which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Food for Peace Act to restore the original intent of commodity transfers, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H4DFE0B7D6E7F442586D143056A43DD5F"><section id="idc909ebf8e5324035bfd28eec0001ca67" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Farmers Feed the World Act of 2023</short-title></quote>.</text></section><section id="HD07E77664DB34EA3B0A3187B842C5FAE"><enum>2.</enum><header>Peter O’Brien Food for Peace Program</header><subsection id="H0D68344A22094646A1E90B63F412E43B"><enum>(a)</enum><header>Renaming of program</header><paragraph commented="no" display-inline="no-display-inline" id="ida84dedf068a54ad1bdb26245e49664fe"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Title II of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1721">7 U.S.C. 1721 et seq.</external-xref>) is amended in the title heading by striking <quote><header-in-text level="title" style="OLC">Emergency and Private Assistance Programs</header-in-text></quote> and inserting <quote><header-in-text level="title" style="OLC">Peter O’Brien Food for Peace Program</header-in-text></quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd3be3ab212bd4a5d91e94c116a5e51dc"><enum>(2)</enum><header>General authority</header><text>Section 201 of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1721">7 U.S.C. 1721</external-xref>) is amended in the matter preceding paragraph (1) by striking <quote>title (to be implemented by the Administrator)</quote> and inserting <quote>title, to be known as the <quote>Peter O'Brien Food for Peace Program</quote>, to be implemented by the Administrator,</quote>.</text></paragraph></subsection><subsection id="H26F70E14E757440DA75A878D8E602F2A"><enum>(b)</enum><header>Provision of agricultural commodities</header><text display-inline="yes-display-inline">Section 202 of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1722">7 U.S.C. 1722</external-xref>) is amended—</text><paragraph id="H01D8BD2BD7524ED094A11FE8407A98AF"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="ideec4e233a0c84b7f968dae3d185c1e7e"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>of law, the Administrator</quote> and inserting <quote>in this Act, the Administrator, with the consent of the Secretary,</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id536bf2c9869a48c4b98e202ff255fb78"><enum>(B)</enum><text>by striking <quote>the Administrator determines</quote> and inserting <quote>the Secretary determines</quote>;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id01386ebef4aa47ca9eb1257597d10833"><enum>(2)</enum><text>in subsection (e)—</text><subparagraph id="HB09A55188FF34F47B669C3B8A9B78F14"><enum>(A)</enum><text>in paragraph (1), by striking <quote>7.5 percent nor more than 20 percent</quote> and inserting <quote>5 percent nor more than 10 percent</quote>; and</text></subparagraph><subparagraph id="H4FBAACE8F0F54F17A94A967B489BF679"><enum>(B)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HF466A09DACB3457183ACBC1026104148"><paragraph id="HB703060574DF44B9BA2327B319098876"><enum>(5)</enum><header>Limitation on diversion of funds</header><text display-inline="yes-display-inline">Of the funds made available in each fiscal year under this title to the Administrator, not more than 50 percent shall be made available for expenses other than the procurement of agricultural commodities and ocean transportation.</text></paragraph><paragraph id="H6B0356CBDC544C7889F01287D56BD07D"><enum>(6)</enum><header>Report</header><text>Not later than 180 days after the end of each fiscal year, the Administrator shall submit to the appropriate committees of Congress, and make publicly available on the website of the Administrator, a report that describes—</text><subparagraph commented="no" display-inline="no-display-inline" id="ideebfaf723c5e4ca59e189682dc42e62e"><enum>(A)</enum><text display-inline="yes-display-inline">the uses of funds under this subsection;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idba60aaf91e8c4af9b06939717348ad6b"><enum>(B)</enum><text>each instance of a provision of this Act notwithstood under subsection (a) and the circumstances associated with that instance, including an identification of the particular provision notwithstood; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida8ec00c8ea394331a8c0b65ecef2b14b"><enum>(C)</enum><text display-inline="yes-display-inline">each request made by the Administrator to the Secretary to provide agricultural commodities under subsection (a), the reason for the request, the determination of the Secretary to grant or not grant the request, and the reason for the determination.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbf3acd2466a74fc2baa7f380763b4fff"><enum>(3)</enum><text>in subsection (g)—</text><subparagraph id="HDF2349C3B31949AF942E314753C120EE"><enum>(A)</enum><text>by striking <quote>or food procured outside of the United States,</quote>;</text></subparagraph><subparagraph id="HECB5BF9F247E4F12967D96302A9ABDA5"><enum>(B)</enum><text>by inserting <quote>produced and</quote> before <quote>furnished</quote>; and</text></subparagraph><subparagraph id="id9cc0de97566643e8bd7cf155dbb35bf9"><enum>(C)</enum><text>by striking <quote>of America</quote>.</text></subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H9D210875B84E46478D2F83ABB1306290"><enum>(c)</enum><header>Levels of assistance</header><text>Section 204(a)(3) of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1724">7 U.S.C. 1724(a)(3)</external-xref>) is amended—</text><paragraph display-inline="no-display-inline" commented="no" id="id5551be4162f740f98ae05174f2e665dd"><enum>(1)</enum><text display-inline="yes-display-inline">in the first sentence, by striking <quote>The Administrator</quote> and inserting <quote>The Secretary, following consultation with the Administrator,</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcfadab38cc06419997fb08f8f380530d"><enum>(2)</enum><text>by striking the second sentence and inserting the following: <quote>Not later than 180 days after the end of each fiscal year, the Secretary shall prepare and submit to the Committees on Foreign Affairs, Agriculture, and Appropriations of the House of Representatives and the Committees on Foreign Relations, Agriculture, Nutrition, and Forestry, and Appropriations of the Senate, and make publicly available on the website of the Administrator, a report that describes the reasons for the waiver.</quote>.</text></paragraph></subsection><subsection id="HBC0F4D0D3BAB487296E5676212906919"><enum>(d)</enum><header>Prohibition on certain assistance</header><text display-inline="yes-display-inline">Title II of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1721">7 U.S.C. 1721 et seq.</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HFBA5698FC1074089BCD3292CA61B80A8"><section id="HF9DB23AA34EF41C18700AF20AEF6E103"><enum>209.</enum><header>Prohibition on certain assistance</header><text display-inline="no-display-inline">Under this title, the use of food procured outside of the United States, food vouchers, or cash transfers for food as a form of assistance is prohibited.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H944B20AE99BB4E1AA736FA18A22B2E09"><enum>(e)</enum><header>Definition of agricultural commodity</header><text>Section 402(2) of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1732">7 U.S.C. 1732(2)</external-xref>) is amended in the first sentence by striking <quote>, unless otherwise provided for in this Act,</quote>.</text></subsection><subsection id="HC49D46A5CFEB40DD8FCF6867D0A7803A"><enum>(f)</enum><header>General provisions</header><text>Section 403 of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1733">7 U.S.C. 1733</external-xref>) is amended—</text><paragraph id="HA7CE0F5CA3034686B555B89A3A8AFDD5"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idca6a6baff22040db92a505f72fa32417"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by striking <quote>, food procured outside of the United States, food voucher, or cash transfer for food</quote>; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8d85e4672ffe4f2fb80fdf3fc53fdb61"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><clause id="idf222c3e376294a3aa0d92043e7e8892f"><enum>(i)</enum><text>by striking <quote>in the case of the provision of an agricultural commodity,</quote>; and</text></clause><clause id="id93aa304f9bb947a1b8c27eed1cd5be40"><enum>(ii)</enum><text>by striking <quote>the commodity</quote> each place it appears and inserting <quote>the agricultural commodity</quote>; and</text></clause></subparagraph><subparagraph id="H2A8B0B926A1C47A5B678B7675EB85034"><enum>(C)</enum><text>in paragraph (2), by striking <quote>or use of the food procured outside of the United States, food voucher, or cash transfer for food in the recipient country</quote>; and</text></subparagraph></paragraph><paragraph id="H36D068446FF2451C898155C3F8C133B7"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b), in the first sentence, by striking <quote>, the use of food procured outside of the United States, food vouchers, and cash transfers for food,</quote>.</text></paragraph></subsection><subsection id="HD7FF879BF70F40ADA9C6EB01AED554FB"><enum>(g)</enum><header>Use of Commodity Credit Corporation</header><text>Section 406(b)(6) of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1736">7 U.S.C. 1736(b)(6)</external-xref>) is amended by striking <quote>, distribution, and program implementation costs to use the commodities</quote> and inserting <quote>and distribution costs</quote>. </text></subsection><subsection id="H3CCC1917BD7D4AB08969E329E7251B51"><enum>(h)</enum><header>Conforming amendments</header><paragraph commented="no" display-inline="no-display-inline" id="id0dd7ab083eb64c9486435d1c10db442a"><enum>(1)</enum><text display-inline="yes-display-inline">Section 3206 of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/1726c">7 U.S.C. 1726c</external-xref>) is repealed.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaf7305e5b225415f9183a205939a8910"><enum>(2)</enum><text>Section 9(b) of the Global Food Security Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/22/9308">22 U.S.C. 9308(b)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id297d819150de42898b3750690a08f59a"><enum>(A)</enum><text display-inline="yes-display-inline">by striking paragraph (5); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id81312cd9fc8e4d19876d9321e43be305"><enum>(B)</enum><text>by redesignating paragraphs (6) and (7) as paragraphs (5) and (6), respectively.</text></subparagraph></paragraph></subsection></section><section id="H6F09D5F808344AA28E2C573BF74C5A2E"><enum>3.</enum><header>Simplified Access to the Bill Emerson Humanitarian Trust</header><text display-inline="no-display-inline">Section 302 of the Agricultural Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/7/1736f-1">7 U.S.C. 1736f–1</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ide8c55336a3e84e8a8e966dd405d5814d"><enum>(1)</enum><text>in subsection (c)(1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id537a8709bbda4b82bb92f90987bb27c0"><enum>(A)</enum><text>in subparagraph (B)(i), in the matter preceding subclause (I)—</text><clause commented="no" display-inline="no-display-inline" id="id7896c1def1764c77b807601abf5bd603"><enum>(i)</enum><text display-inline="yes-display-inline">by inserting <quote>by the Secretary in the discretion of the Secretary, which shall be informed by information provided, at the request of the Secretary, by the Administrator regarding the ongoing programs of the Administrator, without undue delay,</quote> after <quote>released</quote>; and</text></clause><clause id="HC668C813D4854B29B15EED9BFD9619AE"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>(<external-xref legal-doc="usc" parsable-cite="usc/7/1721">7 U.S.C. 1721 et seq.</external-xref>)—</quote> and inserting <quote>(<external-xref legal-doc="usc" parsable-cite="usc/7/1721">7 U.S.C. 1721 et seq.</external-xref>), as approved by the Secretary—</quote>; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id477bc26a84b34e2fb1732bcebe90e88f"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>the Administrator</quote> and inserting <quote>the Secretary</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4189767ffd0e409ba235e6a72bcaa9fa"><enum>(2)</enum><text>in subsection (f)(2)(A), by inserting <quote>by the Secretary</quote> after <quote>shall be reimbursed</quote>.</text></paragraph></section></legis-body></bill>
