which was read twice and referred to the <committee-name committee-id="SLIA00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Indian Affairs</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20230321">March 21, 2023</action-date><action-desc>Reported by <sponsor name-id="S353">Mr. Schatz</sponsor>, without amendment</action-desc></action><legis-type>A BILL</legis-type><official-title>To take certain land located in San Diego County, California, into trust for the benefit of the Pala Band of Mission Indians, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H7643DF57CB4C4D96A622FB9D4009D67B"><section section-type="section-one" id="H2A4D43FA71314499A4A5858AF78EE670"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pala Band of Mission Indians Land Transfer Act of 2023</short-title></quote>.</text></section><section id="H40F0FD66093843B2872650BBE66A3DA7"><enum>2.</enum><header>Transfer of land into trust for the Pala Band of Mission Indians</header><subsection id="H1D676FD9DFF6485EB1D19875093C7A36"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H3FA51ECFC73C40F3B3EC27EFA070DFF8"><enum>(1)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="H66A9827F5C764496987FEC37DAAE212C" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Tribe</header><text display-inline="yes-display-inline">The term <term>Tribe</term> means the Pala Band of Mission Indians.</text></paragraph></subsection><subsection id="id9AA982640B3844BE9047556C0B3C0F0D"><enum>(b)</enum><header>Transfer and administration</header><paragraph id="HCE6CAD10A9A44EE282F019553028462C"><enum>(1)</enum><header>Transfer of land into trust</header><text>If, not later than 180 days after the date of enactment of this Act, the Tribe transfers title to the land referred to in subsection (c) to the United States, the Secretary, not later than 180 days after the date of that transfer, shall take that land into trust for the benefit of the Tribe.</text></paragraph><paragraph id="HD0C11006E7164CC184ED483C7FA8196B"><enum>(2)</enum><header>Administration</header><text display-inline="yes-display-inline">The land taken into trust under paragraph (1) shall be part of the Pala Indian Reservation and administered in accordance with the laws and regulations generally applicable to land held in trust by the United States for an Indian Tribe.</text></paragraph></subsection><subsection id="H4C917EE730EF4B418D10D6EFC2F7A3DC"><enum>(c)</enum><header>Land description</header><text display-inline="yes-display-inline">The land referred to in subsection (b)(1) is the approximately 721.12 acres of land located in San Diego County, California, generally depicted as <quote>Gregory Canyon Property Boundary</quote> on the map entitled <quote>Pala Gregory Canyon Property Boundary and Parcels</quote> and dated May 12, 2020.</text></subsection><subsection id="H034F58354DEC41D4A2AECB45BFB31AF6"><enum>(d)</enum><header>Rules of construction</header><text>Nothing in this section—</text><paragraph id="H790EFF628F014C808D2F7F087518699F"><enum>(1)</enum><text>enlarges, impairs, or otherwise affects any right or claim of the Tribe to any land or interest in land that is in existence before the date of enactment of this Act;</text></paragraph><paragraph id="HE0E61BA6900D49299D192F507F1F74D2"><enum>(2)</enum><text>affects any water right of the Tribe in existence before the date of enactment of this Act; or</text></paragraph><paragraph id="HCE2F9F030D094646B8074CBBA9F59680"><enum>(3)</enum><text>terminates or limits any access in any way to any right-of-way or right-of-use issued, granted, or permitted before the date of enactment of this Act.</text></paragraph></subsection><subsection id="HE6178D09C64C4DE9A02CDFC2F258EDCA"><enum>(e)</enum><header>Restricted use of transferred lands</header><text>The Tribe may not conduct, on the land taken into trust under subsection (b)(1), gaming activities—</text><paragraph id="H41F21F0F5D6E4C46A90C5237313D1255"><enum>(1)</enum><text>as a matter of claimed inherent authority; or</text></paragraph><paragraph id="HE1902B94A88841BEA588640C05CF8F60"><enum>(2)</enum><text>under any Federal law, including the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2701">25 U.S.C. 2701 et seq.</external-xref>) and regulations promulgated by the Secretary or the National Indian Gaming Commission under that Act.</text></paragraph></subsection></section></legis-body><endorsement><action-date date="20230321">March 21, 2023</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
