which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit schools that receive certain support from the Federal Communications Commission from allowing access to social media platforms on subsidized services, devices, or networks, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Eyes on the Board Act of 2023</short-title></quote>.</text></section><section id="ida14d2d8b74a147aeaa92cfa2b708601d"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id0f95dfe07470485c93e40565adbd0268"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission.</text></paragraph><paragraph id="idc5b3afce2d8a4c699263ac5b819d11bc"><enum>(2)</enum><header>Covered support</header><text>The term <term>covered support</term> means support from—</text><subparagraph id="idacab05d986a94fa7862ae9270a90cc53"><enum>(A)</enum><text>the E-Rate program; or</text></subparagraph><subparagraph id="idb5b783747a21472983fafc5e41e97d31"><enum>(B)</enum><text>the Emergency Connectivity Fund.</text></subparagraph></paragraph><paragraph id="id274345a31a474eec938f1d62bc14e734"><enum>(3)</enum><header>Emergency Connectivity Fund</header><text>The term <term>Emergency Connectivity Fund</term> means the fund established under section 7402(c)(1) of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254</external-xref> note).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide7d7d324c1a246df8b8eb8767a06117b"><enum>(4)</enum><header>E-rate program</header><text>The term <term>E-rate program</term> means the universal service program for schools and libraries established under section 254(h) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254(h)</external-xref>), the rules of which are set forth under subpart F of part 54 of title 47, Code of Federal Regulations, or any successor regulations. </text></paragraph><paragraph id="id7ce895417b764f04a16c6f853eadc141"><enum>(5)</enum><header>Social media platform</header><text>The term <term>social media platform</term>—</text><subparagraph id="ida7acd314b92b4a0aae041fde127d6b3d"><enum>(A)</enum><text>means any website, online service, online application, or mobile application that— </text><clause commented="no" display-inline="no-display-inline" id="id8d199c65355c4226a7a32e3744206de0"><enum>(i)</enum><text display-inline="yes-display-inline">serves the public; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id5102eac572134cfea800ece4bf81f8d0"><enum>(ii)</enum><text display-inline="yes-display-inline">primarily provides a forum for users to communicate user-generated content, including messages, videos, images, games, and audio files, to other online users; and </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id03763b68767041188138898702b3ada8"><enum>(B)</enum><text display-inline="yes-display-inline">does not include—</text><clause id="id93d94e4625b54ebcaf46470e1bb258cf"><enum>(i)</enum><text>an internet service provider;</text></clause><clause id="id17c451ed4dcd4be8a9f72e2095a09856"><enum>(ii)</enum><text>electronic mail; or</text></clause><clause id="idd6768ae63eae41cea05000764d46c15a"><enum>(iii)</enum><text>an online service, application, or website—</text><subclause id="id4afd19af040b430f87316555dbf72063"><enum>(I)</enum><text>that consists primarily of content that is not user-generated, but is preselected by the provider; and</text></subclause><subclause id="id19eacf3a214242f1a3cced7282cbc6c8"><enum>(II)</enum><text>for which any chat, comment, or interactive functionality is incidental to, directly related to, or dependent on the provision of content described in subclause (I).</text></subclause></clause></subparagraph></paragraph></section><section id="id40691959b480476aab47643c9bddfe84"><enum>3.</enum><header>Prohibition on use of school broadband subsidies for access to social media platforms</header><subsection id="ide0efeb8b81254b4696d2a5a66312bd9b"><enum>(a)</enum><header>Prohibition</header><paragraph commented="no" display-inline="no-display-inline" id="id2099df8c2c6a486faddfaedc1b322765"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Except for purposes of complying with section 254(h)(5)(B)(iii) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254(h)(5)(B)(iii)</external-xref>), a school that receives covered support may not allow access to a social media platform to students on any supported service, device, or network.</text></paragraph><paragraph id="id21157ab4ebe545ceaa54ff0d8eb15382"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in paragraph (1) may be construed to prohibit parent-sanctioned learning management systems and school information systems used for purposes of schools conveying content related to the education of students.</text></paragraph></subsection><subsection id="id439511da57f14be19f4683f56ffebfa3"><enum>(b)</enum><header>Certification</header><paragraph id="id06ea223be0db45a8b86210080c41921e"><enum>(1)</enum><header>Certification for E-Rate applicants</header><text>Beginning in the first funding year that begins after the date of enactment of this Act, each school applying for support under the E-Rate program (without regard to whether the school submits an application directly for that support or such an application is submitted on behalf of the school by a consortium or school district), as a condition for receiving that support, shall, during each annual application cycle, certify that the school will comply with the requirements of this section for the year covered by the application.</text></paragraph><paragraph id="id198c41fb8eb1486e8ba9f320e5c2d4d1"><enum>(2)</enum><header>Certification for emergency connectivity fund applicants</header><text>The Commission may not provide support from amounts made available from the Emergency Connectivity Fund to any school that has not certified compliance with the requirements of this section as of the date that is 180 days after the date of enactment of this Act.</text></paragraph></subsection><subsection id="id3ac748863a6b492685793f5174948847"><enum>(c)</enum><header>Enforcement</header><text>The Commission shall— </text><paragraph commented="no" display-inline="no-display-inline" id="id5a573535268d4d62bec184c25b6449d0"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 120 days after the date of enactment of this Act, amend the rules of the Commission to carry out this section; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9b5ac6f3b82d4e26a745576ddca1971d"><enum>(2)</enum><text display-inline="yes-display-inline">enforce this section, and any rules issued under this section, as if this section and those rules were part of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>) or the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>; 135 Stat. 4), as applicable, or the rules issued under either such Act.</text></paragraph></subsection></section><section id="id66a5462a4e35495c9e61f86acc82a6b0"><enum>4.</enum><header>Empowering transparency and parental limits on screen time in schools</header><subsection id="idde30fa866dbc42e087c023661c7f8600"><enum>(a)</enum><header>In general</header><text>Section 254(h)(5)(B) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254(h)(5)(B)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id43800259d4044555b9d6851d824a94cb"><enum>(1)</enum><text>in clause (ii), by striking <quote>and</quote> at the end;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1218a67ac8d144559648ce396b519bcd"><enum>(2)</enum><text>in clause (iii), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6f9e81ce1bcf441a8dd5058e279d4545"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC729DD4D76C343EE97611EB11C5952CF"><clause id="id991f952085194bbaa285a53be969a1ae"><enum>(iv)</enum><text>has adopted a screen time policy that includes guidelines, disaggregated by grade, for the number of hours and uses of screen time that may be assigned to students, whether during school hours or as homework, on a regular basis.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id147cea7492d44a0a80edf52586f91ec0"><enum>(b)</enum><header>Certification and reporting</header><text>Beginning in the first funding year that begins after the date of enactment of this Act, each school seeking covered support (without regard to whether the school submits an application directly for that covered support or such an application is submitted on behalf of the school by a consortium or school district) shall, as a condition of receiving that covered support—</text><paragraph commented="no" display-inline="no-display-inline" id="id4d8cece5aa254bd49a1dfa02d6deda93"><enum>(1)</enum><text display-inline="yes-display-inline">certify that the school will comply with the requirements of this section and the amendments made by this section for the year covered by the application; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id45d99b1b8ae14c61bf348ef050392c1f"><enum>(2)</enum><text display-inline="yes-display-inline">provide to the Commission a copy of the screen time policy of the school to which the certification relates.</text></paragraph></subsection><subsection id="id1595cd59c95f42899935b454f1b7f03a"><enum>(c)</enum><header>Commission requirements</header><text>The Commission shall, not later than 120 days after the date of enactment of this Act, amend the rules of the Commission to carry out this section and the amendments made by this section.</text></subsection></section><section id="idf82d3c38f06f4a85b046ca847e28588f"><enum>5.</enum><header>Internet safety policies</header><text display-inline="no-display-inline">Section 254 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254</external-xref>) is amended—</text><paragraph id="ida89836a5ac0a4c3c99d5f9139cafb21b"><enum>(1)</enum><text>in subsection (h)(5)—</text><subparagraph id="idf236328c3d3b44fb91b4f115886efb9b"><enum>(A)</enum><text>in subparagraph (A)(i)—</text><clause id="id9523f231ba7443669430c896d8330ec3"><enum>(i)</enum><text>in subclause (I), by inserting <quote>and copies of the internet safety policy and screen time policy to which each such certification pertains</quote> before the semicolon at the end; and</text></clause><clause id="id5cde9d31bda244ffb802993f09dbb72d"><enum>(ii)</enum><text>in subclause (II)—</text><subclause id="id3d569892f23d4db5b730abd7177a2eda"><enum>(I)</enum><text>by striking <quote>Commission</quote> and all that follows through the end of the subclause and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="id9398DBBBFE8049D4BC0C71C32A4E3583"><text>Commission—</text><item id="id83b4f5588a344049a211d5bc533ee225"><enum>(aa)</enum><text>a certification that an internet safety policy and screen time policy described in subclause (I) have been adopted and implemented for the school; and</text></item><after-quoted-block>; and </after-quoted-block></quoted-block></subclause><subclause id="idd593058a7f644af9ac3a38b02bcb344b"><enum>(II)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idae985ce3d63243d39c6f24893f042b60"><item id="id607cd711b54348f2ad0ff40c05b2b859"><enum>(bb)</enum><text>copies of the internet safety policy and screen time policy described in item (aa); and</text></item><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause></subparagraph><subparagraph id="id82ffe5ffb0824c628c51dd2e5c5af3a7"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id51eb9c12fa6a430a8abae01aa384771c"><subparagraph id="idd0cd851d16714c3f988a1a9cc1261bc8"><enum>(G)</enum><header>Database of internet safety and screen time policies</header><text>The Commission shall establish an easily accessible, public database that contains each internet safety policy and screen time policy submitted to the Commission under subclauses (I) and (II) of subparagraph (A)(i).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id88a5a20a87b84580a37e7ced8a2cf6ca"><enum>(2)</enum><text>in subsection (l), by striking paragraph (3) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb9958435b7164bc3be574cb85c588cdd"><paragraph id="id48321ced75cd40c4993207296cc4665f"><enum>(3)</enum><header>Availability for review</header><text>A copy of each internet safety policy adopted by a library under this subsection shall be made available to the Commission, upon request of the Commission, by the library for purposes of the review of the internet safety policy by the Commission.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
