<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 3054</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20231017">October 17, 2023</action-date><action-desc><sponsor name-id="S423">Mr. Ricketts</sponsor> (for himself and <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Immigration and Nationality Act to provide F visas and employment authorization for international student athletes who enter into endorsement contracts for the commercial use of their names, images, and likenesses.</official-title></form><legis-body><section id="idc7370b5e25cd48e7813d56f71a5580fa" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Name, Image, and Likeness for International Collegiate Athletes Act</short-title></quote>.</text></section><section id="ida738226f78244140b9b0b5cdd60c6a4d" section-type="subsequent-section"><enum>2.</enum><header>F visas and employment authorization for international student athletes</header><subsection commented="no" display-inline="no-display-inline" id="id58f70fed68ab42469c652d37a5f2d209"><enum>(a)</enum><header display-inline="yes-display-inline">F visa category</header><text display-inline="yes-display-inline">Section 101(a)(15)(F) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(F)</external-xref>) is amended—</text><paragraph id="ida2148e681da945439f6a5a180cc841a5"><enum>(1)</enum><text>in clause (ii), by striking <quote>and</quote> at the end; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb4c4c9a072564d12a00c7c124b641908"><enum>(2)</enum><text>in clause (iii), by striking the semicolon at the end and inserting <quote>, and (iv) an alien who is or will become a student athlete upon enrollment at an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)) and who intends to enter into an endorsement contract for the purpose of earning compensation for the commercial use of the alien's name, image, or likeness;</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide8fe9f5f39a04dada9d1cc650886f3e3"><enum>(b)</enum><header>Employment authorization</header><text>Section 214(m) of Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(m)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEDD1F06E54234071AD3897869106410A"><paragraph id="id3b584089bcba49fbb02e705a5055548d" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id3d98e55ed499489a9214976b73eee0eb"><enum>(A)</enum><text>A nonimmigrant who obtains the status of a nonimmigrant under clause (iv) of section 101(a)(15)(F) shall be eligible for employment authorization for the purpose of engaging in activities pursuant to an endorsement contract for the commercial use of the nonimmigrant's name, image, or likeness.</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id9f7674d9ea0a4c7e8320636c21c064e8"><enum>(B)</enum><text>The Secretary of Homeland Security may seek to engage the designated school official of the institution of higher education at which such a nonimmigrant is enrolled in oversight of the employment activity of the nonimmigrant for the purpose of ensuring compliance with this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
