Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require a watermark for AI-generated materials, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advisory for AI-Generated Content Act</short-title></quote>.</text></section><section id="id01d90406376c4cc49d9246b150c98627"><enum>2.</enum><header>Watermarks on AI-generated materials</header><subsection commented="no" display-inline="no-display-inline" id="id58892bd4f8d24e7aa6a8921b0d360035"><enum>(a)</enum><header>In general</header><paragraph commented="no" display-inline="no-display-inline" id="idda10b4d638564936ab9d33a1d46b8d64"><enum>(1)</enum><header display-inline="yes-display-inline">Watermark requirement</header><text>It shall be unlawful for an AI-generating entity to create covered AI-generated material unless such material includes a watermark that meets the standards established by the Commission under paragraph (2).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id31739599c38e46fcb0097c4c134ec7cd"><enum>(2)</enum><header display-inline="yes-display-inline">Standards for AI watermarks</header><text>Not later than 180 days after the date of enactment of this section, the Commission, in consultation with the Federal Communications Commission, the Attorney General, and the Secretary of Homeland Security, shall issue regulations to establish standards for the watermarks required under paragraph (1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb5724c5b17aa4afab0b2e959c5bc4397"><enum>(3)</enum><header display-inline="yes-display-inline">Effective date</header><text>The requirement established under paragraph (1) shall take effect on the date that is 1 year after the date on which the Commission promulgates the regulations required under paragraph (2).</text></paragraph></subsection><subsection id="id68325e5b79644055860ad32c7659856b"><enum>(b)</enum><header>Enforcement</header><paragraph id="id4528a00c54c049208fac2319fd4152ec"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of this section or a regulation promulgated thereunder shall be treated as a violation of a rule defining an unfair or deceptive act or practice under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph id="id456bda636a044036b5e1a95f664c2955"><enum>(2)</enum><header>Powers of the Commission</header><subparagraph id="id9e5757af2f864002b150d2fbcdc0a207"><enum>(A)</enum><header>In general</header><text>The Commission shall enforce this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act.</text></subparagraph><subparagraph id="idfb2c0cc7af534f6e8f55f1cb98a587c7"><enum>(B)</enum><header>Privileges and immunities</header><text>Any person who violates this section or a regulation promulgated thereunder shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></subparagraph><subparagraph id="id831b23a687424d00a459a9d8a92996c8"><enum>(C)</enum><header>Authority preserved</header><text>Nothing in this section shall be construed to limit the authority of the Commission under any other provision of law.</text></subparagraph><subparagraph id="id9b474e69e8474ffdadb3baf38399e39c" commented="no"><enum>(D)</enum><header>Rulemaking</header><text>The Commission shall promulgate in accordance with section 553 of title 5, United States Code, such rules as may be necessary to carry out this section.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4fcf64cfb357428c8bda463d35525ab6"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id0171b675a8fd473bb7026a03438e8066"><enum>(1)</enum><header>AI-generating entity</header><text>The term <term>AI-generating entity</term> means an entity that generates, creates, or otherwise produces AI-generated material.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2ca78cbf83db43cca4a4f339422a7469"><enum>(2)</enum><header display-inline="yes-display-inline">AI-generated material</header><text>The term <term>AI-generated material</term> means artificial intelligence technology that can produce various types of content, including text, images, audio, or synthetic data.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id38f95d86baa44d2583588de401ad35cf"><enum>(3)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="id8f02544f1cbb43938a5dbfa198d53426"><enum>(4)</enum><header>Covered AI-generated material</header><text>The term <term>covered AI-generated material</term> means AI-generated material that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id563ba6e7685e46c698f95c460efa14b6"><enum>(A)</enum><text>impersonates a specific individual or group of individuals;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id44dfcb60aa724b8c81f5aa2bc1b7fd58"><enum>(B)</enum><text>is represented as original material by the AI-generating entity that produced the material, including with respect to artwork, songs, or news media; or</text></subparagraph><subparagraph id="ida94d26836ab749eaa2f24896e86e8b8b"><enum>(C)</enum><text>meets such criteria as the Commission may establish.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
