which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To defer student loan payments for survivors of sex-based harassment.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HBDB7C402BA064C7EA2A7E91451D91146"><section id="HBF85B3E70B974E19BB7FDEA2B0528D12" section-type="section-one"><enum>1.</enum><header>Deferment for victims of sex-based harassment</header><text display-inline="no-display-inline">Section 455(f) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e(f)</external-xref>) is amended—</text><paragraph id="HAA002C8AB0AA428E8CEE6CC382B9F8FE"><enum>(1)</enum><text>in paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idab05603680cb47c889b62645138d1e8c"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>or</quote> at the end of subparagraph (C); </text></subparagraph><subparagraph id="HA8FA2DDD7D9B4EC9B888504EFA1E9DF2"><enum>(B)</enum><text>by striking the period at the end of subparagraph (D) and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="H9EBCCA7AD5F44CC6A708BE61B8901344"><enum>(C)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id28b9af25af744ab18bd18d561209e6d7"><subparagraph id="idea7956a448854bfc8ebd9d672d906a28"><enum>(E)</enum><text>not in excess of 3 years (for 1 or more periods of not less than 3 months and not more than 12 months), beginning on the date on which the borrower—</text><clause id="idf5efd49baf2e434b94b6be57395ee23c"><enum>(i)</enum><text>ceases to carry at least one-half the normal full-time work load for the course of study that the borrower is pursuing, as determined by the eligible institution (as such term is defined in section 435(a)) the borrower is attending; and</text></clause><clause id="id05958959d64a45cfbf60dfc83eef9930"><enum>(ii)</enum><text>submits documentation to the Secretary showing that the borrower reported to a covered individual that the borrower was a victim of sex-based harassment (regardless of whether institutional findings were made regarding that harassment).</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id24236bc43a8f40379582cb2c866597e0"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD761FF30FFF447B583CE446F44C38DCE"><paragraph commented="no" display-inline="no-display-inline" id="id40f048308dd7432099ca87b87bfceeb7"><enum>(6)</enum><header>Definitions regarding sex-based harassment</header><text>For purposes of paragraph (2)(E)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4f37e75ea7e64030911bde77f462d876"><enum>(A)</enum><text>the term <term>covered individual</term> means—</text><clause commented="no" display-inline="no-display-inline" id="id0cdcd5aa3fa4470b80656365a262208b"><enum>(i)</enum><text display-inline="yes-display-inline">the title IX coordinator at the institution (within the meaning of section 106.8 of title 34, Code of Federal Regulations, or successor regulations);</text></clause><clause commented="no" display-inline="no-display-inline" id="idc507724a1b814fd68a88679f1dff18ba"><enum>(ii)</enum><text>another title IX official or administrator at the institution; or </text></clause><clause commented="no" display-inline="no-display-inline" id="id26165601da0b4fccbb5c8b8547382a43"><enum>(iii)</enum><text>a health care provider; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide774d47cda50499fa0c257908c1ceb17"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>sex-based harassment</term> means—</text><clause commented="no" display-inline="no-display-inline" id="idcb1c298937b44064832893bf44deac97"><enum>(i)</enum><text display-inline="yes-display-inline">sexual harassment, as defined in paragraph (1) or (2) of section 106.30(a) of title 34, Code of Federal Regulations (as in effect on September 30, 2023);</text></clause><clause commented="no" display-inline="no-display-inline" id="id520beb970bd14b79ae40e13ff1cfb1ab"><enum>(ii)</enum><text>dating violence, domestic violence, or stalking, as those terms are defined in section 485(f)(6)(A)(i); or</text></clause><clause commented="no" display-inline="no-display-inline" id="idda74150a2abc49379e1f385378c7f94c"><enum>(iii)</enum><text display-inline="yes-display-inline">sexual assault, as that term is defined in section 485(f)(6)(A)(v).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H701F7C9623E84BB2A22646D18139A7C9"><enum>2.</enum><header>Return of funds waiver</header><text display-inline="no-display-inline">Section 484B(b)(2) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1091b">20 U.S.C. 1091b(b)(2)</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H6F7CA4A243844E2C96A7EA088F20547C"><subparagraph id="H5E397FECB3F545D5AB00DDAE1EB048FA"><enum>(F)</enum><header>Waivers of grant assistance and loan repayment by students who are victims of sex-based harassment</header><text display-inline="yes-display-inline">In addition to the waivers authorized by subparagraphs (D) and (E), the Secretary may waive the amounts that students are required to return under this section with respect to any grant assistance (including Federal Pell Grants) or loans made under this title if the withdrawals on which the returns are based are withdrawals by students—</text><clause id="HD824983232A94A119460442D5C4A1887"><enum>(i)</enum><text display-inline="yes-display-inline">whose attendance was interrupted due to being a victim of sex-based harassment (as such term is defined in section 455(f)(6)); and</text></clause><clause id="H9A4DA15DB934421CA082926AC5661740"><enum>(ii)</enum><text>in the case of students who, in the absence of this subparagraph, would have been required to return loans made under this title, who are receiving a deferment under section 455(f)(2)(E) on such loans.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id334c0bcc421c43a29fbf7b37542c7d63"><enum>3.</enum><header>Report to Congress</header><text display-inline="no-display-inline">Not later than 5 years after the date of enactment of this Act, the Secretary of Education shall prepare and submit to Congress a report that includes an evaluation of the effectiveness of the activities established under this Act, and the amendments made by this Act, including opportunities for increased program integrity.</text></section></legis-body></bill>
