<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 2975</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230928" legis-day="20230922">September 28 (legislative day, September 22), 2023</action-date><action-desc><sponsor name-id="S347">Mr. Moran</sponsor> (for himself and <cosponsor name-id="S314">Mr. Tester</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to improve payment and processing of payments or allowances for beneficiary travel, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Road to Access Act of 2023</short-title></quote>.</text></section><section id="idf80022b117ad46dfb83d45be8c48f317"><enum>2.</enum><header>Improvements relating to Department of Veterans Affairs beneficiary travel</header><subsection commented="no" display-inline="no-display-inline" id="ide8c275bb74c4441cb8374e5fbd189dce"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 111 of title 38, United States Code. is amended by adding at the end the following new subsections:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD8EC28998A5F43F098BF87C22CB5C9ED"><subsection id="id3bbbc002974843a4af8fba8a49454e0f"><enum>(h)</enum><text>The Secretary shall accept claims for reimbursement for expenses under subsection (a) submitted to the Secretary on or before the date that is 180 days after the date of eligible travel, or such later date as the Secretary considers appropriate.</text></subsection><subsection id="id5b979ebf8cfa4b468453fd5e1683fe5b"><enum>(i)</enum><text>For the first instance of care a person receives at a Department facility each year or that is authorized by the Department, the Secretary shall send the veteran written outreach providing information on the payments and allowances available under this section and encouraging the person to submit a claim for allowance under this section. Such communication may also include information about programs described in section 111A of this title available through facilities local to the person.</text></subsection><subsection id="id88995fdce6394fc5a776fe7e955285f7"><enum>(j)</enum><text>For each claim of a person for allowance or reimbursement denied under this section, the Secretary shall inform the person regarding—</text><paragraph commented="no" display-inline="no-display-inline" id="ida10b0649334f4a5e90d6e8c9e3b62039"><enum>(1)</enum><text display-inline="yes-display-inline">the reason for the denial; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id40765008d7b841f89178a97fc62bea49"><enum>(2)</enum><text display-inline="yes-display-inline">the options available to the person for—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0c90366873c14eefb5fad9b537712392"><enum>(A)</enum><text display-inline="yes-display-inline">resubmitting the claim; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida1217e6b086746c49517d3a101b362ad"><enum>(B)</enum><text display-inline="yes-display-inline">appealing the denial.</text></subparagraph></paragraph></subsection><subsection id="id5000a18952704c4f9f1e20a2b7fa47ae"><enum>(k)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id47d4ecd271e04cdfb71e693ac0c7b71e"><enum>(1)</enum><text>To the extent practicable, not later than one year after the date of the enactment of the <short-title>Road to Access Act of 2023</short-title>, the Secretary shall establish a policy whereby a veteran described in paragraph (2) who is eligible for reimbursement under this section have mileage reimbursement claims submitted on their behalf for review by the Department for any care provided at a facility of the Department or by the staff of the Department.</text></paragraph><paragraph id="ideb7a23d3a6504a53926cfcd941698819" indent="up1"><enum>(2)</enum><text>A veteran described in this paragraph is a veteran—</text><subparagraph id="id7a3b1680c68147e28f5cc1ae1554b08c"><enum>(A)</enum><text>with a service-connected disability rate at 50 percent or more;</text></subparagraph><subparagraph id="idff0aa5fcfcad4a2e92024d8fed3709a0"><enum>(B)</enum><text>with a disability as defined in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>);</text></subparagraph><subparagraph id="idfb48492e82d74e4bbdebfed71888bd5d"><enum>(C)</enum><text>without reasonable access to the Beneficiary Travel Self Service System, or successor system with similar functions, including lack of access to reliable mobile telephone or internet service or not in possession of the appropriate technology for accessing the Beneficiary Travel Self Service System, or successor system; or</text></subparagraph><subparagraph id="ide7bcd53cb45c486ea9d0546e10fa6e3f"><enum>(D)</enum><text>reliant upon a caregiver or other resource to submit a claim on behalf of the veteran due to a mental or physical limitation.</text></subparagraph></paragraph></subsection><subsection id="id3542dedb373d4fb4b60fe6457f0412f8"><enum>(l)</enum><text>The Secretary shall—</text><paragraph id="id23d8e661aca64942a2b18574b659fbc6"><enum>(1)</enum><text>allow any person submitting a claim for allowance or payment under this section to submit the claim in a paper or other format that does not require access to technology devices, mobile telephone service, or internet service;</text></paragraph><paragraph id="id0c1cd4568db2477693cccb87f72c6918"><enum>(2)</enum><text>educate relevant staff of the Department regarding this access requirement described in paragraph (1); and</text></paragraph><paragraph id="id349d561190c0404bbf078ae5eabd38be"><enum>(3)</enum><text>provide reasonable and equitable access to the alternatives offered by paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id2af59f061e984330aed0d3eb97f7fb2c"><enum>(b)</enum><header>Updates to certain technology systems</header><text>Not later than two years after the date of the enactment of this Act, the Secretary of Veterans Affairs shall complete such updates and modifications to technology systems of the Department of Veterans Affairs as the Secretary considers appropriate to carry out subsection (k) of section 111 of such title, as added by subsection (a) of this section.</text></subsection></section></legis-body></bill>
