<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 2870</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230920">September 20, 2023</action-date><action-desc><sponsor name-id="S404">Mr. Scott of Florida</sponsor> (for himself and <cosponsor name-id="S350">Mr. Rubio</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Endangered Species Act of 1973 to allow certain activities to be conducted with respect to sturgeon held in captivity or in a controlled environment in the United States, and for other purposes.</official-title></form><legis-body><section id="id0C35CAD796AC47C8BB84E87957D6C77D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sturgeon Conservation and Sustainability Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="ida1909846a97145939df7439a256dfd30"><enum>2.</enum><header>Sturgeon held in captivity or controlled environments in the United States</header><subsection commented="no" display-inline="no-display-inline" id="id0d4923f3ce8e47bc90d37cf553b908ed"><enum/><text>Section 9(b) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1538">16 U.S.C. 1538(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA9E5CDBA82C94178B9579686B5CE32C9"><paragraph commented="no" display-inline="no-display-inline" id="idcaef4aaa500d4ab89135057ebb30309b" indent="up1"><enum>(3)</enum><header>Sturgeon</header><subparagraph commented="no" display-inline="no-display-inline" id="id1d448ada44e94defaf3e08e8f24ee960"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (a)(1) and section 7(a)(2) shall not apply to—</text><clause commented="no" display-inline="no-display-inline" id="id7dc1acb18e6e44e2a04822a934f33ba5"><enum>(i)</enum><text display-inline="yes-display-inline">a sturgeon farmed in the United States that is legally held in captivity or in a controlled environment as of the date of enactment of this paragraph, until such time as the sturgeon is intentionally returned to a wild state; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idec1554d2975b40a488b2386ab3f54991"><enum>(ii)</enum><text display-inline="yes-display-inline">progeny of a sturgeon described in clause (i), until such time as the progeny is intentionally returned to a wild state.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida8719d8d439f4fd18d03340f51793504"><enum>(B)</enum><header>Demonstration; requirements</header><clause commented="no" display-inline="no-display-inline" id="id6024c535b1f8475889b3e1518a0d0495"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Any person holding any sturgeon or progeny described in subparagraph (A) shall—</text><subclause commented="no" display-inline="no-display-inline" id="id52ba0c55fc1541cb806767866a8a0eda"><enum>(I)</enum><text display-inline="yes-display-inline">be able to demonstrate that the sturgeon or progeny qualifies as a sturgeon or progeny, as applicable, described in that subparagraph; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id906b6b3ee8dc483b9bf7604629e51749"><enum>(II)</enum><text display-inline="yes-display-inline">maintain and submit to the Secretary, on request of the Secretary, such inventories, documentation, and records as the Secretary may, by regulation, require as being reasonably appropriate to carry out the purposes of this paragraph.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id58aee349847c4c42ac7649d25e95a5e9"><enum>(ii)</enum><header>Requirements</header><text display-inline="yes-display-inline">Requirements described in clause (i)(II) shall not unnecessarily duplicate the requirements of other rules and regulations promulgated by the Secretary under this Act.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
