<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 2921</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230926" legis-day="20230922">September 26 (legislative day, September 22), 2023</action-date><action-desc><sponsor name-id="S411">Mr. Marshall</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Internal Revenue Code of 1986 to permit 529 plans to be used for certain non-degree technical training certificate programs, apprenticeship programs, and other training programs.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HCAA50DC2779E4205A6A48AB42C26D568"><section section-type="section-one" id="HBB4C751CA5854AD997CFC58E67356FF8"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Workforce Empowerment Act</short-title></quote>.</text></section><section id="H60A49261444A43DD83DD92036323E74E"><enum>2.</enum><header>529 account funding for non-degree technical training certificate programs, apprenticeship programs, and other training programs</header><subsection id="H34C9607A610B41B0B5570C80C6DE871C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (8) of <external-xref legal-doc="usc" parsable-cite="usc/26/529">section 529(c)</external-xref> of the Internal Revenue Code of 1986 is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC785B4C9BD1B48F9A587A1281726C9AA"><paragraph id="HDD96DFF860D14285ADEC7B78602EDDEE"><enum>(8)</enum><header>Treatment of certain expenses associated with technical training certificate programs, registered apprenticeship programs, and other training programs</header><text>Any reference in this subsection to the term <term>qualified higher education expense</term> shall include a reference to expenses for fees, books, supplies, and equipment required for the participation of a designated beneficiary in—</text><subparagraph id="H10163A8F65464296ACA21CA395F58615"><enum>(A)</enum><text display-inline="yes-display-inline">an apprenticeship program registered and certified with the Secretary of Labor under the Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship Act</quote>; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50 et seq.</external-xref>),</text></subparagraph><subparagraph id="id191cc91d86fe4acf910f281556685d15"><enum>(B)</enum><text>a preapprenticeship program as defined in section 681.480 of title 20, Code of Federal Regulations (or any succeeding regulation),</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcb710c9a13f045f0953741fe82b2ae4e"><enum>(C)</enum><text>a program of high school career and technical education (as the terms <term>high school</term> and <term>career and technical education</term> are defined in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/29/2302">29 U.S.C. 2302</external-xref>)), or</text></subparagraph><subparagraph id="H333E84F29A494B89AD8B94FAA10D5682"><enum>(D)</enum><text display-inline="yes-display-inline">obtaining or maintaining a recognized postsecondary credential as defined in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>), including testing and other fees required by the organization issuing the recognized postsecondary credential as a condition of obtaining or maintaining the credential.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="H5DE37E8390BA4E4096ECA5BC268CF9C0"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to expenses paid or incurred after the date of the enactment of this Act for programs beginning after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
