<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 2941</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230927" legis-day="20230922">September 27 (legislative day, September 22), 2023</action-date><action-desc><sponsor name-id="S363">Mr. King</sponsor> (for himself and <cosponsor name-id="S309">Mr. Casey</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to provide coverage of preventive home visits under Medicare, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventive Home Visit Act</short-title></quote>.</text></section><section id="id13e083424e7a488ab5851d40d79ee7ec"><enum>2.</enum><header>Medicare coverage of preventive home visits</header><subsection id="id309b4882247b4ad79e1e84730d921d7d"><enum>(a)</enum><header>In general</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended—</text><paragraph id="iddf28858e1f49474aa5a1104cd2001b7b"><enum>(1)</enum><text>in subsection (s)(2)—</text><subparagraph id="idec2c43776f6b47f5a670562ffe6705d3"><enum>(A)</enum><text>in subparagraph (II), by striking <quote>subsection (lll)(3))</quote> and all that follows and inserting <quote>subsection (lll)(3));</quote>;</text></subparagraph><subparagraph id="id4bd58f04220340b09406fa72bc048c0d"><enum>(B)</enum><text>in subparagraph (JJ), by adding <quote>and</quote> after the semicolon; and</text></subparagraph><subparagraph id="id2702930fdc824f20944f981a39bddf0f"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id590fa2d4027148f8ad7d040f8848229a"><subclause id="idc7aed6820d724f5196a0d46a8e070c0a" indent="up3"><enum>(II)</enum><text>a preventive home visit as defined in subsection (nnn).</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id52b3ca19364f4679918b572fff9cd9e0"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddfcaf69db3b146c797d96c3ec7fdedbf"><subsection id="idbd51b3e621b04d4b9ea1d3dc36fc57e9"><enum>(nnn)</enum><header>Preventive home visit</header><text>The term <term>preventive home visit</term> means a visit to the home of an individual by a qualified professional or team of professionals (as defined by the Secretary), not more frequently than once every 2 years, during which the qualified professional provides an assessment of the home environment of the individual, identifies health risks, and provides referrals, as appropriate, for interventions or home modifications to improve physical function, balance, strength and mobility, reduce other falls risk factors, or enhance nutrition with respect to the individual. The preventive home visit can be conducted in-person, remotely, or a combination thereof.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id0c2d4f27d990473790b139f4cbe404b7"><enum>(b)</enum><header>Payment</header><paragraph id="id0c2bbb58208249089d31faf836e5c181"><enum>(1)</enum><header>In general</header><text>Section 1833(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)</external-xref>) is amended—</text><subparagraph id="id5148c4f301574974a3d1c21d50fea97b"><enum>(A)</enum><text>by striking <quote>and (HH)</quote> and inserting <quote>(HH)</quote>; and</text></subparagraph><subparagraph id="id8802bbfc70cf4835a52cd56cded1accb"><enum>(B)</enum><text>by inserting before the semicolon at the end the following: <quote>and (II) with respect to a preventive home visit as defined in section 1861(nnn), the amount paid shall be equal to 100 percent of the lesser of the actual charge for the service or the amount determined under section 1834(aa)</quote>.</text></subparagraph></paragraph><paragraph id="id9f960c950b174396b7ac9d7a6361e9d2"><enum>(2)</enum><header>Payment determination</header><text>Section 1834 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id01b81d6428954e85af217ccc35bc9377"><subsection id="id054d371292da4149895133b0fcf39512"><enum>(aa)</enum><header>Preventive home visits</header><text>The Secretary shall establish a bundled payment amount for a preventive home visit (as defined in section 1861(nnn)), including any referrals made in connection with the visit.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id152c96c98f664b84b58138d540284d07"><enum>(c)</enum><header>Frequency limitation</header><text>Section 1862(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(a)(1)</external-xref>) is amended—</text><paragraph id="id8acea766f0bc4c529230a4235be14922"><enum>(1)</enum><text>in subparagraph (O), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="id868267d9b52945a3b342731ad6b47b8c"><enum>(2)</enum><text>in subparagraph (P), by inserting <quote>and</quote> after the semicolon; and</text></paragraph><paragraph id="id19b876e153364bfbbb24c09531cb52fd"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbe245d99e0494463a69b7adb9be41023"><subparagraph id="idaaa9e83508c2452ab2192d9dd1856cff" indent="up1"><enum>(Q)</enum><text>in the case of a preventive home visit as defined in section 1861(nnn), which is provided more frequently than is covered under such section.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide5f6fc74fb2d4094ad03eee2dc853536"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to services furnished on or after January 1, 2025.</text></subsection></section></legis-body></bill>
