<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 3092</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20231019">October 19, 2023</action-date><action-desc><sponsor name-id="S384">Mr. Tillis</sponsor> (for himself and <cosponsor name-id="S343">Mr. Boozman</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To clarify certain regulations to allow for the installation of pulsating light systems for high-mounted stop lamps, and for other purposes.</official-title></form><legis-body><section id="HEEFF0DF2B6EC4F31838450A46894DF32" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Collision Avoidance Systems Act of 2023</short-title></quote>.</text></section><section id="H4B4FC3CDC34C4676A9AF11F86A4AAD90"><enum>2.</enum><header>Rear-end collision avoidance systems</header><subsection id="H0EEAF578D7184667B3DA645DDFFB0FEB"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HEA5AFDBC126448F8B6283C83E753217F"><enum>(1)</enum><header>Pulsating light system</header><text display-inline="yes-display-inline">The term <term>pulsating light system</term> means a system for a high-mounted stop lamp in which—</text><subparagraph id="HCD9859EC415E4BFA8DCBE887B0706DD5"><enum>(A)</enum><text display-inline="yes-display-inline">when the brake of the vehicle is applied, the lamp pulses rapidly not more than 4 times and for not more than 1.2 seconds, after which the lamp converts to a continuous light as a normal stop lamp until the time the brake is released; and</text></subparagraph><subparagraph id="HBC1A6F0C45424CD09CCC1D8311C7C22F"><enum>(B)</enum><text display-inline="yes-display-inline">the pulses described in subparagraph (A) may not repeat on a subsequent application of the brake of the vehicle for a lock-out period of at least 5 seconds after the release of the brake described in that subparagraph.</text></subparagraph></paragraph><paragraph id="H4FCB20326334496494C80B52AB5C67A2" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Standard 108</header><text>The term <term>Standard 108</term> means Federal Motor Vehicle Safety Standard Number 108, contained in section 571.108 of title 49, Code of Federal Regulations (or a successor regulation).</text></paragraph></subsection><subsection id="H977662E7C5BD43AC9E222FF08F0320A5" display-inline="no-display-inline"><enum>(b)</enum><header>Clarification on pulsating light systems</header><text>Beginning on the date of enactment of this Act, Standard 108 shall be deemed to allow for the use of pulsating light systems on vehicles covered by Standard 108.</text></subsection><subsection id="H983DC2E995E84AE5AB0DEF97ACBCAC70" display-inline="no-display-inline"><enum>(c)</enum><header>Rulemaking</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Transportation shall promulgate such regulations as are necessary to update Standard 108—</text><paragraph id="H551A4A3C831A41248FE26AE166CD404A"><enum>(1)</enum><text>to include performance-based standards for pulsating light systems; and</text></paragraph><paragraph id="H292E9E54E15C48AE874343A49B5278CD"><enum>(2)</enum><text>to allow for the use of pulsating light systems on motor vehicles covered by Standard 108.</text></paragraph></subsection></section></legis-body></bill>
