<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 3013</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20231004">October 4, 2023</action-date><action-desc><sponsor name-id="S288">Ms. Murkowski</sponsor> (for herself, <cosponsor name-id="S327">Mr. Warner</cosponsor>, <cosponsor name-id="S390">Mr. Van Hollen</cosponsor>, <cosponsor name-id="S362">Mr. Kaine</cosponsor>, <cosponsor name-id="S308">Mr. Cardin</cosponsor>, <cosponsor name-id="S383">Mr. Sullivan</cosponsor>, <cosponsor name-id="S373">Mr. Cassidy</cosponsor>, and <cosponsor name-id="S389">Mr. Kennedy</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To permanently authorize the exemption of aliens working as fish processors from the numerical limitation on H–2B nonimmigrant visas.</official-title></form><legis-body><section id="id4b34bcbc9f2748e19222d3b500db2cbe" section-type="section-one"><enum>1.</enum><header>Exemption of aliens working as fish processors from the numerical limitation on H–2B nonimmigrant visas</header><subsection commented="no" display-inline="no-display-inline" id="id3165836d0ffc4a7f9de08722c6e82655"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 214(g)(10) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(g)(10)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ida116aeba018843d88fdababef7860537"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>The numerical limitations of paragraph (1)(B)</quote> and inserting <quote>(A) The numerical limitation under paragraph (1)(B)</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id513fdfc7fd0f4a2189920e0ca15e1853"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idABD72109D9DE49BD94833DBC2463132C"><subparagraph id="id33c591a309ff40be8fc86602c9209501" indent="up2"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id29aaf7abc6ba4c198a448a1cdf5d75cf"><enum>(i)</enum><text>The numerical limitation under paragraph (1)(B) shall not apply to any nonimmigrant alien issued a visa or otherwise provided status under section 101(a)(15)(H)(ii)(b) who is employed (or has received an offer of employment)—</text><subclause indent="up1" commented="no" display-inline="no-display-inline" id="id597799b322b54f16a361ac36f361aebd"><enum>(I)</enum><text display-inline="yes-display-inline">as a fish roe processor, a fish roe technician, or a supervisor of fish roe processing; or</text></subclause><subclause indent="up1" commented="no" display-inline="no-display-inline" id="id80b5da92260049d88fd9953ea39cc195"><enum>(II)</enum><text display-inline="yes-display-inline">as a fish processor.</text></subclause></clause><clause indent="up1" commented="no" display-inline="no-display-inline" id="id2e83999d44d544a5acc489baa367848e"><enum>(ii)</enum><text display-inline="yes-display-inline">As used in clause (i)—</text><subclause commented="no" display-inline="no-display-inline" id="idd95bf6f737264e9d927c903dee40979d"><enum>(I)</enum><text display-inline="yes-display-inline">the term <term>fish</term> means fresh or saltwater finfish, mollusks, crustaceans, and all other forms of aquatic animal life, including the roe of such animals, other than marine mammals and birds; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb1d4ab1c8fbd4bf183ccd1491170f740"><enum>(II)</enum><text display-inline="yes-display-inline">the term <term>processor</term> means any person engaged in the processing of fish, including handling, storing, preparing, heading, eviscerating, shucking, freezing, changing into different market forms, manufacturing, preserving, packing, labeling, dockside unloading, holding, and all other processing activities.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id66e4b365c3b04e12840f1458516a604c"><enum>(b)</enum><header>Repeal</header><text>Section 14006 of the Department of Defense Appropriations Act, 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/108/287">Public Law 108–287</external-xref>) is repealed.</text></subsection></section></legis-body></bill>
