which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20240723">July 23, 2024</action-date><action-desc>Reported by <sponsor name-id="S338">Mr. Manchin</sponsor>, without amendment</action-desc></action><legis-type>A BILL</legis-type><official-title>To withdraw certain Federal land in the Pecos Watershed area of the State of New Mexico from mineral entry, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pecos Watershed Protection Act</short-title></quote>.</text></section><section id="id4D63C95D2D994267AB405DB23DEEC6E9"><enum>2.</enum><header>Withdrawal of Federal land in Pecos Watershed area, New Mexico</header><subsection id="id0DFC224CE07245FEAC06AB19B9C32E26"><enum>(a)</enum><header>Definition of Federal land</header><text>In this section, the term <term>Federal land</term> means the Federal land depicted as <quote>Pecos Withdrawal</quote> on the map entitled <quote>Proposed Mineral Withdrawal Legislative Map</quote> and dated September 11, 2023.</text></subsection><subsection id="idf954a499d50a4bd79b1b1f4ef7d907d7"><enum>(b)</enum><header>Withdrawal</header><text>Subject to valid rights in existence on the date of enactment of this Act, the Federal land is withdrawn from all forms of—</text><paragraph id="idA57FE9081EB34E9E9F5A93F04FEB0DB8"><enum>(1)</enum><text>entry, appropriation, or disposal under the public land laws;</text></paragraph><paragraph id="idBA9BCEB072CF4A688A4439B288DDA957"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and </text></paragraph><paragraph id="id93AD5AB8010441C0A25AA7F0BBF69EE8" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>disposition under all laws pertaining to mineral and geothermal leasing or mineral materials. </text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idaf00dafa7b094aef91ceb18640ffbaf2"><enum>3.</enum><header>Designation of Thompson Peak Wilderness Area, New Mexico</header><subsection id="id3F4FF24D013F421CAA094AB5E0BFF1CF"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id8E27D0FA4C28438DA8AD8A687CDD6558"><enum>(1)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph><paragraph id="id2386395D6D344A2D979E8994C256AC62"><enum>(2)</enum><header>State</header><text>The term <term>State</term> means the State of New Mexico.</text></paragraph><paragraph id="id4DF717A05DBD4164A69CE127C408C756"><enum>(3)</enum><header>Wilderness area</header><text>The term <term>wilderness area</term> means the Thompson Peak Wilderness Area designated by subsection (b).</text></paragraph></subsection><subsection id="id9BA00AEF72B843EE8F2CA4FC66170C6B"><enum>(b)</enum><header>Designation</header><text display-inline="yes-display-inline">In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), the approximately 11,599 acres of land managed by the Forest Service in the State, as generally depicted on the map entitled <quote>Proposed Mineral Withdrawal Legislative Map</quote> and dated September 11, 2023, is designated as a wilderness area and as a component of the National Wilderness Preservation System, to be known as the <quote>Thompson Peak Wilderness Area</quote>.</text></subsection><subsection id="id9473ac48ff904ba79bb0042a92fa56fa"><enum>(c)</enum><header>Map and legal description</header><paragraph id="id0E23B95897EA486E989BB3056C5B4F77"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this Act, the Secretary shall file a map and legal description of the wilderness area with—</text><subparagraph id="id9FD6454A62E343838FCF6744FFE4D6AB"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Energy and Natural Resources of the Senate; and </text></subparagraph><subparagraph id="id9041C54C640C49E38C1E152F43597E01"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Natural Resources of the House of Representatives. </text></subparagraph></paragraph><paragraph id="id8DE5B90BF63347B4AB84E00E24106624"><enum>(2)</enum><header>Effect</header><text display-inline="yes-display-inline">The map and legal description filed under paragraph (1) shall have the same force and effect as if included in this Act, except that the Secretary may correct clerical and typographical errors in the map and legal description.</text></paragraph><paragraph id="idC61F3860CE1943D6A2A1028B99883AF5"><enum>(3)</enum><header>Availability</header><text display-inline="yes-display-inline">The map and legal description filed under paragraph (1) shall be on file and available for public inspection in the Office of the Chief of the Forest Service.</text></paragraph></subsection><subsection id="iddb86170863d84d678c0f1d03cce5404e"><enum>(d)</enum><header>Administration</header><paragraph id="id53D6A38B728E43ABA5B638511B6AE6E5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to valid existing rights, the wilderness area shall be administered by the Secretary in accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), except that any reference in that Act to the effective date of that Act shall be considered to be a reference to the date of enactment of this Act. </text></paragraph><paragraph id="id1927b0dad6884187af1e741703ee2024"><enum>(2)</enum><header>Adjacent management</header><subparagraph id="idB32123805CDA46BCA9FB355326CA7873"><enum>(A)</enum><header>No protective perimeters or buffer zones</header><text display-inline="yes-display-inline">Congress does not intend for the designation of the wilderness area to create a protective perimeter or buffer zone around the wilderness area.</text></subparagraph><subparagraph id="id2C687C7C9B1F4AC28712E230A9FC5C54"><enum>(B)</enum><header>Nonwilderness activities</header><text display-inline="yes-display-inline">The fact that nonwilderness activities or uses outside of the wilderness area can be seen or heard from an area within the wilderness area shall not preclude the conduct of the nonwilderness activities or uses outside the boundaries of the wilderness area. </text></subparagraph></paragraph><paragraph id="idc36d4a280c6148d68521a6ab86918ef6"><enum>(3)</enum><header>Fish and wildlife management</header><text display-inline="yes-display-inline">In accordance with section 4(d)(7) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(7)</external-xref>), nothing in this section affects the jurisdiction or responsibilities of the State with respect to fish and wildlife management in the wilderness area (including the regulation of hunting, fishing, and trapping).</text></paragraph><paragraph id="id7c50fa41c58144549652fff722349e34"><enum>(4)</enum><header>Grazing</header><text>The Secretary shall allow the continuation of the grazing of livestock in the wilderness area, if established before the date of enactment of this Act, in accordance with—</text><subparagraph id="idd2da253e8c93429cbf62506aca7b023b" commented="no"><enum>(A)</enum><text>section 4(d)(4) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(4)</external-xref>); and</text></subparagraph><subparagraph id="idc951ba98c34045e4b98adbaf15607bd1" commented="no"><enum>(B)</enum><text>the guidelines set forth in Appendix A of the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 2570 of the 101st Congress (H. Rept. 101–405).</text></subparagraph></paragraph><paragraph id="id3df108978cb64ba7a17f3c0cc0ac2d32"><enum>(5)</enum><header>Wildfire, insect, and disease control</header><text display-inline="yes-display-inline">The Secretary may carry out measures in the wilderness area that the Secretary determines to be necessary to control fire, insects, or diseases, in accordance with section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>).</text></paragraph></subsection><subsection id="idff01d396723240deb1ca9d16a2f7cdc0" commented="no"><enum>(e)</enum><header>Incorporation of acquired land and interests in land</header><text>Any land or interest in land within the boundaries of the wilderness area that is acquired by the United States after the date of enactment of this Act shall be added to and administered as part of the wilderness area. </text></subsection><subsection id="ida60d4ef9cdf94abaa51b444f9695ef4f" commented="no"><enum>(f)</enum><header>Withdrawal</header><text>Subject to valid existing rights, the wilderness area is withdrawn from—</text><paragraph id="idf5a12bacfee54b2697a178a53f2ba26f" commented="no"><enum>(1)</enum><text>entry, appropriation, or disposal under the public land laws;</text></paragraph><paragraph id="id65bfd3e93f114629acdd99ab03442978" commented="no"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text></paragraph><paragraph id="id28a9c3fc8fc64e078fb21c0dc0f74f9f" commented="no"><enum>(3)</enum><text>disposition under all laws relating to mineral and geothermal leasing or mineral materials. </text></paragraph></subsection></section></legis-body><endorsement><action-date date="20240723">July 23, 2024</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
