which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Agriculture to provide support for organic dairy producers and processors, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Organic Dairy Assistance, Investment, and Reporting Yields Act of 2023</short-title></quote> or the <quote><short-title>O DAIRY Act of 2023</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id24ba3a47bf074090863c319e94bde061"><enum>2.</enum><header>Extension of ELAP to certain losses incurred by organic dairy farmers</header><subsection commented="no" display-inline="no-display-inline" id="id2A5158D7F2794AC08F101B356E1C582A"><enum>(a)</enum><header>Emergency assistance for livestock, honey bees, and farm-Raised fish</header><text display-inline="yes-display-inline">Section 1501(d)(2) of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/7/9081">7 U.S.C. 9081(d)(2)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idbf39cb126eff412981124f0e8dc84c8c"><enum>(1)</enum><text>by striking <quote>used to reduce</quote> and inserting the following: “used—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB68C45E0390246E2BA04EA1047210EEF"><subparagraph commented="no" display-inline="no-display-inline" id="id467431250f08427d98cd4ad83203d3df"><enum>(A)</enum><text display-inline="yes-display-inline">to reduce</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida0162c2987364689a9fc65eaef0aa343"><enum>(2)</enum><text>in subparagraph (A) (as so designated), by striking <quote>fever.</quote> and inserting the following: “fever; and</text><quoted-block style="OLC" display-inline="no-display-inline" id="id639354AA4C6E4DCBB1838E62A0508A0D"><subparagraph commented="no" display-inline="no-display-inline" id="ide5a42da3117d4dd3a6e9a33ff6ffe48a"><enum>(B)</enum><text>to reduce losses incurred by organic dairy farmers that are beyond those covered by other disaster programs of the Department of Agriculture, including losses that are caused by an increase in organic feed or other input costs that result in a cumulative decrease in net income of more than 10 percent in any 1 calendar year.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="idCBC4A6AC4A284A3482DC23EAA38ED356"><enum>(b)</enum><header>Streamlined payment process</header><text>Section 1501 of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/7/9081">7 U.S.C. 9081</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEA0CE027389A401994537B6AE833A46A"><subsection display-inline="no-display-inline" commented="no" id="id8B350AF1B0AB4CF1B66C0BDD03E8BB7D"><enum>(g)</enum><header>Streamlined payment process</header><text>The Secretary, to the maximum extent practicable, shall streamline the process for making payments under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" id="idc38106abe9ec44c0b42fee2464e218cf"><enum>3.</enum><header>Improved data collection for organic dairy</header><subsection commented="no" display-inline="no-display-inline" id="idb7535f31015a4564abde5906c11a3378"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary of Agriculture (referred to in this Act as the <term>Secretary</term>) shall provide support for regional and national programs to collect and publish cost-of-production data for organic milk, including data relating to—</text><paragraph commented="no" display-inline="no-display-inline" id="idb72a5d0a290747ae99949c3475d46b48"><enum>(1)</enum><text display-inline="yes-display-inline">the costs of major organic feedstuffs, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6da10ef40f7f408dbbdac40232a5fa91"><enum>(A)</enum><text display-inline="yes-display-inline">corn;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id86e1f3f519f74f2ea57ca0984ddb90d0"><enum>(B)</enum><text display-inline="yes-display-inline">corn silage;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id81a6fc497ff641b49b1248c03ac3394d"><enum>(C)</enum><text display-inline="yes-display-inline">soybeans;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2ac719cf5a7b4742916f97c12f09017c"><enum>(D)</enum><text display-inline="yes-display-inline">sorghum;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2a6a6cffadda49efa30bb56e3de7e6ab"><enum>(E)</enum><text display-inline="yes-display-inline">oilseeds;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id12d9a0232a2e4f89812a31337a4bdab4"><enum>(F)</enum><text display-inline="yes-display-inline">small grains;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id323d328020cf4b089baec013cb50f507"><enum>(G)</enum><text display-inline="yes-display-inline">forage crops;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idab3e134c74cb40e09691cc0fb43686ed"><enum>(H)</enum><text display-inline="yes-display-inline">pasture;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9993b1ad1cbd4af7bce112a62c7dbb74"><enum>(I)</enum><text display-inline="yes-display-inline">hay; and</text></subparagraph><subparagraph id="id13212c7b4a0e4400a71f7ce3244bcf9d"><enum>(J)</enum><text>any other major organic feedstuff, as determined by the Secretary;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4e63793943344b559c7b4028968fb181"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to the costs described in paragraph (1), prices for—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf9a6c1a08fd946f4a63aa0baccd58cba"><enum>(A)</enum><text display-inline="yes-display-inline">major organic feedstuffs produced domestically; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8b46e6f93c12486482b52015cf16e00a"><enum>(B)</enum><text display-inline="yes-display-inline">imported major organic feedstuffs; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf423ce808fd9451aa2eb5e9998a87b44"><enum>(3)</enum><text display-inline="yes-display-inline">all other costs relating to the production of organic milk.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id69bb783631074204b67b525ff0ff015d"><enum>(b)</enum><header>Organic All Milk Price Survey</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall establish a survey, to be known as the <quote>Organic All Milk Prices Survey</quote>, which shall be analogous to the existing All Milk Prices Survey of the National Agricultural Statistics Service, to gather and report monthly data about the amounts that organic dairy farmers are being paid for the organic milk produced by those organic dairy farmers and the prices received for organic milk cows, including—</text><paragraph commented="no" display-inline="no-display-inline" id="id90bf46f0d68143f0b1850e1d82800df8"><enum>(1)</enum><text display-inline="yes-display-inline">national data; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6f87ca020a1d4577b3e0efe7203e8bc1"><enum>(2)</enum><text display-inline="yes-display-inline">data relating to, at a minimum, the 6 regions with the greatest quantity of organic dairy production, as determined by the Secretary.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id04186a08c24b40feb6be6ecfc4c9544a"><enum>(c)</enum><header>Organic milk reporting</header><paragraph commented="no" display-inline="no-display-inline" id="ida1f770448e7c4ec8b8b45dcb6fea96a4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary, using data collected by the National Agricultural Statistics Service, the Economic Research Service, or the Agricultural Marketing Service, shall publish new periodic reports that include, or add to existing periodic reports, data for organic milk, which shall be equivalent to data reported for conventionally produced milk.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id92683bf27cdd485d90c0cfa7234fda9d"><enum>(2)</enum><header>Requirement</header><text>Reports published under paragraph (1) shall include, at a minimum—</text><subparagraph commented="no" display-inline="no-display-inline" id="id22dfc2998d814b3cbc46b54f04dfdcca"><enum>(A)</enum><text display-inline="yes-display-inline">organic cost-of-production data by State;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id61fef6eabe1046fe8b4254a8fcdacd1e"><enum>(B)</enum><text>regional data relating to the quantity of organic milk production;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2bd5c4f506a144899b235f883fa36565"><enum>(C)</enum><text>organic mailbox price for the 6 regions with the greatest quantity of organic dairy production, as determined by the Secretary; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id28bc2d5f4ac14fe49ec5b0bca76e556a"><enum>(D)</enum><text>major organic feedstuff prices.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id8a5a4aee1c4241f083fc8de5e2aa7d8d"><enum>4.</enum><header>Safety net program for organic dairy farms</header><subsection commented="no" display-inline="no-display-inline" id="id7acefacd61be4ab18c7476388f353229"><enum>(a)</enum><header>Proposal</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall publish in the Federal Register a proposal to establish new organic dairy safety net programs to ensure that such programs provide adequate support for organic dairy farms based on cost data specific to organic dairy.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idfcf2143fb6094bff9c2253976b0631d6"><enum>(b)</enum><header>Considerations</header><paragraph commented="no" display-inline="no-display-inline" id="iddfdd635c3ec94358b235437713dec806"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall accept written and recorded comments with respect to the development of a proposal under subsection (a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb980df399cba4909870645f0eb44faee"><enum>(2)</enum><header>Public availability</header><text display-inline="yes-display-inline">Comments accepted under paragraph (1) shall be made available to the public.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc36fe7e2fa5a403284fc7b76b92bbd93"><enum>(c)</enum><header>Requirement</header><text>In developing a proposal under subsection (a), the Secretary shall ensure that—</text><paragraph commented="no" display-inline="no-display-inline" id="id3d3dc97e1ff94a90976981174c81f9bb"><enum>(1)</enum><text display-inline="yes-display-inline">all organic dairy operations are eligible to participate in the programs proposed to be established pursuant to that proposal; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idee96ee3a0ea14ca4a4b7c937cee25048"><enum>(2)</enum><text display-inline="yes-display-inline">those programs prioritize support for small dairy operations (as determined based on the small business size standard for the applicable North American Industry Classification System code described in section 121.201 of title 13, Code of Federal Regulations (or a successor regulation)).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id95c10249efc44a5e8fd7fbeef1852d63"><enum>(d)</enum><header>Report to Congress</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall submit to Congress a report that—</text><paragraph commented="no" display-inline="no-display-inline" id="id4aa885521a0c445d97c33cf0f87870db"><enum>(1)</enum><text display-inline="yes-display-inline">includes recommendations relating to the implementation of the proposal developed under subsection (a); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7723e67d5aca492c8e8f2843fa50e81c"><enum>(2)</enum><text display-inline="yes-display-inline">describes any actions taken by the Secretary to implement that proposal.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id033dee4c6663464dadf78a9afcc403c4"><enum>5.</enum><header>Investments in organic dairy processing infrastructure</header><subsection commented="no" display-inline="no-display-inline" id="id99e7aa240ba4427b9332a277c90b915a"><enum>(a)</enum><header display-inline="yes-display-inline">Infrastructure investment funding program</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a program to provide funding for investments in infrastructure to enhance regional organic milkshed markets that seek to drive a greater affinity for regionally sourced and processed organic dairy products by incentivizing support for—</text><paragraph id="id35d87b77ec464975b8d7b364de3be911"><enum>(1)</enum><text>the development of new organic dairy processing plants that support multiple regional small dairy operations (as determined based on the small business size standard for the applicable North American Industry Classification System code described in section 121.201 of title 13, Code of Federal Regulations (or a successor regulation));</text></paragraph><paragraph id="id7aa7c6407bd04c83b489bdf3ef1d2fa8"><enum>(2)</enum><text>initiatives that establish institutional purchasing of local organic dairy products;</text></paragraph><paragraph id="id849cc0ef18a342eda47b6d384f3e3d10"><enum>(3)</enum><text>investment in infrastructure on farms and in sites that aggregate raw milk to gain transport and processing efficiencies;</text></paragraph><paragraph id="id249b05036e9e43afad132e710193ffc2"><enum>(4)</enum><text>the establishment of on-farm organic dairy processing and storage;</text></paragraph><paragraph id="id3846e44a88d5421181035c8424cad541"><enum>(5)</enum><text>producers and processors that want to expand regional organic processing infrastructure serving regionally produced organic milk from multiple regional small dairy operations (as determined based on the small business size standard for the applicable North American Industry Classification System code described in section 121.201 of title 13, Code of Federal Regulations (or a successor regulation)), including by— </text><subparagraph commented="no" display-inline="no-display-inline" id="id715ccaeb8a984d77b64fbff1b8ac0f30"><enum>(A)</enum><text display-inline="yes-display-inline">supporting work to finalize business plans; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide0982cceb9fd47c5b07fb055bf61ee66"><enum>(B)</enum><text display-inline="yes-display-inline">providing processor start-up capital; and</text></subparagraph></paragraph><paragraph id="id94fa83086e074a618fd4aaf43d5ba9d6"><enum>(6)</enum><text>initiatives that support increasing regional processing capacity to facilitate co-packing and tolling for regionally produced organic milk from multiple regional small dairy operations (as determined based on the small business size standard for the applicable North American Industry Classification System code described in section 121.201 of title 13, Code of Federal Regulations (or a successor regulation)).</text></paragraph></subsection><subsection id="ide56a9001a38b4266b048c306fe2b0b68"><enum>(b)</enum><header>Regional organic dairy market specialists</header><paragraph commented="no" display-inline="no-display-inline" id="id630d98463c784b5a8388bc97a961adb6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall establish regional positions in each major organic dairy producing region, to be known as <quote>Regional Organic Dairy Market Specialists</quote>—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc20d36ff4fff4725b98104d57c9d4ce4"><enum>(A)</enum><text display-inline="yes-display-inline">to conduct research on the marketing of organic dairy, including research relating to—</text><clause commented="no" display-inline="no-display-inline" id="id1eed97407c1a4fbcbc26fed7dfd69aae"><enum>(i)</enum><text display-inline="yes-display-inline">quality standards, including changes in those standards over time;</text></clause><clause commented="no" display-inline="no-display-inline" id="id87c00885c9704675a0f51fb4bbe03cf7"><enum>(ii)</enum><text display-inline="yes-display-inline">cost-of-production data;</text></clause><clause commented="no" display-inline="no-display-inline" id="ide61bb11e55804b4eb4d67207f73397f2"><enum>(iii)</enum><text display-inline="yes-display-inline">consolidation of, and lack of competition among, buyers;</text></clause><clause commented="no" display-inline="no-display-inline" id="id33348b14aa614e63ab355afb42f718dd"><enum>(iv)</enum><text display-inline="yes-display-inline">requirements for certification, including changes in those requirements over time;</text></clause><clause commented="no" display-inline="no-display-inline" id="id87583eb800f54d20a18f423a49ca3f27"><enum>(v)</enum><text display-inline="yes-display-inline">direct marketing of value-added products at the farm level; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ide5d48ba25d3a4b998863fb3bb57063fd"><enum>(vi)</enum><text>the establishment and promotion of new or existing regional organic dairy brands that source regional milk; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb220773a11b9435ba20ac10499ca8615"><enum>(B)</enum><text>to provide reports, recommendations, and advice to the Secretary, organic dairy producers and processors, Congress, and the public with respect to the matters described in clauses (i) through (vi) of subparagraph (A) and other matters relating to the marketing of organic dairy, including a report describing the options, costs, and feasibility of establishing an organic dairy insurance program through the Department of Agriculture.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb2f3161d50d54f2e89ba1ea937d21f9d"><enum>(2)</enum><header>Requirement</header><text>A Regional Organic Dairy Market Specialist may be—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7f2916ee25384fa6b3df73b3c87c5fa2"><enum>(A)</enum><text display-inline="yes-display-inline">an employee of the Department of Agriculture; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1ba945593f1048d2b77b6cb00071cedd"><enum>(B)</enum><text display-inline="yes-display-inline">a position at a relevant institution of higher education.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9b007159204e416d83b469ed9c71246b"><enum>(3)</enum><header>Research teams</header><text>A Regional Organic Dairy Market Specialist shall establish a research team to assist the Regional Organic Dairy Market Specialist in conducting the research described in paragraph (1)(A).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id54b1eaeb9b5748d1b0943ae98aac6bc9"><enum>(4)</enum><header>Period of support</header><subparagraph commented="no" display-inline="no-display-inline" id="idafc7bf1d239f41bbb928f2a203050887"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall enter into a commitment to provide support for Regional Organic Dairy Market Specialists, and the research teams established under paragraph (3), for a period of 5 years.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9ae71adebdf24aabac21aa0a8c5d1368"><enum>(B)</enum><header>Renewal of support</header><text>Subject to the availability of appropriations, at the end of a 5-year period of support, the Secretary may renew the support of a Regional Organic Dairy Market Specialist (and the research team of that Regional Organic Dairy Market Specialist) for 1 or more successive 5-year periods, pursuant to such commitments as the Secretary determines to be appropriate.</text></subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="id1D95BB54BA8D4EDFA90346228EB327A9"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary for each of fiscal years 2024 through 2028—</text><paragraph commented="no" display-inline="no-display-inline" id="idc14c0a9f95f143fd804e98b9a35f1ffd"><enum>(1)</enum><text>$20,000,000 to carry out subsection (a); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb9199404d8ef4c21a4e5b838be485ae3"><enum>(2)</enum><text>$5,000,000 to carry out subsection (b).</text></paragraph></subsection></section></legis-body></bill>
