which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Consolidated Farm and Rural Development Act to modify limitations on amounts of farm ownership loans and operating loans, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Producer and Agricultural Credit Enhancement Act of 2023</short-title></quote>.</text></section><section id="id309AB99DECEC4854BCD5D3DA0B1569F3"><enum>2.</enum><header>Limitations on loan amounts</header><subsection id="id63B391EB0BBB4C099298554088C221A1"><enum>(a)</enum><header>Limitations on amount of farm ownership loans</header><text display-inline="yes-display-inline">Section 305(a)(2) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1925">7 U.S.C. 1925(a)(2)</external-xref>) is amended by striking <quote>$600,000, or, in the case of a loan guaranteed by the Secretary, $1,750,000 (increased, beginning with fiscal year 2019</quote> and inserting <quote>$850,000, or, in the case of a loan guaranteed by the Secretary, $3,000,000 (increased, beginning with fiscal year 2023</quote>.</text></subsection><subsection id="id729E094EFA344BBAABA46A228AC94654"><enum>(b)</enum><header>Limitations on amount of operating loans</header><text display-inline="yes-display-inline">Section 313(a)(1) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1943">7 U.S.C. 1943(a)(1)</external-xref>) is amended by striking <quote>$400,000, or, in the case of a loan guaranteed by the Secretary, $1,750,000 (increased, beginning with fiscal year 2019</quote> and inserting <quote>$750,000, or, in the case of a loan guaranteed by the Secretary, $2,600,000 (increased, beginning with fiscal year 2023</quote>. </text></subsection></section><section commented="no" display-inline="no-display-inline" id="id0567b1c2aa254d3982a076422a7987aa"><enum>3.</enum><header>Inflation percentage</header><text display-inline="no-display-inline">Section 305(c) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1925">7 U.S.C. 1925(c)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idc2227d11a0944907b6ad24fbf4b13804"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>of the Prices Paid By Farmers Index (as compiled by the National Agricultural Statistics Service of the Department of Agriculture) for the 12-month period ending on July 31 of the immediately preceding fiscal year</quote> and inserting <quote>of the per acre average United States farm real estate value, the per acre average United States cropland value, and the per acre average United States pasture value for the preceding year (as published in the applicable Agricultural Land Values report of the National Agricultural Statistics Service of the Department of Agriculture), weighted equally</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1d1365a98d674852a9c67e1322c28c1d"><enum>(2)</enum><text>in paragraph (2), by striking <quote>of such index (as so defined) for the 12-month period that immediately precedes the 12-month period described in paragraph (1)</quote> and inserting <quote>of the per acre average United States farm real estate value, the per acre average United States cropland value, and the per acre average United States pasture value for the year immediately preceding the year described in paragraph (1) (as so published), weighted equally</quote>.</text></paragraph></section><section id="id827D176AA4574970A11659AD6B20A03B"><enum>4.</enum><header>Down payment loan program</header><text display-inline="no-display-inline">Section 310E(b)(1) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1935">7 U.S.C. 1935(b)(1)</external-xref>) is amended—</text><paragraph id="idDF8E2FF170E6452BAB04E823BEA2F934"><enum>(1)</enum><text>in the matter preceding subparagraph (A), by striking <quote>exceed 45 percent of the least</quote> and inserting <quote>exceed, subject to section 305(a), 45 percent of the lesser</quote>;</text></paragraph><paragraph id="id58624D5EB98B4B43927EEBC08EF915CC"><enum>(2)</enum><text>in subparagraph (A), by adding <quote>or</quote> after the semicolon; </text></paragraph><paragraph id="idE71CF506175A403AB0EDCB7AF656C4D1"><enum>(3)</enum><text>in subparagraph (B), by striking <quote>; or</quote> and inserting a period; and</text></paragraph><paragraph id="id158C48CEAD984CC392B63F8A32B8D4E8"><enum>(4)</enum><text>by striking subparagraph (C).</text></paragraph></section><section id="id5c0c99257e4a4fdba0ce09fd01e633dc"><enum>5.</enum><header>Limitation on microloan amounts</header><text display-inline="no-display-inline">Section 313(c)(2) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1943">7 U.S.C. 1943(c)(2)</external-xref>) is amended by striking <quote>$50,000</quote> and inserting <quote>$100,000</quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id8ffc3a0eaaba498a8754262165ed3f71"><enum>6.</enum><header>Refinancing of guaranteed loans into direct loans</header><subsection commented="no" display-inline="no-display-inline" id="id7c01961c75ad4f87bf0eb4d910ecf12b"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Agriculture, acting through the Administrator of the Farm Service Agency (referred to in this section as the <term>Secretary</term>), shall promulgate regulations allowing certain loans guaranteed by the Farm Service Agency to be refinanced into direct loans issued by the Farm Service Agency, in accordance with this section.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idb21500c16c794275935ac2c57872ddc2"><enum>(b)</enum><header>Requirements</header><paragraph commented="no" display-inline="no-display-inline" id="id2602e670283641eb98c538de6deef021"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The regulations promulgated under subsection (a) shall provide that a guaranteed loan described in that subsection may be refinanced into a direct loan described in that subsection only if the Secretary determines that—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide51538663bee45b2953081b6d9768739"><enum>(A)</enum><text>the guaranteed loan is distressed;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0909637a35994c78a4f1a73c9050a2ac"><enum>(B)</enum><text>the borrower on that guaranteed loan has attempted to work with the lender and has been unsuccessful;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8ccc2bc9d74f48d08feb917a9a68a285"><enum>(C)</enum><text>a reasonable chance for the success of the operation financed by the guaranteed loan exists; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ided08fb10539d472bba89ccf598805057"><enum>(D)</enum><text>all other criteria established by the Secretary for purposes of this section to protect taxpayer funds and the loan programs of the Farm Service Agency have been satisfied.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide43951380a104ab887bf7fc8ff0e372a"><enum>(2)</enum><header>Reasonable chance of success</header><text>For purposes of paragraph (1)(C), the Secretary may determine that a reasonable chance for the success of an operation exists if the Secretary determines that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id215c61ff51084adab338991308b6c141"><enum>(A)</enum><text>all relevant problems with the operation financed by the guaranteed loan—</text><clause commented="no" display-inline="no-display-inline" id="ida42d095458db425da47203ea4e0bf148"><enum>(i)</enum><text display-inline="yes-display-inline">have been identified; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id9ab057caf69b4615b0ae047af5994b7e"><enum>(ii)</enum><text display-inline="yes-display-inline">can be corrected; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id655112ca2e8b4290a7b0a0c8ad06166c"><enum>(B)</enum><text>on correction of those problems, the operation can achieve, or be returned to, a sound financial basis.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8d57d14ded5b4b319ba76d4d13ee047e"><enum>(c)</enum><header>No effect on subsidies</header><text>In carrying out this section, the Secretary shall ensure that the refinancing of guaranteed loans into direct loans has no impact on the subsidy rate of—</text><paragraph commented="no" display-inline="no-display-inline" id="id5c68c68db10f4aa58c0d32510e31bb01"><enum>(1)</enum><text display-inline="yes-display-inline">loans guaranteed by the Farm Service Agency; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id21e92f8acd2b4cd789e3c3c8e6f3f455"><enum>(2)</enum><text>direct loans issued by the Farm Service Agency.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8169426598cf4bc3b3f558a5bc85bea6"><enum>(d)</enum><header>Loan programs</header><text>In making direct loans pursuant to the regulations promulgated under subsection (a), the Secretary may refinance a loan guaranteed under 1 program of the Farm Service Agency into a direct loan issued under another program of the Farm Service Agency, as the Secretary determines to be appropriate and in accordance with the laws applicable to the program under which the new direct loan is issued.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id7ff77f807a984f00a374c7a7ee2b9742"><enum>(e)</enum><header>Maximum amount of direct refinancing loans</header><text>A direct loan issued by the Farm Service Agency pursuant to the regulations promulgated under subsection (a) shall be subject to any otherwise applicable limitation on the maximum amount of a direct loan issued by the Farm Service Agency, including, if applicable, the limitations described in—</text><paragraph commented="no" display-inline="no-display-inline" id="id1c0ae0413b2d4890ab4bec2f4ab61508"><enum>(1)</enum><text display-inline="yes-display-inline">section 305 of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1925">7 U.S.C. 1925</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide122b33fba1a42518d37d551a74d711e"><enum>(2)</enum><text>section 313 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1943">7 U.S.C. 1943</external-xref>).</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idc93f6e91077246f584f91f4398fb2739"><enum>7.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph commented="no" display-inline="no-display-inline" id="id9ae1683ec1fc46d48049ad879042fb30"><enum>(1)</enum><text>access to credit is essential to the success of farmers and ranchers; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id34553dc8a4f14b1a827dc5c9d26bdfc0"><enum>(2)</enum><text>microloans, direct loans, and guaranteed loans provided by the Farm Service Agency should be fully funded to meet producer demand, help beginning farmers and ranchers, and support family farms.</text></paragraph></section></legis-body></bill>
