<section section-type="section-one" id="H1E910BC2912B4971827A83A5CAC42508"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fresh Produce Procurement Reform Act of 2023</short-title></quote>.</text></section> <section id="HF33C7FCEF2B24FB0A3A068DB95F98FBC"><enum>2.</enum><header>Contracts for fresh produce</header> <subsection id="HB7B0CBBE5B554378BB5EC2D2F54C0578"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H8884D064CFBA4034854B5BA048857741"><enum>(1)</enum><header>Beginning farmer</header><text>The term <term>beginning farmer</term> has the meaning given the term <quote>beginning farmer or rancher</quote> in section 343(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)</external-xref>). </text></paragraph> <paragraph id="H4A62F95EAE5F45288B24EBD27AEFD8B4"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means an entity that—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id709beb23e440466295284f910a4a6d7c"><enum>(A)</enum><text display-inline="yes-display-inline">is—</text> <clause id="H8272CDC40545421E9162783323475C75" commented="no"><enum>(i)</enum><text>a grower, packer, distributor, or food-hub;</text></clause>
<clause id="H21285162F84D4C57A1DF3A43C4194816" commented="no"><enum>(ii)</enum><text>a nonprofit organization; or</text></clause> <clause id="H8B7D8411262648789C3423A569B1B2C5" commented="no"><enum>(iii)</enum><text>a cooperative; and</text></clause></subparagraph>
<subparagraph id="id91f357ee8fef498ab36f10e16e1c2fca"><enum>(B)</enum>
<clause commented="no" display-inline="yes-display-inline" id="idD877228D9A60444C95C687F2C0ECA934"><enum>(i)</enum><text>is located in the State or locality in which the produce shall be distributed; or</text></clause> <clause id="id565AB3FF778B49E7B82E66280CB9F484" indent="up1"><enum>(ii)</enum><text>has demonstrated experience distributing to that State or locality.</text></clause></subparagraph></paragraph>
<paragraph id="HBCB9CF8300414EA2BF5FEE104C8C9CB0"><enum>(3)</enum><header>Family farm</header><text>The term <term>family farm</term> has the meaning given the term in section 761.2 of title 7, Code of Federal Regulations (as in effect on December 30, 2007).</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idc6d1a3039bfe4f00813032ecb24105a9"><enum>(4)</enum><header>Program</header><text>The term <quote>program</quote> means the program established under subsection (b).</text></paragraph>
<paragraph id="H2EA1197317FF4A45BAA74B1A0BABA44B"><enum>(5)</enum><header>Qualifying entity</header><text>The term <term>qualifying entity</term> means a nonprofit food bank, a nonprofit food pantry, a nonprofit school, a nonprofit child or senior care center, a nonprofit youth-serving community based organization, a Tribal organization, or a public agency that—</text> <subparagraph id="id489B983EA93E4ADDB35B2183C83814C6"><enum>(A)</enum><text>participates in a nutrition program administered by the Secretary, including—</text>
<clause id="idC499142726004861941F6353FDA6F465"><enum>(i)</enum><text>the school lunch program established under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>);</text></clause> <clause id="id9DC4A609807B4376A01BA7D99CEB658D"><enum>(ii)</enum><text>the summer food service program established under section 13 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1761">42 U.S.C. 1761</external-xref>);</text></clause>
<clause id="id0B85473B11FB47AD8EB09F923964BE44"><enum>(iii)</enum><text>the child and adult care food program established under section 17 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766</external-xref>);</text></clause> <clause id="id3353F238DD5B4E1883B57FD0508F3349"><enum>(iv)</enum><text>the food distribution program on Indian reservations established under section 4(b) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2013">7 U.S.C. 2013(b)</external-xref>);</text></clause>
<clause id="idB152E7F93E7B457FA959FC8BDA1D59A7"><enum>(v)</enum><text>the commodity supplemental food program established under section 4 of the Agriculture and Consumer Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/7/612c">7 U.S.C. 612c</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/93/86">Public Law 93–86</external-xref>); and</text></clause> <clause id="idA50490681F904DEEA9F326F939C3007C"><enum>(vi)</enum><text>the emergency food assistance program established pursuant to the Emergency Food Assistance Act of 1983 (<external-xref legal-doc="usc" parsable-cite="usc/7/7501">7 U.S.C. 7501 et seq.</external-xref>); or</text></clause></subparagraph>
<subparagraph id="H18798586A33F47019E4713F20248B189"><enum>(B)</enum><text>does not participate in a nutrition program described in subparagraph (A) but has demonstrated experience in serving the needs of vulnerable populations facing food and nutrition insecurity.</text></subparagraph></paragraph> <paragraph id="H9534C8DD5339464E8E852C7F6174389A"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Administrator of the Agricultural Marketing Service.</text></paragraph>
<paragraph id="H2289D7CEA6094D94A413B5937BA03738"><enum>(7)</enum><header>Socially disadvantaged farmer</header><text>The term <term>socially disadvantaged farmer</term> has the meaning given the term <quote>socially disadvantaged farmer or rancher</quote> in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>). </text></paragraph> <paragraph id="idbeebe15f75fb4d269617ec9f379fd403"><enum>(8)</enum><header>State</header><text>The term <quote>State</quote> means—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id78e53ee0a5074d82834ba734c47fc779"><enum>(A)</enum><text display-inline="yes-display-inline">a State;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id228de3adc2d845269d96743aec369221"><enum>(B)</enum><text display-inline="yes-display-inline">the District of Columbia;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id492e4471842e4f468d87b2fbe39255e4"><enum>(C)</enum><text>an Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)); and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id7bcdd9325dae491db783349924dde5ba"><enum>(D)</enum><text>a territory or possession of the United States.</text></subparagraph></paragraph>
<paragraph id="id2E25A9E0F1094AFB83B3A4016DF8F48A"><enum>(9)</enum><header>Veteran farmer</header><text>The term <term>veteran farmer</term> has the meaning given the term <quote>veteran farmer or rancher</quote> in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>). </text></paragraph></subsection> <subsection id="HA9E7321FE1B84FE9B920327A953894C4"><enum>(b)</enum><header>Establishment</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary, in consultation with the Administrator of the Food and Nutrition Service, shall establish a program under which the Secretary shall enter into contracts with eligible entities to procure fresh produce (excluding legumes) for distribution to qualifying entities that serve individuals at risk of food and nutrition insecurity. </text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="id3c162b8af5bb47a1a3632e76553bcfe8"><enum>(c)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of the program are—</text> <paragraph id="HE9E8A98F433248EC827D9BAD0F31302F"><enum>(1)</enum><text>to increase access of low-income households to a wide variety of fresh produce;</text></paragraph>
<paragraph id="H7BB33288FB2F4355A37B226E61293A91"><enum>(2)</enum><text>to directly connect produce producers and distributors to nonprofit emergency feeding entities;</text></paragraph> <paragraph id="H9A71C3F335DE4E359B280FA1603FDF35"><enum>(3)</enum><text>to increase the procurement of fresh produce by the Federal Government;</text></paragraph>
<paragraph id="H3F90F5FDAEA04F0E8218531209E589F3"><enum>(4)</enum><text>to strengthen the local and regional food supply chain;</text></paragraph> <paragraph id="HC7AABDA6BFA645E4A97AB2C45367F3E4"><enum>(5)</enum><text>to reduce on-farm food loss caused by a market disruption; and</text></paragraph>
<paragraph id="HD784CB9153B94311A65668E1F2106607" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text>to model nimbleness and responsiveness in and out of emergency situations relating to food insecurity, nutrition security, and disruptions to the food supply chain. </text></paragraph></subsection> <subsection id="HDCB4262F56D74B03B328865AF672919F"><enum>(d)</enum><header>Selection</header> <paragraph commented="no" display-inline="no-display-inline" id="idb0ed40df901842e4a959e35add1ff152"><enum>(1)</enum><header>Criteria</header><text display-inline="yes-display-inline">In selecting eligible entities with which to enter into contracts under the program, the Secretary shall consider whether the eligible entity—</text>
<subparagraph id="H4D351D1A24264EF3A12B9931A174DE84"><enum>(A)</enum><text>has demonstrated experience in fresh produce supply chain distribution;</text></subparagraph> <subparagraph id="id506ef877ac9e44f1bb69e92adc4d02e4"><enum>(B)</enum><text>is a small business concern (as defined in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>));</text></subparagraph>
<subparagraph id="id23C3F866C68846BEBD5A59C79BB5CE16"><enum>(C)</enum><text>holds a PACA license, relevant food safety certifications, and any other relevant licenses or certifications, as determined by the Secretary;</text></subparagraph> <subparagraph id="HAB1DAD8C0AE84A93A24F014C11A808E8"><enum>(D)</enum><text>sources from small- and medium-sized growers, and local and regional produce, as geographically and seasonally feasible; </text></subparagraph>
<subparagraph id="id2ca1517ac9984668867e58f15e125e27"><enum>(E)</enum><text>has demonstrated relationships with at least 2 qualifying entities, including a qualifying entity that does not receive resources through the emergency food assistance program established pursuant to the Emergency Food Assistance Act of 1983 (<external-xref legal-doc="usc" parsable-cite="usc/7/7501">7 U.S.C. 7501 et seq.</external-xref>); and </text></subparagraph> <subparagraph id="H3D3C406737E94056B8A96448B9B392FD"><enum>(F)</enum><text>offers the Secretary a price determined by the Secretary to be the overall best value without limiting evaluation factors to lowest price or highest technical rating.</text></subparagraph></paragraph>
<paragraph id="H124BEF6279904CA292F3A833309ED04C"><enum>(2)</enum><header>Priority</header><text>In selecting eligible entities with which to enter into contracts under the program, the Secretary shall give priority to eligible entities that—</text> <subparagraph id="id2D5690736A664898A7BE3B5142B9CD6B"><enum>(A)</enum><text>grow the produce that will be provided and distributed to qualifying entities;</text></subparagraph>
<subparagraph id="H672381E1C15342B199612A6DABF87702"><enum>(B)</enum><text>are, or source from—</text> <clause id="idB382E542878B43458999A5F22BB0C9F8"><enum>(i)</enum><text>beginning farmers;</text></clause>
<clause id="id868D247EEE774A80A2D63001A1652133"><enum>(ii)</enum><text>small or mid-sized farms that are structured as family farms; or</text></clause> <clause commented="no" display-inline="no-display-inline" id="id80f7db8a83ad4687b465ee48f6f256fd"><enum>(iii)</enum><text display-inline="yes-display-inline">socially disadvantaged farmers, including women-owned and veteran-owned eligible entities; and</text></clause></subparagraph>
<subparagraph id="HA33668B1B5204135ADD667EA70EA08FC"><enum>(C)</enum><text>are able to deliver to areas most in need of fresh produce, as determined by the Secretary.</text></subparagraph></paragraph></subsection> <subsection id="HC57ACE17A8754C03BC00542101FE49B8"><enum>(e)</enum><header>Contract terms</header> <paragraph id="id7C36B2591143496EA4C6310EABF90270"><enum>(1)</enum><header>Period of performance</header><text>The period of performance for a contract entered into under the program shall be—</text>
<subparagraph id="HB1EA5F239ED94F02AE60DEE179E406EE"><enum>(A)</enum><text display-inline="yes-display-inline">not less than 90 days; and</text></subparagraph> <subparagraph id="H521FC09DAD5C4D22B4A105B9EE286C6A"><enum>(B)</enum><text display-inline="yes-display-inline">not more than 120 days.</text></subparagraph></paragraph>
<paragraph id="id899D8AD928834BDD808CEBF7F74E2EDD"><enum>(2)</enum><header>Price</header><text>The price paid by the Secretary under a contract entered into under the program shall be inclusive of all transportation and distribution costs associated with delivering fresh produce to the final destination of the applicable qualifying entity. </text></paragraph> <paragraph id="H6A36F60847BD44FCAFC7CD5B53E48BE0"><enum>(3)</enum><header>Produce makeup</header><text>A contract entered into under the program shall require that the fresh produce procured for distribution to a qualifying entity meets the following requirements: </text>
<subparagraph id="H0A072926D7654B9BAB7C90C62FB4C33D"><enum>(A)</enum><text>The fresh produce is grown in the United States.</text></subparagraph> <subparagraph id="HE8BC6189B9B64369BE22C4679FAC8093"><enum>(B)</enum><text>The fresh produce includes locally grown produce as geographically and seasonally feasible, as determined by the Secretary.</text></subparagraph>
<subparagraph id="HE090E46110944360BE2ACEAA3A078D20"><enum>(C)</enum><text>Not fewer than 7 varieties of fresh produce are distributed.</text></subparagraph> <subparagraph id="HF9F4A8586F4C45048CFD9E02BCD4FDD4"><enum>(D)</enum><text>The variety of fresh produce distributed is consistent with the most recent Dietary Guidelines for Americans published under section 301 of the National Nutrition Monitoring and Related Research Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/5341">7 U.S.C. 5341</external-xref>).</text></subparagraph>
<subparagraph id="H7BA530C78CD147B58B0443B8598507B1"><enum>(E)</enum><text>The fresh produce includes specialty crops of cultural importance to the recipients of the fresh produce, as determined by the Secretary, in consultation with the distributing qualifying entity. </text></subparagraph></paragraph> <paragraph id="id00409d5ed1f74adfb6452a03d7da275c"><enum>(4)</enum><header>Payment under contract</header><text>Under a contract entered into under the program, the Secretary shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id49c6bbc3d50e43eb80880397721c22cf"><enum>(A)</enum><text display-inline="yes-display-inline">make a payment to the eligible entity of not less than 30 percent of the contract price in advance of the first distribution of produce under the contract; and </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id6a6f28ff3d3d44759c06c2ce9d5b85a8"><enum>(B)</enum><text>after the eligible entity provides documentation that the payment under subparagraph (A) has been spent, pay the remaining amount under the contract in 2 disbursements of equal value. </text></subparagraph></paragraph></subsection>
<subsection id="HFE07F0211DD148FFB45760FE15F1CB94"><enum>(f)</enum><header>Program administration</header>
<paragraph id="HF7AE0348B63F4D1D8BCDCDD504A112F1"><enum>(1)</enum><header>Qualifying entities</header><text>The Secretary shall—</text> <subparagraph id="id2FE813464D6A4314AB84162E3758F551" commented="no"><enum>(A)</enum><text>maintain a list of qualifying entities that participate in the program; and</text></subparagraph>
<subparagraph id="id2E4C66F5B4C44160981EA9DC135F4E7F"><enum>(B)</enum><text>conduct outreach to ensure that qualifying entities are made aware of the program. </text></subparagraph></paragraph> <paragraph id="H7088C2E8BEE34B5087CCC731E5473D3E"><enum>(2)</enum><header>Equity and geographic reach</header> <subparagraph id="id011978262C2E423AABF9B9799577FFF0"><enum>(A)</enum><header>In general</header><text>In carrying out the program each fiscal year, the Secretary shall enter into contracts with eligible entities in a manner that ensures that the total value of contracts entered into in each State is proportionate to the number of households and individuals living in poverty within the State, as determined by the Secretary.</text></subparagraph>
<subparagraph id="H5A2EFE5FFCBA4E348DFCEAB7FC82EF56"><enum>(B)</enum><header>Diversity</header><text>The Secretary shall award multiple contracts under the program to eligible entities located in or serving each region of the Food and Nutrition Service to provide opportunities to a broad range of producers and eligible entities.</text></subparagraph></paragraph> <paragraph id="H6DF1C46A4C5E4273B32CA906E682559D"><enum>(3)</enum><header>Vulnerable areas</header><text>In carrying out the program, the Secretary shall establish a process—</text>
<subparagraph id="HC58605D5FC39445E940CC9D6241CC622"><enum>(A)</enum><text>to determine the areas most in need of produce provision under the program, including rural areas, the territories and possessions of the United States, and areas under the jurisdiction of a Tribal government; and</text></subparagraph> <subparagraph id="H8075B99B221448D8A246022C1C254B57"><enum>(B)</enum><text>to ensure that those areas are served by the program.</text></subparagraph></paragraph>
<paragraph id="idDAE6FE8CC1D34532B998A7712770C823"><enum>(4)</enum><header>Financial information and assistance</header><text>The Secretary shall provide—</text> <subparagraph id="id29CEB61AD98F4F5BA23B79E64CB9BBE8"><enum>(A)</enum><text>information to assist small farmers, beginning farmers, veteran farmers, and socially disadvantaged farmers in obtaining food safety certifications; and </text></subparagraph>
<subparagraph id="id45F25A97C9EC4321BCD8C52AABFE29C2"><enum>(B)</enum><text>financial assistance to cover the associated costs of necessary changes and upgrades to practices and equipment to improve food safety. </text></subparagraph></paragraph> <paragraph id="H3F5994E4ACA44593ABD390B5502D06F1"><enum>(5)</enum><header>Technical assistance</header><text>The Secretary shall provide technical assistance to eligible entities participating in the program with respect to—</text>
<subparagraph id="HF21C056E78F547AB8EF0DEA1AB174F16"><enum>(A)</enum><text>the contract terms and expectations applicable to those eligible entities;</text></subparagraph> <subparagraph id="HAF2B293F905C42FBA441DB1F36A05104"><enum>(B)</enum><text>best practices for the distribution of produce and expectations of the Secretary relating to distribution; and</text></subparagraph>
<subparagraph id="HD93E319915E84595A8AAE3804083394A"><enum>(C)</enum><text>food safety certification. </text></subparagraph></paragraph></subsection> <subsection id="HED9151886EEE4018BE72F630F600DCAD"><enum>(g)</enum><header>Reporting</header> <paragraph id="HFB98F768D10F4278AF00E708A7F58618"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Agriculture of the House of Representatives a report that describes the activities carried out under the program, including, within a State— </text>
<subparagraph id="id7512926C3836456B9772F3256C9FA719"><enum>(A)</enum><text>the counties and percentage of counties served;</text></subparagraph> <subparagraph id="id2664FDF921F44FC69ADE073C3D8C1088"><enum>(B)</enum><text>the number of produce packages provided;</text></subparagraph>
<subparagraph id="idBA1C8C5A012840EF9ECD47B0D472C10C"><enum>(C)</enum><text>the quantity and variety of fresh produce distributed; </text></subparagraph> <subparagraph id="idA7B0E206457F4AA68F946F620E041879"><enum>(D)</enum><text>the number of farms from which produce is sourced, including the size of those farms;</text></subparagraph>
<subparagraph id="idE6B73A30DFE648CAB179C02E72A53B31"><enum>(E)</enum><text>the percentage of fresh produce procured locally and regionally; and </text></subparagraph> <subparagraph id="id48458C05CB8D4DAB943D9775FE35BB0F"><enum>(F)</enum><text>any other data determined relevant by the Secretary.</text></subparagraph></paragraph>
<paragraph id="idE5016ACAFC2241D8AF51E84DB8FBF1B8"><enum>(2)</enum><header>GAO report</header><text>Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Agriculture of the House of Representatives a report that evaluates the effectiveness of the program with respect to the purposes of the program described in subsection (c).</text></paragraph></subsection></section> </legis-body> </bill>
