Federal Land Management Agency Working Group.</toc-entry></toc></subsection></section><section id="id3584934C650D44D09873A3C82212F3B4"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idABF9B48C76AE4A909087519CC1B34807"><enum>(1)</enum><header>Communications facility</header><text>The term <term>communications facility</term> includes—</text><subparagraph id="id53AAA126E17D42A398CE15189C1B853F"><enum>(A)</enum><text>any infrastructure, including any transmitting device, tower, or support structure, and any equipment, switches, wiring, cabling, power sources, shelters, or cabinets, associated with the licensed or permitted unlicensed wireless or wireline transmission of writings, signs, signals, data, images, pictures, and sounds of all kinds; and</text></subparagraph><subparagraph id="id3CDB26575940452CB97AB58FA614650A"><enum>(B)</enum><text>any antenna or apparatus that—</text><clause id="id6FF3F2ED700B4143830F6B4191BFF804"><enum>(i)</enum><text>is designed for the purpose of emitting radio frequency;</text></clause><clause id="id3643A00B0F0C4B36BAC674B609005D19"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id008C2E7B03B54F89B49C503C9E1E556E"><enum>(I)</enum><text>is designed to be operated, or is operating, from a fixed location pursuant to authorization by the Federal Communications Commission; or</text></subclause><subclause id="id393D8497A59A4023B7E9CBC5D339DF72" indent="up1"><enum>(II)</enum><text>is using duly authorized devices that do not require individual licenses; and</text></subclause></clause><clause id="id99A663EADEC54224A867B79F9391B9F7" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text>is added to a tower, building, pole, cable, or other structure.</text></clause></subparagraph></paragraph><paragraph id="id9D5E5ED2F41541D8BC284EFF670B2FD3"><enum>(2)</enum><header>Communications site</header><text>The term <term>communications site</term> means an area of Federal land available for communications use.</text></paragraph><paragraph id="id4D77180C00F6422487D04DE4AA748E1C"><enum>(3)</enum><header>Communications use</header><subparagraph id="id6A69D3F09C1F4716B8F782416E278F50"><enum>(A)</enum><header>In general</header><text>The term <term>communications use</term> means the placement or operation of infrastructure for wireline or wireless telecommunications, including cable television, television, and radio communications, regardless of whether the placement or operation is pursuant to a license issued by the Federal Communications Commission or on an unlicensed basis in accordance with the regulations of the Federal Communications Commission.</text></subparagraph><subparagraph id="idB1AB4A10F5C948B79966A24AF22E9D3E"><enum>(B)</enum><header>Inclusions</header><text>The term <term>communications use</term> includes any ancillary activities, uses, or facilities directly related to the placement or operation of infrastructure for wireline or wireless telecommunications.</text></subparagraph></paragraph><paragraph id="id600F099921554DBCB454D481FB17264B"><enum>(4)</enum><header>Communications use authorization</header><text>The term <term>communications use authorization</term> means a right-of-way, permit, or lease granted, issued, or executed by a Federal land management agency for the primary purpose of authorizing the occupancy and use of Federal land for the construction, placement, and operation of a communications facility.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id568bd92f0e604fcb8492f45a957e681e"><enum>(5)</enum><header>Cost recovery fee</header><text>The term <term>cost recovery fee</term> means any fee collected by a Federal land management agency related to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7e8e5ba3d8e34d6c94a8daa6ce535b50"><enum>(A)</enum><text display-inline="yes-display-inline">an application for a communications use authorization; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf6f51371661b45e489ba0e204f2ebf91"><enum>(B)</enum><text display-inline="yes-display-inline">the occupancy and use authorized by a communications use authorization pursuant to and consistent with authorizing law.</text></subparagraph></paragraph><paragraph id="idC11FDC26BED645C38E73639D46218F0C"><enum>(6)</enum><header>Covered land</header><text>The term <term>covered land</term> means land managed by the Secretary concerned.</text></paragraph><paragraph id="idFCC038710A3444348486FC183AF56CA5"><enum>(7)</enum><header>Electronic SF–299</header><text>The term <term>electronic SF–299</term> means a version of Standard Form 299, or a substantially similar form, that has been digitally modified for online interaction.</text></paragraph><paragraph id="id855708E04D1B4B69A4787F482E7F3E6C"><enum>(8)</enum><header>Federal land</header><text>The term <term>Federal land</term> means land under the jurisdiction and management of a Federal land management agency.</text></paragraph><paragraph id="id3AC9094FE90141698FB991558F588DD5"><enum>(9)</enum><header>Federal land management agency</header><text>The term <term>Federal land management agency</term> means—</text><subparagraph id="id2286D95585D240B68D65240E18F0C8AB"><enum>(A)</enum><text>the National Park Service;</text></subparagraph><subparagraph id="idF09D683FDB0547F1B5E0994BE8AAF14A"><enum>(B)</enum><text>the Bureau of Land Management;</text></subparagraph><subparagraph id="idB258621650384ADA93AAA9623CD6BE37"><enum>(C)</enum><text>the Bureau of Reclamation;</text></subparagraph><subparagraph id="id086BA272563E493A85223788B2C99096" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>the United States Fish and Wildlife Service;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7d6602e3835c484dadd179253952e4bb"><enum>(E)</enum><text display-inline="yes-display-inline">the Bureau of Indian Affairs; and</text></subparagraph><subparagraph id="id4B3DD431A3B94FA28753D8D948502CE1"><enum>(F)</enum><text>the Forest Service.</text></subparagraph></paragraph><paragraph id="id32daf09e75ae4c57a5767d2de540312f"><enum>(10)</enum><header>Organizational unit</header><text>The term <term>organizational unit</term> means—</text><subparagraph id="idd4ac9229b2184b00bb21227e4de815cb"><enum>(A)</enum><text>with respect to Federal land administered by the Secretary of the Interior—</text><clause id="id15573b9b65e04745b290abb9c0de4008"><enum>(i)</enum><text>a State office;</text></clause><clause id="id218baf93c25444459d235a97ae97220d"><enum>(ii)</enum><text>a district office;</text></clause><clause id="idd766714e4b724fd081ec72b047577f59"><enum>(iii)</enum><text>a field office; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id31e214fa51e04704bcbdfc1646e8a38d"><enum>(iv)</enum><text>a regional office; and</text></clause></subparagraph><subparagraph id="ida0c9c3bd61524fc899736a20c84363d5"><enum>(B)</enum><text>with respect to the Forest Service—</text><clause id="id0099ce39c08848cbb55776b2d8c94ee3"><enum>(i)</enum><text>a regional office;</text></clause><clause id="id174fe643800b41e1a5fb365ff2191227"><enum>(ii)</enum><text>the headquarters;</text></clause><clause id="id76013be35d0c4a4ba1aca3eb1143cc43"><enum>(iii)</enum><text>an administrative unit; or</text></clause><clause id="iddca074c860b2456b9b711a15a9c549ca" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text>a ranger district office.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idae67b9d530b34c5bb1ba32f069734c66"><enum>(11)</enum><header>Previously disturbed Federal land</header><text>The term <term>previously disturbed Federal land</term> means Federal land with respect to which a communications use authorization has been granted, issued, or executed.</text></paragraph><paragraph id="idF5EA56A5BAB04567AA8032AFE6FC99E9"><enum>(12)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text><subparagraph id="id1DE650CA977B4376AA666B0B76972672"><enum>(A)</enum><text>the Secretary of the Interior, with respect to Federal land under the jurisdiction and management of the Secretary of the Interior, acting through, as applicable—</text><clause id="id137F22B8680245A38D43E3929170D803"><enum>(i)</enum><text>the Commissioner of Reclamation;</text></clause><clause id="idE4D9D3B24B784D3DBC2249618D20B36C"><enum>(ii)</enum><text>the Director of the National Park Service;</text></clause><clause id="id11111E49AF2E4D0E98D9211CEB889411"><enum>(iii)</enum><text>the Director of the United States Fish and Wildlife Service;</text></clause><clause id="idE589511D1D6D4C6C9066186DE9D39BF2"><enum>(iv)</enum><text>the Director of the Bureau of Land Management; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id0112928fa36d4445a06df6c6a2253798"><enum>(v)</enum><text>the Director of the Bureau of Indian Affairs; and</text></clause></subparagraph><subparagraph id="id1E51DC87C01F46D797ED188886FF75E9" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>the Secretary of Agriculture, with respect to National Forest System land, acting through the Chief of the Forest Service.</text></subparagraph></paragraph><paragraph id="id266E34277D704F179BC8ADB07326A8D5" commented="no" display-inline="no-display-inline"><enum>(13)</enum><header>Standard Form 299</header><text>The term <term>Standard Form 299</term> means the form developed by the Administrator of General Services under section 6409(b)(2)(A) of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455(b)(2)(A)</external-xref>) or any successor form.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3e2362c947874e1e8484a0b0c6841c7d"><enum>(14)</enum><header>Underserved broadband location</header><text>The term <term>underserved broadband location</term> means any location that lacks access to broadband service with a speed of not less than—</text><subparagraph commented="no" display-inline="no-display-inline" id="id00d6a67f34c74cf08cf0131d2636bf32"><enum>(A)</enum><text display-inline="yes-display-inline">100 megabits per second for downloads; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id172ef546c87246cb8a6a274f3348092b"><enum>(B)</enum><text display-inline="yes-display-inline">20 megabits per second for uploads.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA41BAFC639D44B15BED0265C5A8BD61B"><enum>(15)</enum><header>Unserved broadband location</header><text>The term <term>unserved broadband location</term> means any location that lacks access to broadband service with a speed of not less than—</text><subparagraph commented="no" display-inline="no-display-inline" id="id547FEB09361E44FD87BE8AD69049376E"><enum>(A)</enum><text display-inline="yes-display-inline">25 megabits per second for downloads; and</text></subparagraph><subparagraph id="idAB2A6767F3E743BA95DB28008812EC7E" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">3 megabits per second for uploads.</text></subparagraph></paragraph><paragraph id="id060884fbb16545b194595efd84b1ec43"><enum>(16)</enum><header>Working group</header><text>The term <term>working group</term> means the Federal Land Management Agency Working Group established by section 11(a).</text></paragraph></section><section id="id375C9D1DEA7045FCB60C2315CD0BD60C"><enum>3.</enum><header>Promulgation of regulations for streamlining purposes</header><subsection commented="no" display-inline="no-display-inline" id="PHD9419383A99543E480E93D6BF4AE70C3"><enum>(a)</enum><header>Regulations</header><text>Notwithstanding section 6409 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455</external-xref>), not later than 1 year after the date of enactment of this Act, the Secretary concerned shall promulgate regulations—</text><paragraph id="PH4095F47F1D8D475CA772D41D96F9F82D"><enum>(1)</enum><text>to ensure, to the maximum extent practicable, that the process is uniform and standardized across applicable organizational units;</text></paragraph><paragraph id="PH0FCFD1F689F04A7C9B932139E9CD0660"><enum>(2)</enum><text>to require that applications to locate or modify communications facilities on covered land be considered and granted on a competitively neutral, technology neutral, and nondiscriminatory basis; and</text></paragraph><paragraph id="ide3f87da9314b4b7db8c5abc73ee8b446"><enum>(3)</enum><text>to require that the cost recovery fee for locating or modifying covered facilities on covered land be—</text><subparagraph id="id37BCE5B5A8D24D208EB71D4603C8C9E2"><enum>(A)</enum><text>calculated and assessed on an annual basis; and</text></subparagraph><subparagraph id="idA0C98A4633EB4AF696B1EDEA9DBC89F7"><enum>(B)</enum><text>based solely on costs incurred by the organizational unit in processing applications and overseeing any construction related thereto.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="PH7E2B5EA2EC9C4E21848E10E542F90CDC"><enum>(b)</enum><header>Requirements</header><text>The regulations promulgated under subsection (a) shall—</text><paragraph id="PHF4FCF897A1504D08ADA8184C9B9843B4"><enum>(1)</enum><text>include procedures for the tracking of applications described in subsection (a)(1), including—</text><subparagraph id="PHD0579DD72ED846158916B711B3541565"><enum>(A)</enum><text>identifying on a publicly available website the number of applications—</text><clause id="PHA801A103AF234C599279B4CBFC20563A"><enum>(i)</enum><text>received;</text></clause><clause id="PH0999A707E258460B9B538A80677B8D0B"><enum>(ii)</enum><text>approved; and</text></clause><clause id="PHCC2E636E9E084A7AA5FC17067D6044C2"><enum>(iii)</enum><text>denied;</text></clause></subparagraph><subparagraph id="PH55A034AB89874C4C8808FF1D27AF9CFB"><enum>(B)</enum><text>in the case of an application that is denied, requiring that the applicant be provided with—</text><clause id="id108E7E4601214A9CBBA6C3053E0CB9D3"><enum>(i)</enum><text>a written decision describing the reasons for the denial; and</text></clause><clause id="idE64B082C84CD4D32B07B98E37AA7C0FA"><enum>(ii)</enum><text>an opportunity to cure or appeal the denial; and </text></clause></subparagraph><subparagraph id="PH44D2B7A4E4684DAABC16C35136B28EB1"><enum>(C)</enum><text>describing the period of time between the receipt of an application and the issuance of a final decision on an application; and</text></subparagraph></paragraph><paragraph id="PHDDB61FBDF1134BEF9ABEF8B86A412CF4"><enum>(2)</enum><text>provide for minimum lease terms of not less than 30 years for leases with respect to the location of communications facilities on covered land.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="PH4FFEDD55BDA049F08B65F01ECA4933CC"><enum>(c)</enum><header>Additional considerations</header><text>In promulgating regulations under subsection (a), the Secretary concerned shall consider—</text><paragraph id="PHAE77C889C07F4D7F8A4E9538500D1B67"><enum>(1)</enum><text>how discrete reviews in considering an application described in paragraph (1) of that subsection can be conducted simultaneously, rather than sequentially, by any organizational units that must approve the location or modification; and</text></paragraph><paragraph id="PHC366C2405B1E4B648395E109B1967CB9"><enum>(2)</enum><text>how to eliminate overlapping requirements among the organizational units with respect to the location or modification of a communications facility on covered land administered by the organizational units.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="PHA100EF0510774DC2A2C1B3259A04C16E"><enum>(d)</enum><header>Communication of streamlined process to organizational units</header><text>The Secretary concerned shall, with respect to the regulations promulgated under subsection (a)—</text><paragraph id="PH7E63B74ABD5E4E2C8B63824DA121FD70"><enum>(1)</enum><text>communicate the regulations to the applicable organizational units; and</text></paragraph><paragraph id="PHE158DD2F804C4768975EEC62EFC012B9"><enum>(2)</enum><text>ensure that those organizational units follow the regulations.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="PH4F9A9761721444F688FF40858C819933"><enum>(e)</enum><header>Savings provisions</header><paragraph id="PHB8150175A0F8454C9A04B9F504AD1DE1"><enum>(1)</enum><header>Real property authorities</header><text>Nothing in this section provides any executive agency or organizational unit with any new leasing or other real property authorities not in existence before the date of enactment of this Act.</text></paragraph><paragraph id="PH288F9DFD33874A09BAB7204C9BB1CC9A"><enum>(2)</enum><header>Effect on other laws</header><subparagraph id="idF8F8976A58E241D3A5E11EB9DED6909C"><enum>(A)</enum><header>In general</header><text>Nothing in this section, including any action taken pursuant to this section, affects a decision or determination made by any executive agency before the date of enactment of this Act to sell, dispose of, declare excess or surplus, lease, reuse, or redevelop any Federal real property pursuant to title 40, United States Code, the Federal Assets Sale and Transfer Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/40/1303">40 U.S.C. 1303</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/287">Public Law 114–287</external-xref>), or any other law governing real property activities of the Federal Government.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD3D4423AEEE648A5BDC8EB43EBCF4CD9"><enum>(B)</enum><header>Agreements</header><text>No agreement entered into pursuant to this section obligates the Federal Government to hold, control, or otherwise retain or use real property that may otherwise be deemed as excess, surplus, or that could otherwise be sold, leased, or redeveloped.</text></subparagraph></paragraph></subsection></section><section id="idA0643EC999084346B829EDE3B86E7FAE"><enum>4.</enum><header>Online tracking of application progress</header><subsection id="id86C95CD0FD1A4860B361CE79490A575B"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that communications projects (as defined in section 41001 of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m">42 U.S.C. 4370m</external-xref>)) should be, under title XLI of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m">42 U.S.C. 4370m et seq.</external-xref>), considered a high priority as having an increased regional or national economic significance.</text></subsection><subsection id="idC6628AC479664A1EB9DC8BFDE3440F64"><enum>(b)</enum><header>Communications projects as covered projects</header><text>Section 41001 of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m">42 U.S.C. 4370m</external-xref>) is amended—</text><paragraph id="id0C26E2957F924BA39CFA19612CFDF41A"><enum>(1)</enum><text>by redesignating paragraphs (4) through (18) as paragraphs (5) through (19), respectively;</text></paragraph><paragraph id="id063065CC24BE45708951016C964A87B0"><enum>(2)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4B51DC203B924AD38A369EDF71844432"><paragraph id="id2BB078B302AA4B4A8DDEF75E3AE887EB"><enum>(4)</enum><header>Communications project</header><subparagraph id="id1970D1DA11254BB2B59C842779E59E10"><enum>(A)</enum><header>In general</header><text>The term <term>communications project</term> means any construction project carried out at a communications site.</text></subparagraph><subparagraph id="id3A28FA19B24E4AD7A7C17EE9AA2A86C9"><enum>(B)</enum><header>Other terms</header><text>For purposes of this paragraph:</text><clause id="idAC0DA0520DDC4C5E977FA88730B3F2A2"><enum>(i)</enum><header>Communications facility</header><text>The term <term>communications facility</term> includes—</text><subclause id="idBD57B3FFCF8945EA9596B5ABF3B6A028"><enum>(I)</enum><text>any infrastructure, including any transmitting device, tower, or support structure, and any equipment, switches, wiring, cabling, power sources, shelters, or cabinets, associated with the licensed or permitted unlicensed wireless or wireline transmission of writings, signs, signals, data, images, pictures, and sounds of all kinds; and</text></subclause><subclause id="idF6627E6FA3164E4EBFF698169089722A"><enum>(II)</enum><text>any antenna or apparatus that—</text><item id="id49050C334F8E413E9625C3C92AE56FC2"><enum>(aa)</enum><text>is designed for the purpose of emitting radio frequency;</text></item><item id="idC6D460909252422FA7642077430A1D54"><enum>(bb)</enum><subitem commented="no" display-inline="yes-display-inline" id="id87cf783686954c3ea9003f5d31662890"><enum>(AA)</enum><text>is designed to be operated, or is operating, from a fixed location pursuant to authorization by the Federal Communications Commission; or</text></subitem><subitem id="idE7AC8BF4AD6B46299ECD657AC87A91D6" indent="up1"><enum>(BB)</enum><text>is using duly authorized devices that do not require individual licenses; and</text></subitem></item><item id="id3B8F02602936400295CA74A13E934D3A" commented="no" display-inline="no-display-inline"><enum>(cc)</enum><text>is added to a tower, building, pole, cable, or other structure. </text></item></subclause></clause><clause id="idBF8F1D0103194AD38D607B766EB56A8F"><enum>(ii)</enum><header>Communications site</header><text>The term <term>communications site</term> means an area of Federal land available for communications use.</text></clause><clause id="idC78AA1C117AA45C3822919E6C8193318"><enum>(iii)</enum><header>Communications use</header><subclause id="id70C2D81D3D774F14B55C4488E304E0C9"><enum>(I)</enum><header>In general</header><text>The term <term>communications use</term> means the placement or operation of infrastructure for wireline or wireless telecommunications, including cable television, television, and radio communications, regardless of whether the placement or operation is pursuant to a license issued by the Federal Communications Commission or on an unlicensed basis in accordance with the regulations of the Federal Communications Commission.</text></subclause><subclause id="id91B504155BC64DBF9A3856649DC170F8" commented="no" display-inline="no-display-inline"><enum>(II)</enum><header>Inclusions</header><text>The term <term>communications use</term> includes any ancillary activities, uses, or facilities directly related to the placement or operation of infrastructure for wireline or wireless telecommunications.</text></subclause></clause><clause id="idE72AFEA1F7A7495DA99F873F7780AC43"><enum>(iv)</enum><header>Federal land</header><text>The term <term>Federal land</term> means land under the jurisdiction and management of a Federal land management agency.</text></clause><clause id="id654C7C8CEE214EFD82D4822BF6B481A6"><enum>(v)</enum><header>Federal land management agency</header><text>The term <term>Federal land management agency</term> means—</text><subclause id="id2BE8E4AF5A02403A89571835456AE3AC"><enum>(I)</enum><text>the National Park Service;</text></subclause><subclause id="id7A8A8EDD95934050B35E22E42F675CD8"><enum>(II)</enum><text>the Bureau of Land Management;</text></subclause><subclause id="id1B82DA7C83A14358BBCA132C5C69A54A"><enum>(III)</enum><text>the Bureau of Reclamation;</text></subclause><subclause id="id706A17A647F74FDA81D4DADA4B386477" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text>the United States Fish and Wildlife Service;</text></subclause><subclause id="idB7922FD7905A4BA092B6866246BA3C5D" commented="no" display-inline="no-display-inline"><enum>(V)</enum><text>the Forest Service; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idf082e58998e641b4be3e891af3a26146"><enum>(VI)</enum><text display-inline="yes-display-inline">the Bureau of Indian Affairs.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idFF7289EE9C1F4BB2A252615000AC67F1"><enum>(3)</enum><text>in paragraph (7)(A) (as so redesignated)—</text><subparagraph commented="no" id="idA2C916EB5FDB40BF8A7766D1BA04B472"><enum>(A)</enum><text>in the matter preceding clause (i), by inserting <quote>communications projects,</quote> after <quote>carbon capture,</quote>; and</text></subparagraph><subparagraph commented="no" id="id0986DDDDA32649B58C0F5B01DAAA037E"><enum>(B)</enum><text>in clause (i), by striking subclause (II) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5751A5D9020F43C9BFE6D2DFCD0E3D7C"><subclause id="idE6F768C191454CB98E03854628BC3E7D" indent="up1"><enum>(II)</enum><text>is likely to require a total investment—</text><item id="id467FC5DF912E47569F290E01578F4429"><enum>(aa)</enum><text>in the case of a communications project, of any amount; and</text></item><item commented="no" display-inline="no-display-inline" id="idAB77A8C6362B4FDB8475110408FBFA29"><enum>(bb)</enum><text>in the case of any other activity, of more than $200,000,000; and</text></item></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section id="idEC13EBBB99D645818B5B50B293D3C4D1"><enum>5.</enum><header>Improving public safety on Federal land</header><text display-inline="no-display-inline"> Not later than 30 days after the date of enactment of this Act, the Secretary concerned shall direct the head of each Federal land management agency under the jurisdiction of the Secretary concerned to establish a new categorical exclusion from the requirements of title I of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4331">42 U.S.C. 4331 et seq.</external-xref>) for projects involving an existing communications facility that would improve public safety on Federal land, such as—</text><paragraph id="id031154ec9ff14b568f21d972e83f3263"><enum>(1)</enum><text>providing backup power for the communications facility;</text></paragraph><paragraph id="id790ef287512a42978db24741a4dab7a2"><enum>(2)</enum><text>improving supporting infrastructure at the communications facility; or</text></paragraph><paragraph id="id0d43a420cdd9480ba2cdaf5b3ae75472"><enum>(3)</enum><text>providing more reliable or redundant connection capabilities using the communications facility.</text></paragraph></section><section id="S1"><enum>6.</enum><header>Previously disturbed rights-of-way exemption</header><text display-inline="no-display-inline"> No review shall be required under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) or division A of subtitle III of title 54, United States Code, as a condition of granting a communications use authorization for the occupancy and use of previously disturbed Federal land.</text></section><section id="idDCA3E0DDE9A947C88780091A691F66CD"><enum>7.</enum><header>Wireless facility modifications</header><text display-inline="no-display-inline">Section 6409(a) of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455(a)</external-xref>) is amended by striking paragraph (3).</text></section><section id="id282DCB6A6497465BB2E4B5D93CDC2AC6"><enum>8.</enum><header>Establishment of online portals</header><subsection commented="no" display-inline="no-display-inline" id="id3F5D0A1288284C8A90140CB7FC2BDB90"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, each Federal land management agency shall establish an online portal to accept an electronic SF–299.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id9A89DB7ADAEB4466ADE9F4059CBEC019"><enum>(b)</enum><header>Coordination</header><text>The Federal land management agencies shall coordinate with each other to establish uniform versions of the online portal required under subsection (a).</text></subsection></section><section id="IDE8F1CAB44F954BF084067ABBBB8182CA"><enum>9.</enum><header>Collection and retention of cost recovery fees</header><subsection id="ID339BB3086A6949138CAFD50C91325DF4"><enum>(a)</enum><header>Collection and retention of cost recovery fees associated with communications use authorizations on Federal land and Federal land management agency support for communications site programs</header><paragraph id="ID28566A9F4EBC4791816F1BE991107AC0"><enum>(1)</enum><header>Special account required</header><text>The Secretary of the Treasury shall establish a special account in the Treasury for each Federal land management agency for the deposit of cost recovery fees received by the Federal land management agency relating to communications use authorizations granted, issued, or executed by the Federal land management agency.</text></paragraph><paragraph id="idC212BDC64300415689F7F124B290926A"><enum>(2)</enum><header>Requirements for cost recovery fees</header><text>Notwithstanding any other provision of law, any cost recovery fees collected by a Federal land management agency pursuant to this section shall be—</text><subparagraph commented="no" id="H5C50398509FB4A768D7AE4A50DC6B0E2"><enum>(A)</enum><text>collected only to the extent provided in advance in an appropriations Act; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDD31B5FD9BBB4353BFAA53464B54D42A"><enum>(B)</enum><text>imposed on a competitively neutral, technology-neutral, and nondiscriminatory basis with respect to other uses of the applicable communications site.</text></subparagraph></paragraph><paragraph id="ID7FC2BCD3CB7C43DD9212B0CB2CA2E11F"><enum>(3)</enum><header>Deposit and retention of cost recovery fees</header><text>Cost recovery fees received by a Federal land management agency shall—</text><subparagraph id="ID5F6A608D4016403FB2211FF8849FE2FF"><enum>(A)</enum><text>be deposited in the special account established for that Federal land management agency under paragraph (1); and</text></subparagraph><subparagraph id="ID45AF7593D21A4E3EAA3510FEC6D01DFE"><enum>(B)</enum><text>remain available for expenditure under paragraph (4), to the extent and in such amounts as are provided in advance in appropriations Acts.</text></subparagraph></paragraph><paragraph id="IDBF9EC6DE8F464996ADABE9E9DE8B1093"><enum>(4)</enum><header>Expenditure of retained fees</header><text>Amounts deposited in the special account established for a Federal land management agency under paragraph (1) shall be used by the Federal land management agency for activities relating to communications use authorizations or communications sites, including the following:</text><subparagraph id="ID42EDFA8410234F9AA539B034F617C977"><enum>(A)</enum><text>Administering communications use authorizations, including through cooperative agreements under subsection (b).</text></subparagraph><subparagraph id="ID22E1F4E0A18F47A6B9D563C2FACBF51D"><enum>(B)</enum><text>Preparing needs assessments or other programmatic analyses necessary to establish communications sites and authorize communications uses on or adjacent to Federal land.</text></subparagraph><subparagraph id="ID0B5FD21A17D3446E94BD075883A4DD81"><enum>(C)</enum><text>Developing management plans for the placement of communications sites on or adjacent to Federal land on a competitively neutral, technology-neutral, nondiscriminatory basis.</text></subparagraph><subparagraph id="IDA707A8B20E1E49928BBE9E8298ADD05E"><enum>(D)</enum><text>Training for management of communications sites on or adjacent to Federal land.</text></subparagraph><subparagraph id="ID88CAFEA3606644239A9502559B18DE06"><enum>(E)</enum><text>Obtaining, improving access to, or establishing communications sites on or adjacent to Federal land.</text></subparagraph><subparagraph id="idC2FEA7CE2B5E4B36B471F4DDDAF8756B"><enum>(F)</enum><text>Hiring and training personnel to perform duties that will help—</text><clause id="id533A29E3C56241DAB75116B249C1DCE9"><enum>(i)</enum><text>to streamline permitting processes associated with communications use authorizations and the use of communications sites for communications use on Federal land; and</text></clause><clause id="id1CCD716C8C35424792AF45B17EAD5CA0"><enum>(ii)</enum><text>to reduce the time it takes for permits relating to communications use authorizations and the use of communications sites for communications use on Federal land to be approved.</text></clause></subparagraph></paragraph><paragraph id="ID301E692A379043598CB16D93D14346CC"><enum>(5)</enum><header>No effect on other fee retention authorities</header><text>This subsection shall not limit or otherwise affect fee retention by a Federal land management agency under any other authority.</text></paragraph></subsection><subsection id="IDD49D9F8E5EDC4C12A0F39999DEC324A8"><enum>(b)</enum><header>Cooperative agreement authority</header><text display-inline="yes-display-inline">The Secretary of the Interior may enter into cooperative agreements to carry out the activities described in subsection (a)(4).</text></subsection><subsection commented="no" id="id8122d3ebb600451b9d8e608b3a283de7"><enum>(c)</enum><header>Clarification of cooperative agreement authority of the Secretary of Agriculture</header><text display-inline="yes-display-inline">Section 8705(f) of the Agriculture Improvement Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/43/1761a">43 U.S.C. 1761a(f)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0c63b6cf384e45c98211ccc2b26c8e58"><paragraph commented="no" id="idc0ab650d1169463b8c4655a2017f13c7"><enum>(6)</enum><header>Cooperative agreement authority</header><text>The Secretary may enter into cooperative agreements to carry out the activities described in subparagraphs (A) through (D) of paragraph (4).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id718A21B4C2DF49089BB1555E408ED092"><enum>10.</enum><header>Federal Land Management Agency Working Group</header><subsection id="id3B1E4DB869E84EC6AF1FADBA62575129"><enum>(a)</enum><header>Establishment</header><text>There is established a working group, to be known as the <quote>Federal Land Management Agency Working Group</quote>.</text></subsection><subsection id="id0C165C32586347839F2F053D26D0947B"><enum>(b)</enum><header>Membership</header><text>The working group shall be composed of 1 representative of each of the Federal land management agencies, to be appointed by the Secretary concerned.</text></subsection><subsection id="id23F4B0DCE1F440608273EE1338DBD7B5"><enum>(c)</enum><header>Duties</header><text>The working group shall—</text><paragraph id="id67E1A1DDCA254E86ABEB1A0D40AA21E3"><enum>(1)</enum><text>periodically meet to coordinate and expedite the review of applications for communications use authorizations; and</text></paragraph><paragraph id="id25E1B8F2191C43D5A472831335D8B8CF" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>coordinate with the Federal Communications Commission to use broadband location data created under section 802(c) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/642">47 U.S.C. 642(c)</external-xref>) to identify unserved locations that may need to use a Federal right-of-way and prepare for potential communications use authorization applications.</text></paragraph></subsection></section></legis-body></bill>
