which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To deny asylum to members of a Communist or other totalitarian party, and for other purposes.</official-title></form><legis-body><section id="id3c2856412e5547bc857abb8ba93d9b7d" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Asylum for CCP Spies Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idacbacb710a764104939d605b33e9da64" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Denial of asylum to members of a Communist or other totalitarian party</header><text display-inline="no-display-inline">Section 208(b)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158(b)(2)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ida2483fbc453c4e00910810e8cae1baf7"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfacbfaf8051e4696b2cd72f0a29a8836"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (v), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf4821f24ade84b0a8672efc519e4e086"><enum>(B)</enum><text display-inline="yes-display-inline">in clause (vi), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7722209b474a4c8b91ba5863d41b286a"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5B91134265BA465F95B33AB1A4EA964F"><clause commented="no" display-inline="no-display-inline" id="id8513891b886a4dde9bf63992f811abe8"><enum>(vii)</enum><text display-inline="yes-display-inline">the alien is described in section 212(a)(3)(D)(i), except as provided in subparagraph (B)(iii) and subject to </text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id20029ed413c843298bcecc8f1cd83017"><enum>(2)</enum><text>in subparagraph (B), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id25EDB08C82D74FB4B3591AF660F78992"><clause id="idbcb48754c25d4ae98f4e007a1d3255d0"><enum>(iii)</enum><header>Exception to party membership</header><subclause commented="no" display-inline="no-display-inline" id="id70f645a14a6a476f8d24863061addf56"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (A)(vii), an alien who is described in section 212(a)(3)(D)(i) may be granted asylum pursuant to paragraph (1) if—</text><item id="id61f1c2501b0d41d68c15a609416d9d12"><enum>(aa)</enum><text>the alien—</text><subitem commented="no" display-inline="no-display-inline" id="id57e4f097746e4e238fe158a62fabf4ab"><enum>(AA)</enum><text display-inline="yes-display-inline">has, before applying for asylum and through a service approved by the Federal Government, publicly renounced his or her membership in the Communist or totalitarian party of which the alien was a member or with which the alien was affiliated and denounces such party during the asylum adjudication process; and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="IDC328AD10FE344C6D8505C119001405D5"><enum>(BB)</enum><text display-inline="yes-display-inline">establishes, to the satisfaction of the Attorney General or the Secretary of Homeland Security, that the membership or affiliation of the alien with a Communist or totalitarian party is or was involuntary, limited to a period when the alien was younger than 16 years of age, automatic, by operation of law, without the alien's personal acquiescence, or solely for the purpose of obtaining employment, food rations, or other living essentials; and</text></subitem></item><item id="ide3938457b3f847e1a2033366a4c91af3"><enum>(bb)</enum><text>the Attorney General or the Secretary of Homeland Security, in consultation with the Director of National Intelligence, determines that the alien is not a danger to the security of the United States.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id17efbe2d070d4aa3ad53142c925c979a"><enum>(iv)</enum><header>Waiver</header><subclause commented="no" display-inline="no-display-inline" id="ide667213feef9489d993e51e260ae5a38"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of an alien described in section 212(a)(3)(D)(i) who is not eligible for asylum under clause (iii), the Attorney General or the Secretary of Homeland Security may waive the application of such section if the Attorney General or the Secretary, in consultation with the Director of National Intelligence, determines that such alien has significant information relating to national security.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id1a39aa98e6f94e1ea7cde869c6968aac"><enum>(II)</enum><header>Conditions</header><text display-inline="yes-display-inline">An alien may only be granted a waiver under this clause if—</text><item commented="no" display-inline="no-display-inline" id="idc4b8e16f16b04ecabf56d0171c831123"><enum>(aa)</enum><text display-inline="yes-display-inline">the alien, through a service approved by the Federal Government, publicly renounces his or her membership in the Communist or totalitarian party of which the alien was a member or with which the alien was affiliated and denounces such party during the asylum adjudication process; and </text></item><item commented="no" display-inline="no-display-inline" id="idcadab48d082048e3814f802296dd7335"><enum>(bb)</enum><text display-inline="yes-display-inline">the Attorney General or the Secretary of Homeland Security, in consultation with the Director of National Intelligence, determines that the alien is not a danger to the security of the United States.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
