which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Inspector General of the Department of Homeland Security to investigate the vetting and processing of illegal aliens apprehended along the southwest border and to ensure that all laws are being upheld.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id952FF5F72817498AA932B38E0022BFE0"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Upholding the Law at Our Border Act</short-title></quote>.</text></section><section id="id2617830a09c4442ba3a016b617e19340"><enum>2.</enum><header>Investigation and report on vetting and processing of illegal aliens apprehended along the southwest border and ensuring that all laws are being upheld</header><text display-inline="no-display-inline">Not less frequently than every 60 days until there have been fewer than 35,000 apprehensions per month at the southwest border for 3 consecutive months, the Inspector General of the Department of Homeland Security shall conduct an investigation and submit a report and provide a briefing to the President, the Secretary of Homeland Security, the Attorney General, the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>, and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> regarding, with respect to the period beginning on January 20, 2021—</text><paragraph id="idE92C70D0F10347EAAD4725DB26F9EF5A"><enum>(1)</enum><text display-inline="yes-display-inline">the vetting procedures applicable to aliens (as defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>)) seeking entry or admission to the United States who were apprehended along the southwest border of the United States, including the process for conducting in-person interviews with such aliens and the number of such interviews that were conducted;</text></paragraph><paragraph id="id6fddc40f45b14e3997ca0c07ed87b6d5"><enum>(2)</enum><text>the total number of aliens who are unlawfully present in the United States (referred to in this section as <quote>illegal aliens</quote>) who were processed and released into the interior of the United States;</text></paragraph><paragraph id="id121de81c7bfd44989bab19dc4c42b86d"><enum>(3)</enum><text>the number of illegal aliens who received parole (humanitarian or otherwise);</text></paragraph><paragraph id="idbbc54ed2e14042889aa6110b2afb028f"><enum>(4)</enum><text>the results of the audit of parole applications, including the justification for any instances in which parole was granted;</text></paragraph><paragraph id="id43b73baa0fa8442983ea7759412b5c76"><enum>(5)</enum><text>the total number of illegal aliens who have been placed in removal proceedings pursuant to section 240 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229a">8 U.S.C. 1229a</external-xref>), including—</text><subparagraph id="id143d8636a1fb4ed3ab3507f2f7b9ca90"><enum>(A)</enum><text>how many of such illegal aliens have been removed; and</text></subparagraph><subparagraph id="id77b7091a22184524a9752a2ea5fc6db6"><enum>(B)</enum><text>how many of such illegal aliens are eligible for any immigration benefit, such as asylum or lawful permanent residence;</text></subparagraph></paragraph><paragraph id="idf26ba4ed75a64ed7a61bfd10ba002947"><enum>(6)</enum><text>the results of the audit of asylum application under section 208 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158</external-xref>);</text></paragraph><paragraph id="idfa2b0a04ec584a0280da7fabcf34c609"><enum>(7)</enum><text>the total number of illegal aliens who have been placed in expedited removal proceedings pursuant to section 235(b)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)(1)</external-xref>), including how many have been removed;</text></paragraph><paragraph id="idb021a53f730a4fd9a88d122ac0755c5b"><enum>(8)</enum><text>the efforts of the Department of Homeland Security to continually monitor all of the illegal aliens who were apprehended along the southwest border of the United States and then released on parole, including—</text><subparagraph id="id564efe36c9a747fc9f1f64bb4ed82948"><enum>(A)</enum><text>the number of such illegal aliens who were given a <quote>notice to report</quote> to a U.S. Immigration and Customs Enforcement office; </text></subparagraph><subparagraph id="idB8DFBCA5C3034DA28682BE6CC6A1D39E"><enum>(B)</enum><text>the number of such illegal aliens who actually reported in compliance with such notice to report;</text></subparagraph><subparagraph id="idd05d237b1c3b4d69ba2aafeb407525d0"><enum>(C)</enum><text>the number of such illegal aliens who were given a <quote>notice to appear</quote> before an immigration judge; and</text></subparagraph><subparagraph id="id31a493be0cfb433b86017cd8729a3415"><enum>(D)</enum><text>the number of such illegal aliens who have prior criminal convictions or terms of imprisonment in the United States or outside of the United States;</text></subparagraph></paragraph><paragraph id="id8660C8969A8E4E6C8DD0A78CA7FCA4C7"><enum>(9)</enum><text>the total number of illegal aliens who were processed and released into the interior of the United States without participating in an alternatives to detention program, such as using an ankle monitor or another tracking monitor; and</text></paragraph><paragraph id="id02f94e6030744effa912bd31d59ba430"><enum>(10)</enum><text>the States and counties in which the Department of Homeland Security or the Department of Health and Human Services has resettled illegal aliens since January 20, 2021.</text></paragraph></section></legis-body></bill>
