which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Food and Nutrition Act of 2008 to provide guidance and enhanced technical assistance for States seeking to establish a restaurant meals program under the supplemental nutrition assistance program, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Meals for At-Risk Americans Act of 2023</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="ida2f498a8249a45af8c97ea285330aeed"><enum>2.</enum><header>Assistance for State restaurant meals programs</header><subsection commented="no" display-inline="no-display-inline" id="iddec48c550f1a46cf95e6d4183f6afabc"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 11 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC70990A79C0E4CDB9585EEDD81D15CE1"><subsection commented="no" display-inline="no-display-inline" id="id414f1c05f9e64cefbf13b917cbbbabaf"><enum>(y)</enum><header>Assistance for State restaurant meals programs</header><paragraph commented="no" display-inline="no-display-inline" id="idb024d74512d94fafb3d62152de2c16a2"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this subsection:</text><subparagraph id="ida0a3390f22df455ab1f20ca58bb620d9" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header>Digital application</header><text>The term <term>digital application</term> means a web-based platform that allows for the digital submission of applications. </text></subparagraph><subparagraph id="id888408222f564866aef858e9a85f4bee"><enum>(B)</enum><header>Enhanced technical assistance</header><text>The term <term>enhanced technical assistance</term> means enhanced detailed educational guidance for States to learn how to set up a restaurant meals program.</text></subparagraph><subparagraph id="iddfcadbf51acd4d96bddbf794b9ce89e7"><enum>(C)</enum><header>Restaurant meals program</header><text>The term <term>restaurant meals program</term> means a State option restaurant program carried out under subsection (e)(25). <italic></italic></text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4189adbbdedf47b0a7520263d467ba06"><enum>(2)</enum><header>Rulemaking</header><subparagraph id="id70741b115448475ebee2d130e70757ec"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this subsection, the Secretary shall promulgate a rule, which may be an interim final rule, that establishes—</text><clause commented="no" display-inline="no-display-inline" id="ida7fec4f129634162b72f5a3ec68b8347"><enum>(i)</enum><text display-inline="yes-display-inline">guidance for States seeking to establish a restaurant meals program; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id59c2013319b94a4ebad1431f4a630c4a"><enum>(ii)</enum><text>a digital application that a State may use to submit a State plan under subsection (e)(25) for establishing a restaurant meals program. </text></clause></subparagraph><subparagraph id="idc9368f9ba4d24a8d9cb8246b39f1114a" commented="no"><enum>(B)</enum><header>Effectiveness of interim final rules</header><text>An interim final rule promulgated under subparagraph (A) shall be immediately effective on publication in the Federal Register without requiring the Secretary to demonstrate good cause, notwithstanding subparagraph (B) of section 553(b) of title 5, United States Code.</text></subparagraph><subparagraph id="id854b2b5453f84ed99e0f6975a1272791" commented="no"><enum>(C)</enum><header>Opportunity for comment and hearing</header><text>An interim final rule promulgated under subparagraph (A) shall give interested persons the opportunity to comment and to request a hearing.</text></subparagraph><subparagraph id="id6dde0ee9b5cd4ac1ac34c31a276490c9" commented="no"><enum>(D)</enum><header>Final rule</header><text>After the conclusion of any comment period or hearing under subparagraph (C), the Secretary shall issue a final rule in accordance with section 553 of title 5, United States Code. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide034ba01214f4c8a9f362082fd669f56"><enum>(3)</enum><header>State application status</header><subparagraph commented="no" display-inline="no-display-inline" id="ida4bb2173fd42451086f41d7f0a051267"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall notify a State agency seeking to establish a restaurant meals program of the status of the application of the State agency, including whether the application is in review, approved, or denied.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0f1b5eac27384ea7972763a0e0290e7f"><enum>(B)</enum><header>Reason for denial</header><text>If an application described in subparagraph (A) is denied, the Secretary shall provide a statement explaining the reasons for the denial.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1fdad402ebfc4e0e9a5e8806297686a1"><enum>(4)</enum><header>Restaurant application status</header><text>The Secretary shall use a real-time data sharing process established by the Secretary to provide to States frequent status updates on the status of applications to the Secretary from restaurants in the State to participate in the restaurant meals program of that State, which shall include an explanation for any denial of a restaurant application.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1f50a78c5bb846a8b22864d9190d2f29"><enum>(5)</enum><header>Enhanced technical assistance</header><text>Not later than 120 days after the date of enactment of this subsection, the Secretary shall provide enhanced technical assistance to States seeking to establish a restaurant meals program, including assistance to establish a digital application for use by the State for the purpose of collecting applications from restaurants in the State.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id61d25f93b37b4cbe8502e824e6655932"><enum>(b)</enum><header>Program requirements</header><text display-inline="yes-display-inline">Section 11(e)(25)(A) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020(e)(25)(A)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id343068dce3274c38baa979bb4d341c17"><enum>(1)</enum><text>in clause (ii), by striking <quote>and</quote> at the end;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id54fb3d15a8d74287958403ac997bb8f3"><enum>(2)</enum><text>by redesignating clause (iii) as clause (iv); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd185089a98ab4b4d97aa9c495223855c"><enum>(3)</enum><text>by inserting after clause (ii) the following:</text><quoted-block id="id9C01A775DBDD4E5491989040CA72D747" style="OLC" act-name=""><clause id="id73A19C5528FB4AFD8138E9BCFE013F20"><enum>(iii)</enum><text>whether the State agency will offer a digital application (as defined in subsection (y)(1)) as an option for restaurants in the State seeking to apply to participate in the program; and</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
