<section id="H098E3500C6F7420AAB4CAD2EFCD20719"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act: </text> <paragraph id="H8FF78BFAAAF1440FAB79723A58A0EE59"><enum>(1)</enum><header>CBP</header><text>The term <term>CBP</term> means U.S. Customs and Border Protection.</text></paragraph>
<paragraph id="idE0949C0DDB7340F597DBC1390CFEA6C1"><enum>(2)</enum><header>Child</header><text>The term <term>child</term> has the meaning given such term in section 101(b)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(b)(1)</external-xref>). </text></paragraph> <paragraph id="id8DF37B5610CE4DD9A110E2880FF7EFC2"><enum>(3)</enum><header>Commissioner</header><text>The term <term>Commissioner</term> means the Commissioner of U.S. Customs and Border Protection.</text></paragraph>
<paragraph id="H9627CEEF51EB4C3489836F8EF4D0A7DE"><enum>(4)</enum><header>Detainee</header><text>The term <term>detainee</term> means any individual who is detained in CBP custody.</text></paragraph> <paragraph id="id90D376D92AAC40BA970A55E79F574A40"><enum>(5)</enum><header>Forward operating base</header><text>The term <term>forward operating base</term> means a permanent facility that has been established by CBP in a forward or remote location and has been so designated by CBP. </text></paragraph>
<paragraph id="H43FDC14BA09D48768712C5D0E8F9027F"><enum>(6)</enum><header>Interpretation services</header><text>The term <term>interpretation services</term> includes translation services that are performed in person or through a telephone or video service. </text></paragraph> <paragraph id="HCA68BA0DB88A40D5AC617737E93193BB"><enum>(7)</enum><header>U.S. customs and border protection facility</header><text>The term <term>U.S. Customs and Border Protection facility</term> includes—</text>
<subparagraph id="H5F690B57543A42718D422D6E718E281B"><enum>(A)</enum><text>U.S. Border Patrol stations;</text></subparagraph> <subparagraph id="HDBA143DEAE444F48B43105CCE9F88473"><enum>(B)</enum><text>ports of entry;</text></subparagraph>
<subparagraph id="H497541781BE84E489CFF8329B96E6803"><enum>(C)</enum><text>checkpoints;</text></subparagraph> <subparagraph id="H004DA40EAEDC4DC9B0CFB190570950C9"><enum>(D)</enum><text>forward operating bases;</text></subparagraph>
<subparagraph id="H38CE38E061C34AED990305400C68C3C2"><enum>(E)</enum><text>secondary inspection areas; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H7E7020B6BB6B4C6AA38054305B16AA46"><enum>(F)</enum><text>short-term custody facilities. </text></subparagraph></paragraph></section>
<section id="HCC8FF73250E64B0F85D7EA6F28A125FE"><enum>3.</enum><header>Initial health screening protocol</header>
<subsection id="H1DB5CF444557430A9A3795F1907F3809"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Commissioner, in consultation with the Secretary of Health and Human Services, the Administrator of the Health Resources and Services Administration, and nongovernmental experts in the delivery of health care in humanitarian crises and in the delivery of health care to children, shall develop guidelines and protocols for the provision of health screenings and appropriate medical care for detainees, as required under this section.</text></subsection> <subsection id="H2A5DA67864B845E4B7500D90CED06194"><enum>(b)</enum><header>Initial screening and medical assessment</header><text>The Commissioner shall ensure that all detainees receive an initial in-person screening by a licensed medical professional in accordance with the standards described in subsection (c)—</text>
<paragraph id="H14D0C48C371B472CA6A15908D1D412B8"><enum>(1)</enum><text>to assess and identify any illness, condition, or age-appropriate mental or physical symptoms that may have resulted from distressing or traumatic experiences;</text></paragraph> <paragraph id="H93FB9091618A4FFD93C0645782ADE4B8"><enum>(2)</enum><text>to identify acute conditions and high-risk vulnerabilities; and</text></paragraph>
<paragraph id="HF1A447CB560A4CA5AFE9779FD803BFFA"><enum>(3)</enum><text>to ensure that appropriate health care is provided to individuals as needed, including pediatric, obstetric, and geriatric care.</text></paragraph></subsection> <subsection id="H169E7B956EAD43849B5B68E495DA8192"><enum>(c)</enum><header>Standardization of initial screening and medical assessment</header> <paragraph id="H7F04A8531AE1432C83AA5E2BA3B0BCC3"><enum>(1)</enum><header> In general</header><text>The initial screening and medical assessment of detainees shall include—</text>
<subparagraph id="HA7235B0566B642AFAEC191D9F14AD64B"><enum>(A)</enum><text>an interview and the use of a standardized medical intake questionnaire or the equivalent;</text></subparagraph> <subparagraph id="H05767227443947A1BC7250480EC8DCD9"><enum>(B)</enum><text>screening of vital signs, including pulse rate, body temperature, blood pressure, oxygen saturation, and respiration rate;</text></subparagraph>
<subparagraph id="H38D8B5C4B8514402938CF50E54947A8A"><enum>(C)</enum><text>screening for blood glucose for known or suspected diabetics;</text></subparagraph> <subparagraph id="H0CB2BCBA1239420D9D6A1FAFB471B74E"><enum>(D)</enum><text>weight assessment of detainees younger than 12 years of age; </text></subparagraph>
<subparagraph id="HB89287E02E884CFFBAF0011940E0A514"><enum>(E)</enum><text>a physical examination; and</text></subparagraph> <subparagraph id="H3DE6C3869478467788F206D868A8AC23"><enum>(F)</enum><text>a risk assessment and the development of a plan for monitoring and care, as appropriate. </text></subparagraph></paragraph>
<paragraph id="HB603BEAC857A4503B189BE98841846A5"><enum>(2)</enum><header>Prescription medication</header>
<subparagraph id="idC0A9CE642A644CEDBFEE3242B5DF33AF"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The medical professional conducting the screening pursuant to subsection (b) shall—</text> <clause id="idC357E0629D0B4FC4866E75F0489BE47E"><enum>(i)</enum><text display-inline="yes-display-inline">review any prescribed medication that is in the detainee’s possession or that was confiscated by CBP upon arrival; and </text></clause>
<clause id="idE88CA70F0F574F818AC93C1F8BD3456D"><enum>(ii)</enum><text display-inline="yes-display-inline">determine if such medication should be—</text> <subclause id="idAF3FF27C5D5645B192816032A253FABB"><enum>(I)</enum><text display-inline="yes-display-inline">kept by the detainee for use during detention;</text></subclause>
<subclause id="id46D860C2B94B45108D08AF98C11B2D71"><enum>(II)</enum><text display-inline="yes-display-inline">properly stored by CBP, with appropriate access for use during detention; or </text></subclause> <subclause id="id4270D4E4DDFD4062B2EB450D7273B08B"><enum>(III)</enum><text display-inline="yes-display-inline">maintained with the detained individual’s personal property. </text></subclause></clause></subparagraph>
<subparagraph id="idA1DD668B16C54A79A3B87B96295DC6FE"><enum>(B)</enum><header>Right to medication</header><text display-inline="yes-display-inline">A detainee may not be denied the use of necessary and appropriate medication for the management of the detainee’s illness.</text></subparagraph></paragraph> <paragraph id="H69B9351D24D2451F8CD03EF17A2139D6"><enum>(3)</enum><header>Rule of construction</header><text>Nothing in this subsection may be construed as requiring detainees to disclose their medical status or history.</text></paragraph></subsection>
<subsection id="HC627910F4FB34DED84FA6EFE138F93B9"><enum>(d)</enum><header>Timing</header>
<paragraph id="HA0CE2FA360E64A0EB55DEEA88D04B7ED"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the initial screening and medical assessment described in subsections (b) and (c) shall take place as soon as practicable, but not later than 12 hours after a detainee’s arrival at a CBP facility.</text></paragraph> <paragraph id="HE74FE89422AF4A42ABD3FCBAE8E7163C"><enum>(2)</enum><header>High priority individuals</header><text>The initial screening and medical assessment referred to in paragraph (1) shall take place as soon as practicable, but not later than 6 hours after a detainee’s arrival at a CBP facility if the individual—</text>
<subparagraph id="idA816D4868CB94DD49482232CBA060570"><enum>(A)</enum><text>reasonably self-identifies as having a medical condition that requires prompt medical attention; or </text></subparagraph> <subparagraph id="id50CCAE409E764C72B898D1E018B50863"><enum>(B)</enum><text>is—</text>
<clause id="HBD7D5C3BE9FF4476A2FC1EDA2016AE21"><enum>(i)</enum><text>exhibiting signs of acute or potentially severe physical or mental illness, or otherwise has an acute or chronic physical or mental disability or illness;</text></clause> <clause id="H36728F42B87844F081C906745CA3BEC3"><enum>(ii)</enum><text>pregnant;</text></clause>
<clause id="H4FF3E698A1C5469FB49278BCB42812F4"><enum>(iii)</enum><text>a child (with priority given, as appropriate, to the youngest children); or</text></clause> <clause id="H71633B53F5B74641930A77F1493639FD"><enum>(iv)</enum><text>elderly.</text></clause></subparagraph></paragraph></subsection>
<subsection id="HD494EA50C501421CBA4D04AD51675D86"><enum>(e)</enum><header>Further care</header>
<paragraph id="HAFECC08E53F248BE87ED3B4F6672189A"><enum>(1)</enum><header>In general</header><text>If, as a result of the initial health screening and medical assessment described in subsections (b) and (c), the licensed medical professional conducting such screening or assessment determines that 1 or more of the detainee’s vital sign measurements are significantly outside normal ranges, in accordance with the National Emergency Services Education Standards, or if the detainee is identified as high risk or in need of medical intervention, the detainee shall be provided, as expeditiously as possible, with an in-person or technology-facilitated medical consultation with a licensed emergency care professional.</text></paragraph> <paragraph id="H91B25F4F13654F41865183E0964C1C0B"><enum>(2)</enum><header>Reevaluation</header> <subparagraph id="H459A99B61DF446BDB508134BAE155631"><enum>(A)</enum><header>In general</header><text>Each detainee described in paragraph (1)—</text>
<clause id="id788EB7455AED48B7BA61B2F52F60999F"><enum>(i)</enum><text>shall be reevaluated not later than 24 hours after the consultation required under such paragraph; and</text></clause> <clause id="id3FB59740BEDC417A88FB971A97059F85"><enum>(ii)</enum> <subclause commented="no" display-inline="yes-display-inline" id="id234A50BEC40540BE85D566F097985381"><enum>(I)</enum><text>shall be monitored thereafter as determined by an emergency care professional; or</text></subclause>
<subclause id="id568EDB90128748A185508EB2A58FD8BC" indent="up1"><enum>(II)</enum><text>if the detainee is a child, shall be monitored thereafter as determined by a licensed emergency care professional with a background in pediatric care.</text></subclause></clause></subparagraph> <subparagraph id="H21FBFD5B11C94CC9AA927731E3007A2B"><enum>(B)</enum><header>Reevaluation before travel</header><text>In addition to the reevaluations required under subparagraph (A), detainees described in paragraph (1), before being transported to another location—</text>
<clause id="id14BFA5ABDC0A421BA6102752D409696F"><enum>(i)</enum><text>shall have all of their vital signs reevaluated; and </text></clause> <clause id="idE3149A0767CB4DD5A8309CE8C5A3DDE9"><enum>(ii)</enum><text>shall be cleared by a medical professional as being able to travel safely.</text></clause></subparagraph></paragraph>
<paragraph id="HF343E455AFD74A8B87D25663F3026A05"><enum>(3)</enum><header>Psychological and mental care</header><text display-inline="yes-display-inline">The Commissioner shall ensure that detainees who have experienced physical or sexual violence or who have experienced events that may cause severe trauma or toxic stress, are provided access to basic, humane, and supportive psychological assistance.</text></paragraph></subsection> <subsection id="H28E7B389265F4558A3C188BA47C0C391"><enum>(f)</enum><header>Interpreters</header><text display-inline="yes-display-inline">To ensure that health screenings and medical care required under this section are carried out in the best interests of the detainee, the Commissioner shall ensure that—</text>
<paragraph id="id609299916E2946F5952DDD3BE91613D4"><enum>(1)</enum><text display-inline="yes-display-inline">language-appropriate interpretation services, including interpretation of indigenous languages, are provided to each detainee; and </text></paragraph> <paragraph id="idAC99ADC947D340EF9C51B45AEBBA72F2"><enum>(2)</enum><text display-inline="yes-display-inline">each detainee is informed of the availability of such interpretation services.</text></paragraph></subsection>
<subsection id="H1E302EFFDCFF4DE1BE84168E4E0DBB4B"><enum>(g)</enum><header>Chaperones</header><text>To ensure that health screenings and medical care required under this section are carried out in the best interests of the detainee—</text> <paragraph id="HF3AF5C3B8D694E9FA806174314A2B316"><enum>(1)</enum><text display-inline="yes-display-inline">the Commissioner shall establish guidelines for, and ensure the presence of, chaperones for all detainees during medical screenings and examinations in accordance with relevant guidelines in the American Medical Association Code of Medical Ethics and recommendations of the American Academy of Pediatrics; and</text></paragraph>
<paragraph id="H29039B6949934159B781A58981D3CF00"><enum>(2)</enum><text>to the extent practicable, the physical examination of a child shall always be performed in the presence of—</text> <subparagraph id="idA41C7B175F3D4ADFB5A577B73C6A401C"><enum>(A)</enum><text>a parent or legal guardian; or </text></subparagraph>
<subparagraph id="id20F1CDB11D3A4F1E9F056D768675E8B1"><enum>(B)</enum><text>the detainee’s closest present adult relative, if a parent or legal guardian is unavailable.</text></subparagraph></paragraph></subsection> <subsection id="HB069463A2B7D420BA4CBF38D6D8F6170"><enum>(h)</enum><header>Documentation</header><text>The Commissioner shall ensure that—</text>
<paragraph id="id4A1611BEECA948C88699EE59576A7B16"><enum>(1)</enum><text>the health screenings and medical care required under this section and any other medical evaluations and interventions for detainees are documented in accordance with commonly accepted standards in the United States for medical record documentation; and</text></paragraph> <paragraph id="id329168E004724EA4A6E5850403AEC1C6"><enum>(2)</enum><text>such documentation is provided to any individual who received a health screening and subsequent medical treatment upon release from CBP custody.</text></paragraph></subsection>
<subsection id="HC7E0CC5090AF4B2AAE0A686194108798"><enum>(i)</enum><header>Infrastructure and equipment</header><text>The Commissioner or the Administrator of General Services shall ensure that each location to which detainees are first transported after an initial encounter with an agent or officer of CBP has— </text> <paragraph id="H61D37F2F6001422E84AB77AAB63E2658"><enum>(1)</enum><text>a private space that—</text>
<subparagraph id="id58823AC2083B489B91FE42FA5DFF5744"><enum>(A)</enum><text>provides a comfortable and considerate atmosphere for the patient; and </text></subparagraph> <subparagraph id="idEC6A32F462424DEBA6FB455784861C41"><enum>(B)</enum><text>ensures the patient’s dignity and right to privacy during the health screening and medical assessment and any necessary follow-up care;</text></subparagraph></paragraph>
<paragraph id="H6F704B465A954075B28751DBE0292483"><enum>(2)</enum><text>all necessary and appropriate medical equipment and facilities—</text> <subparagraph id="id39E9C71D40C447619B8712B1A098AF3D"><enum>(A)</enum><text>to conduct the health screenings and follow-up care required under this section;</text></subparagraph>
<subparagraph id="idB9E6799466AC4D779739840F22DFB81D"><enum>(B)</enum><text>to treat trauma;</text></subparagraph> <subparagraph id="idA0D5FA702C3247759FE7C0DEA5274225"><enum>(C)</enum><text>to provide emergency care, including resuscitation of individuals of all ages; and </text></subparagraph>
<subparagraph id="idC4BC507CD03A4769864110DDE8F2142E"><enum>(D)</enum><text>to prevent the spread of communicable diseases;</text></subparagraph></paragraph> <paragraph id="HEB17863AD91E4B58AD5DBA081A6B2463"><enum>(3)</enum><text>basic over-the-counter medications appropriate for all age groups; and</text></paragraph>
<paragraph id="H9EAC0F5D1ED2445386E5F05278C220BE"><enum>(4)</enum><text>appropriate transportation to medical facilities in the case of a medical emergency, or an on-call service with the ability to arrive at the CBP facility within 30 minutes.</text></paragraph></subsection> <subsection id="HA8718BF44D5D46AA8406D98A6789D249"><enum>(j)</enum><header>Personnel</header><text display-inline="yes-display-inline">The Commissioner or the Administrator of General Services, as the case may be, shall ensure that each location to which detainees are first transported after an initial encounter has—</text>
<paragraph id="id815AA1FCE349412E961CA90189FC341E"><enum>(1)</enum><text display-inline="yes-display-inline">at least 1 licensed medical professional on site to conduct health screenings; and</text></paragraph> <paragraph id="id87AEA8D592DB4A06A6CFC0D35A231637"><enum>(2)</enum><text display-inline="yes-display-inline">other personnel that are or may be necessary for carrying out the functions described in subsection (e), such as licensed emergency care professionals, specialty physicians (including physicians specializing in pediatrics, family medicine, obstetrics and gynecology, geriatric medicine, internal medicine, and infectious diseases), nurse practitioners, other nurses, physician assistants, licensed social workers, mental health professionals, public health professionals, dieticians, interpreters, and chaperones, on site to the extent practicable, or, if not practicable, available on call. </text></paragraph></subsection>
<subsection id="H1A6E814B23614D31A02061C6BEA2E0D8"><enum>(k)</enum><header>Ethical guidelines</header><text>The Commissioner shall ensure that all medical assessments and procedures conducted pursuant to this section are conducted in accordance with ethical guidelines in the applicable medical field and respect human dignity.</text></subsection></section> <section id="H5A2CC902EFE3464A83E97C15001837D0"><enum>4.</enum><header>Water, sanitation and hygiene</header><text display-inline="no-display-inline">The Commissioner shall ensure that all detainees have access to—</text>
<paragraph id="H446E2C62527A4079A2788644A81A3BD8"><enum>(1)</enum><text>not less than 1 gallon of drinking water per person per day, in addition to any other age-appropriate fluids that may be needed;</text></paragraph> <paragraph id="H5A275B2BEAFE42128543F679151C4954"><enum>(2)</enum><text>a private, safe, clean, and reliable permanent or portable toilet with proper waste disposal and a hand washing station, with not fewer than 1 toilet available for every 12 male detainees, and not fewer than 1 toilet available for every 8 female detainees;</text></paragraph>
<paragraph id="H31287BE590134C65BE65047BC33016B0"><enum>(3)</enum><text>a clean diaper changing facility, which includes proper waste disposal, a hand washing station, and unrestricted access to diapers; </text></paragraph> <paragraph id="H6D60F62DD72D49188F774DABFC06B4F7"><enum>(4)</enum><text>the opportunity to bathe daily in a permanent or portable shower that is private and secure; and</text></paragraph>
<paragraph id="H1757F78C96C640B8BC2A1E54B3619AF4"><enum>(5)</enum><text>products for individuals of all age groups and for individuals with disabilities to maintain basic personal hygiene, including soap, a toothbrush, toothpaste, adult diapers, feminine hygiene products, and receptacles for the proper storage and disposal of such products.</text></paragraph></section> <section id="H0F92D4FBDC32410EAF4183A08DC12399"><enum>5.</enum><header>Food and nutrition</header><text display-inline="no-display-inline">The Commissioner shall ensure that detainees have access to—</text>
<paragraph id="HD5627FB814E6499EB7A54FCD450A1CA4"><enum>(1)</enum><text>3 meals per day, including—</text> <subparagraph id="H620B2E2D4C6244B6A7521C654F556E15"><enum>(A)</enum><text>for individuals 12 years of age or older, a diet that contains not fewer than 2,000 calories per day; and</text></subparagraph>
<subparagraph id="H51CE22FDDA294A1A9EC3C40869093742"><enum>(B)</enum><text>for children younger than 12 years of age, a diet that contains an appropriate number of calories per day based on the child’s age and weight;</text></subparagraph></paragraph> <paragraph id="H341DD4C6937F41C2BBF011047D84386C"><enum>(2)</enum><text>accommodations for any dietary needs or restrictions; and </text></paragraph>
<paragraph id="HEBA9B3E5BAA548A4B0360868B3DA1A0F"><enum>(3)</enum><text>access to food in a manner that follows applicable food safety standards.</text></paragraph></section> <section id="H8CF384817DDB4640ABCE6B07C9A0DD86"><enum>6.</enum><header>Shelter</header><text display-inline="no-display-inline">The Commissioner shall ensure that in each facility at which a detainee is detained—</text>
<paragraph id="H367397ED294F4890B92AC783D77C895D"><enum>(1)</enum><text>except as provided in paragraph (2), males and females are detained separately;</text></paragraph> <paragraph id="H64A04D486981446A97A0920FF1FC7347"><enum>(2)</enum><text>for any minor child arriving in the United States with an adult relative or legal guardian, such child—</text>
<subparagraph id="idBC1D436385A54E36A0131F3340CE7CF3"><enum>(A)</enum><text>is detained with such relative or legal guardian unless such an arrangement poses safety or security concerns; and</text></subparagraph> <subparagraph id="idDEAC8F87B6CC4100A4340AE57D466B6F"><enum>(B)</enum><text>if such child is detained apart from an adult relative or legal guardian as a result of such safety or security concerns, is not detained with adults;</text></subparagraph></paragraph>
<paragraph id="HB90A38B1E83D476CACD130161364D6FA"><enum>(3)</enum><text>for any unaccompanied minor arriving in the United States without an adult relative or legal guardian, such child is detained in an age-appropriate facility and not detained with adults;</text></paragraph> <paragraph id="H2B3303566F624329AAD14E142A0A6AAE"><enum>(4)</enum><text>a detainee with a temporary or permanent disability is held in an accessible location and in a manner that provides for his or her safety, comfort, and security, with accommodations provided to the extent needed;</text></paragraph>
<paragraph id="HA802A2E060694071BABD3F56E8041EB9"><enum>(5)</enum><text>no detainee is placed in a room for any period if such placement would exceed the maximum occupancy level as determined by the appropriate building code, fire marshal, or other authority;</text></paragraph> <paragraph id="H3ED22282842A4CCB91EBA8089F0E44A1"><enum>(6)</enum><text>each detainee is provided with temperature appropriate clothing and bedding;</text></paragraph>
<paragraph id="H338FA44943C744D598B2EBEF5BE77F78"><enum>(7)</enum><text>the facility is well lit and well ventilated, with the humidity and temperature kept at comfortable levels (between 68 and 74 degrees Fahrenheit);</text></paragraph> <paragraph id="H3669464CBE0D40A7995883F5CAA61AE1"><enum>(8)</enum><text>detainees who are in custody for more than 48 hours are given access to the outdoors for not less than 1 hour during the daylight hours during each 24-hour period;</text></paragraph>
<paragraph id="HD0C87A36ED554200AA6456356E94DEA9"><enum>(9)</enum><text>detainees are allowed to practice their religion or to not practice a religion, at their discretion;</text></paragraph> <paragraph id="H4210360BE5F04F0F83E721BAFC05849A"><enum>(10)</enum><text>detainees are given access to lighting and noise levels that are safe and conducive for sleeping throughout the night between the hours of 10:00 p.m. and 6:00 a.m;</text></paragraph>
<paragraph id="H4C6CF29E4D5342F685440753D9CE20D0"><enum>(11)</enum><text>CBP officers, employees, and contracted personnel—</text> <subparagraph id="HF7C6C4B90F1F4C71BD6DDE4BC6924915"><enum>(A)</enum><text>follow medical standards for the isolation and prevention of communicable diseases; and</text></subparagraph>
<subparagraph id="H1366A72499844B22B670B1FA06D46EA6"><enum>(B)</enum><text>ensure the physical and mental safety of detainees who identify as lesbian, gay, bisexual, transgender, or intersex;</text></subparagraph></paragraph> <paragraph id="HB64D1BD501D249B18CAEB1240B26F5F0"><enum>(12)</enum><text>the facility has video monitoring—</text>
<subparagraph id="id648108DFD6124FA5B3B08C140C788144"><enum>(A)</enum><text>to provide for the safety of the detainees; and </text></subparagraph> <subparagraph id="id79B50B80884F4640B9BFFC14D6353F71"><enum>(B)</enum><text>to prevent sexual abuse and physical harm of vulnerable detainees;</text></subparagraph></paragraph>
<paragraph id="HDBCDEA4C60694FAA85C4A2FE58379E43"><enum>(13)</enum><text display-inline="yes-display-inline">there is posted or otherwise made available in all areas where detainees are located a language appropriate <quote>Detainee Bill of Rights</quote> (including indigenous languages), which specifies all rights afforded to detainees under this Act; and</text></paragraph> <paragraph id="H7AC4EC6347FB4BE1968469C260C68B70"><enum>(14)</enum><text display-inline="yes-display-inline">the facility certifies that—</text>
<subparagraph id="idD19BB2B0848A4516AD76741ED5E72BBF"><enum>(A)</enum><text display-inline="yes-display-inline">the video monitoring required under paragraph (12) is properly working at all times; and</text></subparagraph> <subparagraph id="idE141C745B9464D1CA4A1766A4A821ECB"><enum>(B)</enum><text display-inline="yes-display-inline">the videos resulting from video monitoring are preserved for at least 90 days.</text></subparagraph></paragraph></section>
<section id="HC69C0F8ED4FD45A78D76FABDD6E62D08"><enum>7.</enum><header>Coordination and surge capacity</header><text display-inline="no-display-inline">The Secretary of Homeland Security shall enter into memoranda of understanding with appropriate Federal agencies, such as the Department of Health and Human Services, and applicable government emergency relief services, and shall enter into contracts with health care, public health, social work, and transportation professionals, for purposes of addressing surge capacity and ensuring compliance with this Act.</text></section> <section id="H849FFCFEFBF0465E8FD38A207EAAB614"><enum>8.</enum><header>Training</header><text display-inline="no-display-inline">The Commissioner shall ensure that CBP personnel assigned to each short-term custodial facility are professionally trained, including by receiving such continuing education as the Commissioner determines appropriate, in all subjects necessary to ensure compliance with this Act, including—</text>
<paragraph id="HFE3030C7ED344A9BB39DB8838878503B"><enum>(1)</enum><text>humanitarian response protocols and standards;</text></paragraph> <paragraph id="HB0F4AACCD1F64D64A4E8B537DBEDF0FC"><enum>(2)</enum><text>indicators of physical and mental illness, and medical distress in children and adults;</text></paragraph>
<paragraph id="H10E36E17F49C493AA00F8E1E1A180D71"><enum>(3)</enum><text>indicators of child sexual exploitation and effective responses to missing migrant children; and </text></paragraph> <paragraph id="HF887A0FCBDF2487E91A71F5C00C6C713"><enum>(4)</enum><text>procedures to report incidents of suspected child sexual abuse and exploitation directly to the National Center for Missing and Exploited Children.</text></paragraph></section>
<section id="H55B80B506B0942F8A3BEA0D8D6C8879F"><enum>9.</enum><header>Interfacility transfer of care</header>
<subsection id="H40FDA656CE9D44BF8383157ADD87E7A2"><enum>(a)</enum><header>Transfer</header><text display-inline="yes-display-inline">When a detainee is discharged from a medical facility or emergency services department, the Commissioner shall ensure that responsibility of care is transferred from the medical facility or emergency services department to an accepting licensed CBP health care provider.</text></subsection> <subsection id="H59B70C2C6653478D8D2163B127729EE4"><enum>(b)</enum><header>Responsibilities of accepting providers</header><text>Each accepting licensed CBP health care provider shall review the medical facility or emergency department’s evaluation, diagnosis, treatment, management, and discharge care instructions—</text>
<paragraph id="idA0E9AB2796A34C1997DC08D128191E75"><enum>(1)</enum><text>to assess the safety of the discharge and transfer; and </text></paragraph> <paragraph id="id486C284E11024F2AB1D0E8C5574877D9"><enum>(2)</enum><text>to provide necessary follow-up care.</text></paragraph></subsection></section>
<section id="H27A94D9EE68A4D119CEE3A4BA53D88A1"><enum>10.</enum><header>Planning and initial implementation</header>
<subsection id="H10191E4075404810AFA3FFC0402C7925"><enum>(a)</enum><header>Planning</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Secretary of Homeland Security shall submit a detailed plan to Congress that describes the timeline, process, and challenges of implementing the requirements under this Act.</text></subsection> <subsection id="HF70E4D9EC4724D06AB3269C3C6D232E0"><enum>(b)</enum><header>Implementation</header><text>The Secretary of Homeland Security shall ensure that the requirements under this Act are implemented not later than 6 months after the date of the enactment of this Act.</text></subsection></section>
<section id="HCCED395B87154C79989E8E422B69D7C9"><enum>11.</enum><header>Contractor compliance</header><text display-inline="no-display-inline">The Secretary of Homeland Security shall ensure that all personnel contracted to carry out this Act comply with the requirements under this Act.</text></section> <section id="H66FDF07B22134F72A81DEBB176315A98"><enum>12.</enum><header>Inspections</header> <subsection id="H2FDDDA84939D489BB186E781A487D6C4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Inspector General of the Department of Homeland Security shall—</text>
<paragraph id="H473333E0E1DA4D349BB4327899127AD0"><enum>(1)</enum><text>conduct unannounced inspections of ports of entry, border patrol stations, and detention facilities administered by CBP or contractors of CBP; and</text></paragraph> <paragraph id="H251E0D5CF7574D5B932602857460A003"><enum>(2)</enum><text>submit to Congress—</text>
<subparagraph id="id841EDF2EB1204AADBB87EEC5016D013A"><enum>(A)</enum><text>reports on the results of the inspections conducted pursuant to paragraph (1); and</text></subparagraph> <subparagraph id="idA49141B97ABF4EF480A37D1719EC751D"><enum>(B)</enum><text>other reports related to custody operations.</text></subparagraph></paragraph></subsection>
<subsection id="HC8BD3A1F78D84591B00125BE6D6C6EDA"><enum>(b)</enum><header>Particular attention</header><text>In carrying out subsection (a), the Inspector General shall pay particular attention to—</text> <paragraph id="HCFA3450B76814D7D979D15B75D0B7BC1"><enum>(1)</enum><text>the degree of compliance by CBP with the requirements under this Act;</text></paragraph>
<paragraph id="H7B980E67F4904C14922A90A9024AE6C8"><enum>(2)</enum><text>remedial actions taken by CBP; </text></paragraph> <paragraph id="H0BECDFBFA85B4DF49DDFE481994325BC"><enum>(3)</enum><text>the health needs of detainees; and</text></paragraph>
<paragraph id="HA4D6E10D102E4AEAB4C191731DC15C1C"><enum>(4)</enum><text display-inline="yes-display-inline">the degree of compliance with part 115 of title 6, Code of Federal Regulations (commonly known as the <quote>Standards to Prevent, Detect, and Respond to Sexual Abuse and Assault in Confinement Facilities</quote>). </text></paragraph></subsection> <subsection id="HDBA8B7513E5F46E59397146A063D482B"><enum>(c)</enum><header>Access to facilities</header><text display-inline="yes-display-inline">The Commissioner may not deny a Member of Congress entrance to any facility or building used, owned, or operated by CBP. </text></subsection></section>
<section id="H92DE3CCDC02D40EF98A669CDD74EF2DE"><enum>13.</enum><header>Government Accountability Office report</header>
<subsection id="H12BFD447F2EB44E58D81D01AA3974577"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Comptroller General of the United States—</text> <paragraph id="HF85D8FD6DEC54376AEA8D034A9A7318B"><enum>(1)</enum><text>not later than 6 months after the date of the enactment of this Act, shall commence a study on implementation of, and compliance with, this Act; and</text></paragraph>
<paragraph id="HC10C8608BDFA46BA86C03D51F3DC337B"><enum>(2)</enum><text>not later than 1 year after the date of the enactment of this Act, shall submit a report to Congress containing the results of the study required under paragraph (1).</text></paragraph></subsection> <subsection id="HF4C361C7F08A450A9BD00C89091FC946"><enum>(b)</enum><header>Issues To be studied</header><text display-inline="yes-display-inline">The study required under subsection (a)(1) shall examine—</text>
<paragraph id="idE14F926D74BD4826B96A6BC0668ACB26"><enum>(1)</enum><text display-inline="yes-display-inline">the management and oversight by CBP of ports of entry, border patrol stations, and other detention facilities, including the extent to which CBP and the Department of Homeland Security have effective processes in place to comply with the requirements under this Act; and</text></paragraph> <paragraph id="idA0692B406A1A4BD79B536D8D4E1CD988"><enum>(2)</enum><text display-inline="yes-display-inline">the extent to which CBP personnel, in carrying out this Act, make abusive, derisive, profane, or harassing statements or gestures, or engage in any other conduct evidencing hatred or invidious prejudice to or about 1 person or group on account of race, color, religion, national origin, sex, sexual orientation, age, or disability, including on social media.</text></paragraph></subsection></section>
<section id="HE829181E887F426691CAAD0E683C14DB"><enum>14.</enum><header>Publication of data on complaints of sexual abuse at U.S. Customs and Border Protection facilities</header><text display-inline="no-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of Homeland Security, acting in coordination with the Office of Inspector General and the Office for Civil Rights and Civil Liberties of the Department of Homeland Security, shall publicly release aggregate data on complaints of sexual abuse at CBP facilities on its website on a quarterly basis, excluding any personally identifiable information that may compromise the confidentiality of individuals who reported such abuse.</text></section> <section id="HCC6A454A877C4D18BFD643BF5D7F173B"><enum>15.</enum><header>Rules of construction</header><text display-inline="no-display-inline">Nothing in this Act may be construed as—</text>
<paragraph id="HDFB583328D73451B8B77040E275A0F3E"><enum>(1)</enum><text>authorizing CBP to detain individuals for longer than 72 hours;</text></paragraph> <paragraph id="HE86DDC93F080494B86F8DBD8FB1C98CE"><enum>(2)</enum><text>contradicting the March 7, 2014, Department of Homeland Security rule adopting Standards to Prevent, Detect, and Respond to Sexual Abuse and Assault in Confinement Facilities, which includes a zero tolerance policy prohibiting all forms of sexual abuse and assault of individuals in U.S. Customs and Border Protection custody, including in holding facilities, during transport, and during processing;</text></paragraph>
<paragraph id="H7E9EA99E89334B58AA42C895C53E42EE"><enum>(3)</enum><text>contradicting current protocols related to Department of Homeland Security background checks in the hiring process;</text></paragraph> <paragraph id="H89233ABA57B042E699A1B1D18C3D067F"><enum>(4)</enum><text>restricting the Department of Homeland Security from denying employment to, or terminating the employment of, any individual who—</text>
<subparagraph id="id66E30759D0D54DE2B82A339F60F84098"><enum>(A)</enum><text>would be or is involved with the handling or processing at holding facilities, during transport, or during processing, or care of detainees, including the care of children; and </text></subparagraph> <subparagraph id="id551AD0FEAF144C7CBA7F0222F746A02B"><enum>(B)</enum><text>has been convicted of a sex crime or other offense involving a child victim; or</text></subparagraph></paragraph>
<paragraph id="HAC332210086B49DFB9B71E11E71D6A30"><enum>(5)</enum><text> affecting the obligation to fully comply with all applicable immigration laws, including being subject to any penalties, fines, or other sanctions.</text></paragraph></section> </legis-body> </bill>
