which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Veterans Affairs to enter into an agreement with the city of Fargo, North Dakota, for the conveyance of certain land of the Department of Veterans Affairs at Fargo National Cemetery, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act: </text><paragraph id="id181e971ba44b4d8fa9e35ead5209ffcf"><enum>(1)</enum><header>City</header><text>The term <term>City</term> means the city of Fargo, North Dakota. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1cb965441a1b4f9ba3536d19e6119964"><enum>(2)</enum><header display-inline="yes-display-inline">Department</header><text>The term <term>Department</term> means the Department of Veterans Affairs.</text></paragraph><paragraph id="ida181d5d01c2e40bd94338e10be38d6e4"><enum>(3)</enum><header>Parcel</header><text>The term <term>parcel</term> means the approximately 2.73 acres of land of the Department of Veterans Affairs at Fargo National Cemetery in Harwood, North Dakota, located in the southeast corner of the proposed expansion of the cemetery as depicted on the map provided by the Department entitled <quote>Fargo National Cemetery</quote><quote>Figure B</quote> and dated April 21, 2023.</text></paragraph><paragraph id="idcd7e0c7b39534655830c5e68f8faf437"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Veterans Affairs.</text></paragraph></section><section id="idf2ff6e89fb234726b30a8a736495557a"><enum>2.</enum><header>Conveyance of Department of Veterans Affairs land at Fargo National Cemetery</header><subsection id="id9e3ed32473c8490ea0ca61a68cde78fd"><enum>(a)</enum><header>In general</header><text>After the acquisition by the Department of Veterans Affairs of 29.06 acres adjacent to the original 4.82-acre area of Fargo National Cemetery, North Dakota, and only if such acquisition is completed, upon a written request from the City for the conveyance of the parcel, the Secretary shall enter into an agreement with the City under which the Secretary shall convey to the City all right, title, and interest of the United States in and to the parcel for the purpose of improving the experience of visitors and volunteers at Fargo National Cemetery.</text></subsection><subsection id="id31008082b8ca46dfb51f046f3e6ecdb6"><enum>(b)</enum><header>Consideration</header><paragraph id="id21fe7a7e1ed541159975b04f5f985db8"><enum>(1)</enum><header>In general</header><text>Under the agreement described in subsection (a), for the conveyance of the parcel, the City shall pay to the Secretary an amount equal to the market value of the parcel, as determined by the appraisal conducted under paragraph (2). </text></paragraph><paragraph id="id191f2f58419f4fc4a490e603012c96ea"><enum>(2)</enum><header>Appraisal</header><text>The Secretary shall conduct an appraisal of the parcel to be conveyed under subsection (a) in accordance with—</text><subparagraph id="iddb215128956444f3af269f7d412a8865"><enum>(A)</enum><text>the Uniform Appraisal Standards for Federal Land Acquisitions;</text></subparagraph><subparagraph id="id883a67479a26417da4dc8b3c89dba999"><enum>(B)</enum><text>the Uniform Standards of Professional Appraisal Practice; and</text></subparagraph><subparagraph id="idacc78808a83344879110604c2a268607"><enum>(C)</enum><text>any other applicable law (including regulations).</text></subparagraph></paragraph></subsection><subsection id="idd9a2f165db804a699077d0ef6b5dab23"><enum>(c)</enum><header>Additional conditions</header><text>The Secretary may require such additional conditions in connection with the conveyance of the parcel as the Secretary considers appropriate.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id0f8a9bd7991d416f8fc645b13c4357cb"><enum>(d)</enum><header>Proceeds</header><text display-inline="yes-display-inline">Proceeds from the conveyance of the parcel shall be deposited into the National Cemetery Administration Facilities Operation Fund. </text></subsection></section><section id="id643f7afada7c464f87e78e5f0a048db9"><enum>3. </enum><header>Rules of construction</header><subsection id="id18af3447a8ed484a87179f0cdc93ea58"><enum>(a)</enum><header>No requirement for purchase or sale of other parcels</header><text>Nothing in this Act shall be construed to require or encourage the Secretary to purchase or sell any parcel not described in section 1(3).</text></subsection><subsection id="idfcebbdc06c92408393753951434a9fd4"><enum>(b)</enum><header>No requirement for special agreements</header><text>Nothing in this Act shall be construed to require or encourage the Secretary to enter into any special agreement with an entity not described in section 1(1).</text></subsection></section></legis-body></bill>
