enum>(B)</enum><text>plans for flood fighting and evacuation; and</text></subparagraph><subparagraph id="idbdd176f39c604874992e67cf2a714a65"><enum>(C)</enum><text>public education and awareness of flood risks. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idae5a755a5cc44a29aa7902e83d822fc1"><enum>(4)</enum><header>Plan criteria and technical support</header><text display-inline="yes-display-inline">The Administrator, in consultation with the Board, shall provide criteria, and may provide technical support, for the development and implementation of floodplain management plans prepared under this subsection.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id0f50d8171f0e42b6bec32adda5d8fe08"><enum>(4)</enum><text>by striking subsection (f) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idcd9c1fef8fde4fc096fa145b4000f856"><subsection id="ide18cc9c279244e55873b9aca64d06cde"><enum>(f)</enum><header>Priority system</header><text>The Administrator, in consultation with the Board, shall develop a risk-based priority system for States to use in prioritizing multiple applications each year for eligible high hazard potential dams for which grants may be made under this section.</text></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="id0109a2ba2043423caf663f9048c2bc4f"><enum>(5)</enum><text>in subsection (g)(1)—</text><subparagraph id="id6c3df2e96c1245de91193e705cbdf4c1"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>Any</quote> and inserting <quote>Except as provided in subparagraph (C), any</quote>; and</text></subparagraph><subparagraph id="idc40a9955a77e4eedbcf7fea0e5295ef0"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id15641dc5eb1f4bd885e647772edcb999"><subparagraph id="id85bcb30ed35c480481327b23a34ce1a8"><enum>(C)</enum><header>Small disadvantaged communities</header><text>Subparagraph (A) shall not apply to a project carried out by or for the benefit of a small disadvantaged community.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id134ab405932a46b9a451fa2f818c8809"><enum>(6)</enum><text>in subsection (j)(4), by striking <quote>2026</quote> and inserting <quote>2028</quote>.</text></paragraph></subsection><subsection id="id9d8af510a11347298420a6f71725dddf"><enum>(c)</enum><header>Authorization of appropriations</header><text>Section 14 of the National Dam Safety Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/467j">33 U.S.C. 467j</external-xref>) is amended—</text><paragraph id="id92e115f447b048b2b4d87f2ea3bfd176"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id893a0e5d0a024087901cb3b5dd167713"><enum>(A)</enum><text>in paragraph (1), by striking <quote>2023</quote> and inserting <quote>2028</quote>; and</text></subparagraph><subparagraph id="id9dbfdf8d168c4123a81a5069034cd2d0"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="id248f9546fa4042989fc8df0fa8bdae12"><enum>(i)</enum><text>in subparagraph (A), in the matter preceding clause (i), by striking <quote>subparagraphs (B) and (C)</quote> and inserting <quote>subparagraph (B)</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="idfdc9f6e767e8492a8216aae9ed16a2f6"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking subparagraph (B); and</text></clause><clause commented="no" display-inline="no-display-inline" id="idbc77514589b84a73a96d1fdb6e4078e8"><enum>(iii)</enum><text>by redesignating subparagraph (C) as subparagraph (B);</text></clause></subparagraph></paragraph><paragraph id="ide425b003bf9640f1b748a871ed224c9a"><enum>(2)</enum><text>in subsection (b), by striking <quote>2023</quote> and inserting <quote>2028</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide61d73dd5ac347aea9d3aa94c2df6e2c"><enum>(3)</enum><text>in subsection (c), by striking <quote>2023</quote> and inserting <quote>2028</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id97aa331bb8f94178a25ca1494609e2bb"><enum>(4)</enum><text>in subsection (d), by striking <quote>2023</quote> and inserting <quote>2028</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbfc6cbf1943341b2a97773ef2c6faf5d"><enum>(5)</enum><text>in subsection (e), by striking <quote>2023</quote> and inserting <quote>2028</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id714b6b70e07c44bea80b51f34a64139d"><enum>(6)</enum><text>in subsection (f), by striking <quote>2023</quote> and inserting <quote>2028</quote>.</text></paragraph></subsection></section></legis-body></bill>
