<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 2881</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230921">September 21, 2023</action-date><action-desc><sponsor name-id="S413">Mr. Padilla</sponsor> (for himself, <cosponsor name-id="S422">Mr. Welch</cosponsor>, <cosponsor name-id="S359">Mr. Heinrich</cosponsor>, <cosponsor name-id="S247">Mr. Wyden</cosponsor>, <cosponsor name-id="S324">Mrs. Shaheen</cosponsor>, <cosponsor name-id="S330">Mr. Bennet</cosponsor>, and <cosponsor name-id="S418">Mr. Fetterman</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Higher Education Act of 1965 to require institutions of higher education to provide notice to students participating in a State or federally financed work-study program about potential eligibility for participation in the supplemental nutrition assistance program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H9EE27D26B03D4940B5112C2C61776506"><section section-type="section-one" id="H0F745111E66843FDA33E491A6155AD2C"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Opportunity To Address College Hunger Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="HB850549C29484EC29F430E4CF0BE45DD"><enum>2.</enum><header>Notification regarding SNAP for students participating in a State or federally financed work-study program</header><text display-inline="no-display-inline">Section 443 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087-53">20 U.S.C. 1087–53</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HDF7874E71D5E44ADAB79A069E90FFC2A"><subsection id="H9A7FF2C0A1014E15A638F3879BCD7E18"><enum>(f)</enum><header>Notification regarding SNAP</header><paragraph display-inline="no-display-inline" id="H9BCFCC597ABD4E429AB263BA15CE258E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An institution receiving a grant under this part shall send a notification (by email or other electronic means) to each eligible student informing the student of their potential eligibility for participation in SNAP and the process for obtaining more information, confirming eligibility, and accessing benefits under that program. The notification shall be developed by the Secretary of Education in consultation with the Secretary of Agriculture, and shall include details on eligibility requirements for participation in SNAP that a student must satisfy. The notification shall be, to the extent practicable, specific to the student’s State of residence and shall provide contact information for the local office where an application for SNAP may be made.</text></paragraph><paragraph id="H956210BFFFE04854ACE149B48D0BC8D0"><enum>(2)</enum><header>Evidence of participation in federally financed work-study program</header><text display-inline="yes-display-inline">The notification under paragraph (1) shall include an official document confirming that the recipient is an eligible student sufficient for purposes of demonstrating that the exclusion from ineligibility for participation in SNAP under section 6(e)(4) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015(e)(4)</external-xref>) applies to the student.</text></paragraph><paragraph id="H744D3676542A43C98EABB6D8A93C9D80"><enum>(3)</enum><header>Guidance</header><text display-inline="yes-display-inline">The Secretary of Education, in consultation with the Secretary of Agriculture, shall provide guidance to States and institutions of higher education on how to identify and communicate with students who are likely to be eligible for SNAP, including those eligible for a State or federally financed work-study program.</text></paragraph><paragraph id="H52FDC55CF81842728CAA88B32B4DAC9F"><enum>(4)</enum><header>Definitions</header><text>For purposes of this subsection:</text><subparagraph id="HA2DE6E71A2F44834B3ED5F64FE5EF7B0"><enum>(A)</enum><text display-inline="yes-display-inline">The term <term>eligible student</term> means a student that is participating in a State or federally financed work-study program.</text></subparagraph><subparagraph id="H45EEF5BCB23F470385A147711AA2006D"><enum>(B)</enum><text display-inline="yes-display-inline">The term <term>SNAP</term> means the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
