which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the issuance of an interim or final rule, and to prohibit the inclusion in certain oil and gas leases, exploration or development plans, or well permits requirements or recommendations, that establish a vessel speed or operational restriction in the Central or Western Planning Area of the Gulf of Mexico of the outer Continental Shelf until the Secretary of the Interior and the Secretary of Commerce complete a study demonstrating that proposed mitigation efforts would have no negative impact on supply chains, United States offshore energy production and generation, military activities, including readiness, and United States commercial and recreational fishing maritime commerce, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Warding off Hostile Administrative Leasing Efforts Act</short-title></quote> or the <quote><short-title>WHALE Act</short-title></quote>.</text></section><section id="id49c740747ed94a539dcab1d5252d6a86"><enum>2.</enum><header>Vessel speed or operational restrictions in the Gulf of Mexico</header><subsection id="id2bfb8baf6c904c2bb9c0cfe578f3f8c7"><enum>(a)</enum><header>In general</header><text>The Secretary of Commerce shall not issue an interim or final rule, and the Secretary of the Interior shall not include in an offshore oil and gas lease sale, exploration or development plan, or well permit in the Central or Western Planning Area of the Gulf of Mexico of the outer Continental Shelf a requirement or recommendation, that establishes a vessel speed or vessel operational restriction for any length of time in such a Planning Area until the Secretary of Commerce and Secretary of the Interior—</text><paragraph id="id4b79f12df199454a8a6e8e428f963bf9"><enum>(1)</enum><text>complete a study—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida75b5fbdf9054033a4cf0deda1fa2685"><enum>(A)</enum><text display-inline="yes-display-inline">assessing the impact of any mitigation protocols developed under subsection (b) on—</text><clause commented="no" display-inline="no-display-inline" id="id0277fd3d05a2418da119df15a36902cf"><enum>(i)</enum><text display-inline="yes-display-inline">the core habitat for Rice's whales in the Eastern Planning Area of the Gulf of Mexico; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id32185b2e315841f4b0d7de883e979fca"><enum>(ii)</enum><text>seasonal occupation and usage patterns outside such core habitat; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc2a7c070a775449a96dc9650a3b2d2f9"><enum>(B)</enum><text display-inline="yes-display-inline">demonstrating that mitigation protocols developed under subsection (b) would have no negative impact on supply chains, United States offshore energy production and generation, military activities, including readiness, and United States commercial and recreational fishing or maritime commerce; and</text></subparagraph></paragraph><paragraph id="id5fba7e2be08c4890b19979c3f72e3b37" commented="no"><enum>(2)</enum><text>not later than 60 days after completing the study described in paragraph (1), submit a report containing the findings of such study to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2d927b7593874e38b41f9abeda1e9652"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Commerce, Science, and Transportation and the Committee on Energy and Natural Resources of the Senate; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8746a4456dad415f8a46b9384e0d3495"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Natural Resources and the Committee on Energy and Commerce of the House of Representatives.</text></subparagraph></paragraph></subsection><subsection id="idcd7ed992acf94261999919e744251423"><enum>(b)</enum><header>Mitigation protocols required</header><paragraph id="idecaa32beefaf487995d9ea686dee5a4e"><enum>(1)</enum><header>In general</header><text>The Secretary of Commerce, in concurrence with the Secretary of the Interior and in consultation with the Secretary of the department in which the Coast Guard is operating, the Secretary of Defense, the Secretary of Transportation, and affected stakeholders, shall develop mitigation protocols that make use of any monitoring system designed under section 11303 of the Don Young Coast Guard Authorization Act of 2022 (<external-xref legal-doc="usc" parsable-cite="usc/16/1391">16 U.S.C. 1391</external-xref>) to direct sector-specific mitigation measures that reduce the risk of serious injury and mortality to Rice’s whales in the Eastern Planning Area of the Gulf of Mexico.</text></paragraph><paragraph id="id2ec61f77dc7f42b1bba2e005dfe2f761"><enum>(2)</enum><header>Prohibitions</header><text>The mitigation protocols developed under paragraph (1) may not include—</text><subparagraph commented="no" display-inline="no-display-inline" id="id869b676cefc1418fb44149fdc3131bcf"><enum>(A)</enum><text display-inline="yes-display-inline">any prohibitions on transit at night; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idefb62312bc334c768283701ef7416cb3"><enum>(B)</enum><text display-inline="yes-display-inline">implementation of a vessel speed or vessel operational restriction.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc68f04ae11d84d85ba38709d48dc25da"><enum>(c)</enum><header>National security</header><text>The Secretary of Commerce shall, in coordination with the Secretary of Defense, provide in any interim or final rule described in subsection (a) an exception for national security activities.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id859317daec054ab4818933421bf4e6c3"><enum>(d)</enum><header display-inline="yes-display-inline">Definition of core habitat</header><text>For purposes of this section, the term <term>core habitat</term>, with respect to Rice's whales, has the meaning given the term <term>Bryde’s whale area</term> in the <quote>Biological Opinion on the Federally Regulated Oil and Gas Program Activities in the Gulf of Mexico</quote> published by the Department of Commerce on March 13, 2020. </text></subsection></section></legis-body></bill>
