Operating grants for community behavioral health clinics.</toc-entry></toc></subsection></section><title id="id52865ed4704f45309acaf0b3b7168ed2" style="OLC"><enum>I</enum><header>Ensuring Permanency for Certified Community Behavioral Health Clinics in the Medicaid Program</header><section id="idf6925f84b2a94dcc959690746580d388"><enum>101.</enum><header>Establishing Certified Community Behavioral Health Clinic Services as a Medicaid State Plan Option</header><subsection commented="no" display-inline="no-display-inline" id="idd4f23281d41b4bc29fdfd732d34d9272"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1905 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d</external-xref>) is amended—</text><paragraph id="ida1570435ff6c41dcb3a4ae0452f2ba48"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="idb11af456f54744c7882e4081111214b4"><enum>(A)</enum><text>in paragraph (30), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="id789f335cf2fc4f12bd45cf95c39a8e63"><enum>(B)</enum><text>by redesignating paragraph (31) as paragraph (32); and</text></subparagraph><subparagraph id="id45fffdd089534fa1b4bcf7d1891633ea"><enum>(C)</enum><text>by inserting after paragraph (30) the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb6c3b5129ba143c9ad711a125f29ea54"><paragraph id="idd5d8066aa68f439684b64ed7253ca168"><enum>(31)</enum><text>certified community behavioral health clinic services, as defined in subsection (jj); and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id0f0d0ba70986449f88e089ebefda6456"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2922BE208D71494AB3BA9D825A8778B5"><subsection commented="no" display-inline="no-display-inline" id="id231f406f469f4e62b30c649bcf7296d6"><enum>(jj)</enum><header>Certified community behavioral health clinic services</header><paragraph id="id61c0114a66e84eb3b153a2360c34b43e"><enum>(1)</enum><header>In general</header><text>The term <term>certified community behavioral health services</term> means any of the following when furnished to an individual as a patient of a certified community behavioral health clinic (as defined in paragraph (2)), in a manner reflecting person-centered care and which, if not available directly through a certified community behavioral health clinic, may be provided or referred through formal relationships with other providers:</text><subparagraph id="id9bc8f06b2f314195bea190dace3d7ee3"><enum>(A)</enum><text>Crisis mental health services, including 24-hour mobile crisis teams, emergency crisis intervention services, and crisis stabilization.</text></subparagraph><subparagraph id="idd815a780f81c48b68eb289b938f54ab2"><enum>(B)</enum><text>Screening, assessment, and diagnosis, including risk assessment.</text></subparagraph><subparagraph id="id43b812b472574571b2c2fcaa2f5fcb0c"><enum>(C)</enum><text>Patient-centered treatment planning or similar processes, including risk assessment and crisis planning.</text></subparagraph><subparagraph id="id352e9b2a8f2b4d1992bd46e984087744"><enum>(D)</enum><text>Outpatient mental health and substance use services.</text></subparagraph><subparagraph id="id9a5f1c96579043dab62c583098b832df"><enum>(E)</enum><text>Outpatient clinic primary care screening and monitoring of key health indicators and health risk.</text></subparagraph><subparagraph id="id7f600eb25de8432c874e2bda3862055a"><enum>(F)</enum><text>Targeted case management.</text></subparagraph><subparagraph id="id025b8a09731e44758d5e036fe2b9f7fc"><enum>(G)</enum><text>Psychiatric rehabilitation services.</text></subparagraph><subparagraph id="ide1f25f7d19224224a74611556907c82b"><enum>(H)</enum><text>Peer support and counselor services and family supports.</text></subparagraph><subparagraph id="iddb14f2703d144fde8e6232298194272d"><enum>(I)</enum><text>Intensive, community-based mental health care for members of the armed forces and veterans, particularly those members and veterans located in rural areas, provided the care is consistent with minimum clinical mental health guidelines promulgated by the Veterans Health Administration, including clinical guidelines contained in the Uniform Mental Health Services Handbook of such Administration.</text></subparagraph></paragraph><paragraph id="id6ecf0749eb8f4725aff599aadff0a56e"><enum>(2)</enum><header>Certified community behavioral health clinic</header><text>The term <term>certified community behavioral health clinic</term> means an organization that—</text><subparagraph id="id301515ef842a4eecb7b3871c09ba1f6d"><enum>(A)</enum><text>is engaged in furnishing to patients all of the services described in paragraph (1);</text></subparagraph><subparagraph id="ide9920e39ff3f414f97b6df2a92afc901"><enum>(B)</enum><text>is legally authorized to furnish such services under State law;</text></subparagraph><subparagraph id="idf00bcaafde9442a6ae3337e210d3722e"><enum>(C)</enum><text>agrees, as a condition of the certification described in subparagraph (D), to furnish to the State or Secretary any data required as part of ongoing monitoring of the organization’s provision of services, including any such data as the State, by agreement with the Secretary, shall access via the system described in section 340J–4 of the Public Health Service Act; and </text></subparagraph><subparagraph id="id4aad9f6b487d4a1f8f83b7ba15785f4d"><enum>(D)</enum><text>has been certified by a State—</text><clause id="id6f56921d5b734c389d50c12d60a6db1f"><enum>(i)</enum><text>as meeting the criteria established by the Secretary pursuant to subsection (a) of section 223 of the Protecting Access to Medicare Act and is carrying out a demonstration program under this title under subsection (d) of such section; or</text></clause><clause id="idebe08e6d85094b288cd072d726f92541"><enum>(ii)</enum><text>for purposes of services furnished on or after January 1, 2024, subject to paragraph (3), as meeting the criteria established under section 340J–1(a) of the Public Health Service Act, and as being eligible to furnish medical assistance under the State plan under this title (or under a waiver of such plan) for certified community behavioral health services described in paragraph (1). </text></clause></subparagraph></paragraph><paragraph id="id55b09193c588402696caadbe1a1b2932"><enum>(3)</enum><header>Accreditation</header><text>In the case of services furnished on or after January 1, 2024, at State option, a State may determine that an organization does not meet the criteria established under section 340J–1(a) of the Public Health Service Act unless the organization has an accreditation by an accreditation body approved under section 340J–5 of the Public Health Service Act. An election by a State under the preceding sentence shall not relieve a State of the requirement to certify an organization under paragraph (2)(D).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idea8026b6a652497198d01514f23a9a7e"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="idbf5837c60aad4191ba67850bf8810eab"><enum>(1)</enum><text>Section 1902(nn)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(nn)(3)</external-xref>), is amended by striking <quote>paragraph (31)</quote> and inserting <quote>the last numbered paragraph</quote>.</text></paragraph><paragraph id="id2a726d8cca9f4ec3977c24ad7615443d"><enum>(2)</enum><text>The fifth sentence of section 1905(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is amended by striking <quote>paragraph (30)</quote> and inserting <quote>the last numbered paragraph</quote>.</text></paragraph><paragraph id="id006a6c85361e417c8ddaf544ada551b3" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>Effective July 1, 2025, section 1902(a)(84)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(84)(A)</external-xref>), as amended by section 5122(a)(2) of division FF of <external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>, is amended by striking <quote>paragraph (31)</quote> and inserting <quote>the last numbered paragraph</quote>. </text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id6a2093d588284f05b1664d79b8a488a0"><enum>102.</enum><header>Establishing a Medicaid Prospective Payment System for Certified Community Behavioral Health Clinics</header><text display-inline="no-display-inline">Section 1902 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6E3D5D87934844829B16C88C314AF7C1"><subsection id="idcf85f4566f014fd5803aa52d29c955c6"><enum>(uu)</enum><header>Payment for services provided by certified community behavioral health clinics</header><paragraph id="ided829a8bcd3346209672a9db2ac16cd9"><enum>(1)</enum><header>In general</header><text>Beginning with fiscal year 2024, with respect to services furnished on or after January 1, 2024, and each succeeding fiscal year, a State may provide under the State plan under this title (or under a waiver of such plan) for payment for services described in section 1905(a)(31) furnished by a certified community behavioral health clinic (in this subsection referred to as a <term>clinic</term>) in accordance with the provisions of this subsection.</text></paragraph><paragraph id="id990c9c79a9ce4b62963ea10734a1d88a"><enum>(2)</enum><header>Payment for services in initial year and every third year</header><text>Subject to paragraphs (4), (5), and (6), for services furnished by a clinic in the first fiscal year for which a State elects to provide for payment for services described in section 1905(a)(31) in accordance with the payment option under paragraph (1), and every third fiscal year thereafter in which the State makes such an election, the State shall provide for payment for such services in an amount (calculated on the basis of daily visits or unduplicated monthly visits, at the State’s election) that is equal to 100 percent of the average costs of the clinic of furnishing any of the services described in paragraph (31) of section 1905(a) during the 2 fiscal years preceding the fiscal year involved which are reasonable and related to the costs of furnishing such services; provided that, in the absence of complete actual cost data representing the provision of the full covered benefit in such preceding fiscal years, certified community behavioral health clinics may, at the State’s discretion, use estimated or projected data relating to specific services for which they lack cost experience. The per-unit rate derived from such cost data shall be adjusted to take into account any increase or decrease in the scope of such services furnished by the clinic in the fiscal year involved.</text></paragraph><paragraph id="idce51e2615a05428c8cd373f9d79ce8ba"><enum>(3)</enum><header>Payment for services in succeeding fiscal years</header><text>Subject to paragraphs (4), (5), and (6), for services described in section 1905(a)(31) furnished by a clinic for which a State elects to provide for payment for such services in accordance with the payment option under paragraph (1) and that are furnished in a fiscal year that is not described in paragraph (2), the State plan shall provide for payment for such services in an amount (calculated on the basis of daily visits or unduplicated monthly visits, at the State’s election) that is equal to the amount calculated under this subsection for such services and clinic for the preceding year—</text><subparagraph id="id680bb3efa9484a15befa755772c23575"><enum>(A)</enum><text>increased by the percentage increase in the inflationary factor described in section 1834(aa)(2)(C); and</text></subparagraph><subparagraph id="id937b73ddc393402eb32ab65fd6807ef0"><enum>(B)</enum><text>adjusted to take into account any increase or decrease in the scope of such services furnished by the clinic during the fiscal year involved.</text></subparagraph></paragraph><paragraph id="id530ee311906545fdbff21a89fb952789"><enum>(4)</enum><header>Establishment of initial year payment for new clinics</header><text>In any case in which an entity first qualifies as a certified community behavioral health clinic after the first fiscal year in which a State elects to provide for payment for services described in section 1905(a)(31) in accordance with the payment option under paragraph (1), the State plan shall provide for payment for such services in the first 2 years in which the clinic so qualifies in an amount (calculated on the basis of daily visits or unduplicated monthly visits, at the State’s election) that is equal to the rates established under this subsection for other such clinics located in the same or adjacent area with a similar case load, or in the absence of any such clinic, based on the average per-unit rate for other certified community behavioral health clinics in the State; provided, however, that effective, at latest, as of the 3rd year in which the clinic furnishes such services, the State establishes a unique payment rate for the clinic based on the methodology described in paragraph (2), using allowable costs from the clinic’s first 2 fiscal years of operation as the basis for establishing such rates; and provided, additionally, that in any year following the establishment of an initial rate under this paragraph, the State plan or waiver provides for the payment amount to be calculated in accordance with paragraph (2) or (3) (as applicable).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id625bb59073ad4760a084b62ed600d039"><enum>(5)</enum><header display-inline="yes-display-inline">Administration in the case of managed care</header><subparagraph id="idfa91babf9fb74ec7b25ad56f05822837"><enum>(A)</enum><header>In general</header><text>In the case of services furnished by a certified community behavioral health clinic pursuant to a contract between the clinic and a managed care entity (as defined in section 1932(a)(1)(B)), the State plan or a waiver of such plan shall provide for 1 of the following:</text><clause id="ida671f0cea15b4db286e425400e76a6ff"><enum>(i)</enum><text>Payment to the clinic by the State of a supplemental payment equal to the amount (if any) by which the amount determined under paragraph (2), (3), or (4) (as applicable) exceeds the amount of payments under the contract, with such supplemental payment being made pursuant to a payment schedule agreed to by the State and the certified community behavioral health clinic, but in no case less frequently than every 3 months.</text></clause><clause id="id990d1bf5964d4e88a5bdfa1378fdd892"><enum>(ii)</enum><text>Delegation by the State to the managed care entity of the obligation to pay the clinic at least the rate determined under paragraph (2), (3), or (4) (as applicable); provided, however, that the State shall use reconciliation and oversight processes to ensure that each clinic is paid at least the amounts required under such paragraphs.</text></clause></subparagraph></paragraph><paragraph id="idb9525fe4f34448e9820666a18182fb03"><enum>(6)</enum><header>Alternative payment methodologies</header><text>Notwithstanding any other provision of this subsection, the State plan or a waiver of such plan may provide for payment in any year to a certified community behavioral health clinic for services described in paragraph (31) of section 1905(a) in an amount which is determined under an alternative payment methodology that—</text><subparagraph id="idae4120bf783340169b79dc5de2f87559"><enum>(A)</enum><text>is agreed to by the State and the clinic; and</text></subparagraph><subparagraph id="idc9e69611958f4e279d0ffed3c23a3255"><enum>(B)</enum><text>results in payment to the clinic of an amount which is not less than the amount otherwise required to be paid to the clinic under this subsection.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="idbfb6a39870bf45d09cc663c8c57677e9" style="OLC"><enum>II</enum><header>Coverage of certified community behavioral health clinic services under the Medicare program</header><section id="id08937b0c359c47ba8ba4143ff932a7d6"><enum>201.</enum><header>Coverage of certified community behavioral health clinic services under the Medicare program</header><subsection id="HDD7A6FD591E5432E9698785D5F215270"><enum>(a)</enum><header>Coverage</header><text display-inline="yes-display-inline">Section 1861(s)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>) is amended—</text><paragraph id="id80c7d144bbbb4ea7a2dc50f4cdea0052"><enum>(1)</enum><text>in subparagraph (II), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="id7f2af721629d44a59b386abecf9ecc64"><enum>(2)</enum><text>in subparagraph (JJ), by inserting <quote>and</quote> at the end; and</text></paragraph><paragraph id="H3F7CD8A973EA40B2BA09541818D32662"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block id="HEC9ED0240E3C4AD8AF5247FBC0E48408" display-inline="no-display-inline" style="OLC"><subparagraph id="H4AAE7F1E7D8D4F32BAC5BC967B8197C7" indent="up1"><enum>(KK)</enum><text display-inline="yes-display-inline">certified community behavioral health clinic services (as defined in subsection (aa)(8)) furnished on or after January 1, 2024.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6edac0a076234a1ba943c5eb7ec93e49"><enum>(b)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">Section 1861(aa) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended—</text><paragraph id="id946fa3818cb14c91abc3fe2014951744"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text style="other" other-style="archaic" level="subsection">and Federally Qualified Health Center Services</header-in-text></quote> and inserting <quote><header-in-text style="other" other-style="archaic" level="subsection">, Federally qualified health center services, and certified community behavioral health clinic services</header-in-text></quote>; and</text></paragraph><paragraph id="iddea6ea7ccf2f42d4b6d4cd589d5ffaf4"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idff81dc1e8d44471fbc9e1513ffea85dc"><paragraph id="id8c71b04f1da44d668ccc4940fb086ef8" indent="up1"><enum>(8)</enum><text>The terms <quote>certified community behavioral health clinic services</quote> and <quote>certified community behavioral health clinic</quote> have the meaning given those terms in paragraphs (1) and (2), respectively, of section 1905(jj).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id447a12fa66f54ae2bdb8eb76b3f7a4c4"><enum>(c)</enum><header>Payment</header><paragraph commented="no" display-inline="no-display-inline" id="idaafcb8c4a76d4766888e930c29994090"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Section 1833(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)</external-xref>) is amended—</text><subparagraph id="HC7B6A1576CE3432482048FA351EB4F91"><enum>(A)</enum><text>by striking <quote>and (HH)</quote> and inserting <quote>(HH)</quote>; and</text></subparagraph><subparagraph id="HC166C1460E694A619F9A4209BD0BF24C"><enum>(B)</enum><text>by inserting before the semicolon at the end the following: <quote>, and (II) with respect to certified community behavioral health clinic services for which payment is made under section 1834(aa), the amounts paid shall be equal to 80 percent of the lesser of the actual charge or the amount determined under such section</quote>. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2567c0479ccc4074a71292eb533663f8"><enum>(2)</enum><header display-inline="yes-display-inline">Development and implementation of prospective payment system</header><text display-inline="yes-display-inline">Section 1834 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida873e702315f479e836573a2825f683d"><subsection id="id187592e2c435494eaad424c16692b244"><enum>(aa)</enum><header>Development and implementation of prospective payment system for certified community behavioral health clinics</header><paragraph id="id75b1a33ea69f48ec829b542111cc9c25"><enum>(1)</enum><header>Development</header><text>The Secretary shall develop a prospective payment system for payment to certified community behavioral health clinics (as defined in section 1861(aa)(8)) for the furnishing of certified community behavioral health clinic services (as defined in such section) under this title. Such system shall be established to take into account the type, intensity, and duration of services furnished by certified community behavioral health clinics. Such system may include adjustments, including geographic adjustments, as determined appropriate by the Secretary.</text></paragraph><paragraph id="id09465334f49a48749a1ce03c3e74b7ac"><enum>(2)</enum><header>Implementation</header><subparagraph id="id72211b93a6d2415c99b86aa4c8063801"><enum>(A)</enum><header>In general</header><text>The Secretary shall provide, for cost reporting periods beginning on or after January 1, 2024, for payments of prospective payment rates for certified community behavioral health clinic services furnished by certified community behavioral health clinics under this title in accordance with the prospective payment system developed by the Secretary under paragraph (1).</text></subparagraph><subparagraph id="id15003eaf9b4c4e1d9d11295725831f01"><enum>(B)</enum><header>Initial payments</header><text>The Secretary shall implement such prospective payment system to reflect the national average allowable service costs of such clinics on the basis of the most current audited cost report data for two fiscal years available to the Secretary; provided that, in the absence of complete actual cost data representing the provision of the full covered benefit during the relevant fiscal years, certified community behavioral health clinics may, at the Secretary’s discretion, use estimated or projected data relating to specific services. Initial payments shall be established without the application of a per visit limit or productivity screen and shall be based on national average costs per unit of service, updated as appropriate by the inflationary adjustment described in subparagraph (C).</text></subparagraph><subparagraph id="id6fd88fca84d84bf98803f4f8a2463030"><enum>(C)</enum><header>Payments in subsequent years</header><text>Payment rates in years after the year of implementation of such system shall be the payment rates in the previous year increased—</text><clause id="idfcb4b0fd306e49f89c0bb83d00b912be"><enum>(i)</enum><text>in the first year after implementation of such system, by the percentage increase in the MEI (as defined in section 1842(i)(3)) for the year involved; and</text></clause><clause id="idedd7a7838deb40e99b7f16f919ba73f7"><enum>(ii)</enum><text>in subsequent years, by the percentage increase in a market basket of certified community behavioral health clinic services, designed by the Secretary, or if such an index is not available, by the percentage increase in the MEI (as defined in section 1842(i)(3)) for the year involved.</text></clause></subparagraph></paragraph><paragraph id="id8a415d809b784ab3887e60b99fe854e7"><enum>(3)</enum><header>Unit of payment</header><text>In establishing a prospective payment amount under the system under this subsection, the Secretary shall consider an appropriate unit of service and a general system design that provides for continued access to quality services.</text></paragraph><paragraph id="id5f67237a4d944fcca3f840834ff7f8c8"><enum>(4)</enum><header>Periodic reevaluation of rates</header><text>At the Secretary’s discretion, the Secretary shall, from time to time, adjust the amounts that would otherwise be applicable under subparagraph (2) by a percentage determined appropriate by the Secretary to reflect such factors as changes in the intensity of services furnished within a unit of service, the average cost of providing care per unit of service, and other factors that the Secretary considers to be relevant. Such adjustment shall be made before the update under clause (i) or (ii) of paragraph (2)(C)(i) has been applied for the year.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="ida0514856581547f68fedfd73fc24d2a8"><enum>(d)</enum><header>Waiver of application of deductible</header><text display-inline="yes-display-inline">Section 1833(b)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(b)(4)</external-xref>) is amended by inserting <quote>or certified community behavioral health clinic services</quote> before the comma at the end.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id58b5bb30ff554cb18ff7ba49b77ad041"><enum>(e)</enum><header>PRRB Review of cost reports</header><text>Section 1878(j) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395oo">42 U.S.C. 1395oo(j)</external-xref>) is amended by striking <quote>and a Federally qualified health center</quote> and inserting <quote>, a Federally qualified health center, and a certified community behavioral health clinic</quote>.</text></subsection><subsection id="id0a82d4bc5340422a9146a9d1ce83486d"><enum>(f)</enum><header>Safe harbor for waiver of coinsurance</header><text display-inline="yes-display-inline">Section 1128B(b)(3)(D) of the Social Security Act (42 U.S.C. 1320a–7b(b)(3)(D)) is amended by inserting <quote>or a certified community behavioral health clinic</quote> after <quote>Federally qualified health care center</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idcd348eb540e0473590c38ed5f8d60bb2"><enum>(g)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to services furnished on or after January 1, 2024.</text></subsection></section></title><title id="id2a74d84e781f4a6ba2b0d6d3083d1a59" style="OLC"><enum>III</enum><header>Community behavioral health clinic grants</header><section id="id65fa2d06a2ce45fdb25d3898d9636ae4"><enum>301.</enum><header>Operating grants for community behavioral health clinics</header><text display-inline="no-display-inline">Part D of title III of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254b">42 U.S.C. 254b et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="id7E4D8B63D3C048D5BE355BA29860488C" display-inline="no-display-inline" style="OLC"><subpart id="ida0f6f2b5147a4018b474c88fca69fe50"><enum>XIII<?LEXA-Enum XIII?></enum><header>Community behavioral health clinics</header><section id="idd7eaa8e2ce4d45d4af379430264a3f6a"><enum>340J.<?LEXA-Enum 340J.?></enum><header>Definitions</header><text display-inline="no-display-inline">In this subpart:</text><paragraph commented="no" display-inline="no-display-inline" id="id3BD0B6279BF24254AF38002CD5F770B6"><enum>(1)</enum><header>Certified community behavioral health clinic</header><text>The term <term>certified community behavioral health clinic</term> has the meaning given the term in section 1905(jj)(2)) of the Social Security Act.</text></paragraph><paragraph id="idB7443350BFD74B3D843CDB984BADB571"><enum>(2)</enum><header>Certified community behavioral health services</header><text>The term <term>certified community behavioral health services</term> has the meaning given the term in section 1905(jj)(1) of the Social Security Act. </text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id1c747000b405409590dc95794362cc5d"><enum>340J–1.<?LEXA-Enum 340J–1.?></enum><header display-inline="yes-display-inline">Community behavioral health clinic certification</header><subsection commented="no" display-inline="no-display-inline" id="id18c61e9e7f1d492997e169295e9bf096"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of the <short-title>Ensuring Excellence in Mental Health Act</short-title>, the Secretary, after public notice and opportunity for comment, shall publish in the Federal Register criteria for a clinic to be certified as a community behavioral health clinic for purposes of section 1905(jj)(2)(D)(ii) of the Social Security Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id57eb955e3466447db3d93eb5cdef983a"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">The criteria published under subsection (a) shall include criteria with respect to the following:</text><paragraph id="id99b7285499f547c6ab89bfbecc98780b"><enum>(1)</enum><header>Staffing</header><text>Staffing requirements, including criteria that staff have diverse disciplinary backgrounds, have necessary State-required license and accreditation, and are culturally and linguistically trained to serve the needs of the patient populations of the community behavioral health clinic.</text></paragraph><paragraph id="id9822f1b1cf51472fabe2ba6076a735eb"><enum>(2)</enum><header>Availability and accessibility of services</header><text>Availability and accessibility of services, including crisis management services that are available and accessible 24 hours a day, the use of a sliding scale for payment, and no rejection for services or limiting of services on the basis of a patient's ability to pay or a place of residence.</text></paragraph><paragraph id="id328d66d01c9e45b99595ab2ada105f9d"><enum>(3)</enum><header>Care coordination</header><text>Care coordination, including requirements to coordinate care across settings and providers to ensure seamless transitions for patients across the full spectrum of health services including acute, chronic, and behavioral health needs. Care coordination requirements shall include partnerships or formal contracts with the following:</text><subparagraph id="id92279670e8974a989890942ee366be65" commented="no"><enum>(A)</enum><text>Federally-qualified health centers (as defined in section 1905(l) of the Social Security Act) and, as applicable, rural health clinics (as so defined), to provide Federally-qualified health center services (as so defined) and, as applicable, rural health clinic services (as so defined), to the extent such services are not provided directly through the community behavioral health clinic.</text></subparagraph><subparagraph id="id4845502b509345a5a5e2b726ba9c1d38"><enum>(B)</enum><text>Inpatient psychiatric facilities and substance use detoxification, post-detoxification step-down services, and residential programs.</text></subparagraph><subparagraph id="idcbe756538d0341ee82b3a0a5b6fc90d3"><enum>(C)</enum><text>Other community or regional services, supports, and providers, including schools, child welfare agencies, juvenile and criminal justice agencies and facilities, Indian Health Service youth regional treatment centers, State-licensed and nationally accredited child placing agencies for therapeutic foster care service, and other social and human services.</text></subparagraph><subparagraph id="ida86bf251e33d40c8b6a0055af851abca"><enum>(D)</enum><text>Medical centers, outpatient clinics, and drop-in centers of the Department of Veterans Affairs and other facilities of the Department (as defined in section 1701 of title 38, United States Code). </text></subparagraph><subparagraph id="id5720e16cfc454d809fc9936bb3683e64"><enum>(E)</enum><text>Inpatient acute care hospitals and hospital outpatient clinics.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc9264280bc9e43ef885b6acf76a725b3"><enum>(4)</enum><header>Scope of services</header><text>Provision (in a manner reflecting person-centered care) of the full array of certified community behavioral health services which, if not available directly through the community behavioral health clinic, are provided or referred through formal relationships with other providers.</text></paragraph><paragraph id="id4df1764391aa45e08d1df0a535d560c3"><enum>(5)</enum><header>Quality and other reporting</header><text>Requirements relating to development by the community behavioral health clinic of an effective procedure for compiling and reporting to the Secretary such statistics and other information as the Secretary may require relating to—</text><subparagraph id="id5fcccaf474bd4be490e0cb8a6a34a1a9"><enum>(A)</enum><text>the costs of its operations;</text></subparagraph><subparagraph id="id2701c253828343ce973cb097cb7b5aa0"><enum>(B)</enum><text>the patterns of use of its services, including the reporting of encounter data, clinical outcomes data, quality data, and such other data as the Secretary may require;</text></subparagraph><subparagraph id="id21f5d598c9374fb9a86103ca65bc1d16"><enum>(C)</enum><text>the availability, accessibility, and acceptability of its services; and</text></subparagraph><subparagraph id="id5fdf67063e28471e9b875fe110dd7bc2"><enum>(D)</enum><text>such other matters relating to operations of the applicant as the Secretary may require.</text></subparagraph></paragraph><paragraph id="id67128c582096461bbfe467c449f3b129"><enum>(6)</enum><header>Organizational authority</header><text>Requirements that a community behavioral health clinic be—</text><subparagraph commented="no" display-inline="no-display-inline" id="id64b3a60573ce4d3398ff43aca9f72328"><enum>(A)</enum><text display-inline="yes-display-inline">a nonprofit entity;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id25f7f901ee834ef6bd50033af26013e7"><enum>(B)</enum><text display-inline="yes-display-inline">part of a local government behavioral health authority; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7c218e986e3144e299c7dc71dd0204a0"><enum>(C)</enum><text display-inline="yes-display-inline">operated under the authority of the Indian Health Service;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9b5e46ab9d834234904bb55f00849b12"><enum>(D)</enum><text display-inline="yes-display-inline">operated by an Indian Tribe or Tribal organization pursuant to a contract, grant, cooperative agreement, or compact with the Indian Health Service pursuant to the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name>; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id28026950eda24d73a7bce7fb90fe2f66"><enum>(E)</enum><text display-inline="yes-display-inline">operated by an urban Indian organization pursuant to a grant or contract with the Indian Health Service under title V of the Indian Health Care Improvement Act. </text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id7922059219274ce39d37d591e5532925"><enum>340J–2.<?LEXA-Enum 340J–2.?></enum><header display-inline="yes-display-inline">Operating grants for community behavioral health clinics</header><subsection id="idfa3cb804870343b0a6b867cf3b8dcdbd"><enum>(a)</enum><header>In general</header><text>The Secretary shall establish a grant program under which the Secretary shall award grants to eligible community behavioral health clinics to provide (in a manner reflecting person-centered care) the full array of certified community behavioral health services.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ideb6b8f0b2c224da38b13f982d0d92e2e"><enum>(b)</enum><header>Eligibility</header><text>To be eligible to receive a grant under subsection (a), a community behavioral health clinic shall be—</text><paragraph commented="no" display-inline="no-display-inline" id="iddc76f1d2fbd84ff29cbec167df35c222"><enum>(1)</enum><text display-inline="yes-display-inline">a certified community behavioral health clinic; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id921c761704a040fa8980ea18a67584df"><enum>(2)</enum><text>a community behavioral health clinic that indicates in the grant application that the clinic will use the grant funds to meet the criteria described in section 340J–1(a).</text></paragraph></subsection><subsection id="id86ac6d0b7611432bbd3fdb5c283ab5f4"><enum>(c)</enum><header>Use of funds</header><text>A community behavioral health clinic that receives a grant under subsection (a)—</text><paragraph id="id8926a61aafae4eb78debdce04689b8ab"><enum>(1)</enum><text>shall use the grant funds—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9ca305efe4f14cc6a3959c4be42d8589"><enum>(A)</enum><text display-inline="yes-display-inline">to provide the services described in subsection (a); and</text></subparagraph><subparagraph id="id30d73678f0a04695bd3e1d28438b5a80" commented="no"><enum>(B)</enum><text>in the case of a community behavioral health clinic described in subsection (b)(2), to meet the criteria described in section 340J–1(a); and </text></subparagraph></paragraph><paragraph id="id168b66f6be4b4c049048e67f753976fc"><enum>(2)</enum><text>may use the grant funds—</text><subparagraph commented="no" display-inline="no-display-inline" id="id92935528e2eb46708d1e42da2292fcc5"><enum>(A)</enum><text display-inline="yes-display-inline">to carry out other activities that—</text><clause id="id68010d87637f4abea75bb4a26211d979"><enum>(i)</enum><text>reduce costs associated with the provision of certified community behavioral health services;</text></clause><clause id="id22eab426d70c41268b71e479d27324a4"><enum>(ii)</enum><text>improve access to, and availability of, certified community behavioral health services provided to individuals served by the community behavioral health clinic;</text></clause><clause id="id308108965ec3483c90249bec4def58f3"><enum>(iii)</enum><text>enhance the quality and coordination of certified community behavioral health services; or</text></clause><clause id="idfe6c055068f34608b4331e3715e1f0b6"><enum>(iv)</enum><text>improve the health status of communities; and</text></clause></subparagraph><subparagraph id="id7cdb69d6c4334bc1b9158ad96961bcd4"><enum>(B)</enum><text>to pay for—</text><clause commented="no" display-inline="no-display-inline" id="id2548b93e6d94439a8df9668056ddee1d"><enum>(i)</enum><text display-inline="yes-display-inline">the costs of acquiring and leasing buildings and equipment (including the costs of amortizing the principal of, and paying interest on, loans); </text></clause><clause commented="no" display-inline="no-display-inline" id="id2516ab904782419eac655d065d9168dd"><enum>(ii)</enum><text display-inline="yes-display-inline">costs relating to the purchase or lease of equipment, including data and information systems and behavioral health information technology to facilitate data reporting and other purposes;</text></clause><clause id="idb6e647c8ec12418c873fbcf4459eb960"><enum>(iii)</enum><text>the costs of in-service staff training and other operational or infrastructure costs identified by the Secretary; and</text></clause><clause id="id576d5256beb941c791cce6579f132637"><enum>(iv)</enum><text>costs associated with expanding and modernizing existing buildings or constructing new buildings (including the costs of amortizing the principal of, and paying the interest on, loans), if such costs are specifically allowed for in the grant opportunity published by the Secretary.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3e1f5beb910f47bba4e45ce71841d9b9"><enum>(d)</enum><header>Term</header><text display-inline="yes-display-inline">Grants awarded under subsection (a) shall be for a period of not more than 5 years. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id652fed041074468c92f27eb033a4da9e"><enum>(e)</enum><header>Condition on receipt of funds</header><text display-inline="yes-display-inline">The Secretary shall not make a grant to an applicant under subsection (a) unless the applicant provides assurances to the Secretary that within 120 days of receiving grant funding for the operation of the clinic, the applicant will submit for approval by the Secretary an implementation plan that describes how the applicant will—</text><paragraph commented="no" display-inline="no-display-inline" id="id90218e59302d4bfb949ad1feae0154d9"><enum>(1)</enum><text display-inline="yes-display-inline">provide the services described in subsection (a); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id50fe31b6a22949cba3da347bc211cfd0"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of a community behavioral health clinic described in subsection (b)(2), meet the criteria described in section 340J–1(a).</text></paragraph></subsection><subsection id="idfc6b16c4db744116bbbede216fce0daa"><enum>(f)</enum><header>Amount of grant</header><paragraph id="id613e4e27a7af43a1807d047801e00aaf"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the amount of a grant made in any fiscal year to a community behavioral health clinic under subsection (a) shall be determined by the Secretary based on information provided by the community behavioral health clinic, but may not exceed an amount equal to the difference obtained by subtracting—</text><subparagraph commented="no" display-inline="no-display-inline" id="id98058414a2f641b48dde4c05d542cff3"><enum>(A)</enum><text display-inline="yes-display-inline">the sum obtained by adding—</text><clause commented="no" display-inline="no-display-inline" id="idcd0269aaa52f484e922fae525b947e89"><enum>(i)</enum><text display-inline="yes-display-inline">the total State, local, and other operational funding provided to the clinic for such fiscal year; and</text></clause><clause id="id9a0c0e66e7374bd3a5aa4eb8c128f603"><enum>(ii)</enum><text>the fees, premiums, and third-party reimbursements that the clinic reasonably expects to receive for its operations in such fiscal year; from</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idddffcd4cdd174dd3ae948018cee6e07a"><enum>(B)</enum><text display-inline="yes-display-inline">the costs of operating the clinic to meet the purposes and requirements of the grant program under this section during such fiscal year. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id27b8ee6c367a47e18f717ca4b1389214"><enum>(2)</enum><header>Requirement</header><subparagraph commented="no" display-inline="no-display-inline" id="idbc5cc29b93e04b8997040822eea06c9a"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In determining the costs described in paragraph (1)(B), the Secretary may estimate the anticipated costs of the grant recipient in—</text><clause commented="no" display-inline="no-display-inline" id="id51f58c2bf0c645579949e3e2a6c60649"><enum>(i)</enum><text display-inline="yes-display-inline">providing the services described in subsection (a), including the anticipated costs of providing any individual certified community behavioral health service that the applicant entity does not have cost experience providing at the time of submitting an application for such grant; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7e83c55584564e11a7e6cece7e24daef"><enum>(ii)</enum><text display-inline="yes-display-inline">if applicable, meeting the criteria described in section 340J–1(a). </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb8143297bf4348b5934ecd26d04b2612"><enum>(B)</enum><header>Anticipated costs</header><text>The Secretary shall base the estimate of anticipated costs under subparagraph (A) on an estimate of anticipated costs provided by the applicable community behavioral health clinic.</text></subparagraph></paragraph><paragraph id="idf4308985ce42449eb15e8c9530d8d333"><enum>(3)</enum><header>Payments</header><text>The Secretary may—</text><subparagraph commented="no" display-inline="no-display-inline" id="id84a5b5c3553a44f9a55371b056966e88"><enum>(A)</enum><text display-inline="yes-display-inline">award grants under subsection (a)—</text><clause commented="no" display-inline="no-display-inline" id="idff791b52f24e425d9d93a24870f33be9"><enum>(i)</enum><text display-inline="yes-display-inline">in advance or through reimbursement; and </text></clause><clause commented="no" display-inline="no-display-inline" id="iddea3d0a31588478e9cbf72b580d8db22"><enum>(ii)</enum><text display-inline="yes-display-inline">in installments;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida36021e04ad349178dc9c69cfb583013"><enum>(B)</enum><text display-inline="yes-display-inline">make adjustments to account for overpayments or underpayments.</text></subparagraph></paragraph></subsection><subsection id="id73424635f80441d1a6b17515ab4e041c"><enum>(g)</enum><header>Use of accreditation</header><paragraph commented="no" display-inline="no-display-inline" id="id7eda9df60b26468a9a317965f61608b8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In selecting grant recipients under this section, the Secretary may take into account whether an applicant community behavioral health clinic is accredited under section 340J–5(a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id39a80fac2c0442f4ba1c15c7e12573f8"><enum>(2)</enum><header>Compliance</header><text display-inline="yes-display-inline">In determining whether a community behavioral health clinic receiving a grant under this section is providing the services described in subsection (a) and, if applicable, meeting the criteria described in section 340J–1(a), the Secretary may take into account whether the community behavioral health clinic is accredited under section 340J–5(a).</text></paragraph></subsection><subsection id="id2207e27b05f3413bafa59dcc290dcf40"><enum>(h)</enum><header>Authorization of appropriations</header><paragraph commented="no" display-inline="no-display-inline" id="idd8071aa352f54317b5938268750567f4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section, $552,500,000 for each of fiscal years 2024 through 2028.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0c5976762ca34124bda4f360c10480d6"><enum>(2)</enum><header>Maintenance of funding</header><text display-inline="yes-display-inline">The amount made available under paragraph (1) shall supplement (and not supplant) any other Federal funding made available for community behavioral health clinics.</text></paragraph></subsection></section><section id="id12138e4d5acf421f8c1de6e865d26f14"><enum>340J–3.<?LEXA-Enum 340J–3.?></enum><header>Technical assistance</header><subsection id="id3b5af20ec6044af695e3065e9f87512c"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of the <short-title>Ensuring Excellence in Mental Health Act</short-title>, the Secretary shall establish programs through which the Secretary shall provide (either through the Department of Health and Human Services or by grant or contract) technical assistance and other assistance to any of the following:</text><paragraph id="id0d6d70f47aca4618a76f04684cb22832"><enum>(1)</enum><text>Entities that receive a grant under section 340J–2.</text></paragraph><paragraph id="idf0bc6a42fff54ef4b358148f95a4af87" commented="no"><enum>(2)</enum><text>Entities participating in a Medicaid demonstration program under section 223(d) of the Protecting Access to Medicare Act.</text></paragraph><paragraph id="id5d5e877a102c42838a7e5539ee9e3e93" commented="no"><enum>(3)</enum><text>Certified community behavioral health clinics (as defined in sections 1861(aa)(8) and 1905(jj)(2) of the Social Security Act), furnishing services under title XVIII or title XIX of such Act.</text></paragraph><paragraph id="idd885e36a69a14d599a7ce5d70cfa5d44"><enum>(4)</enum><text>Health or social service provider organizations pursuing or considering certified community behavioral health clinic status or partnering with certified community behavioral health clinics. </text></paragraph><paragraph id="idcda25a81513141e4ae5122dbedb5423f"><enum>(5)</enum><text>Other stakeholders, for the purpose of facilitating successful implementation of the certified community behavioral health clinic model.</text></paragraph></subsection><subsection id="id428d0a4931c64785acace1d088da238e"><enum>(b)</enum><header>Inclusions</header><text>Assistance provided by the Secretary under subsection (a) may include technical and nonfinancial assistance, including—</text><paragraph commented="no" display-inline="no-display-inline" id="id826e2cc07f1d4277927289b899a8bb74"><enum>(1)</enum><text display-inline="yes-display-inline">fiscal and program management assistance;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf4c6a600b8b642ceb40e4a9f7078274a"><enum>(2)</enum><text display-inline="yes-display-inline">operational and administrative support; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id72cb98a0392349ed9be017be69218d03"><enum>(3)</enum><text display-inline="yes-display-inline">the provision of information to the entities about the variety of resources available under this part and how those resources can be best used to meet the health and behavioral health needs of the communities served by the entities.</text></paragraph></subsection><subsection id="idb5a3478c07824cd0bb085dc1f9c20108"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $6,000,000 for each of fiscal years 2024 through 2028.</text></subsection></section><section id="id663de8bbe89646e29219ea8cb1c23db9" commented="no"><enum>340J–4.<?LEXA-Enum 340J–4.?></enum><header>Data infrastructure for community behavioral health clinic reporting</header><subsection id="id53f61611d853429697dffaa29410b5f5"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of the <short-title>Ensuring Excellence in Mental Health Act</short-title>, the Secretary shall establish a system under which the Secretary shall collect and analyze data on community behavioral health clinics.</text></subsection><subsection id="id75082ab2f29d4a90bf7dd8273b03c573"><enum>(b)</enum><header>Scope of data collection</header><text>The system established under subsection (a) shall be used by the Secretary to collect and analyze data from—</text><paragraph id="idb1d91be424fe480eac1e07ce01ff4f1f"><enum>(1)</enum><text>entities that receive a grant under section 340J–2; and</text></paragraph><paragraph id="idf1707825f2e94cfebf0f70a8e28d13b9" commented="no"><enum>(2)</enum><text>organizations that provide services, or have applied to provide services, under title XVIII of the Social Security Act, as described in section 1861(aa)(8) of such Act, or under a State Medicaid program in accordance with section 1905(jj) of such Act.</text></paragraph></subsection><subsection id="id9619939846f14d96a41ce4e5e0005d4d"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $51,000,000 for each of fiscal years 2024 through 2028.</text></subsection></section><section id="id6ed92a21d16b4ed8844572d32551d665"><enum>340J–5.<?LEXA-Enum 340J–5.?></enum><header>Community behavioral health clinic accreditation</header><subsection id="iddfc281da13f64f23a80e0c5b2dba9055" commented="no"><enum>(a)</enum><header>Accreditation standards</header><text>A community behavioral health clinic may be accredited if the entity—</text><paragraph id="ide68d1ceafd07499e88fcf004d550ef01" commented="no"><enum>(1)</enum><text>meets the standards of an approved accreditation body; and</text></paragraph><paragraph id="idc0617d5c50f5437fb695ae74e9e604dc" commented="no"><enum>(2)</enum><text>authorizes the accreditation body to submit to the Secretary (or such agency as the Secretary may designate) such records or other information as the Secretary may require.</text></paragraph></subsection><subsection id="id35d39420d39d47e4bc320b581a625eb7"><enum>(b)</enum><header>Approval of accreditation bodies</header><paragraph id="idb7fb2336dafe435c98934d75fd2c0ffe"><enum>(1)</enum><header>In general</header><text>The Secretary may approve a private nonprofit organization to be an accreditation body for the accreditation of community behavioral health clinics under subsection (a) if—</text><subparagraph id="idaf1f094412c64ee8a7820c3d8406eb5f"><enum>(A)</enum><text>using inspectors qualified to evaluate quality of care in a behavioral health service setting, the accreditation body agrees to inspect the clinic with such frequency as is determined by the Secretary;</text></subparagraph><subparagraph id="id3b1cca6c9a764e10b94adb4f68189328"><enum>(B)</enum><text>the standards applied by the body in determining whether or not to accredit a clinic correspond to the criteria described in section 340J–1(a), and are not less restrictive than such criteria;</text></subparagraph><subparagraph id="idfc99defab2c34a458648b00be9b5c428"><enum>(C)</enum><text>there is adequate provision for assuring that the standards of the accreditation body continue to be met by the clinic;</text></subparagraph><subparagraph id="id5035959e1867481fb01d588fa9da39af"><enum>(D)</enum><text>in the case of any clinic previously accredited by the body which has had its accreditation denied, suspended, withdrawn, or revoked or which has had any other action taken against it by the accrediting body, the accrediting body agrees to submit to the Secretary the name of such clinic within 30 days of the action taken; and</text></subparagraph><subparagraph id="idb49282b0deb6487bb255eaa0c35152ca" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text>if the accreditation body has its approval withdrawn by the Secretary, the body agrees to notify each clinic accredited by the body of the withdrawal within 10 days of the withdrawal.</text></subparagraph></paragraph></subsection></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block></section></title></legis-body></bill>
