<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 2939</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230927" legis-day="20230922">September 27 (legislative day, September 22), 2023</action-date><action-desc><sponsor name-id="S396">Mrs. Blackburn</sponsor> (for herself and <cosponsor name-id="S388">Ms. Hassan</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to require reporting on enforcement and oversight of pharmacy access requirements under Medicare part D.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pharmacy Access Oversight and Reporting Act</short-title></quote>.</text></section><section id="id9fb23dd979094f9a90019d1cf716b2fa"><enum>2.</enum><header>Reporting on enforcement and oversight of pharmacy access requirements</header><text display-inline="no-display-inline">Section 1860D–42 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-152">42 U.S.C. 1395w–152</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id99AFD74846FF42A5AA4F63BA646891B7"><subsection id="id113dc0ae09d3484e88774c8011c77ab9"><enum>(e)</enum><header>Biennial report on enforcement and oversight of pharmacy access requirements</header><paragraph commented="no" display-inline="no-display-inline" id="id959c2bb679754d78982fff89a2cd6838"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 2 years after the date of enactment of this subsection, and at least once every 2 years thereafter, the Secretary shall publish a report on enforcement and oversight actions and activities undertaken by the Secretary with respect to the requirements under section 1860D–4(b)(1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id643bb896b1ed4d3392bbfc79cbdb2589"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">A report under paragraph (1) shall not disclose—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc5b550598a73433a80d448f89d629661"><enum>(A)</enum><text display-inline="yes-display-inline">identifiable information about individuals or entities unless such information is otherwise publicly available; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf400cfbe38584be8808c2be627fde4bc"><enum>(B)</enum><text display-inline="yes-display-inline">trade secrets with respect to any entities.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
