which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the prompt reconstruction of and restoration of suspended operation of rural post offices, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Post Office Reconstruction Act of 2023</short-title></quote>.</text></section><section id="id566ce17dc6bb413c8f613c9753247489"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="id071c5f3efa904f59845cececad6af314"><enum>(1)</enum><text>Rural communities rely heavily on post offices for daily life.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcc8ba20d922a49b18e58a1869d9edb0c"><enum>(2)</enum><text display-inline="yes-display-inline">Many rural towns lack access to digital communications and high-speed broadband.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5267726595c34529a26868428c3dfdb7"><enum>(3)</enum><text display-inline="yes-display-inline">The loss of a functioning post office in a rural community jeopardizes vital services, including reliable medical deliveries, payment disbursements, and essential communications.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2604208cf1f64e559291e89d23155735"><enum>(4)</enum><text display-inline="yes-display-inline">Efficiently and promptly rebuilding rural post offices is necessary to ensure individuals retain vital services.</text></paragraph></section><section id="id752fc99f89a34158941eada575e540e0"><enum>3.</enum><header>Reconstruction and restoration of suspended post offices</header><subsection id="id424fa7c127614c37a8453aea33be5863"><enum>(a)</enum><header>Amendment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/4">Chapter 4</external-xref> of title 39, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idAE500E91990A4965994A7CB0A1039496"><section commented="no" display-inline="no-display-inline" id="idf09a4f35eb714838b383dbede176f945"><enum>417.</enum><header>Reconstruction and restoration of suspended post offices</header><subsection commented="no" display-inline="no-display-inline" id="idb512bbea584d4671bcf9e60a4ecb13c0"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph commented="no" display-inline="no-display-inline" id="idebc7d435dc6f4f46a3fb1b87727df6ce"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>damaged rural post office</term> means a rural post office—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb5fb91a110024fdbabff89b3f2f1ec26"><enum>(A)</enum><text display-inline="yes-display-inline">that becomes inoperable or suffers irreparable damage on or after the date that is 2 years before the date of enactment of this section; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4f8dbf79368a449d9d3e7435b85d84af"><enum>(B)</enum><text>for which no alternate suitable quarters exist in the community;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id750f8857d8f14955a9ca02a689fbb642"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>rural post office</term> means a post office located in an area not included within an urban area (as defined by the Bureau of the Census); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7fe808435d82491da13e2b8f03b3c8e9"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>suspended rural post office</term> means a rural post office that suspends operation due to a lease or rental agreement termination on or after the date that is 2 years before the date of enactment of this section.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id77f901a28955447d9f51d44d370f39ea"><enum>(b)</enum><header display-inline="yes-display-inline">Reconstruction</header><paragraph commented="no" display-inline="no-display-inline" id="ide8573250ed0c4be2af7c62c8bd9de70f"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Postal Service shall commence reconstruction of a damaged rural post office, which shall be carried out in consultation with the Administrator of the Federal Emergency Management Agency if the damage is due to a natural disaster—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4810f9734d524d03b7e505ba629cbcf6"><enum>(A)</enum><text display-inline="yes-display-inline">if the damaged rural post office becomes inoperable or suffers irreparable damage on or after the date of enactment of this section, not later than 90 days after the date of such inoperability or irreparable damage; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd16e1015847c439c9a3cd073b4b275eb"><enum>(B)</enum><text display-inline="yes-display-inline">if the damaged rural post office became inoperable or suffered irreparable damage not more than 2 years before the date of enactment of this section, not later than 90 days after the date of such enactment.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idee80cdc860ac45579a6058b3f050324b"><enum>(2)</enum><header>Exception</header><text>The Postal Service shall delay reconstruction of a damaged rural post office under paragraph (1) if individuals directly involved with the reconstruction will be subject to physical injury or undue risk due to the reconstruction efforts until such time as it would be safe for those individuals to proceed with the reconstruction. </text></paragraph></subsection><subsection id="idfcbef7d756934af09edf0d2a88ec1864"><enum>(c)</enum><header>Restoration of suspended operation</header><text>The Postal Service, in consultation with the Administrator of General Services, shall secure a suitable replacement lease or rental agreement for a suspended rural post office—</text><paragraph commented="no" display-inline="no-display-inline" id="id58f9a5670dd749488d89f8781a790e9a"><enum>(1)</enum><text display-inline="yes-display-inline">if the suspended rural post office suspends operation on or after the date of enactment of this section, not later than 90 days after the date of suspension of operation; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9e0fe02ca6d54c97b4bbb1ea75e4d037"><enum>(2)</enum><text display-inline="yes-display-inline">if the suspended rural post office suspended operation not more than 2 years before the date of enactment of this section, not later than 90 days after the date of such enactment.</text></paragraph></subsection><subsection id="id5ab99617d76b4eb592d3589805fc8b89"><enum>(d)</enum><header>Report required</header><text>If the Postal Service does not execute the measures described in subsection (b) or (c) within the time period required under the applicable subsection, the Postmaster General shall submit to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate </committee-name>and the <committee-name committee-id="">Committee on Oversight and Accountability of the House of Representatives</committee-name> a report that—</text><paragraph commented="no" display-inline="no-display-inline" id="idc6350eaf4a244689ab33b9bf32693e1f"><enum>(1)</enum><text display-inline="yes-display-inline">describes in detail the specific reasons why reconstruction of the damaged rural post office or restoration of operation of the suspended rural post office was not performed;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb420ff4203f946d488d7ee8fcf89148d"><enum>(2)</enum><text display-inline="yes-display-inline">describes in detail any remediation efforts for individuals adversely affected by the suspension of mail operations; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id89ec50fed22f4b6a87ec445e2aecfbef"><enum>(3)</enum><text display-inline="yes-display-inline">provides a specific timeline for completion of the reconstruction or restoration of operations, as applicable.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id1f2ae391da884455b79e2eb3c55bc32e"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/4">chapter 4</external-xref> of title 39, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/39/416">section 416</external-xref> the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id26AA1BF9A3C34D06B62A2DD6D1055E12"><toc><toc-entry level="section" bold="off">417. Reconstruction and restoration of suspended post offices.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id60f32a8d138a421496f1a97c844a1024"><enum>4.</enum><header>Funding</header><text display-inline="no-display-inline">No additional funds are authorized to be appropriated to carry out the amendments made by this Act.</text></section><section id="id64b52f31d1b34bc9b7a7c62f038c76db"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall take effect on the date that is 90 days after the date of enactment of this Act. </text></section></legis-body></bill>
