which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish as a permanent program the organic market development grant program of the Department of Agriculture.</official-title></form><legis-body><section id="id1c6d09f1069e448580525b5b5a6f94d3" section-type="section-one"><enum>1.</enum><header>Organic market development grant program</header><subsection commented="no" display-inline="no-display-inline" id="idac4fe5f92ccc4d15aaf0ca12ed587e84"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="ided22361719cc457da5fb011d791c9a42"><enum>(1)</enum><header display-inline="yes-display-inline">Certified organic product</header><text>The term <term>certified organic product</term> means an agricultural product (as defined in section 2103 of the Organic Foods Production Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6502">7 U.S.C. 6502</external-xref>)) that is organically produced (as defined in that section). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id56ae6e2eb76e426783b1cbccd53ed975"><enum>(2)</enum><header>Eligible entity</header><subparagraph commented="no" display-inline="no-display-inline" id="idd75a81e60621467b89d82750917c1072"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The term <term>eligible entity</term> means an entity described in subparagraph (B) that—</text><clause commented="no" display-inline="no-display-inline" id="idbc685a76df1d4bef937a851cfdab3b12"><enum>(i)</enum><text display-inline="yes-display-inline">is owned and operated within—</text><subclause commented="no" display-inline="no-display-inline" id="idc0df63824b9b4281a7495c1682e9ed77"><enum>(I)</enum><text display-inline="yes-display-inline">a State;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0dc9294ae5294f7dafb48dc785495a05"><enum>(II)</enum><text>the District of Columbia;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3cc81081d26342568c2616321d1553f7"><enum>(III)</enum><text display-inline="yes-display-inline">the Commonwealth of Puerto Rico;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idf4452e5da873495daaae0e4050b3049f"><enum>(IV)</enum><text display-inline="yes-display-inline">the United States Virgin Islands;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idf4da5fa4a09c4b35a23cd8ea6dfb8cfd"><enum>(V)</enum><text display-inline="yes-display-inline">Guam;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="iddb7286e3e2494062a599e565617c472d"><enum>(VI)</enum><text display-inline="yes-display-inline">American Samoa;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id7934328ad9604d178a108726da2fdd2b"><enum>(VII)</enum><text display-inline="yes-display-inline">the Commonwealth of the Northern Mariana Islands; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide97434ed6e1941b5a6a10f271c4480df"><enum>(VIII)</enum><text>the jurisdiction of a Tribal government; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idcea3e569b32e4d89812085a21a440b00"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idc3de54e6b9474065bd4aec490a0d2e44"><enum>(I)</enum><text display-inline="yes-display-inline">is certified in accordance with subpart E of part 205 of title 7, Code of Federal Regulations (or successor regulations); or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id6540427d75184e6397097cb0b5fde365" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">is in transition to certification.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3b34385a771e4ece87a704f7455e36ac"><enum>(B)</enum><header>Entities described</header><text display-inline="yes-display-inline">An entity referred to in subparagraph (A) is—</text><clause id="idaa3220a312df4154a1c7309cf2dd270b"><enum>(i)</enum><text>a producer, producer cooperative, or other commercial entity that produces or handles certified organic products;</text></clause><clause id="idf11e8df9f0c1444b88da2f851cd49f5f"><enum>(ii)</enum><text>a nonprofit corporation;</text></clause><clause commented="no" display-inline="no-display-inline" id="idff0ed06ba15f474e9b378278c75f809f"><enum>(iii)</enum><text display-inline="yes-display-inline">a trade association;</text></clause><clause id="id9ce5fbcd0e86426e9151f523f285f394"><enum>(iv)</enum><text>a public benefit corporation;</text></clause><clause id="id9b0ddb409fac4e9bb1c8f7c171265778"><enum>(v)</enum><text>a philanthropic organization;</text></clause><clause id="id1210736adbf748c5ba0969af99bebc98"><enum>(vi)</enum><text>a unit of Tribal, State, territorial, or local government; or</text></clause><clause id="idd203f0ff6a73473188d7698037a5b62b"><enum>(vii)</enum><text>such other entity as the Secretary may designate.</text></clause></subparagraph><subparagraph id="idc43f4df7fde04c66a7417d4c48a5f962"><enum>(C)</enum><header>Exclusion</header><text>The term <term>eligible entity</term> does not include an entity described in subparagraph (B) the operations of which are suspended or revoked under section 205.662 of title 7, Code of Federal Regulations (or a successor regulation).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id91e1ca247bd44eb9bd0931daf04cd988"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph><paragraph id="id2271e0ef8e34445d93d174f8ab5d0270"><enum>(4)</enum><header>Transition to certification</header><text>The term <term>transition to certification</term>, with respect to an eligible entity, means the period of time during which the crops or livestock of the eligible entity, as applicable, are managed in accordance with the requirements of the National Organic Program before being granted organic certification, which may include—</text><subparagraph id="id12441ed769064294963025678bf22c98"><enum>(A)</enum><text>the management of cropland organically for not less than 3 years;</text></subparagraph><subparagraph id="idb66087f7be1846859c827e997e1950c2"><enum>(B)</enum><text>the management of slaughter of livestock organically from the last third of gestation;</text></subparagraph><subparagraph id="id43478d18cde244bcb27fa246f47ac768"><enum>(C)</enum><text>the management of dairy animals organically for not less than 1 year;</text></subparagraph><subparagraph id="id21263096cd2440c88ca13da06fd303cb"><enum>(D)</enum><text>the management of poultry organically from the second day of life; and</text></subparagraph><subparagraph id="idea97ad34f0284c84b6013858f8b5209c"><enum>(E)</enum><text>such other conditions as the Secretary may require.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1bc33ed165084654ae29d8b0ee3b1938"><enum>(b)</enum><header>Establishment and purpose</header><text>The Secretary, acting through the Administrator of the Agricultural Marketing Service, shall establish a program, to be known as the <quote>Organic Market Development Grant Program</quote>, that—</text><paragraph id="id4d6b3890a7e240e89a87c1991cf23963"><enum>(1)</enum><text>increases the capacity of the domestic organic product supply chain for producers, handlers, suppliers, and processors of certified organic products;</text></paragraph><paragraph id="ida8b10d55ac3c43a09cc29aba3264281f"><enum>(2)</enum><text>modernizes manufacturing, tracking, storage, and information technology systems specific to the purposes described in this subsection, such as process control or organic product ingredient tracking systems;</text></paragraph><paragraph id="id9af72c5f927147648631e7f1e4a45ca1"><enum>(3)</enum><text>improves the capacity of eligible entities to comply with applicable regulatory requirements or quality standards required to access markets, such as requirements and standards relating to food safety and organic product certification;</text></paragraph><paragraph id="id03a4fc00936b460cb348a5e8f2a3ecf4"><enum>(4)</enum><text>expands capacity for storage, processing, aggregation, and distribution of certified organic products to create more and better markets for producers of certified organic products;</text></paragraph><paragraph id="id2c7a16ed8a2f470a9b41d7cd01b0442b"><enum>(5)</enum><text>facilitates market development for domestically produced certified organic products;</text></paragraph><paragraph id="id6cdea02749374b1e982c940c799584dd"><enum>(6)</enum><text>provides for the conduct of feasibility studies and market viability assessments to inform organic transition strategies and opportunities;</text></paragraph><paragraph id="idd8ceffae52d94e508b429cc0b64534e0"><enum>(7)</enum><text>ameliorates barriers to entry to organic product certification for historically underserved entities;</text></paragraph><paragraph id="id4ebeac77a8dd48df85040cb811f85f27"><enum>(8)</enum><text>supports market and promotional activities that help build commercial markets for certified organic products in the United States; and</text></paragraph><paragraph id="id0d7136efcdc7405bb19226d858b85aeb"><enum>(9)</enum><text>provides technical assistance and outreach to program stakeholders and participants.</text></paragraph></subsection><subsection id="id93f53252363c49b7979e9aa67e898b40"><enum>(c)</enum><header>Grants</header><text>For each fiscal year for which amounts are made available to carry out this section under subsection (k), the Secretary shall provide grants to support eligible entities in conducting activities in accordance with the purposes of the program described in subsection (b).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idc9ea8ff1f47b41c3ab678a321f967bef"><enum>(d)</enum><header>Applications</header><paragraph commented="no" display-inline="no-display-inline" id="id35e31cce63684ee69df5978add673039"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>To be eligible to receive a grant under this section, an eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida777bdac2d5943bbbeeaaa0c57ae99ca"><enum>(2)</enum><header>Simplified process</header><text display-inline="yes-display-inline">The Secretary shall implement a simplified application and award process under this section for use by any eligible entity seeking to carry out an equipment-only project.</text></paragraph><paragraph id="id5411364a04ad4b9aba4576179b41ff35"><enum>(3)</enum><header>Benefits</header><subparagraph id="id74dfdb4c487c46d8b8ca59a9f4960055"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), an application submitted under this subsection shall include a description of the direct or indirect producer or food business benefits intended by the eligible entity to result from the proposed project within a reasonable period of time after the receipt of a grant under this section.</text></subparagraph><subparagraph id="id6175254310654e61924daabf4cba171e"><enum>(B)</enum><header>Exception</header><text>Subparagraph (A) shall not apply to any feasibility study or market viability assessment conducted pursuant to this section.</text></subparagraph></paragraph><paragraph id="id3d90d5ea7d4c4439b50a56289f233b7b"><enum>(4)</enum><header>Criteria</header><text>The Secretary shall establish such criteria for the evaluation and funding of proposed projects under this section as the Secretary determines to be appropriate.</text></paragraph><paragraph id="id5f23112b0fd545ce8b0d70256479bf53"><enum>(5)</enum><header>Competitive process</header><text>The Secretary—</text><subparagraph id="idb8956efb15f14c7c892b51a34f80831d"><enum>(A)</enum><text>shall conduct a competitive process to select applications submitted under this subsection;</text></subparagraph><subparagraph id="id24afa6467a1646c99a67bfb78746411d"><enum>(B)</enum><text>may assess and rank applications with similar purposes as a group; and</text></subparagraph><subparagraph id="iddc8b3feba0f0487d9957687a0e8981b3"><enum>(C)</enum><text>before accepting any application under this subsection, shall publish the criteria to be used in evaluating the applications.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9b0652327cd9480cb10441c1cfef6f88"><enum>(e)</enum><header display-inline="yes-display-inline">Project types</header><text>An eligible entity may use amounts received under this section to carry out, in accordance with such goals and deadlines for completion as the Secretary may establish, the following types of projects:</text><paragraph id="idb90af0f8bdd24d76a698cfb9a70de27f"><enum>(1)</enum><text>Market development and promotion of certified organic products.</text></paragraph><paragraph id="id10ee1fa09a574992988f306a8f0497ce"><enum>(2)</enum><text>Certified organic product storage (including cold storage), aggregation, processing, and distribution capacity expansion.</text></paragraph><paragraph id="idbe8f837a41f445ae95f7add1bbc9ae3f"><enum>(3)</enum><text>Equipment-only.</text></paragraph></subsection><subsection id="id13bac12296ca474ebe5bcad38d37ccfc"><enum>(f)</enum><header>Term</header><text>Unless otherwise determined by the Secretary, a grant provided under this section shall have a term of not longer than 3 years. </text></subsection><subsection id="id1480fc76077b42e08f9bd6899cae44bb"><enum>(g)</enum><header>Maximum amount</header><paragraph commented="no" display-inline="no-display-inline" id="id0067e17408824bd59cceaa0d567656b7"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The amount of a grant provided under this section for a project described in paragraph (1) or (2) of subsection (e) shall be not more than $3,000,000.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9f214d80c6ba45b6a5a0330168b597f1"><enum>(2)</enum><header display-inline="yes-display-inline">Simplified equipment-only projects</header><text>The amount of a grant provided under this section for a project described in subsection (e)(3) shall be not more than $100,000.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id552e82c15b614d2abdcf2d0086b8198f"><enum>(h)</enum><header>Matching funds</header><paragraph commented="no" display-inline="no-display-inline" id="id4309d20d060d4d898cfe720707169865"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>An eligible entity that receives a grant under this section to carry out a project described in paragraph (1) or (2) of subsection (e) shall provide a non-Federal share equal to not less than 50 percent of the cost of the project.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id40A23F975F7B46619427A28342E18AD7"><enum>(2)</enum><header display-inline="yes-display-inline">Simplified equipment-only projects</header><text>An eligible entity that receives a grant under this section to carry out a project described in subsection (e)(3) shall not be required to contribute a non-Federal share to the cost of the project.</text></paragraph></subsection><subsection id="idcd6c092d93844064a6f0ca0ca32257f3"><enum>(i)</enum><header>Inapplicability of prior limitations</header><paragraph id="id23b6dffe0dc244b48d6028c8f745133f"><enum>(1)</enum><header>Quantity</header><text>The Secretary may provide a grant under this section to more than 1 eligible entity, as the Secretary determines to be appropriate.</text></paragraph><paragraph id="idd20120e32ad741b584b5751a772c80c5"><enum>(2)</enum><header>Construction and structural changes</header><text>A grant provided under this section may be used by an eligible entity for—</text><subparagraph id="idfc9875b8cd784bdca9709c2223945be6"><enum>(A)</enum><text>new construction; or</text></subparagraph><subparagraph id="idd9edf13646e840a28c05a1071de22366"><enum>(B)</enum><text>any structural modification to an existing building or facility resulting in—</text><clause id="id98122e6d5d614a1ba613a626a457aafe"><enum>(i)</enum><text>an expansion in the square footage of the building or facility; or</text></clause><clause id="id487536131e624b3eb0a1b2d1887fa202"><enum>(ii)</enum><text>a change to the floor, the foundation, or an exterior or load-bearing wall of the building or facility.</text></clause></subparagraph></paragraph></subsection><subsection id="ida582e032f95c405482f9df53dbdcd83a"><enum>(j)</enum><header>Technical assistance</header><text>The Secretary may provide to eligible entities technical assistance under this section, directly or through a cooperative agreement. </text></subsection><subsection id="id593e306a5b944515a2543d99b5567c7b" commented="no"><enum>(k)</enum><header>Funding</header><paragraph commented="no" display-inline="no-display-inline" id="idb797f3e3e3f942c7902aab0fe4d36e7d"><enum>(1)</enum><header>Mandatory funding</header><text display-inline="yes-display-inline">Of the funds of the Commodity Credit Corporation, the Secretary shall use to carry out this section $75,000,000 for fiscal year 2024 and each fiscal year thereafter, to remain available until expended.</text></paragraph><paragraph id="id6982138bc6cd4cc78c78c5cc3851d3fd"><enum>(2)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $25,000,000 for fiscal year 2024 and each fiscal year thereafter, to remain available until expended. </text></paragraph></subsection></section></legis-body></bill>
