which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to permanently extend certain in-home cardiopulmonary rehabilitation flexibilities established in response to COVID–19, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H85B3DF810AF94689BB28A07BC464293E"><section section-type="section-one" id="H5FECD96BA7FB4445A544F6AEE954D939"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sustainable Cardiopulmonary Rehabilitation Services in the Home Act</short-title></quote>.</text></section><section id="H747AEBFAAD3B4414B10A9F17E092B804"><enum>2.</enum><header>Codifying virtual cardiopulmonary rehabilitation flexibilities established in response to COVID–19</header><subsection id="HCC9D7A5C36E34C2193612BFFF6D4B270"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1861(eee)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(eee)(2)</external-xref>) is amended—</text><paragraph id="H840BE743CED24DAC882EC6FE0FACAB77"><enum>(1)</enum><text>in subparagraph (A)(ii), by inserting <quote>, including in the home of an individual when furnished as a telehealth service through audio-visual real-time communications technology, or when such home is designated as a provider-based location of a hospital outpatient department</quote> after <quote>outpatient basis</quote>; and</text></paragraph><paragraph id="H7D080DD6E2C44E7F836B5BA75E735D01"><enum>(2)</enum><text>in subparagraph (B), by inserting <quote>, including through the virtual presence of such physician, physician assistant, nurse practitioner, or clinical nurse specialist, through audio-visual real-time communications technology</quote> after <quote>under the program</quote>.</text></paragraph></subsection><subsection id="H95C9066FA4C94914B437DB4F18402AEE"><enum>(b)</enum><header>Expanding originating sites</header><text>Section 1834(m) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)</external-xref>) is amended—</text><paragraph id="H40E0EBC5ADFA454091FEA03C88BE3D2E"><enum>(1)</enum><text>in paragraph (1), by striking <quote>and (9)</quote> and all that follows through <quote>(as defined in paragraph (4)(E))</quote> and inserting <quote>, (9), and (10), the Secretary shall pay for telehealth services that are furnished via a telecommunications system by a physician (as defined in section 1861(r)) or a practitioner (as defined in paragraph (4)(E)), or by a hospital (as defined in section 1861(e))</quote>;</text></paragraph><paragraph id="H3140EBB884694C2FA7E4BF9384DFA2D7"><enum>(2)</enum><text>in paragraph (2)(A), by striking <quote>or practitioner</quote> each place that it appears and inserting <quote>, practitioner, or hospital</quote>;</text></paragraph><paragraph id="HB69D4019922C45D2856C3AFEBACAE727"><enum>(3)</enum><text>in paragraph (4)(A), by striking <quote>or practitioner</quote> and inserting <quote>, practitioner, or hospital</quote>; </text></paragraph><paragraph id="H62F281FC14CB4ABA8C704D927EF7B1C1"><enum>(4)</enum><text>in paragraph (4)(C)—</text><subparagraph id="H537984EF07E94D61B9FA1D0BEF981AA9"><enum>(A)</enum><text>in clause (i), by striking <quote>and (7)</quote> and inserting <quote>(7), and (10)</quote>; and</text></subparagraph><subparagraph commented="no" id="H1D9E5A3C67094D21A516760DA82CB6BC"><enum>(B)</enum><text>in clause (ii)(X), by striking <quote>paragraph (7)</quote> and inserting <quote>paragraphs (7) and (10)</quote>;</text></subparagraph></paragraph><paragraph id="HC9B0A359743F48B9ACEE92C97D0CAEA9"><enum>(5)</enum><text>in paragraph (4)(F)(i), by striking <quote>paragraph (8)</quote> and inserting <quote>paragraphs (8) and (10)</quote>; and</text></paragraph><paragraph id="H4CEF7FBBF96B41F9A5CEDD84F8DDDB79"><enum>(6)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idff79698da3db45198fe6e7c74157a8f0"><paragraph id="idbeeaa5cd10964acab323ec06a94c3d01"><enum>(10)</enum><header>Treatment of cardiac rehabilitation program, intensive cardiac rehabilitation program, and pulmonary rehabilitation program visits furnished through telehealth</header><text>In the case of items and services furnished on or after January 1, 2024, the geographic requirements described in paragraph (4)(C)(i) shall not apply with respect to telehealth services for cardiac rehabilitation programs and intensive cardiac rehabilitation programs (as such terms are defined in section 1861(eee)) and pulmonary rehabilitation programs (as defined in section 1861(fff)) at an originating site described in subclauses (V) and (X) of paragraph (4)(C)(ii).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id41888614684e48f3b17b5c4bb97032fe"><enum>(c)</enum><header>Authority To establish standards and allow for certain programs To utilize telehealth services</header><paragraph id="ida231d1df1f244c259b990f93136a3eff"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date of enactment of this section, the Secretary of Health and Human Services shall— </text><subparagraph id="H757D8B1BC7E2487E884E6F0F020BABF4"><enum>(A)</enum><text display-inline="yes-display-inline">establish standards for the designation of the home of an individual with status as a provider-based organization of a hospital consistent with waivers issued through the Hospital Without Walls program for cardiac rehabilitation, pulmonary rehabilitation, and intensive cardiac rehabilitation; and</text></subparagraph><subparagraph id="H03D6EFF32F5B4DD4BEA9EBA08466389E"><enum>(B)</enum><text display-inline="yes-display-inline">include items and services furnished under cardiac rehabilitation program or under an intensive cardiac rehabilitation program (as such terms are defined in section 1861(eee) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(eee)</external-xref>), or under a pulmonary rehabilitation program (as defined in section 1861(fff) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(fff)</external-xref>) among telehealth services to be specified under section 1834(m)(4)(F) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(F)</external-xref>). </text></subparagraph></paragraph><paragraph id="idafbdad398bcf4125bea5231dd2a30b50"><enum>(2)</enum><header>Effective date</header><text>The standards established under paragraph (1) shall apply to items and services furnished on or after January 1, 2024.</text></paragraph></subsection><subsection id="id078638aeae684e519a605aa45fa7594b"><enum>(d)</enum><header>Implementation</header><text>Notwithstanding any other provision of the law, the Secretary of Health and Human Services may implement the provisions of, and the amendments made by, this section by program instruction or otherwise.</text></subsection><subsection id="id62c867b262e646bd9d6e1abd3bd39969"><enum>(e)</enum><header>Effective date</header><text>The amendments made by subsections (a) and (b) shall apply to items and services furnished on or after January 1, 2024.</text></subsection></section></legis-body></bill>
