which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>Making continuing appropriations for certain employees and contractors of U.S. Customs and Border Protection and U.S. Immigration and Customs Enforcement in the event of a Government shutdown.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H23931DB5369C4DE5804359DE24A21039"><section id="HB2F1921626CB40B49A7A9B61B8B2DD03" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keep Our Border Agents Paid Act</short-title></quote>.</text></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="id3aa30a3df2a242978b61e4981221511f"><enum>2.</enum><header display-inline="yes-display-inline">Continuing appropriations for certain employees and contractors of U.S. Customs and Border Protection and U.S. Immigration and Customs Enforcement</header><subsection commented="no" display-inline="no-display-inline" id="id9742f65194f349c4a168e70fc8ca151a"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Subtitle C of title IV of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/231">6 U.S.C. 231 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id651E10CB2AC1451186BA0DF7610D8760"><section id="id80808027e8b046f5ab06db772f16792c"><enum>437.</enum><header>Continuing appropriations for certain employees and contractors of U.S. Customs and Border Protection and U.S. Immigration and Customs Enforcement</header><subsection id="H703C88A1B4AF45C88AD42BB7B5BAC973"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For any period in which there is a lapse in appropriations for the Department, there are appropriated, out of any money in the Treasury not otherwise appropriated, such sums as are necessary to provide—</text><paragraph commented="no" display-inline="no-display-inline" id="id783e898be0024340a873c84f3150dc24"><enum>(1)</enum><text display-inline="yes-display-inline">pay to excepted employees and covered contractors of covered components of the Department; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0810e1c8d05b4014a8b5643b345aeff1"><enum>(2)</enum><text display-inline="yes-display-inline">benefits under chapters 55 and 81 of title 5, United States Code, to such employees, including—</text><subparagraph id="id9b6f7da554c240e79b196e922eafb24c"><enum>(A)</enum><text>benefits for captives under section 5569 of that title; </text></subparagraph><subparagraph id="id99b807ce39524939a77369c688348ebf"><enum>(B)</enum><text>compensation for disability or death for missing employees under section 5570 of that title;</text></subparagraph><subparagraph id="id0fc35fd4073348d2bff8f3e356825ee6"><enum>(C)</enum><text>compensation for disability or death of employees under section 8102 of that title; and</text></subparagraph><subparagraph id="idf7f725843049477fbfb8312689f0340b"><enum>(D)</enum><text>funeral expenses and transportation of bodies under section 8134 of that title.</text></subparagraph></paragraph></subsection><subsection id="HADC5B6EF16594233923560D2CB333E63"><enum>(b)</enum><header>Termination</header><text display-inline="yes-display-inline">Appropriations and funds made available and authority granted for any fiscal year under subsection (a) shall be available until whichever of the following first occurs: </text><paragraph id="idA9F7E15B83E64A6C9AB2E95BBF1E0A3B"><enum>(1)</enum><text display-inline="yes-display-inline">The enactment into law of an appropriation (including a continuing appropriation) for the purposes for which amounts are made available under subsection (a). </text></paragraph><paragraph id="idF3E75B246FC6488EB17324C4894C5E78"><enum>(2)</enum><text display-inline="yes-display-inline">The enactment into law of a regular appropriation Act, or a law making continuing appropriations until the end of the fiscal year, without any appropriation for such purposes. </text></paragraph></subsection><subsection id="id5de11c678d2247cc8d2a5e1c29d2be48"><enum>(c)</enum><header>Charging of expenditures</header><text>Expenditures made for the purposes described in subsection (a) from amounts made available under that subsection shall be charged to the applicable appropriation, fund, or authorization whenever a regular appropriation Act, or a law making continuing appropriations, for such purposes is enacted. </text></subsection><subsection id="HBF2254A2E6BA4E8791C4228EE9E0EAD5"><enum>(d)</enum><header>Apportionment</header><text>Appropriations and funds made available by or authority granted under this section may be used without regard to the time limitations for submission and approval of apportionments set forth in section 1513 of title 31, United States Code, but nothing in this section may be construed to waive any other provision of law governing the apportionment of funds. </text></subsection><subsection id="id17077cfeda934b8abaaf2b2d9060c990"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id1ced76e77dec496a90dc63e8a2098d86"><enum>(1)</enum><header>Covered component</header><text>The term <term>covered component</term> means any of the following:</text><subparagraph id="id65ac1e12dd7a46f1af40bff500b1f9f5"><enum>(A)</enum><text>Air and Marine Operations of U.S. Customs and Border Protection.</text></subparagraph><subparagraph id="id8d8690e4e11b4fdbbaa497e7c30ff769"><enum>(B)</enum><text>The Office of Field Operations of U.S. Customs and Border Protection.</text></subparagraph><subparagraph id="idff0a40e84b964913b4b055f05d2d626e"><enum>(C)</enum><text>The U.S. Border Patrol of U.S. Customs and Border Protection. </text></subparagraph><subparagraph id="idb3ae63e47a9042f0a6616bb58602be71"><enum>(D)</enum><text>Homeland Security Investigations of U.S. Immigration and Customs Enforcement.</text></subparagraph><subparagraph id="id645b2eefc85349eda6b3f03c095122e2" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text>Enforcement and Removal Operations of U.S. Immigration and Customs Enforcement. </text></subparagraph></paragraph><paragraph id="id94b414d70fcf4f23a6a0afd61b557481"><enum>(2)</enum><header>Covered contractor</header><text>The term <term>covered contractor</term> means an individual—</text><subparagraph commented="no" display-inline="no-display-inline" id="id568088c5ef074390aaccacdf1d7721b8"><enum>(A)</enum><text display-inline="yes-display-inline">performing work for a covered component under a contract; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd670f2410b68407da7c23848d8e07717"><enum>(B)</enum><text display-inline="yes-display-inline">that the Secretary determines is—</text><clause id="H5B9AABED21004024B56E25CCE2516F37"><enum>(i)</enum><text>providing support to excepted employees of the covered component; or</text></clause><clause id="H7EE9418830F54F08A19D31B84C2F2BE9"><enum>(ii)</enum><text>required to perform work during a lapse in appropriations. </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaad07573840d49e988edf9b947372fd6"><enum>(3)</enum><header display-inline="yes-display-inline">Excepted employee</header><text>The term <term>excepted employee</term> has the meaning given that term in section 1341(c) of title 31, United States Code.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ida6c7021b6a114d009987ce206867f80d"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the Homeland Security Act of 2002 is amended by inserting after the item relating to section 436 the following:</text><quoted-block style="OLC" id="idc93a0493-3fff-4f07-86dd-b888ac0e9ddf"><toc><toc-entry level="section" idref="id80808027e8b046f5ab06db772f16792c">Sec. 437. Continuing appropriations for certain employees and contractors of U.S. Customs and Border Protection and U.S. Immigration and Customs Enforcement.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
