<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 27</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230124" legis-day="20230103">January 24 (legislative day, January 3), 2023</action-date><action-desc><sponsor name-id="S344">Mr. Hoeven</sponsor> (for himself, <cosponsor name-id="S323">Mr. Risch</cosponsor>, <cosponsor name-id="S395">Mrs. Hyde-Smith</cosponsor>, <cosponsor name-id="S376">Ms. Ernst</cosponsor>, <cosponsor name-id="S411">Mr. Marshall</cosponsor>, <cosponsor name-id="S355">Mr. Cruz</cosponsor>, <cosponsor name-id="S398">Mr. Cramer</cosponsor>, <cosponsor name-id="S384">Mr. Tillis</cosponsor>, <cosponsor name-id="S410">Ms. Lummis</cosponsor>, <cosponsor name-id="S357">Mrs. Fischer</cosponsor>, <cosponsor name-id="S266">Mr. Crapo</cosponsor>, <cosponsor name-id="S378">Mr. Lankford</cosponsor>, <cosponsor name-id="S346">Mr. Lee</cosponsor>, <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>, <cosponsor name-id="S350">Mr. Rubio</cosponsor>, <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>, and <cosponsor name-id="S373">Mr. Cassidy</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the Department of Defense from requiring contractors to provide information relating to greenhouse gas emissions.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Focus on the Mission Act of 2023</short-title></quote>.</text></section><section id="idA40C7BF74BBC40948F1587E39384FCF4"><enum>2.</enum><header>Prohibition on requiring defense contractors to provide information relating to greenhouse gas emissions</header><subsection id="idC12F642F336B408EB102D0581E3CB0ED"><enum>(a)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="id913ec8edde2e462da4a17ffbe4389d52"><enum>(1)</enum><header>Greenhouse Gas</header><text>The term <term>greenhouse gas</term> means—</text><subparagraph id="idd8e6b987dd9e48609c958de84f787f6d"><enum>(A)</enum><text>carbon dioxide;</text></subparagraph><subparagraph id="id11ade8b20a22447b88947fc41828cf27"><enum>(B)</enum><text>methane;</text></subparagraph><subparagraph id="id7b586370a82f440ba22d84ce28f59cbf"><enum>(C)</enum><text>nitrous oxide;</text></subparagraph><subparagraph id="id40d6fae1d13a408c8d0842d1eacedca7"><enum>(D)</enum><text>nitrogen trifluoride;</text></subparagraph><subparagraph id="id82c4b5d9345345b3b33c40caead733ba"><enum>(E)</enum><text>hydrofluorocarbons;</text></subparagraph><subparagraph id="idd91abf70bd8c49cb990708317bc392f4"><enum>(F)</enum><text>perfluorcarbons; or</text></subparagraph><subparagraph id="id55a2b12a242a4c3e9781084406b8c269"><enum>(G)</enum><text>sulfur hexafluoride.</text></subparagraph></paragraph><paragraph id="idc1fe1141c5a8433eae1ebaf94fd31035"><enum>(2)</enum><header>Greenhouse gas inventory</header><text>The term <term>greenhouse gas inventory</term> means a quantified list of an entity’s annual greenhouse gas emissions.</text></paragraph><paragraph id="id959f0afb9ae9424ea7cee7e8c232f672"><enum>(3)</enum><header>Scope 1 emissions</header><text>The term <term>Scope 1 emissions</term> means direct greenhouse gas emissions from sources that are owned or controlled by the reporting entity.</text></paragraph><paragraph id="idece499b789624fe79a35d0f295b8eba8"><enum>(4)</enum><header>Scope 2 emissions</header><text>The term <term>Scope 2 emissions</term> means indirect greenhouse gas emissions associated with the generation of electricity, heating and cooling, or steam, when these are purchased or acquired for the reporting entity’s own consumption but occur at sources owned or controlled by another entity.</text></paragraph><paragraph id="id3bd9c0a86e0d445fbeebe4f4834fbfb5"><enum>(5)</enum><header>Scope 3 emissions</header><text>The term <term>Scope 3 emissions</term> means greenhouse gas emissions, other than those that are Scope 2 emissions, that are a consequence of the operations of the reporting entity but occur at sources other than those owned or controlled by the entity. </text></paragraph></subsection><subsection id="id1BD1934F4EDC468B878C0271E38AB7A8"><enum>(b)</enum><header>Prohibition on disclosure requirements</header><text>The Secretary of Defense may not require the recipient of a Federal contract to provide a greenhouse gas inventory or to provide any other report on greenhouse gas emissions, including Scope 1 emissions, Scope 2 emissions, or Scope 3 emissions. </text></subsection></section></legis-body></bill>
