which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To increase the rate of duty applicable to certain ferrosilicon produced in the Russian Federation or the Republic of Belarus and to require a domestic production assessment before increasing rates of duty applicable to products of the Russian Federation and the Republic of Belarus under the Suspending Normal Trade Relations with Russia and Belarus Act, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Increasing American Ferrosilicon Production Act</short-title></quote>.</text></section><section id="ide2ed55f9d8624452b8990799b1603e6e"><enum>2.</enum><header>Increase in rate of duty for certain ferrosilicon imported from the Russian Federation and the Republic of Belarus</header><subsection commented="no" display-inline="no-display-inline" id="id9a81c5081b5f470b86b77eef826e6397"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Pursuant to the authority provided by section 3(b) of the Suspending Normal Trade Relations with Russia and Belarus Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/110">Public Law 117–110</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/19/2434">19 U.S.C. 2434</external-xref> note), the President shall proclaim an increase in the rate of duty applicable to ferrosilicon described in subsection (b) to 35 percent ad valorem.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idb0d6a93106a5444da6ebdfd9095c8670"><enum>(b)</enum><header>Ferrosilicon described</header><text>Ferrosilicon described in this subsection is ferrosilicon—</text><paragraph commented="no" display-inline="no-display-inline" id="id74621fdb8ae1479fbe005833d30305ea"><enum>(1)</enum><text display-inline="yes-display-inline">classified under subheading 7202.21.50 of the Harmonized Tariff Schedule of the United States; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida23b61a3674849c18cc19d6fdcf8391a"><enum>(2)</enum><text display-inline="yes-display-inline">produced in the Russian Federation or the Republic of Belarus.</text></paragraph></subsection></section><section id="id789dcf61e4644c64b63b481295051212"><enum>3.</enum><header>Modification of authority to proclaim increased rates of duty for products of the Russian Federation and the Republic of Belarus</header><subsection id="ida353f688d4d1469a9f06199f6f0d6120"><enum>(a)</enum><header>Requirement for domestic production assessment</header><text display-inline="yes-display-inline">Section 3(b) of the Suspending Normal Trade Relations with Russia and Belarus Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/110">Public Law 117–110</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/19/2434">19 U.S.C. 2434</external-xref> note) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ida35de73b32784049b228d0494ee8cdbd"><enum>(1)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (3) and (4), respectively; and</text></paragraph><paragraph id="idf1abaa959a734382aca1758d3b38c6d7"><enum>(2)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb025978a9cf443d3b1527c992917e586"><paragraph id="idb841d32e31d04fc1a73bc52fc154a6b2"><enum>(2)</enum><header>Domestic production assessment</header><subparagraph id="idc2a813f1d35d46b1b038ad80fe655ebe"><enum>(A)</enum><header>Comment period</header><text>Not later than 30 days after the date of the enactment of the <short-title>Increasing American Ferrosilicon Production Act</short-title>, the United States Trade Representative shall publish in the Federal Register a notice providing for a comment period, which shall remain open until the date specified in paragraph (4), for the submission of comments regarding—</text><clause id="id78536730744a403080b1cc9dcf7e45e4"><enum>(i)</enum><text>which products of the Russian Federation or the Republic of Belarus are also produced in the United States; and</text></clause><clause id="id7ea44389d20842f8976828ab2a3f7902"><enum>(ii)</enum><text>for each such product—</text><subclause commented="no" display-inline="no-display-inline" id="ida1f6fe53934440f1bccbdf102fece363"><enum>(I)</enum><text display-inline="yes-display-inline">the ability of United States producers to increase production to meet demand in the United States for the product, accounting for any projected decreases in imports of the product from the Russian Federation or the Republic of Belarus that would result from increased rates of duty proclaimed under paragraph (1) with respect to such imports; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idadb36f30bfda4c9982bd1e8fcdde3788"><enum>(II)</enum><text>data supporting information submitted under subclause (I).</text></subclause></clause></subparagraph><subparagraph id="id37bbe841be8545b2a8aafe01e7f87e8a"><enum>(B)</enum><header>Notification to congress</header><text>If, based on an assessment of comments submitted under subparagraph (A), the Trade Representative determines that United States producers have the ability to increase production to meet United States demand for a product described in clause (i) of that subparagraph, the Trade Representative shall—</text><clause id="idb2c0d14979c24307aeb4a1ac702a5e79"><enum>(i)</enum><text>notify Congress;</text></clause><clause id="idb294bcb18e99424c8ed0933c64bba19e"><enum>(ii)</enum><text>indicate whether the President will proclaim an increase in the rate of duty applicable to imports of the product from the Russian Federation or the Republic of Belarus under paragraph (1); and</text></clause><clause id="id799d83a6369d4ea193228e59167541e3"><enum>(iii)</enum><text>if the President will not proclaim such an increase, explain the reasoning for the decision not to proclaim such an increase.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idc53f00a1ce4646b481134f6563e8b22b"><enum>(b)</enum><header>Extension of authority</header><text display-inline="yes-display-inline">Paragraph (4) of section 3(b) of the Suspending Normal Trade Relations with Russia and Belarus Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/110">Public Law 117–110</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/19/2434">19 U.S.C. 2434</external-xref> note), as redesignated by subsection (a)(2), is further amended by striking <quote>2024</quote> and inserting <quote>2025</quote>.</text></subsection></section></legis-body></bill>
