which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure that only licensed health care professionals furnish disability examinations under a certain Department of Veterans Affairs pilot program for use of contract physicians for disability examinations, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idA5189FAAD57F4C71BC3E40076F9931A3"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Better Examiner Standards and Transparency for Veterans Act of 2023</short-title></quote> or the <quote><short-title>BEST for Vets Act of 2023</short-title></quote>.</text></section><section section-type="subsequent-section" id="idAAAAA90647B041EBABE38CE03272C14E"><enum>2.</enum><header>Ensuring only licensed health care professionals furnish medical disability examinations under certain Department of Veterans Affairs pilot program for use contract physicians for disability examinations</header><subsection id="id1AB73D014391432F9AC7CBF39D20D4B4"><enum>(a)</enum><header>Prohibition on use of certain health care professionals</header><text>Section 504(a) of the Veterans' Benefits Improvements Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/275">Public Law 104–275</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/5101">38 U.S.C. 5101</external-xref> note) is amended—</text><paragraph id="idFDA1DE9A3B4F45DFA4DDD67627866992"><enum>(1)</enum><text>by striking <quote>The Secretary of Veterans Affairs</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id80DB166F1CDB41E8A9D987BE21B22CA7"><paragraph id="id0EB273E6E4394A7285F50CD36F8F6EB3"><enum>(1)</enum><header>In general</header><text>The Secretary of Veterans Affairs</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idFC22B166620349BAB65B751B5184EBED"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id51DE30A6244548BB9B7E65CB512714A7"><paragraph id="idE034F917417349C4BC53433740A55E7A"><enum>(2)</enum><header>Prohibition</header><text>No examination described in paragraph (1) may be carried out under this section by any health care professional other than one described in subsection (c)(2).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id308B3D4F3E4C4DF7B275DE856F135541"><enum>(b)</enum><header>Remedies</header><text>The Secretary of Veterans Affairs shall take such actions as the Secretary considers appropriate to ensure that only health care professionals described in subsection (c)(2) of section 504 of the Veterans' Benefits Improvements Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/275">Public Law 104–275</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/5101">38 U.S.C. 5101</external-xref> note) are conducting examinations pursuant to contracts entered into under such section.</text></subsection><subsection id="idB00CCB2AC3694F05A8D73CFB244091B6"><enum>(c)</enum><header>Annual report</header><text>Not later than one year after the date of the enactment of this Act and not less frequently than once each year thereafter, the Secretary shall submit to the Committee on Veterans' Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives a report on—</text><paragraph id="id4C9208CCCDEB4CAAAA8B70819E8FEC80"><enum>(1)</enum><text>the conduct of the pilot program established under section 504 of the Veterans' Benefits Improvements Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/275">Public Law 104–275</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/5101">38 U.S.C. 5101</external-xref> note); and</text></paragraph><paragraph id="idC8C1A1875B9C4811B73035B19CBAEEE8"><enum>(2)</enum><text>the actions of the Secretary under subsection (b).</text></paragraph></subsection><subsection id="id4035AFB0DE394BE8BFEAD81345A7A41A"><enum>(d)</enum><header>Technical corrections</header><text>Section 504 of the Veterans' Benefits Improvements Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/275">Public Law 104–275</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/5101">38 U.S.C. 5101</external-xref> note) is amended, in the section heading, by striking <quote><header-in-text level="section" style="OLC">physicians</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">health care professionals</header-in-text></quote>.</text></subsection></section></legis-body></bill>
