and</text></paragraph><paragraph id="id78b4aa9bab604e78827d66de7a0bfe2e"><enum>(2)</enum><text>to pursue the labeling or treatment of the People’s Republic of China as a developed nation in each international organization of which the United States and the People’s Republic of China are both current members.</text></paragraph></section><section id="ide4c43dad413e4bcdb80325974b314975" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id03f166f6dfb7476f8cfa6f902abe52e1"><enum>(1)</enum><header>Appropriate committees of congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="ide82857992f5c40ce84846a2546d36426"><enum>(A)</enum><text>the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>; and</text></subparagraph><subparagraph id="id8f588f8412a245a3b692bf2d5cf90f48"><enum>(B)</enum><text>the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>.</text></subparagraph></paragraph><paragraph id="ida471fd1c9152410d9a2ace26512ef540" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of State. </text></paragraph></section><section id="idd5b8f6563ed449749b0c0de6407a0fae" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>4.</enum><header>Report on development status in current treaty negotiations</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary shall submit a report to the appropriate committees of Congress identifying all current treaty negotiations in which—</text><paragraph id="id66a4bd73616749f5bed52141489944a8"><enum>(1)</enum><text>the proposed treaty develops different standards for the enforcement of the treaty based on the development status of the member states of the treaty; and</text></paragraph><paragraph id="idf1ca74e788424676a586702d25bdbcf5"><enum>(2)</enum><text>the People's Republic of China is under consideration for becoming a party to the treaty.</text></paragraph></section><section id="iddc20f26215a64e3cb505e984dcd2121d" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>5.</enum><header>Report on development status in existing organizations and treaties</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary shall submit a report to the appropriate committees of Congress identifying—</text><paragraph id="ide77a3cdbf8af408a850bbcebd6c0bded"><enum>(1)</enum><text>all international organizations or treaties, of which the United States is a member, that have different standards for enforcement based on the development status of the member states; and</text></paragraph><paragraph id="id12323b4806ad465c8ccfb8f51e75775a"><enum>(2)</enum><text>for each of the organizations or treaties identified pursuant to paragraph (1), the Secretary shall provide a list of countries that—</text><subparagraph id="id19e2ee776a204bbb88361b66962c623c"><enum>(A)</enum><text>are labeled as developing nations or receive the benefits of a developing nation under the terms of the organization or treaty; and</text></subparagraph><subparagraph id="id96f970a9e832482a9e926fccce2e464f"><enum>(B)</enum><text>meet the World Bank classification for upper middle income or high-income countries. </text></subparagraph></paragraph></section><section id="id69f08fbb5f18409d886eecfd14cf2913" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>6.</enum><header>Mechanisms for changing development status</header><subsection id="id6024b560253d41c997cb24694924174b"><enum>(a)</enum><header>In general</header><text>In any international organization of which the United States and the People's Republic of China are both current members, the Secretary shall pursue—</text><paragraph id="id0724712d358e42f3aa33372a6e343213"><enum>(1)</enum><text>changing the status of the People's Republic of China from developing nation to developed nation if a mechanism exists in such organization to make such status change; or</text></paragraph><paragraph id="id3c3013ac8844475893a9c1f6c95fb0e7"><enum>(2)</enum><text>proposing the development of a mechanism described in paragraph (1) to change the status of the People's Republic of China in such organization from developing nation to developed nation.</text></paragraph></subsection><subsection id="id2d811ee2e0a7412f990efd2170ecd80a"><enum>(b)</enum><header>Waiver</header><text>The President may waive the application of paragraph (1) or (2) of subsection (a) with respect to any international organization if the President notifies the appropriate committees of Congress that such a waiver is in the national interests of the United States.</text></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section commented="no" display-inline="no-display-inline" id="id07b9d802b5784d61bae87b6c20c7f3dc" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ending China's Developing Nation Status Act</short-title></quote>.</text></section><section id="id7238b1ee-5a08-4650-a6a5-91827273467d" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>2.</enum><header>Finding; statement of policy</header><subsection commented="no" display-inline="no-display-inline" id="id196ca76184ef49b3a6d2826aba870a71"><enum>(a)</enum><header display-inline="yes-display-inline">Finding</header><text>Congress finds that the People’s Republic of China is still classified as a developing nation under multiple treaties and international organization structures, even though it has grown to be the second largest economy in the world. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id9c507eaee63340c1b4d9a75e3bd0acff"><enum>(b)</enum><header>Statement of policy</header><text display-inline="yes-display-inline">It is the policy of the United States—</text><paragraph id="idca278845-73b2-4d1d-bebd-8042c459e2c1"><enum>(1)</enum><text>to oppose the labeling or treatment of the People’s Republic of China as a developing nation in current and future treaty negotiations and in each international organization of which the United States and the People’s Republic of China are both current members;</text></paragraph><paragraph id="id4310776a-7d04-4eaf-bcd3-c7238189feb7"><enum>(2)</enum><text>to pursue the labeling or treatment of the People’s Republic of China as a developed nation in each international organization of which the United States and the People’s Republic of China are both current members; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida8bac0c1fd454e9d9d2d0492e68cebd7"><enum>(3)</enum><text>to work with allies and partners of the United States to implement the policies described in paragraphs (1) and (2). </text></paragraph></subsection></section><section id="iddc88ae2f-a6b3-4570-882f-1227a38239ab" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idc4eb43cb-45fb-4464-80a8-a261cfbb0fa8"><enum>(1)</enum><header>Appropriate committees of congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="id82e027cb-6d4f-42b2-95bf-6ff892b87075"><enum>(A)</enum><text>the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>; and</text></subparagraph><subparagraph id="ide0f46402-05a9-423c-8afa-44f6541e39c5"><enum>(B)</enum><text>the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc40a4809-03e9-4807-8ada-e09362a00c9b"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of State. </text></paragraph></section><section id="idd13370d2-4c01-457f-9c2f-6e8993b27072" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>4.</enum><header>Report on development status in current treaty negotiations</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary shall submit a report to the appropriate committees of Congress that—</text><paragraph id="idf546de52-b56a-4ebe-a85e-3c41477af502"><enum>(1)</enum><text>identifies all current treaty negotiations in which—</text><subparagraph commented="no" display-inline="no-display-inline" id="id61b9fb8b64a8440883e226b433483779"><enum>(A)</enum><text display-inline="yes-display-inline">the proposed treaty would provide for different treatment or standards for enforcement of the treaty based on respective development status of the states that are party to the treaty; and</text></subparagraph><subparagraph id="id03502c57-03f8-4949-929b-fa85e36fc9f2"><enum>(B)</enum><text>the People's Republic of China is actively participating in the negotiations, or it is reasonably foreseeable that the People's Republic of China would seek to become a party to the treaty; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2a16e4052d484df08be6d05dafd8b47e"><enum>(2)</enum><text>for each treaty negotiation identified pursuant to paragraph (1), describes how the treaty under negotiation would provide different treatment or standards for enforcement of the treaty based on development status of the states parties. </text></paragraph></section><section id="idd49636a4-d55a-4e75-a838-c1c6c97e4622" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>5.</enum><header>Report on development status in existing organizations and treaties</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary shall submit a report to the appropriate committees of Congress that—</text><paragraph id="idc9c84113-e54b-4929-a6ad-aabdfc0ca9cc"><enum>(1)</enum><text>identifies all international organizations or treaties, of which the United States is a member, that provide different treatment or standards for enforcement based on the respective development status of the member states or states parties;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida906315f7a564f02add4828a5d9f586d"><enum>(2)</enum><text>describes the mechanisms for changing the country designation for each relevant treaty or organization; and </text></paragraph><paragraph id="idd8d3f3b1-ec5b-4af0-b6f2-63719ddbfb9f"><enum>(3)</enum><text>for each of the organizations or treaties identified pursuant to paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc8156ed670464fc7a326bfa49f8287cc"><enum>(A)</enum><text display-inline="yes-display-inline">includes a list of countries that—</text><clause id="id8077c33b-2576-4163-8848-204b6bc7dc82"><enum>(i)</enum><text>are labeled as developing nations or receive the benefits of a developing nation under the terms of the organization or treaty; and</text></clause><clause id="id80ed16cd-1012-4819-b172-66bc20770b2b"><enum>(ii)</enum><text>meet the World Bank classification for upper middle income or high-income countries; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide73136d7b2604fa2a013b4fb7a3cf2d6"><enum>(B)</enum><text>describes how the organization or treaty provides different treatment or standards for enforcement based on development status of the member states or states parties. </text></subparagraph></paragraph></section><section id="idae196eaf-7267-452a-a9dc-20f4a4f55dd0" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>6.</enum><header>Mechanisms for changing development status</header><subsection id="id0bd3bb0b-89dc-4710-8ca2-d32b98dd8660"><enum>(a)</enum><header>In general</header><text>In any international organization of which the United States and the People's Republic of China are both current members, the Secretary, in consultation with allies and partners of the United States, shall pursue—</text><paragraph id="id5e6dfd2d-a506-41a2-8882-982e00d74e55"><enum>(1)</enum><text>changing the status of the People's Republic of China from developing nation to developed nation if a mechanism exists in such organization to make such status change; or</text></paragraph><paragraph id="ide6f6a9fb-7d16-4d02-af97-4256f191d0b2"><enum>(2)</enum><text>proposing the development of a mechanism described in paragraph (1) to change the status of the People's Republic of China in such organization from developing nation to developed nation.</text></paragraph></subsection><subsection id="id6f21375d-d2f1-4ee7-9513-b8dbe9da014c"><enum>(b)</enum><header>Waiver</header><text>The President may waive the application of paragraph (1) or (2) of subsection (a) with respect to any international organization if the President notifies the appropriate committees of Congress that such a waiver is in the national interests of the United States.</text></subsection></section></legis-body><endorsement><action-date>June 13, 2023</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
