which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the removal of small-diameter trees in fire hazard areas, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small-diameter Timber and Underutilized Material Act of 2023</short-title></quote>.</text></section><section id="idaea4cb98aabe4d218f195d09a5ff3c96"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id288c7f6eda9249229a30f4163130d66d"><enum>(1)</enum><header>Federal land</header><text>The term <term>Federal land</term> means land under the jurisdiction of—</text><subparagraph id="idcead5f2d63e24edb8b9530ee734b7707"><enum>(A)</enum><text>the Bureau of Land Management;</text></subparagraph><subparagraph id="id28021982d78640769d28ddb8cf380f51"><enum>(B)</enum><text>the Bureau of Reclamation;</text></subparagraph><subparagraph id="idefece1e294f3430882a8fef261084ff9"><enum>(C)</enum><text>the National Park Service;</text></subparagraph><subparagraph id="idd57116054a334c62a09ebb416daf913a"><enum>(D)</enum><text>the United States Fish and Wildlife Service; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb55440ae463945dbab354248f6b1a59d"><enum>(E)</enum><text>the Forest Service. </text></subparagraph></paragraph><paragraph id="ide1402cb007024364a73b4e9a4e07b5f8"><enum>(2)</enum><header>Fire hazard area</header><text>The term <term>fire hazard area</term> means an area that—</text><subparagraph id="idf9cb378fba4c4d6e968dc79208e87785"><enum>(A)</enum><text>has been identified by the Secretary concerned as having a very high wildfire hazard risk;</text></subparagraph><subparagraph id="id85ba585004e14282b242a72b31758201"><enum>(B)</enum><text>is located on Federal land; and</text></subparagraph><subparagraph id="id9f5c17abbb7c4b3f9873bb8715898d3b"><enum>(C)</enum><text>is located west of the 100th meridian in the contiguous 48 States.</text></subparagraph></paragraph><paragraph id="id6dadc5d525e64287869cbeef98fbf3a0"><enum>(3)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text><subparagraph id="IDB52FF2AEE34D455C9E2286E9823D0979"><enum>(A)</enum><text>the Secretary of Agriculture, acting through the Chief of the Forest Service, with respect to Federal land administered by that Secretary; and</text></subparagraph><subparagraph id="ID00948E2B28494E1395980622868E1C67"><enum>(B)</enum><text>the Secretary of the Interior, with respect to Federal land administered by that Secretary.</text></subparagraph></paragraph><paragraph id="id41426709fa694bc5a6f9da47f7773b91"><enum>(4)</enum><header>Small-diameter tree</header><text>The term <term>small-diameter tree</term> means a tree, or portion thereof, as determined by the Secretary concerned, that has a diameter at breast height of generally not greater than 8 inches. </text></paragraph></section><section id="id6889f71ecd024b7da63b5c58b8f45334"><enum>3.</enum><header>Prices</header><subsection id="id5d5a079cdbcb4bb895cadae2805d8322"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (b), notwithstanding any other provision of law—</text><paragraph id="id30376f3aa2e74c65a699fb1f6519dadd"><enum>(1)</enum><text>the Secretary concerned may not—</text><subparagraph id="id014BE801783A405B8CB1EFD5B297ABBE"><enum>(A)</enum><text>charge a fee to authorize a person to remove a small-diameter tree in a fire hazard area, including a fee for a special use permit; or</text></subparagraph><subparagraph id="id0b87eac5d2f44b9bbd23fd92c2169c73"><enum>(B)</enum><text>recover any processing or monitoring cost of authorizing a person to remove a small-diameter tree in a fire hazard area; and</text></subparagraph></paragraph><paragraph id="idB14F7B4304454D388B86744F8850A0FA"><enum>(2)</enum><text>if the Secretary concerned authorizes a person to remove a small-diameter tree, including through a timber sale, in a fire hazard area, the Secretary concerned shall not require the person to pay any amount for the small-diameter tree.</text></paragraph></subsection><subsection id="idEEED2862B6CE481CAABF665C081E51FE"><enum>(b)</enum><header>Fees</header><text>The Secretary concerned may charge a fee, in accordance with regulations promulgated by the Secretary concerned, for removal of a small-diameter tree of a particular species of tree in a fire hazard area if the Secretary concerned—</text><paragraph id="idF67370CC050441429FE59C70FCAE1D38"><enum>(1)</enum><text>determines that the fee is appropriate; and</text></paragraph><paragraph id="idDAA280CE46BC43FDB1B158B82767AD20"><enum>(2)</enum><text>discloses that determination to the public.</text></paragraph></subsection><subsection id="id10b69fd6a8b24cf4829a2232c23cb731"><enum>(c)</enum><header>No volume determinations; appraisals</header><text>As part of a small-diameter tree removal described in subsection (a), the Secretary concerned may not—</text><paragraph id="idA67DF9C2CDDF4082A469708390ADD7E5"><enum>(1)</enum><text>require a volume determination, including by scaling, measuring, weighing, or counting small-diameter trees before or after cutting or removal; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id718054dffac8432a91af0a42c642a026"><enum>(2)</enum><text>conduct a timber appraisal to determine the fair-market value of the small-diameter trees being removed.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idD9CAA52E3DA14675BB9356DBBE8519D3"><enum>(d)</enum><header>Applicability</header><text>This section shall only apply to contracts or permits authorizing a person to remove a small-diameter tree as described in subsection (a) entered into on or after the date of enactment of this Act.</text></subsection></section><section id="id6696d625add9453582e3ac1e217c5b2a"><enum>4.</enum><header>Free-use area designation</header><text display-inline="no-display-inline">The Secretary of Agriculture, acting through the Chief of the Forest Service, shall designate as a free-use area under section 223.6 of title 36, Code of Federal Regulations (or a successor regulation), any fire hazard area in the National Forest System that contains a small-diameter tree.</text></section><section id="idfdc52cfed8a64599998a79f15e52e002"><enum>5.</enum><header>Tree designation</header><text display-inline="no-display-inline">The Secretary concerned shall seek to designate for removal small-diameter trees in a fire hazard area by utilizing the most efficient method of designation, which may include designation by description, designation by prescription, or physical marking.</text></section></legis-body></bill>
