which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To develop and disseminate accurate, relevant, and accessible resources to promote understanding about Native American and Tribal histories.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Native Histories and Cultures Education Act of 2023</short-title></quote>.</text></section><section id="idb6ab08bf10c747ec8d73e9dcacf7a3a3"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="id7101bbe6eefa4db6b938a41a6585e2fd"><enum>(1)</enum><text>Native American peoples are a vital part of our Nation’s past and present.</text></paragraph><paragraph id="id3070bbecd2364c5ca22078867e17cbf5"><enum>(2)</enum><text>Native American peoples have made significant contributions to the United States and continue to serve as leaders in communities across the Nation and with distinction as public servants, scholars, scientists, entrepreneurs, artists, and authors, and in many other professions and specialties.</text></paragraph><paragraph id="id0fdcddc5366a4f8c8ca5067afd5e4b26"><enum>(3)</enum><text>The United States has a unique government-to-government relationship with Indian Tribes and treaty-based trust responsibilities owed to Native American peoples and Indian Tribes.</text></paragraph><paragraph commented="no" id="id56a60acbcc8044feb17973ecdb4d2d13"><enum>(4)</enum><text>Congress has played a critical role in recognizing the cultures and contributions of Native American peoples throughout the history of the United States by establishing the National Museum of the American Indian in 1989 to—</text><subparagraph id="idde8e71d7be4a49739d0cde6c1bb3abfb"><enum>(A)</enum><text>advance the study of Native American language, literature, history, art, anthropology, and life; and</text></subparagraph><subparagraph id="id5c019eb8a6554e6a8e8bece6ee9b5ebc"><enum>(B)</enum><text>provide for Native American research and study programs.</text></subparagraph></paragraph><paragraph id="id5df5157c69364404a0071661f0a32c23"><enum>(5)</enum><text>Indian Tribes, Tribal Colleges and Universities, Native American organizations, and Native American communities have worked diligently to bring accurate Native American histories and culturally informed educational opportunities to American classrooms.</text></paragraph><paragraph id="idd31fdfe436c549779fb5cca61820a602"><enum>(6)</enum><text>Washington, Oregon, Montana, Arizona, New Mexico, Wisconsin, Maine, Connecticut, Virginia, Florida, Minnesota, and Hawaii include Native American education in content standards for kindergarten through grade 12 education.</text></paragraph><paragraph id="id294d38d7fff24550b706b7392904e155"><enum>(7)</enum><text>It is important for students in the United States to have a complete and accurate education about—</text><subparagraph id="idc12d52dbb10d486287a2dcfc0f93b0b7"><enum>(A)</enum><text>the experience of Native American peoples in the United States today and throughout history;</text></subparagraph><subparagraph id="id9c52fd7d5d26457da6ccb3b3276254a1" commented="no"><enum>(B)</enum><text>the misrepresentation of Native American peoples that pervades popular culture, professional sports, and beyond through the use of unsanctioned mascots and Native imagery;</text></subparagraph><subparagraph id="id95b8d6ed348b429590ea118ab690b506"><enum>(C)</enum><text>the Federal Government’s adoption of the relocation, termination, and other discriminatory and genocidal policies, including the Indian Boarding School Policy, and similar policies employed in the Territory of Hawaii, to strip American Indian, Alaska Native, and Native Hawaiian children of their indigenous identities, language, and culture; </text></subparagraph><subparagraph id="id1fe70afe381d4b89ba6a118e7d709e13"><enum>(D)</enum><text>the unique government-to-government relationship between the Federal Government and Indian Tribes; and</text></subparagraph><subparagraph id="id857c8d047a12494fbfacc3ab4c57abe4"><enum>(E)</enum><text>the Federal Government’s treaty-based trust responsibilities to Native American peoples and Indian Tribes.</text></subparagraph></paragraph><paragraph id="id0129173acb5e489ca7f88849b0792498"><enum>(8)</enum><text>The Federal Government can improve the representation of Native American peoples, their histories, and their contributions, as well as the unique relationship between Indian Tribes and the Federal Government, in more classrooms by supporting community-based curricula development.</text></paragraph></section><section id="id089d8e17bb95420e80c4cfb6a0ac030d"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" id="iddfd587ee98034c358da76550dd61b8a5"><enum>(1)</enum><header>Base curriculum</header><text>The term <term>base curriculum</term> means a nationally focused curriculum on Native histories and cultures developed by the Director of the Museum under section 5(a)(1).</text></paragraph><paragraph id="idbc16e1e7991a465c85a3e35c6ccec90a"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a partnership that—</text><subparagraph id="idb15a819c2fed42418e8094065175c8b5"><enum>(A)</enum><text>shall include a State educational agency and 1 or more Indian Tribes, Tribal organizations, or Native Hawaiian education organizations; </text></subparagraph><subparagraph id="idf576e1c883294462bfb4058df56694a3"><enum>(B)</enum><text>may include 1 or more local educational agencies; and</text></subparagraph><subparagraph id="idcf9d2a7b3c4847f5a1b83ab1870ac95f"><enum>(C)</enum><text>may include 1 or more Tribal educational agencies.</text></subparagraph></paragraph><paragraph id="id6d76ecd1ad7741bc8d0b8640df6b90ee"><enum>(3)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> means the recognized governing body of any Indian or Alaska Native Tribe, band, nation, pueblo, village, community, component band, or component reservation, individually recognized (including parenthetically) in the list published most recently as of the date of enactment of this Act pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3B73933BABDC4A4DA841F460F7A768AB"><enum>(4)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>). </text></paragraph><paragraph id="id1C38B9E9F20B4FC3A81942487F0358E8"><enum>(5)</enum><header>Local educational agency</header><text>The term <term>local educational agency</term> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>). </text></paragraph><paragraph id="id8C4EB8A3F7A240FC9EB6E56223E64FF7"><enum>(6)</enum><header>Museum</header><text>The term <term>Museum</term> means the National Museum of the American Indian. </text></paragraph><paragraph id="id7168941489ca46319354d28de1cc20c0"><enum>(7)</enum><header>Native American</header><text>The term <term>Native American</term> has the meaning given the term in section 103 of the Native American Languages Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2902">25 U.S.C. 2902</external-xref>).</text></paragraph><paragraph id="id6ef7cdd736e34ceaaf3f328e7b8a44ca"><enum>(8)</enum><header>Native Hawaiian educational organization</header><text>The term <term>Native Hawaiian educational organization</term> has the meaning given the term in section 6207 of the Native Hawaiian Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7517">20 U.S.C. 7517</external-xref>). </text></paragraph><paragraph id="id38dfca98dbe5452d9dbab0be2e4edd06"><enum>(9)</enum><header>Native histories and cultures</header><text>The term <term>Native histories and cultures</term> means accurate, fact-based, and thorough information about the histories and cultures of Native American peoples prior to the first European contact, during the colonization of North America, and until the present date. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idacdb027c199a48c88441c336614d32d5"><enum>(10)</enum><header>Native histories and cultures education program</header><text>The term <term>Native histories and cultures education program</term> means a program that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idAE2AB960CF5B4BA7BF2B6097E1137969"><enum>(A)</enum><text>has as its specific and primary purpose to—</text><clause commented="no" display-inline="no-display-inline" id="id561C9195EDDD46828D3B98EA63B2E88C"><enum>(i)</enum><text>improve awareness and understanding of the experiences of Native American peoples and Native histories and cultures; and</text></clause><clause id="id43cb1f20adea4affa2677a125e9e09e3"><enum>(ii)</enum><text>describe and educate individuals on the structures of Indian Tribes as sovereign entities with separate executive, legislative, and judicial government structures; </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id84904427EDF54E8188B5DEC61897CE68"><enum>(B)</enum><text>uses the base curriculum; and</text></subparagraph><subparagraph id="id4e0501c247ef47ddaf253faa87004b88"><enum>(C)</enum><text>incorporates local and regionally appropriate information on the histories and cultures of Indian Tribes and Native American peoples in that area that is developed in consultation with such Indian Tribes and Native American peoples.</text></subparagraph></paragraph><paragraph id="id4be0febf20204be8a83248ebd19d51ba"><enum>(11)</enum><header>Professional development</header><text>The term <term>professional development</term> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id96E16E8699D24DC69DC9AEC882D4A587"><enum>(12)</enum><header>State educational agency</header><text>The term <term>State educational agency</term> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="idfc848d10fc5a4340803f392bec8520d9"><enum>(13)</enum><header>Tribal educational agency</header><text>The term <term>Tribal educational agency</term> has the meaning given the term <term>tribal educational agency</term> in section 6132(b)(3) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7452">20 U.S.C. 7452(b)(3)</external-xref>). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id597371197C0648479B84DF2C4F42F425"><enum>(14)</enum><header>Tribal organization</header><text>The term <term>Tribal organization</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>). </text></paragraph></section><section id="id288822ace0c34f7c8bdfee43819b6b08"><enum>4.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are to—</text><paragraph id="idf3d2f7683e2c43bbb63d89f9937a061a"><enum>(1)</enum><text>expand the Museum’s educational efforts and develop and make freely accessible base curriculum resources and materials that—</text><subparagraph id="id34dd01179f684ce3b56cc9a5249eb472"><enum>(A)</enum><text>have been developed after significant consultation, engagement, and coordination with Indian Tribes, Tribal organizations, and stakeholders representing Native American peoples and interests, including Native Hawaiian educational organizations; and</text></subparagraph><subparagraph id="id6235C5B9817A451790D6B8D9964B777B"><enum>(B)</enum><text>are available for students, educators, parents, and interested individuals and groups;</text></subparagraph></paragraph><paragraph id="id5b68a38cc2974e0cb51adcb3419fb390"><enum>(2)</enum><text>support partnerships among States, Indian Tribes, Tribal organizations, and Native Hawaiian educational organizations to develop additional educational resources and materials related to Native histories and cultures that are local and regionally specific; and</text></paragraph><paragraph id="id23edba09037e484897dee365db342656"><enum>(3)</enum><text>provide opportunities for State educational agencies to implement Native histories and cultures education programs built around the base curriculum provided by the Museum with additional locally and regionally appropriate information.</text></paragraph></section><section id="idE9781E9FF5E0404BA076281144D36706"><enum>5.</enum><header>Native histories and cultures education program</header><subsection id="idde62a7047b994617a4ff34e103ecbe08"><enum>(a)</enum><header>Solicitation of feedback and development of base curriculum for Native histories and cultures</header><paragraph id="id229a8b47ad73469bb494f091b1c1f38b"><enum>(1)</enum><header>In general</header><text>The Director of the Museum shall—</text><subparagraph id="id85bc2e07f92d4a7cb2acc5e98025dac5"><enum>(A)</enum><text>for a period of not less than 9 months, regarding the learning objectives and development of the base curriculum on Native histories and cultures under subparagraph (B)—</text><clause id="idb326690496d24072902c8fa3e98cfb62"><enum>(i)</enum><text>engage in robust and active consultation with Indian Tribes and Tribal organizations; and</text></clause><clause id="id2a8dbffe6cd84e05945a2e01afb48702"><enum>(ii)</enum><text>solicit comments from organizations representing the interests of Native American peoples in the United States, and any other relevant stakeholders, including Native Hawaiian educational organizations and Tribal Colleges and Universities;</text></clause></subparagraph><subparagraph id="id85904911430349448855058b41faaee0"><enum>(B)</enum><text>develop, not later than 1 year after the end of the period described in subparagraph (A), a base curriculum on Native histories and cultures that—</text><clause id="id97ac2380857740f1baa284f761eda298"><enum>(i)</enum><text>is appropriate for all grade levels of elementary school and secondary school education;</text></clause><clause id="ida2503e14d3de4832b34bb4f49050a722"><enum>(ii)</enum><text>includes the significant contributions Native Americans have made to the United States as leaders in their communities and States, and as scholars, scientists, entrepreneurs, artists, authors, and educators, and in other fields;</text></clause><clause id="idec690659786948ee8f47f5963dff024f"><enum>(iii)</enum><text>explains the unique government-to-government relationship between the Federal Government and Indian Tribes and the trust and treaty-based responsibilities owed to Native American peoples and Indian Tribes;</text></clause><clause id="id99f8d9598dea461dafe3e6a4825fd044"><enum>(iv)</enum><text>includes the important role Native American peoples have played in the history of the United States and through present day;</text></clause><clause id="id04ecffdb7f0d441c8b3dfa09faf72ced"><enum>(v)</enum><text>teaches the experiences of Native American peoples in the United States today and throughout history, including the Federal Government’s adoption of the Indian Boarding School Policy, and similar policies employed in the Territory of Hawaii, to strip American Indian, Alaska Native, and Native Hawaiian children of their indigenous identities, language, and culture; and</text></clause><clause id="idf0414aef25db4d9bae7c3a5838d90d19"><enum>(vi)</enum><text>includes other appropriate subjects that will enable people to understand and appreciate the histories, cultures, and perspectives of Native American peoples and how such histories, cultures, and perspectives have been and will continue to be part of the fabric of the United States;</text></clause></subparagraph><subparagraph commented="no" id="id752e6f55f3f74e92827bddd0bdadca8c"><enum>(C)</enum><text>make available for public comment the base curriculum and make adjustments as appropriate; </text></subparagraph><subparagraph id="id46bfdd5ecc6440589ec2bd96bfbcf344"><enum>(D)</enum><text>engage in outreach promoting the availability of the base curriculum to educators, State educational agencies, local educational agencies, Indian Tribes, Tribal organizations, Native Hawaiian educational organizations, educator preparation programs, groups involved with the provision of professional development for educators, and other interested stakeholders, which may include making materials accessible, at no charge, to educators through means and services that educators frequently use to access educational materials;</text></subparagraph><subparagraph id="id3833c537f16040f9958dc2f19f2d8438"><enum>(E)</enum><text>make the base curriculum and any updates to the curriculum developed under this paragraph publicly available, at no charge, on the Museum’s website and through other means;</text></subparagraph><subparagraph id="ide4b647f2911940fb8b61b82082ee78df"><enum>(F)</enum><text>provide technical assistance to eligible entities, State educational agencies, local educational agencies, Tribal educational agencies, and educators;</text></subparagraph><subparagraph id="id994c77666431466db24c4ca2094e9288"><enum>(G)</enum><text>solicit public comment from Indian Tribes, Tribal organizations, and organizations representing the interests of Native American peoples in the United States, including Native Hawaiian educational organizations, local educational agencies, State educational agencies, educators, or other entities utilizing the base curriculum made freely available under subparagraph (E) to assess the success of its implementation and collect data used for reporting to Congress under section 6;</text></subparagraph><subparagraph id="idb96ca4bc1adf4a7d9cc361ca3e08e538"><enum>(H)</enum><text>provide mechanisms to accept feedback and comment continuously, and make revisions and updates to the base curriculum periodically; and</text></subparagraph><subparagraph id="id2718fba3438a4bb58a0e30fbf0d2eb94"><enum>(I)</enum><text>formally make revisions and updates to the base curriculum based upon feedback and comments under this paragraph, 1 and 2 years after initial implementation and, as appropriate, periodically thereafter. </text></subparagraph></paragraph><paragraph id="id1c3424a8c7204f6eb54e45cdbeb01007"><enum>(2)</enum><header>Inclusion of available materials</header><text>In developing the base curriculum under paragraph (1), the Director of the Museum may use or incorporate any educational material available through the Museum as of the date of enactment of this Act.</text></paragraph><paragraph id="id67ae375d9cc44c6b87fef58f278b6b5d"><enum>(3)</enum><header>Coordination</header><text>The Director of the Institute of Museum and Library Services shall make available any educational material or resources requested by the Director of the Museum to develop the base curriculum under paragraph (1). </text></paragraph></subsection><subsection id="id280e19a27d3449259f6b03b204ece078"><enum>(b)</enum><header>Grants authorized</header><paragraph id="id356e757a1d3e45569312f097c4ae0224"><enum>(1)</enum><header>In general</header><text>Upon completion of the initial development of the base curriculum under subsection (a)(1)(B), the Director of the Museum shall award grants to eligible entities—</text><subparagraph id="id6FF41E254CD84052BAA91994B1A71B9A"><enum>(A)</enum><text>to use the base curriculum to develop and plan Native histories and cultures education programs that are local and regionally specific; and </text></subparagraph><subparagraph id="id5875A4C75F13445C92A1DB21EB5453A1"><enum>(B)</enum><text>to implement such programs in elementary schools and secondary schools served by the eligible entity. </text></subparagraph></paragraph><paragraph id="id8be8f97354e145c6a70ef87d34e18ea5"><enum>(2)</enum><header>Applications</header><text>An eligible entity desiring a grant under this subsection shall submit an application to the Director of the Museum at such time, in such manner, and based on such competitive criteria as the Director of the Museum may require. Each such application shall include the following:</text><subparagraph id="idbb84b8ae7f3a4fe3abe95669189d5196"><enum>(A)</enum><text>A description of the partnership and coordination between all partner entities comprising the eligible entity, including any formal agreements or memoranda of understanding.</text></subparagraph><subparagraph id="id267803c4757f406f88a1c4a190e9cce2"><enum>(B)</enum><text>A description of any outreach conducted beyond the eligible entity to Indian Tribes, Tribal organizations, Native Hawaiian educational organizations, Tribal educational agencies, or local, regional, or otherwise relevant stakeholders.</text></subparagraph><subparagraph id="idde60f6bdc87643419bc855751bb07e46"><enum>(C)</enum><text>A description of how any Indian Tribe, Tribal organization, or Native Hawaiian educational organization included in the eligible entity will be compensated for their efforts under the grant.</text></subparagraph><subparagraph id="idb6cd5bc7e5884246aa7197286d9eed10"><enum>(D)</enum><text>A description of the local and regional, historical, and cultural materials that the eligible entity will seek to include in the educational materials and Native histories and cultures education program developed under the grant.</text></subparagraph><subparagraph id="idd81cb6f933604f158b7b3138cdc4996b"><enum>(E)</enum><text>A description of how such materials will align with the challenging State academic standards and assessments under paragraphs (1) and (2) of section 1111(b) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)</external-xref>).</text></subparagraph><subparagraph id="id89cf51443c8848bd89cff9b9d14ab84c"><enum>(F)</enum><text>A description of how such materials will align with a State’s academic standards and assessments related to social studies and history or other relevant subject.</text></subparagraph><subparagraph id="idb370bbc1365546bc95a6a5de6e1205c9"><enum>(G)</enum><text>A description of how the eligible entity will meet the reporting requirements.</text></subparagraph></paragraph><paragraph id="idff111d8b677a463fb79b9403520e62e6"><enum>(3)</enum><header>Uses of funds</header><text>An eligible entity receiving a grant under this subsection shall use the grant funds to develop, plan, and implement a Native histories and cultures education program, including—</text><subparagraph id="id6bf4983d77954832a88927f9762bac98"><enum>(A)</enum><text>developing local and regionally specific Native histories and cultures education program resources for use in conjunction with the base curriculum; </text></subparagraph><subparagraph commented="no" id="id778e72409f0f4dccbe2dbf129bfa03b4"><enum>(B)</enum><text>developing a plan for the implementation of a Native histories and cultures education program that would be implemented in public elementary schools and secondary schools served by the eligible entity, including coordination with local educational agencies and teachers;</text></subparagraph><subparagraph commented="no" id="id9c80d6e834d9490d8452958c09cf666c"><enum>(C)</enum><text>utilizing the base curriculum and developing additional curriculum to align with the challenging State academic standards and assessments under paragraphs (1) and (2) of section 1111(b) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)</external-xref>);</text></subparagraph><subparagraph id="id57b365fad1b746748ea3f52858aaee60"><enum>(D)</enum><text>planning, development, and coordination among all partner entities comprising the eligible entity, for purposes of developing local and regionally specific Native histories and cultures education program resources, including compensation for any Indian Tribe, Tribal organization, or Native Hawaiian educational organization within the eligible entity for these activities;</text></subparagraph><subparagraph id="idf3a1a4df320b4dcca1e131b3152217c2"><enum>(E)</enum><text>planning and coordination with other relevant stakeholders, such as local and regional Indian Tribes or Tribal organizations, Native Hawaiian educational organizations, museums, cultural centers, historical societies, institutions of higher education, and curricula experts, for the purpose of developing local and regionally specific Native histories and cultures education program resources;</text></subparagraph><subparagraph id="id6a200dda7e61458bb8e01c44fb4032c2"><enum>(F)</enum><text>coordination with and outreach to students, educators, parents, and organizations representing Native American students, parents, or families;</text></subparagraph><subparagraph id="id6d1999b4a0d343e190eb76009db41e90"><enum>(G)</enum><text>providing professional development to educators on the Native histories and cultures education program, including the importance of the program;</text></subparagraph><subparagraph id="id7455c8242d0b492e80c5e12b371bef42"><enum>(H)</enum><text>implementing a Native histories and cultures education program in public elementary schools and secondary schools in accordance with the implementation plan developed under subparagraph (B);</text></subparagraph><subparagraph id="id171c30e4d7fb4825b5526300a492c6e9"><enum>(I)</enum><text>coordination with undergraduate, postbaccalaureate, or master’s educator preparation programs, including training and outreach for educator candidates and school leader candidates;</text></subparagraph><subparagraph id="id52054f15b3af46e7994e945a061173d4"><enum>(J)</enum><text>providing outreach and broader community awareness on the initiative carried out under this section; and</text></subparagraph><subparagraph id="idacccaf5d33a74c7c94bad36af70d8337"><enum>(K)</enum><text>making revisions and updates to the Native histories and cultures education program, as necessary based on the base curriculum revisions and updates under subsection (a)(1)(I).</text></subparagraph></paragraph></subsection><subsection id="id2b0e36984e304156b7539bd9bb99c76a"><enum>(c)</enum><header>Supplement not supplant</header><text>An eligible entity receiving a grant under subsection (b) shall use grant funds to supplement, and not supplant, any funds that would, in the absence of such grant funds, be made available from State and local sources for the activities described in subsection (b).</text></subsection></section><section id="idccad058f62884153b71c1bd7ab3b595c"><enum>6.</enum><header>Reporting</header><subsection id="id1d612c565cf64775a345c330e00eafc1"><enum>(a)</enum><header>Annual State reports</header><text>An eligible entity that receives a grant under section 5 shall annually report on the effectiveness of the Native histories and cultures education program and activities carried out under the grant to the Director of the Institute of Education Sciences, which shall include, at a minimum, the following:</text><paragraph id="id7d4e467a173d442e8a4f2ad707d5020d"><enum>(1)</enum><text>The number of students served by grant activities.</text></paragraph><paragraph id="idd0d02e396b98401abbfd5da2c6ba5809"><enum>(2)</enum><text>The number of educators who participated in professional development funded by grant activities.</text></paragraph><paragraph id="iddbe3bed8f64940b0be6ea2a5c127bfa3"><enum>(3)</enum><text>The number of educator preparation programs that provided training, and the number of educator candidates and school leaders who received training, funded by grant activities.</text></paragraph><paragraph id="idb0a51edff7bf40de9adf85741592a585"><enum>(4)</enum><text>The number of local educational agencies utilizing the base curriculum or a Native histories and cultures education program.</text></paragraph><paragraph id="id62831a8f35874dc1b3d5cd9d6411be4c"><enum>(5)</enum><text>A description of the performance indicators and performance measures used to evaluate programs and activities with an emphasis on the academic and cultural needs of participating Native American students, including performance indicators and measures that—</text><subparagraph id="id407bebc480274ebcb330e3b08f413f6a"><enum>(A)</enum><text>are able to track student success and improvement over time;</text></subparagraph><subparagraph id="id773cfa3949824ad795f2a72f30e96f3d"><enum>(B)</enum><text>include State assessment results and other indicators of student success and improvement, such as improved attendance during the school day, improved classroom grades, improved school climate and safety, and improved school discipline disparities;</text></subparagraph><subparagraph id="id9b00faf9a0e34ca783e4659937258c74"><enum>(C)</enum><text>for high school students, may include indicators such as graduation rates, grade point average, credits earned, postsecondary enrollment, and career readiness; or</text></subparagraph><subparagraph commented="no" id="id5ce0e30a2ac7486b8013875f489a3d18"><enum>(D)</enum><text>reflect improved performance or student success in other ways. </text></subparagraph></paragraph><paragraph commented="no" id="id533735DB82204266A936D09D965B65C8"><enum>(6)</enum><text>Reporting on the effectiveness of the program, including the results of the performance indicators under paragraph (5), which shall include estimated impact on the student outcomes of participating Native American students. Any performance or enrollment data disaggregation shall be done in a manner that protects the privacy of students. Such performance and enrollment data shall not be disaggregated in the case in which the number of students in a group is insufficient to yield statistically reliable information or the results would reveal personally identifiable information about an individual student. </text></paragraph><paragraph id="id14fc3f519bda47b6acc9b3c5453fe1da"><enum>(7)</enum><text>A report or narrative from the Indian Tribe, Tribal organization, or Native Hawaiian educational organization that is a part of the eligible entity regarding—</text><subparagraph id="id59489961897D488598E9A26F64590F05"><enum>(A)</enum><text>the estimated impact on students enrolled in the Indian Tribe or served by the Tribal organization or Native Hawaiian educational organization; and</text></subparagraph><subparagraph id="idC9B15F8E6E4645C7B2FE279C48B29D94"><enum>(B)</enum><text>the estimated impact, if any, on students enrolled in the Indian Tribe or served by the Tribal organization or Native Hawaiian educational organization in terms of culturally relevant methods of determining value and success.</text></subparagraph></paragraph><paragraph id="idDFD24DFE2917488F921CC00C70577351"><enum>(8)</enum><text>Any feedback on the base curriculum developed under section 5(a)(1)(B).</text></paragraph></subsection><subsection id="id0b13c329282a4d6da83a8bdd3ec8d714"><enum>(b)</enum><header>Institute of education sciences reports</header><paragraph id="id0A82E65B8FE34B30BC87FE4B14C623B3"><enum>(1)</enum><header>In general</header><text>The Director of the Institute of Education Sciences shall prepare and make publicly available a biennial report containing—</text><subparagraph id="id8FEE052570254479B10F7A98DB581E2D"><enum>(A)</enum><text>information on a national and statewide basis, that shall not include the personally identifiable information of students, educators, or other individuals, from the reports submitted under subsection (a) and that may include other information determined appropriate by the Director of the Institute of Education Sciences; </text></subparagraph><subparagraph id="idB4B2C27AB5114C7DB2E2DA0B0011BBE5"><enum>(B)</enum><text>an evaluation of the effectiveness of the Native histories and cultures education programs, including the impact on student performance in general and student performance of Native American students in particular from, or informed by, the annual State reports described in subsection (a); and</text></subparagraph><subparagraph id="id4BA87ABA8019457F8A4456001D1A74FC"><enum>(C)</enum><text>any recommendations based on the evaluation of the Native histories and cultures education programs.</text></subparagraph></paragraph><paragraph id="id737ab81443524f7c92eb0bc3a94cc639"><enum>(2)</enum><header>Reports to Congress</header><text>The Director of the Institute of Education Sciences shall submit to the Committee on Indian Affairs of the Senate, the Committee on Health, Education, Labor, and Pensions of the Senate, the Committee on Natural Resources of the House of Representatives, and the Committee on Education and the Workforce of the House of Representatives, 1 year after the date of enactment of this Act and every 5 years thereafter, a report describing the impact of the program, as determined by the metrics collected under subsection (a).</text></paragraph></subsection><subsection id="id6AD4B6759394428B97CBC9002088D5BF"><enum>(c)</enum><header>National Museum of the American Indian reports</header><text>The Director of the Museum shall submit to the Committee on Indian Affairs of the Senate, the Committee on Health, Education, Labor, and Pensions of the Senate, the Committee on Natural Resources of the House of Representatives, and the Committee on Education and the Workforce of the House of Representatives— </text><paragraph id="idD30F5A09A6E7477A9655529DFD68ED99"><enum>(1)</enum><text>not later than 6 months after the date of enactment of this Act, a brief status report describing the activities carried out under section 5(a)(1)(A);</text></paragraph><paragraph id="idCAD6F1E9670741E7897FB0CA6CF68E8B"><enum>(2)</enum><text>not later than 18 months after the date of enactment of this Act, a report on the base curriculum developed under section 5 and a report on the Director of the Museum's development process and plan for dissemination of the base curriculum; and</text></paragraph><paragraph id="id73B5A4FE05B241759FC4841B8CD9F858"><enum>(3)</enum><text>every 5 years thereafter, a report describing efforts undertaken by the Director of the Museum to revise and update the base curriculum as described in section 5(a)(1)(I). </text></paragraph></subsection></section><section id="id0f08396684e0473e8921b1f26ac19d28"><enum>7.</enum><header>National Museum of the American Indian Act</header><text display-inline="no-display-inline">The National Museum of the American Indian Act (<external-xref legal-doc="usc" parsable-cite="usc/20/80q">20 U.S.C. 80q et seq.</external-xref>) is amended—</text><paragraph commented="no" id="idDCE5435C1B0D4B63AB18991C19E896D0"><enum>(1)</enum><text display-inline="yes-display-inline">in section 3(b)—</text><subparagraph commented="no" id="idC38697FDE97B4C1BB7738E1CE314098D"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>and</quote> after the semicolon;</text></subparagraph><subparagraph commented="no" id="idEB7015728CD44A79AB096AC4B048B1ED"><enum>(B)</enum><text>in paragraph (4), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" id="idF43E520B26034A46BA01E44B7A6EBF1A"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id56df6845edb944a88ff5c0088eab63af"><paragraph id="id257a538f415440948c8bd4dd1f7ec842"><enum>(5)</enum><text>advance the study and awareness of Native American histories and cultures by providing educational resources to educators and schools.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="iddca8eb1e888b42a986401c2c57f281a7"><enum>(2)</enum><text>in section 6, by striking subsection (a)(1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2cc80674fdb44ec188f3f709f7b6246c"><paragraph id="id2d8a18da01494cb3bf5d553f63bf0af9"><enum>(1)</enum><text>a Director who, subject to the policies of the Board of Trustees, shall—</text><subparagraph id="ida18dfc08b99247788907022b52a5cd11"><enum>(A)</enum><text>manage the National Museum; and</text></subparagraph><subparagraph id="id787e07b561d3460482b251a3b4f6ad01"><enum>(B)</enum><text>enter into grants with Indian Tribes, Tribal organizations, Native Hawaiian educational organizations, State educational agencies, and local educational agencies to further the purposes described in section 4 of the <short-title>Native Histories and Cultures Education Act of 2023</short-title> and carry out the responsibilities described under such Act.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id598a58f4acc9486ea7fccf72c4c8af05"><enum>8.</enum><header>Funding</header><subsection id="id78d1982260fe4731839d2b2f5fd94623"><enum>(a)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated—</text><paragraph id="id639b5de17c1b44dfacd0e4ac0b390516"><enum>(1)</enum><text>$1,000,000 for the Museum to carry out the activities described in section 5(a) and to establish the administrative capabilities necessary to administer grants under section 5; and</text></paragraph><paragraph id="id84e96c92108949ee90a04c9fbf39fbb2"><enum>(2)</enum><text>$30,000,000 to award grants under section 5.</text></paragraph></subsection><subsection id="id8615d94eb39f4c038344115a570ea4dc"><enum>(b)</enum><header>Donations, gifts, bequests, and devises of property</header><text>The Director of the Museum is authorized to solicit, accept, hold, administer, invest, and use donated funds and gifts, bequests, and devises of property, both real and personal, to support the initiative under this Act.</text></subsection></section></legis-body></bill>
