which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize funding for the establishment and implementation of infant mortality pilot programs in standard metropolitan statistical areas with high rates of infant mortality, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nationally Enhancing the Well-being of Babies through Outreach and Research Now Act</short-title></quote> or the <quote><short-title>NEWBORN Act</short-title></quote>.</text></section><section id="idf74b0b31053e4bc4925cbfaabea2ced8"><enum>2.</enum><header>Infant mortality pilot programs</header><text display-inline="no-display-inline">Section 330H of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254c-8">42 U.S.C. 254c–8</external-xref>) is amended—</text><paragraph id="idb6b6aeacb04040d49582cfb44e83c808"><enum>(1)</enum><text>by redesignating subsections (e) and (f) as subsections (f) and (g), respectively;</text></paragraph><paragraph id="id0daf83e645784190998eeb3b610a97da"><enum>(2)</enum><text>by inserting after subsection (d) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id04224149ca874bd6a449156b8b13133d"><subsection id="idea40c75aa3ca4a7c8962f5429dae598f"><enum>(e)</enum><header>Infant mortality pilot programs</header><paragraph id="id0f9f9bbae99043e2a65429c7f9c923ed"><enum>(1)</enum><header>In general</header><text>The Secretary shall award grants to eligible entities to establish, implement, and oversee infant mortality pilot programs.</text></paragraph><paragraph id="id15f4c500ad114506b5d0c44cf566726c"><enum>(2)</enum><header>Period of a grant</header><text>The period of a grant under this subsection shall be not more than 5 years.</text></paragraph><paragraph id="id4a01d92fac594e61aea811d9ae87b58d"><enum>(3)</enum><header>Preference</header><text>In awarding grants under this subsection, the Secretary shall give preference to—</text><subparagraph id="idae7ad56808c04eb4ac898a290fb485db"><enum>(A)</enum><text>eligible entities proposing to serve any of the 50 counties or groups of counties with the highest rates of infant mortality in the United States, based on the most recent 3 years of available data, as determined by the Secretary; and</text></subparagraph><subparagraph id="iddac5cdf0eac5489bb9190ff4555d2b79"><enum>(B)</enum><text>eligible entities the proposed infant mortality pilot program of which would address—</text><clause id="idb1ff0f3286e245c18725e41c64cc6408"><enum>(i)</enum><text>birth defects;</text></clause><clause id="id5c7d3d9510914bffb7cf8823df9a516a"><enum>(ii)</enum><text>preterm birth and low birth weight;</text></clause><clause id="id8d10ac138735414fa6825ced059766e9"><enum>(iii)</enum><text>sudden infant death;</text></clause><clause id="idad4af270b1c344c993d7a6fc7e800373"><enum>(iv)</enum><text>maternal pregnancy complications; or</text></clause><clause id="idedbbf7c899644cb9a4801e35576d883f"><enum>(v)</enum><text>injuries to infants.</text></clause></subparagraph></paragraph><paragraph id="id755ab59b697042b5a7efe6a762a2296c"><enum>(4)</enum><header>Use of funds</header><text>An infant mortality pilot program carried out using a grant under this subsection may—</text><subparagraph id="id7e5ff874ae0641cdb094ae27565ce606"><enum>(A)</enum><text>include the development of a plan that identifies the individual needs of each community to be served and strategies to address those needs;</text></subparagraph><subparagraph id="id213d2c3586514eeea68ddd876db8bfcf"><enum>(B)</enum><text>provide outreach to at-risk mothers through programs deemed appropriate by the Administrator;</text></subparagraph><subparagraph id="id6460a5b18f3b4a0ab05a0825d1a66ebd"><enum>(C)</enum><text>develop and implement standardized systems for improved access, utilization, and quality of social, educational, and clinical services to promote healthy pregnancies, full-term births, and healthy infancies delivered to women and their infants, such as—</text><clause id="idd893487a60864dddb3df219bcf33bcb9"><enum>(i)</enum><text>counseling on infant care, feeding, and parenting;</text></clause><clause id="idb6e2b8243261477597f3c1909f0f0206"><enum>(ii)</enum><text>postpartum care;</text></clause><clause id="id6867db69e4e845b9b7dbaffcd07d4242"><enum>(iii)</enum><text>prevention of premature delivery; and</text></clause><clause id="ide84daeaeb9f44dfbb5382fbaf31127f1"><enum>(iv)</enum><text>additional counseling for at-risk mothers, including smoking cessation programs, drug treatment programs, alcohol treatment programs, nutrition and physical activity programs, postpartum depression and domestic violence programs, social and psychological services, dental care, and parenting programs;</text></clause></subparagraph><subparagraph id="idb7210c8582cc4a2dbc060ead9c38ab5b"><enum>(D)</enum><text>establish a rural outreach program to provide care to at-risk mothers in rural areas;</text></subparagraph><subparagraph id="id58ac67ce4cbd4211b84019d81ae14d61"><enum>(E)</enum><text>establish a regional public education campaign, including a campaign to—</text><clause id="id86b9d7ff3b034a18b0e4847d42b6f4a6"><enum>(i)</enum><text>prevent preterm births; and</text></clause><clause id="ide3bf33c09ef44f23bd0c5a53e2af903e"><enum>(ii)</enum><text>provide education to the public about infant mortality;</text></clause></subparagraph><subparagraph id="idbfe1fbe6f24c4a6697486c80b224b86b"><enum>(F)</enum><text>provide for any other activities, programs, or strategies, as identified by the plan under subparagraph (A); and</text></subparagraph><subparagraph id="id02fef6e498ae494a97bfbe855dea1b64"><enum>(G)</enum><text>coordinate efforts between—</text><clause id="id4ce4fca06354443781afa7a71d6c6e49"><enum>(i)</enum><text>the health department of each county or other eligible entity to be served through the infant mortality pilot program; and</text></clause><clause id="idb8f8e2c7429d47e782f3bc39e408630d"><enum>(ii)</enum><text>existing entities that work to reduce the rate of infant mortality within the area of any such county or other eligible entity.</text></clause></subparagraph></paragraph><paragraph id="id82e9e078af164d93aa987d248887e672"><enum>(5)</enum><header>Limitation</header><text>Of the funds received through a grant under this subsection for a fiscal year, an eligible entity shall not use more than 10 percent for program evaluation.</text></paragraph><paragraph id="idbacec0940cac45908cd5734685eb7e9d"><enum>(6)</enum><header>Reports on pilot programs</header><subparagraph id="id77b480e218d54dd9b6331407b4ab1d5b"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after receiving a grant, and annually thereafter for the duration of the grant period, each eligible entity that receives a grant under paragraph (1) shall submit a report to the Secretary that details the infant mortality pilot program carried out using the grant.</text></subparagraph><subparagraph id="idaac944e00c5b494e9629f1ec61d5788d"><enum>(B)</enum><header>Contents of report</header><text>The reports required under subparagraph (A) shall include information such as the methodology of, and outcomes and statistics from, the infant mortality pilot program carried out using the grant.</text></subparagraph><subparagraph id="idec7fe57119b1425f9684408eb2722184"><enum>(C)</enum><header>Evaluation</header><text>The Secretary shall use the reports required under subparagraph (A) to evaluate, and conduct statistical research on, infant mortality pilot programs carried out using grants under this subsection.</text></subparagraph></paragraph><paragraph id="idd317dbda137f424a996f31722ec967b2"><enum>(7)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id79bb19e3bfb6422cbeacabc28b6dfe0e"><enum>(A)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><clause id="idc58bfe1dfe744542ae0b18e684c3ca41"><enum>(i)</enum><text>a county, city, or territorial health department;</text></clause><clause commented="no" display-inline="no-display-inline" id="id4d54a5c889784f7fa81b1cf1d0e0b240"><enum>(ii)</enum><text display-inline="yes-display-inline">the health department of an Indian tribe, a tribal organization, or an Urban Indian organization, as such terms are defined in section 4 of the Indian Health Care Improvement Act; or</text></clause><clause id="ide56375bf6e6d49f48e185ca18becdbcf"><enum>(iii)</enum><text>in the case of a State with a centralized health department, the State health department.</text></clause></subparagraph><subparagraph id="id20102957aa4d44b2b2e1eb7a5a018647"><enum>(B)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary, acting through the Administrator of the Health Resources and Services Administration.</text></subparagraph></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="id6f4ccd019a1a4c99ba321532dc5b36bc"><enum>(3)</enum><text>in subsection (f), as so redesignated—</text><subparagraph id="idcdcd2d7983884ba9b720cb6d65bb4fd1"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id0f9a655eacd6420c8aa053035e403b7a"><enum>(i)</enum><text>in the heading, by striking <quote><header-in-text style="OLC" level="paragraph">Authorization of appropriations</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">Healthy start initiative</header-in-text></quote>; and</text></clause><clause id="id66dff043d2f1485aa2acc840a8e9c472"><enum>(ii)</enum><text>by inserting <quote>(other than subsection (e))</quote> after <quote>carrying out this section</quote>;</text></clause></subparagraph><subparagraph id="id1840769c093648429065138e27e9361b"><enum>(B)</enum><text>by redesignating paragraph (2) as paragraph (3);</text></subparagraph><subparagraph id="id3c153ef09b064c3e9d7c24268d349619"><enum>(C)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide0415a5d7f46472baf2db7b390545097"><paragraph id="id029aca4a016b4b788bc68ca9327e2f63"><enum>(2)</enum><header>Infant mortality pilot programs</header><text>There is authorized to be appropriated $10,000,000 for each of fiscal years 2023 through 2027 to carry out subsection (e).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="ida94eca8c1a1e4d2baf67116db0628586"><enum>(D)</enum><text>in paragraph (3)(A), as so redesignated, by striking <quote>the program under this section</quote> and inserting <quote>the program under subsection (a)</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1831fc219fa84ec2aed8e7a3fcc4c8ce"><enum>(4)</enum><text display-inline="yes-display-inline">in each of paragraphs (2) and (3)(B) of subsection (g), as so redesignated, by striking <quote>subsection (e)(2)(B)</quote> and inserting <quote>subsection (f)(3)(B)</quote>. </text></paragraph></section></legis-body></bill>
