which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Land Policy and Management Act of 1976 to authorize certain construction activities on public lands, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Nurseries</header><text display-inline="no-display-inline">Title VI of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1781">43 U.S.C. 1781 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9BF01523862949079848488B59D24F63"><section id="idE663E23BD21B471BAD1D5BCF3FA4337F"><enum>604.</enum><header>Nurseries</header><subsection id="id576da2fae45c476e82819e094e985c7d"><enum>(a)</enum><header>In general</header><text>Using funds made available under section 40804(b)(8) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6592a">16 U.S.C. 6592a(b)(8)</external-xref>)—</text><paragraph id="ida475f77a556247c5a8488b52c82fd55d"><enum>(1)</enum><text>the Secretary shall carry out a pilot program to establish and operate nurseries on public lands and other Federal land under the jurisdiction of the Secretary; and</text></paragraph><paragraph id="id75ab525bf31e438c807c21f492172cef"><enum>(2)</enum><text>the Secretary of Agriculture, acting through the Chief of the Forest Service, shall carry out a pilot program to establish and operate nurseries on National Forest System land.</text></paragraph></subsection><subsection id="id6f1fdbb93a954ed1b9aec12dd40323bd"><enum>(b)</enum><header>Locations</header><paragraph id="id23e86a70bf9f45d4a048c09d956ce9bc"><enum>(1)</enum><header>Department of the Interior</header><text>The Secretary shall carry out the pilot program established under subsection (a)(1) in—</text><subparagraph id="id43a48bc9efb646cd8f462c53f8a3f6d5"><enum>(A)</enum><text>4 of the eleven contiguous Western States; and</text></subparagraph><subparagraph id="id2166c09eaccc4d86b15a20a6649990f4"><enum>(B)</enum><text>1 State that is not 1 of the eleven contiguous Western States.</text></subparagraph></paragraph><paragraph id="id1fdc493862c44b4091db827083739fb4"><enum>(2)</enum><header>Forest Service</header><text>The Secretary of Agriculture, acting through the Chief of the Forest Service, shall carry out the pilot program established under subsection (a)(2) in—</text><subparagraph id="idA92A5D37E6E04B97925311C42131158C"><enum>(A)</enum><text>4 of the eleven contiguous Western States; and</text></subparagraph><subparagraph id="id2A3DAAF1F2CD414E81111CE6767720F7"><enum>(B)</enum><text>1 State, including the State of Vermont, that is not 1 of the eleven contiguous Western States.</text></subparagraph></paragraph></subsection><subsection id="id72ea2057e6914134add9bf75801ea078"><enum>(c)</enum><header>Activities</header><paragraph id="idD8C39C1B0C874537A025BA5474661BE5"><enum>(1)</enum><header>Definition of Secretary concerned</header><text>In this subsection, the term <term>Secretary concerned</term> means—</text><subparagraph id="id81CDE0AEDB8647039E4418D1575288FF"><enum>(A)</enum><text>the Secretary, with respect to public lands and other Federal land under the jurisdiction of the Secretary; and</text></subparagraph><subparagraph id="idC10ECCE0FF10464FAB0E730C3840177E"><enum>(B)</enum><text>the Secretary of Agriculture, acting through the Chief of the Forest Service, with respect to National Forest System land.</text></subparagraph></paragraph><paragraph id="id9A49DD1B45524C1DB1ACB15E972554D4"><enum>(2)</enum><header>Authorizations</header><text>In carrying out a pilot program established under subsection (a), the Secretary concerned may—</text><subparagraph id="ide06fcc6858e14c0bb0fa89e251474f19"><enum>(A)</enum><text>establish a tree nursery on Federal land under the jurisdiction of the Secretary concerned, and develop the infrastructure necessary to support that nursery, to address Federal and regional conservation tree planting needs, consistent with the Bureau of Land Management National Seed Strategy;</text></subparagraph><subparagraph id="id1df1d08b86e34fe3aea9bdc6a75c6be5"><enum>(B)</enum><text>purchase necessary equipment and machinery and construct the necessary facilities on Federal land under the jurisdiction of the Secretary concerned to store material, equipment, and machinery authorized under this section;</text></subparagraph><subparagraph id="id1121d52c103041a49c846874663f56f6"><enum>(C)</enum><text>enter into cooperative agreements with non-Federal entities to use trees produced in nurseries established under the pilot program;</text></subparagraph><subparagraph id="id5f55f254c40d49af9332c1d0a823f4b1"><enum>(D)</enum><text>conduct necessary research on grazing and forest management on Federal land under the jurisdiction of the Secretary concerned, ensuring the long-term sustainability of such grazing and forest management, to maximize the ability—</text><clause id="idc6de67082aef4d88827b6f045adefd86"><enum>(i)</enum><text>to sequester carbon;</text></clause><clause id="iddd1f6ea0db154d25b9334d945234deb8"><enum>(ii)</enum><text>to prevent soil erosion; and</text></clause><clause id="idb6fb86b576274b628a35291b8edef020"><enum>(iii)</enum><text>to improve air and water quality; and</text></clause></subparagraph><subparagraph id="id5aba9470f792469faf4c04506a08989b"><enum>(E)</enum><text>hire and train personnel to carry out the activities described in this section.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
