which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Fair Labor Standards Act of 1938 and the National Labor Relations Act to clarify the standard for determining whether an individual is an employee, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H5790B2D9EDB447C08DD09DF6A8D3F629"><section section-type="section-one" id="HB2F0CF9FFE204BA19E913DFEE7EC0BCA"><enum>1.</enum><header>Criteria for determining employee status</header><subsection id="H37154F7403E745D783DD658042B3945C"><enum>(a)</enum><header>Criteria for determining employee status under the Fair Labor Standards Act</header><text>Section 3(e) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(e)</external-xref>) is amended—</text><paragraph id="HBA10EC0DBD6F45AFB9517830D1AD0678"><enum>(1)</enum><text>by redesignating paragraphs (2), (3), (4), and (5) as paragraphs (3), (4), (5), and (6), respectively;</text></paragraph><paragraph id="H31F39CCB1C81481BAED5B7DA911712D0"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>paragraphs (2), (3), and (4)</quote> and inserting <quote>paragraphs (3), (4), (5), and (6)</quote>; and</text></paragraph><paragraph id="HE9ACBC3E3F7E45A5A3D045EF9A108F82"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9BEC64695EAD4AF3B89AB49A43170835"><paragraph id="H7580749485044172AAD47A11B52778A8"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H82E73868CA3F4815B5B4480E2FCC4E75"><enum>(A)</enum><text>An individual shall be determined to be an independent contractor rather than an employee of another person if—</text><clause id="HC6D4CD79CA2841E6A87C0B99A26FA609" indent="up1"><enum>(i)</enum><text>such other person does not exercise significant control over the details of the way the work is performed by the individual, without regard to any control the other person may exercise over the final result of the work performed; and</text></clause><clause id="H5CD491A1C8E549AFB676D462B2486FCA" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">while performing such work, the individual has the opportunities and risks inherent with entrepreneurship, such as the discretion to exercise managerial skill, business acumen, or professional judgment.</text></clause></subparagraph><subparagraph id="HBC85F375A82D47D9871D7413DA9025A7" indent="up1"><enum>(B)</enum><text>The following factors may not be used in determining that an individual is an employee of another person:</text><clause id="H98642E1018DE4C098CD38E294D5BFD0A"><enum>(i)</enum><text>Whether such other person requires the individual to comply with legal, statutory, or regulatory requirements.</text></clause><clause id="HA56E637FED4C4BC2B2A87C9CD6ECD02E"><enum>(ii)</enum><text display-inline="yes-display-inline">Whether such other person requires the individual to comply with health and safety standards that are more stringent than otherwise applicable health and safety standards.</text></clause><clause id="H5C0E7D45FEB44ED793DBD16126643C67"><enum>(iii)</enum><text>Whether such other person requires the individual to carry insurance of any kind.</text></clause><clause id="H45DFE14F93A6459ABEC386CA6A912B02"><enum>(iv)</enum><text>Whether such other person requires the individual to meet contractually agreed-upon performance standards, such as deadlines.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HE345D8A97D014623B719B8315017A4DC"><enum>2.</enum><header>Employee classification under the National Labor Relations Act</header><text display-inline="no-display-inline">Section 2(3) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/152">29 U.S.C. 152(3)</external-xref>) is amended—</text><paragraph id="H92BA9A9C12F349999F830E3D4C53BCDE"><enum>(1)</enum><text>by striking <quote>(3) The term <term>employee</term> shall</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE10057D5825E4E75848FC77236A1BE0B"><paragraph id="HDA3874F8BD254B0E9004FBDC1324A1C3"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H7ACA73DD72014A25B9347166CE9B6BEE"><enum>(A)</enum><text display-inline="yes-display-inline">The term <term>employee</term> shall </text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H9AE77720301D40538D11730B420FE01B"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H25E8266026404F60BFD88762F4782C3F"><subparagraph id="H6E30579284D54A289F29B79D7A18ED3E"><enum>(B)</enum><text display-inline="yes-display-inline">Section 3(e)(2) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(e)(2)</external-xref>) shall be used in determining under this Act whether an individual is an independent contractor or an employee of another person, except that for purposes of this Act a reference in such section to the term <quote>employee</quote> or <quote>person</quote> shall be deemed a reference to such term as defined in this section.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
