which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Commerce to establish and carry out a grant program to conserve, restore, and manage kelp forest ecosystems, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HFE9DE5B70A3D41D18C9A3F0658C3BAD2"><section section-type="section-one" id="H7E58073BC31B4EBC9239765CEAEA96AA"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Help Our Kelp Act</short-title></quote>. </text></section><section id="HFBFE118A53F841CF810D558D14228D2E"><enum>2.</enum><header>Grants to conserve, restore, and manage kelp forest ecosystems</header><subsection id="id288d51c437454c0aada0d335e32771ef"><enum>(a)</enum><header>Establishment</header><text>The Administrator shall establish, not later than 180 days after the date of the enactment of this Act, and carry out a grant program under which the Administrator shall award grants to eligible entities described in subsection (b) to carry out eligible projects described in subsection (c) relating to the conservation, restoration, or management of kelp forest ecosystems.</text></subsection><subsection id="id7f5d211e228d4d96a6380006dfacf276"><enum>(b)</enum><header>Eligible entities</header><text>To be eligible for a grant under this section, an entity shall—</text><paragraph id="id5d49aae015b74f4d9882ae8d7afb6d3f"><enum>(1)</enum><text>be—</text><subparagraph id="id7b4878228093401697ed6e2a66e8f8df"><enum>(A)</enum><text>a member of the fishing industry;</text></subparagraph><subparagraph id="idf5f4351af5b94571afadc7036290fb34"><enum>(B)</enum><text>an institution of higher education;</text></subparagraph><subparagraph id="id5a64659e8afe4cd1b5dca138707b5252"><enum>(C)</enum><text>a nonprofit organization;</text></subparagraph><subparagraph id="idf63b88bcdc394a6783e88641ecb3b33e"><enum>(D)</enum><text>an Indian Tribe; </text></subparagraph><subparagraph id="idfcbea2588e7443a6b25ccbb424e5fe75"><enum>(E)</enum><text>a State agency; or</text></subparagraph><subparagraph id="ide4598fe5db0f4362bdc2484f53a7b43b"><enum>(F)</enum><text>a local government;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8e2d717fb75b4b3db1b37ba1dd2a60ab"><enum>(2)</enum><text>consult or collaborate with any other entity described in paragraph (1) throughout the development or implementation of a project relating to the conservation, restoration, or management of kelp forest ecosystems; and </text></paragraph><paragraph id="id6ca38b63fe23476cba3f99a20d6539dc"><enum>(3)</enum><text>submit to the Administrator an application describing that project at such time, in such manner, and containing such information as the Administrator may require, including information regarding—</text><subparagraph commented="no" display-inline="no-display-inline" id="id33dd70d579a14d409bcf938e97ea3d5f"><enum>(A)</enum><text display-inline="yes-display-inline">what criteria will be used to monitor and evaluate the effectiveness of the project; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9760a24091f8401db3aa4a7c90c2ef6a"><enum>(B)</enum><text display-inline="yes-display-inline">the qualifications of the applicant to conduct, monitor, and evaluate the project.</text></subparagraph></paragraph></subsection><subsection id="idc988e984542f483bbbd84540b9d86976"><enum>(c)</enum><header>Eligible projects</header><text>The Administrator shall award grants to eligible entities for projects that—</text><paragraph id="id689603c1c73d42469bcd23835c89d71b"><enum>(1)</enum><text>address the greatest relative regional declines in kelp forest ecosystems;</text></paragraph><paragraph id="idfd10a2ffd7ec4f8ca39693d5fd0d31b5"><enum>(2)</enum><text>focus on elements such as—</text><subparagraph id="id12f7ee9fabf343008d4dc2ffc72451a7"><enum>(A)</enum><text>the long-term resilience of kelp forest ecosystems;</text></subparagraph><subparagraph id="idf2998a9131514d4b900d9ae190ef3996"><enum>(B)</enum><text>long-term socioeconomic resilience related to kelp forest ecosystems;</text></subparagraph><subparagraph id="id96f05dce424449bfba8f7576c1d950b0"><enum>(C)</enum><text>kelp forest seeding and connectivity;</text></subparagraph><subparagraph id="idc629e2622f84446eab7fe13f70a90df5"><enum>(D)</enum><text>reestablishing or recovering natural trophic relationships and structure to support the resilience of kelp forest ecosystems through actions such as predator control through targeted urchin removal and the recovery of sunflower sea stars;</text></subparagraph><subparagraph id="idf3dcb3f52e804cf381526bc0d4322e2b"><enum>(E)</enum><text>monitoring and assessment of kelp forest ecosystems;</text></subparagraph><subparagraph id="id27dd70dd63654bc0b3d419e373107e9c"><enum>(F)</enum><text>integration of Indigenous knowledge and cultural practices into restoration and monitoring of kelp forest ecosystems through consultation with Indian Tribes or promotion of Federal or State co-management with Indian Tribes; or</text></subparagraph><subparagraph id="id4facc95507a74ae591a05e5d55b0e673"><enum>(G)</enum><text>other efforts to restore kelp forest ecosystems and prevent large scale losses of kelp forests; or</text></subparagraph></paragraph><paragraph id="ida1cdf6022cd940b987972a585bd31b44"><enum>(3)</enum><text>are identified by Indian Tribes or Federal or State restoration or management plans as focal areas for recovery of kelp forests and associated species. </text></paragraph></subsection><subsection id="idf1634032060742758cff1d55331a8869"><enum>(d)</enum><header>Matching requirement</header><paragraph id="id1640db5fc4be42f29224a205bc6c4bcb"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the amount of Federal funding received as a grant under this section by an eligible entity may not exceed 85 percent of the total cost of the project for which the grant is awarded. For the purposes of this paragraph, the non-Federal share of the costs of a project may be provided by in-kind contributions and other noncash support.</text></paragraph><paragraph id="idfaf1f76942ef476fbf604a29d97b333e"><enum>(2)</enum><header>Waiver</header><text>The Administrator may waive all or part of the requirement in paragraph (1) if the Administrator determines that—</text><subparagraph id="id03a3c18439f94d838870ea7e728b7431"><enum>(A)</enum><text>no reasonable means are available through which an eligible entity applying for a grant under this section can meet that requirement;</text></subparagraph><subparagraph id="iddd7bb2720d914dceafd7bfd11abb0edf"><enum>(B)</enum><text>the probable benefit of the project outweighs the public interest in such requirement; and</text></subparagraph><subparagraph id="id3ad008c5432e4016923915fa09e5db6d"><enum>(C)</enum><text>the project undertaken is established on lands owned by or held in trust for an Indian Tribe.</text></subparagraph></paragraph></subsection><subsection id="idae59943e10174ae4b054f92469385a46"><enum>(e)</enum><header>Guidelines and criteria</header><text>The Administrator shall—</text><paragraph id="ida97ab63ec3bf478f806afc710b219fbb"><enum>(1)</enum><text>issue guidelines for implementation of the grant program established under subsection (a); and</text></paragraph><paragraph id="id1640dd44aced41ec8612da01813eb2ec"><enum>(2)</enum><text>establish criteria for evaluating eligible projects based on best practices, best available science, and community engagement to rank eligible projects under subsection (c).</text></paragraph></subsection><subsection id="id135d5eae3e004dcd87868f47061510ec"><enum>(f)</enum><header>Authorization of appropriations</header><paragraph id="id452b75b677604aeeba35f6b9f8803fae"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Administrator $5,000,000 for each of fiscal years 2024 through 2028 to carry out this section. </text></paragraph><paragraph id="ida9792465289b4e11863a6e63999fb8aa"><enum>(2)</enum><header>Availability to Indian Tribes</header><subparagraph commented="no" display-inline="no-display-inline" id="id0b89001686ab45deb25e2846d09db5c3"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Of the amount authorized to be appropriated by paragraph (1) for a fiscal year, not less than $750,000 shall be available to award grants under this section to eligible entities that are Indian Tribes.</text></subparagraph><subparagraph id="id8fd8b0dcb34f423e82ae7b4a469dba84"><enum>(B)</enum><header>Contingency; outreach</header><text>If no Indian tribe is awarded a grant under this section in a fiscal year—</text><clause id="idd4f755786db14960b5c3f8be7e081868"><enum>(i)</enum><text>for that fiscal year, the amount described in subparagraph (A) shall be made available to award grants under this section to other eligible entities; and</text></clause><clause id="id55b2998f104c4e25882af1d21ac3f4ae"><enum>(ii)</enum><text>the Administrator shall conduct outreach to inform Indian Tribes and organizations that work with Indian Tribes of the grant program established under subsection (a). </text></clause></subparagraph></paragraph></subsection><subsection id="id1108306f7855464a8a77471319c0db74"><enum>(g)</enum><header>Definitions</header><text>In this section: </text><paragraph id="idf9a3ee0e657940aba728e69742e6e2da"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Secretary of Commerce, acting through the Administrator of the National Oceanic and Atmospheric Administration.</text></paragraph><paragraph id="id2adefebb2641480e800f35a3263832f4"><enum>(2)</enum><header>Fishing industry</header><text>The term <term>fishing industry</term> means—</text><subparagraph id="id765cf3fb767f47ec814a9d0cf523813f"><enum>(A)</enum><text>processors;</text></subparagraph><subparagraph id="idf3f2e80add2346e6b2897ef32a829ba0"><enum>(B)</enum><text>commercial fishermen; and</text></subparagraph><subparagraph id="id8afe9e1b0dd340c1b184a95a9ed61cc7"><enum>(C)</enum><text>recreational fishermen.</text></subparagraph></paragraph><paragraph id="idebef58396a0d480e9c8066559a13569e"><enum>(3)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="idebf47e93847243149f40eebea549a67f"><enum>(4)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given that term in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text></paragraph><paragraph id="idb30f745f249149a49ed1d1e0474f19a3"><enum>(5)</enum><header>Kelp forest ecosystem</header><text>The term <term>kelp forest ecosystem</term> means a naturally occurring, biotic system dominated by canopy-forming, stipitate, or prostrate benthic macroalgae and associated taxa.</text></paragraph><paragraph id="idca7219b0adcc4774bece830da25d3311"><enum>(6)</enum><header>Local government</header><text>The term <term>local government</term> means a unit of general local government, a school district, or other special district established under State law. </text></paragraph><paragraph id="id4ecebb02345e4ec587e016c9bf921b85"><enum>(7)</enum><header>Nonprofit organization</header><text>The term <term>nonprofit organization</term> means an organization—</text><subparagraph id="id9f6c6e634e2a4bb0beac303e35b039b8"><enum>(A)</enum><text>described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986; and</text></subparagraph><subparagraph id="ide1b303d242bb4489ab8e86075ddd8e03"><enum>(B)</enum><text>exempt from tax under section 501(a) of such Code.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
